PERMIT APPLICATIONS EX10.32 - EX10.33 ARE MAJOR APPLICATIONS Applications that involved a more complex suite of technical studies to demonstrate consistency with policies; applications that cover a significant geographic area (e.g. subdivisions, stormwater management ponds), extensive modifications to the landscape, major infrastructure projects, emergency works, resolution of violations/after the fact permits, trail construction CITY OF BRAMPTON EX10.32 1083131 ONTARIO INC. To site grade on Lot 15, Concession 7, N.D.S., (West of Goreway Drive and South of Countryside Drive), in the City of Brampton, Humber River Watershed as located on the property owned by 1083131 Ontario Incorporated. The purpose is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate the construction of a foundation drain collector (FDC) and wetland feature associated with a residential draft plan of subdivision application. The permit will be issued for the period of January 11, 2013 to January 10, 2015 in accordance with the following documents and plans which form part of this permit: Letter of Undertaking, prepared by D. Horgan, Candevcon Limited, dated January 7, 2013, to address all outstanding TRCA engineering and ecology concerns. RATIONALE The application was reviewed by staff on the basis of the following information: 69

Proposal: The purpose of this application is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate the construction of a foundation drain collector (FDC) associated with a residential draft plan of subdivision application (City File No. 21T-05041B) located on the west side of Goreway Drive and south of Countryside Drive, in the City of Brampton. The proposed FDC is required to provide drainage for the weeping tiles associated with a proposed residential draft plan of subdivision located on an adjacent property, known as the Sundial Homes Phase II development (City File No. 21T-05041B). The FDC is proposed to drain to a constructed wetland feature located within the valley lands of the Castlemore Golf and Country Club golf course. The TRCA permit application (CFN 46312) for the proposed residential draft plan of subdivision is also on the January 11, 2013 TRCA Executive Committee meeting agenda. A separate TRCA permit is required for the FDC and wetland feature due to separate land ownership. Staff understands a private easement between the proponent and the land owner of the Sundial Homes Phase II development has been agreed to between both parties. The adjacent draft plan was approved by the Ontario Municipal Board (OMB) on October 9, 2009, and the conditions of draft approval were subsequently amended on November 18, 2010. TRCA was a party to the OMB hearing. As part of the development, the existing eighteen (18) hole golf course is proposed to be reconfigured to a nine (9) hole course. Staff identified through the OMB negotiations the need to retain the valley lands as part of the City of Brampton's natural heritage system which would not be developed for residential purposes. To implement the long-term plan envisioned for these lands, as well as a requirement of the OMB negotiations, the proponent submitted an extensive enhancement planting plan, including the creation of a wetland feature, ensuring that an ecological net gain will be achieved for this reach of the West Branch of The West Humber River. Although the proposed works are located within the Regional Storm Floodplain, existing grades within the floodplain are to be maintained. Further, TRCA engineering staff has reviewed the application and do not anticipate any significant adverse impacts to the storage and/or conveyance of flood waters during a Regional Storm event. Control of Flooding: TRCA engineering staff has reviewed the application and do not anticipate any significant impacts to the storage and/or conveyance of flood waters. Pollution: Appropriate erosion and sediment controls will be installed and maintained throughout all phases of construction. Dynamic Beaches: Not applicable. Erosion: There are no geotechnical and/or slope stability concerns associated with this project. 70

