(b) Increasecompatibilitybetweenabuttinglandusesandbetweenlandusesandpublicrightsofway byprovidinglandscapescreeningorbuffers. (c) Protect public health, safety, and welfare by preserving and enhancing the positive visual experienceofthebuiltenvironment,providingappropriatetransitionbetweendifferentlanduses, preservingneighborhoodcharacter,andenhancingpedestrianandvehiculartrafficsafety. (2) Inadditiontomeetingtherequirementsherein,eachplanmustincludeanycriteriathat mayberequiredbythedirectoroftheplanningandzoningdepartment.ifdisapproved, justificationmustbegiventotheapplicant. (3) Allreviewedplanswillbereturnedtothedesignermarked"approved"or"approvedas noted"or"denied. Rejectedplansmaybereturnedtothedepartmentforreevaluation oncenotedcorrectionsaremade. (4) Acopyofeachapprovedplanwillbearchivedtoensurethatitwasimplementedas permittedandmaintainedasrequired. (c) ContentofLandscapePlan: (1) Landscapeplansshallbepreparedbyalandscapearchitectorlandscapehorticulturist licensedinlouisiana.alandscapeplanshallcontainthefollowinginformation: a. The location and dimensions of all existing and proposed structures, propertylines,servitudes,easements,parkinglotsanddrives,roadways andrightsofway,sidewalks,signs,refusedisposalandrecyclingareas, bicycle paths and parking facilities, fences, utilities on and off site, recreationalfacilities,drainagefacilities,andotherfreestandingstructures, as determined necessary by the Director of the Planning and Zoning Department. b. The location, quantity, size, condition, and name, both botanical and common,ofallexistingplantmaterialsandtrees,andadescriptionofall treepreservationmeasures. c. Thelocation,quantity,size,name,andconditionofallplantmaterialand treesintherightofway,andindicatingplantmaterialandtreestobe retainedandremoved. d. Thelocation,quantity,size,andname,bothbotanicalandcommon,ofall proposedplantmaterialincluding,butnotlimitedto,shadeandevergreen trees,shrubs,groundcover,annuals,perennials,andturf. e. Irrigationorwateringsystemplans,ifapplicable f. Theexistingandproposedgradingofthesiteindicatingcontoursatone(1) footintervals g. AnyotherrequirementdeemednecessarybytheDirectorofInspections andcodeenforcementneededtodeterminecompliancewiththisarticle (2) Whenthefinallandscapeplanissubmitted,adateforcompletionofallplantingsand relatedworkmustbeincludedontheplan.landscapingmustbeinstalledandcompleted inaccordancewiththesubmittedplanpriortotheissuanceofacertificateofoccupancy. (3) Alllandscapeplansmustcontainthefollowinglandscapeandbuffermaintenance agreementnotation: a. Theownerisresponsibleforthemaintenanceofalllandscaping. b. Allplantmaterialsmustbemaintainedinahealthyandgrowingcondition asisappropriatefortheseasonoftheyear. c. Plantmaterials,whichdie,mustbereplacedwithsimilarhealthyplant materials. d. Alllandscapingmustbemaintainedinaneatandorderlymanneratall times. This includes mowing, edging, pruning, fertilizing, watering, weeding, and other such activities common to the maintenance of landscaping. e. Landscapedareasmustbekeptfreeoftrash,litter,weedsandothersuch materialorplantsnotpartofthelandscaping. f. All sight triangles shall be maintained in accordance with AASHTO standardsasperthelatesteditionofapolicyongeometricdesignof HighwaysandStreets. (d) MinorChangestoApprovedLandscapePlans: Minorchangestothelandscapeplanthatdonotresultinareductioninthenetamountofplant materialasspecifiedontheapprovedlandscapeplanorareductioninthenetamountofwater detainedorstoredandfilteredonsitemaybeapprovedbythedirectoroftheplanningandzoning Department.Changestothesizeandamountofplantmaterialsofanapprovedlandscapeplanare notconsideredaminorchange.majorchangesshallbeapprovedbythebodyinitiallygranting approvalofthelandscapeplan. (e) AlternativeCompliance: (1) The landscape standards contained in this Article are intended to encourage development,whichiseconomicallyviableandenvironmentallysensitive.thestandards arenotintendedtobesospecificastoinhibitcreativedevelopment.projectconditions associated with individual sites may justify approval of alternative methods of compliance with the landscape standards. Conditions may arise where normal complianceisimpracticalorimpossible,orwheremaximumachievementofthecity's objectivescanonlybeobtainedthroughalternativecompliance. (2) Requestsforalternativecompliancewillbeacceptedforanypermitapplicationtowhich therequirementsofthisarticleapply,whenone(1)ormoreofthefollowingconditions aremet: a. Topography,soil,vegetation,drainage,orothersiteconditionsaresuch thatfullcomplianceisimpractical. b. Improved environmental quality would result from the alternative complianceprovisionsofthisarticle. c. Spatiallimitations,unusuallyshapedpiecesoflandorunusualservitude requirementsmayjustifyalternativecompliance. d. Publicsafetyconsiderationsmadealternativecompliancenecessary. (3) A request for alternative compliance must be submitted to the Director of the DepartmentofPlanningwhenthelandscapeplanissubmitted. a. TheDirectoroftheDepartmentofPlanning,inconsultationwiththe DirectoroftheInspectionsandCodeEnforcementdepartment,maynot reducetherequirementsofthisarticlebymorethanfifty(50)percent. b. Requestsforalternativecompliancemustbeaccompaniedbysufficient