The purpose is to site grade and construct within the Regulated Area of the Etobicoke Creek watershed to facilitate the construction of a stormwater management pond and outfall associated with a draft plan of subdivision for employment uses. 180 CITY OF MARKHAM EX10.75 CITY OF MARKHAM To temporarily or permanently place, dump or remove any material, originating on the site or elsewhere, interfere with a wetland and alter a watercourse on Reesor Road, north of 19th Avenue, in the City of Markham, Duffins Creek Watershed as located on property owned by the City of Markham. The purpose is to undertake rehabilitation of a culvert located on Reesor Road, 200m north of 19th Avenue. The Ministry of Natural Resources (MNR) coldwater fisheries timing window will apply to this project unless otherwise specified in writing by MNR. A Letter of Advice will be written by TRCA staff on behalf of Fisheries and Oceans Canada (DFO). 182

EX10.76 TRANSPORT CANADA To temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and interfere with a wetland on 9631 Reesor Road, in the City Markham, Rouge River Watershed as located on property owned by Transport Canada. The purpose is to demolish existing vacant structure, decommission septic system and remove all waste and debris from the demolition site. 184

To construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on Part Lot 16, 17, Concession 3 EHS, (Northwest of Countryside Drive and Dixie Road), in the City of Brampton, Etobicoke Creek Watershed as located on the property owned by Sandringham Place Inc. Garden Manor Construction Inc.. The purpose is to site grade and construct within the Regulated Area of the Etobicoke Creek watershed to facilitate the construction of a stormwater management pond and outfall associated with a draft plan of subdivision for employment uses. RATIONALE The application was reviewed by staff on the basis of the following information: 180

Proposal: On April 11, 2012, the City of Brampton Council approved the Zoning By-law and Draft Plan of Subdivision (21T-09010B) for the Countryside Villages Employment Lands East. The subject lands contain one local wetland and one Provincially Significant Wetland (PSW), a wetland and terrestrial habitat compensation block, and a tributary of Spring Creek. The subdivision is located within Area 48 of the Countryside Villages Secondary Plan, for which a Master Environmental Servicing Plan (MESP) was completed. The proposed land use on the subject lands is for employment purposes and limited commercial uses consistent with the vision of the City of Brampton Countryside Villages Secondary Plan. The City of Brampton has identified the lands east and west of Highway 410, between Countryside Drive and Mayfield Road as a strategic location for employment uses. A comprehensive Environmental Impact Study (EIS) has been completed for the Draft Plan of Subdivision. To facilitate the overall development of the subdivision, TRCA permits have been issued in phases. The first phase permitted topsoil stripping, the removal of two local wetlands, and a temporary sediment pond. The second phase permitted additional topsoil stripping, a second temporary sediment pond, the partial removal of a third local wetland, and diverting an intermittent tributary through a swale between the retained local wetland and Provincially Significant Wetland (PSW). To compensate for the removal of the wetland features, the proponent has agreed to establish a compensation area that will create new wetland linkages between the retained local wetland and the PSW, and between the PSW and the Spring Creek tributary. Complementary terrestrial habitat will also be created as part of the overall compensation strategy. A total of approximately 0.77 ha (1.90 ac) of wetland has been removed, and a total of approximately 2.81 ha (6.94 ac) of compensation area is proposed on-site, of which 0.72 ha (1.78 ac) will be newly created wetlands. The subject permit will facilitate the construction of the permanent stormwater management pond and outlet. Subsequent permits will be required for future works for the remainder of the lands to facilitate the ultimate development, including wetland compensation and restoration works, realignment of the Spring Creek tributary, and overall site grading for construction. Control of Flooding: The City of Brampton is advancing approvals within the Countryside Villages Secondary Plan area at the same time as the Town of Caledon is advancing planning approvals for the Mayfield West Phase 1 Industrial Subdivision located north of the Mayfield Road and the Countryside Villages Employment Lands East subdivision. Staff from the TRCA, Region of Peel, City of Brampton, Town of Caledon, the developers and their consultants have been working together to coordinate the phasing of development approvals to ensure the regulatory stormwater flows continue to be safely conveyed in the post-development conditions. One measure that will be required is the remediation of an existing culvert (e.g. widening or twining) at Countryside Drive to accommodate increased storm flows as a result of upstream development and the removal of intermittent tributaries. Schaeffers Consulting Engineers has calculated the cumulative Regional stormwater flows resulting from the various industrial, commercial and residential development within the broader area. They concluded that the culvert through which the tributary on the subject lands flows under Countryside Drive will overtop when the residential development east of Dixie Road. (i.e. Countryside Villages Block 48-1 Phase 1) occurs. Therefore, the City of Brampton and Metrus Developments Inc. have both provided the TRCA with Letters of Undertakings in which the parties commit to remediating the culvert as a condition of pre-servicing approval for the first phase of Countryside Villages Block 48-1. Restoration and channel works on the Countryside Villages Employment Lands East lands are also proposed, which will assist with remediating downstream flood risks. 181

The proposed works for the permanent stormwater management pond and outfall are located outside of the Regional Floodplain. As such, no impacts to the storage and/or conveyance of flood waters are anticipated. TRCA staff will continue to work with staff from the Region of Peel, City of Brampton and Town of Caledon, and the developers and their consultants to implement appropriate flood remediation measures to ensure the ultimate development scenario for the Countryside Villages and Mayfield West Phase 1 Industrial lands do not result in upstream or downstream flood risks. Pollution: Appropriate sediment and erosion controls will be installed and maintained on the subject property during all phases of construction. Dynamic Beaches: Not applicable. Erosion: There are no geotechnical and/or slope stability concerns anticipated with this project. Conservation of Land: Under TRCA's Level III agreement with Fisheries and Oceans Canada (DFO) a Letter of Advice will be issued by the TRCA for the works within the Spring Creek tributary, which is a warmwater stream. The warmwater timing window generally begins July 1 and ends March 31. Plantings No vegetation will be removed as part of this development. Native non-invasive species will be planted as part of the landscaping plans for the stormwater management pond and outlet. Pollution: Standard erosion and sediment control measures (silt fence) will be implemented prior to construction and maintained for the duration of construction, and until the site is stabilized and restored, in order to prevent construction generated sediments from entering any watercourse or wetland.