Conservation of Land: As a result of the golf course development, the valley lands have been significantly altered through grading activities. The proposed works partially implement the long-term plan envisioned for these lands and intend to improve the ecological condition for this reach of the West Branch of The West Humber River. The proposed works involve the construction of a wetland feature along with extensive restoration and enhancement planting plan to achieve an ecological net gain for this area. There are no fisheries concerns associated with this application. Plantings All proposed plant species will be native and non-invasive consistent with TRCA's planting guidelines. Policy Guidelines: This application is in conformity with Section 4.1.1 - New Urban Development and Section 4.3 - Infrastructure and Servicing - of the Authority's Valley and Stream Corridor Management Program (VSCMP). RATIONALE The application was reviewed by staff on the basis of the following information: Proposal: The purpose of this application is to undertake earthworks and servicing and the realignment of two (2) tributaries of Salt Creek of the Humber River Watershed associated with a proposed residential draft approved plan of subdivision (City File No. 21T-05041B) located on the west side of Goreway Drive and south of Countryside Drive, in the City of Brampton. The proposed works are considered to be Phase II of a two-staged development for the above noted draft approved plan of subdivision. The south boundary of Phase II abuts the existing estate residential lots on Tortoise Court. The Phase II lands are approximately 8.3 ha in size, and 91 estate residential lots are proposed for the property. A separate TRCA permit (Permit No. C-120356) was approved by the TRCA Executive Committee at the February 3, 2012 TRCA Executive Committee meeting (Executive Committee Meeting #13/11) for the Phase I development, which is located south of the Tortoise Court subdivision. The subject property is located within the planning boundaries of the approved Vales East Master Environmental Servicing Plan (MESP). The West Branch of The West Humber River valley corridor abuts the subject property to the west; and two (2) minor tributaries of Salt Creek traverse the subdivision (known as Tributary 1 and 2). The draft plan was approved by the Ontario Municipal Board (OMB) on October 9, 2009, and the conditions of draft approval were subsequently amended on November 18, 2010. TRCA was a party to the OMB hearing. Based upon significant negotiations throughout the hearing, counsel for TRCA staff concluded that TRCA was satisfied that the proponent had demonstrated that TRCA s issues could in principle be addressed through the proposed plan with appropriate conditions of draft approval, should the application be approved by the OMB. With the approval of the draft plan by the OMB, TRCA staff has been working with the proponent to bring forward the required permits and ensure TRCA s issues are addressed. Previously, the TRCA Executive Committee approved a TRCA permit application (Permit No. C-110406) on June 13, 2011 to allow for the reconstruction of a downstream portion of Tributary 1 and 2 as part of the Phase I development. The proposed works are to implement the final phases of construction, which will result in the realignment of the stream corridor bisecting the subject property and these works will compliment similar construction activities which have been completed downstream (as approved by the TRCA Executive Committee under TRCA Permit C-06357). Authorization from Fisheries and Oceans Canada (DFO) was obtained for the proposed watercourse reconstruction works. 72

The west part of the subdivision land comprises the Castlemore Golf and Country Club golf course. It is proposed, as part of the development, that the existing eighteen (18) hole golf course be reconfigured to a nine (9) hole course. As a result of the previous golf course development, the natural top of bank located along the western portion of the site has been significantly altered through grading activities. Through extensive negotiations within the context of the OMB hearing, it was agreed that the valley slopes are to be regraded. As a requirement of the OMB conditions of draft approval, as well as a component of this application, the proponent submitted an extensive enhancement planting plan ensuring that an ecological net gain will be achieved for this reach of The West Humber valley corridor, the buffer block, the open space block, as well as the areas beyond the western property limit (i.e., valley lands of the West Branch of The West Humber River). A Stormwater Management Report, which identifies the storm drainage system and stormwater management strategy, has been submitted in support of this application and demonstrated conformity to the approved Functional Servicing Report (FSR) (reviewed as a component of the draft plan of subdivision application) and MESP. The proposed development requires the construction of a foundation drain collector (FDC) outlet, which is proposed on the golf course lands. As these lands are owned by another land owner, a separate TRCA permit application is required, which is also on the January 11, 2013 TRCA Executive Committee meeting agenda. As a component of the TRCA permit application, a hydraulic study and fluviogeomorphic analysis were completed in support of the proposed realignment works for Tributary 1 and 2. The proposed development subject to this permit will be located entirely outside of the Regional Storm Floodplain in a post-development scenario. Based on the hydraulic study, no impacts to the storage and/or conveyance of flood waters is anticipated. Control of Flooding: The proposed residential development is located outside of the Regional Storm Floodplain. Pollution: As a component of this application, an Erosion and Sediment Control Report and supporting plans were submitted, reviewed and supported by TRCA staff. Appropriate erosion and sediment controls will be installed and maintained throughout all phases of construction. Dynamic Beaches: Not applicable. Erosion: There are no geotechnical and/or slope stability concerns associated with this permit application. Conservation of Land: No significant vegetation will be removed as a result of construction. An extensive restoration and enhancement planting plan has been submitted with this application achieving an ecological net gain for this reach of the West Branch of The West Humber River. RATIONALE The application was reviewed by staff on the basis of the following information: Proposal: The applicant seeks permission to develop within a TRCA Regulated Area of the Don River Watershed in order to facilitate the construction of a small front and rear addition to the existing dwelling located at 139 Three Valleys Drive. The subject site is located west of the Don Valley Parkway North and north of Lawrence Avenue East in the City of Toronto (North York Community Council Area). The property contains the valley slope and is regulated with respect to this feature. Control of Flooding: The site is not located within a regional storm flood plain and the proposal will have no impact on the storage and/or conveyance of floodwaters. Pollution: Sediment controls will be installed and maintained during construction to prevent debris from entering the adjacent ravine. Dynamic Beaches: Not applicable Erosion: A geotechnical brief has been reviewed and approved by TRCA geotechnical engineering staff and the proposal will be constructed in accordance with the recommendations of this report. Conservation of Land: TRCA staff are satisfied that there will be no geotechnical/slope stability issues associated with the completed works.