writtenexplanationandlandscapeplandrawingstoallowappropriate evaluationanddecisionbythedirectorofthedepartmentofplanningin consultationwiththedirectorofthedepartmentofinspectionsandcode Enforcement. Section9.05InstallationandMaintenanceofPlantMaterials (a) Installation: (1) All landscape materials shall be installed in accordance with the current planting proceduresestablishedbythe LouisianaNurseryman smanualfortheenvironmental Horticultural Industry, latest edition, as published by the Louisiana Nursery and LandscapeAssociation.Allplantmaterialsshallbefreeofdiseaseandinstalledsothat soilisofsufficientvolume,composition,andnutrientbalancetosustainhealthygrowth. (2) All planting materials shall be of good quality and meet American Association of Nurserymen(AANS)Standardsforminimumacceptableform,quality,andsizefor speciesselected. (3) Soilmustbefertile,friablesoiltypicaloflocality.Itmustbewelldrained,clean,andfree ofclay,stones,andweeds.constructionsand/soilwillnotbeapprovedasasuitable plantingmedium. (4) Aminimumtwoinchmulchdressingisrequiredforallplantings.Mulchshouldbekept awayfromdirectcontactwithtreetrunks.rockandgravelarenotacceptableformsof mulch.theuseofcypressmulchisprohibitedduetoenvironmentallydestructive harvestingpractices. (b) ProtectionofExistingVegetation: AllconstructionprojectsdueshallabidebySection9.09,TreeandShrubPlantingsonPublic Propertyandwillpreserveexisting,noninvasiveplantmaterialwhereverfeasible. (c) Maintenance: Thetechnicalrequirementsforthemaintenanceofplantmaterialsandlandscapeareasareas follows: (1) Thedeveloper,hissuccessor,agentand/orpropertyowner,isresponsibleforthe maintenance,repairandreplacementofalllandscapematerialsthatarerequiredbythis comprehensive landscape ordinance. Maintenance includes but is not limited to weeding,irrigating,fertilizing,pruning,andreplacementofdeadordyingplants. (2) Landscapemaintenancespecificationsrequirethatalllandscapingmustbemaintained in a sound manner and in accordance with accepted maintenance procedures as establishedbythelouisiananurseryandlandscapeassociation. (3) Allplantmaterialsandplantedareasmustbetendedandmaintainedinahealthy growingconditionandkeptfreeofrefuseanddebris.plantmaterialsthatexhibit evidenceofinsectpests,disease,and/ordamagemustbeappropriatelytreated,and deadplantsmustbereplaced. (4) Caremustbetakentoprotectalltreesandlandscapematerialswhileperformingroutine maintenanceoperations(i.e.grasscutting,trenching,etc.). (5) Theremovalofanytreesorlandscapematerialsforthepurposeoffloodordrainage requirementsmustbereplacedbyasimilartreeorplantmaterialasrequiredbythe provisionsofthiscomprehensivelandscapeordinance. (6) AllplantingsaresubjecttoperiodicinspectionsbytheCityofKenner. (7) Thepropertyowneroflandabuttingaconstructedpublicrightofwayisresponsiblefor landscapingandmaintenanceofanyrightofwayareabetweenthefrontpropertyline andthestreetcurb. (8) Treeswhichoverhangsidewalksatcurbsmustbetrimmedtoaminimumheightofsix (6)feetsix(6)inchesabovegrade. (9) Treeswhichoverhangstreetsmustbetrimmedtomaintainclearanceataminimum height of fifteen (15) feet above grade or conform to the latest edition AASHTO (AmericanAssociationofStateHighwayandTrafficOfficials)APolicyonGeometric DesignofHighwaysandStreets,whicheverisgreater. (10)Treetoppingisprohibited (11)DiseasedorHazardousPlants: a. TheDirectoroftheDepartmentofInspectionsandCodeEnforcementhas theauthoritytorequirethatpropertyownerstreatorallowthecitytotreat treesorshrubssufferingfromtransmittablediseasesorinfestationof pests. b. Ifthediseaseorpestswarrantdrasticactiontocurbthespreadtohealthy treesorshrubs,orifthetreerepresentsapublichazard,ontheadviceof thedirectorofthedepartmentofinspectionsandcodeenforcement,the propertyownermayberequiredtocutanddestroythetreesorshrubsor allowthecityoritsagenttodoso,chargingtheactualcostinvolvedtothe propertyowner. c. Ifthepropertyownerrefusestopayanysuchcharges,thechargeswillbe treatedasgrassorweedcharges,followingtheproceduressetforthin KennerCodeofOrdinances9½7(f),9½7(g)and9½7(h),includingliening theowner spropertyandincludingthechargesontheadvelorumtaxbill. (12)SightTriangles:AsperSection7.06(d)(5).,andinaddition,mustconformtoAASHTO (AmericanAssociationofStateHighwayandTrafficOfficials)standardsasperthelatest editionofapolicyongeometricdesignofhighwaysandstreets. (13)Watering: d. OperationofAutomaticIrrigationSystems.Wheneverpossible,automatic irrigationsystemsshouldbeoperatedbetweenthehoursoffour(4)andsix (6)A.M. e. MaintenanceofIrrigationSystems.Irrigationsystemsmustbeconstantly maintainedtoeliminatewasteofwaterduetoseasonalchange,lossof heads,brokenpipes,ormisadjustednozzles. f. ManualWatering.Whennoirrigationsystemisprovided,theownerofthe propertyisresponsiblefortheprovisionofadequatewatertorequired plantmaterials. Section9.06GeneralLandscapeDesignStandards Landscapeplans,asdescribedabove,shallbepreparedbyalandscapearchitectorlandscapecontractor licensedinlouisiana,andevaluatedandapprovedbasedonthefollowingdesigncriteria: (a) ScaleandNatureofLandscapeMaterial: Thescaleandnatureoflandscapematerialsshallbeappropriatetothesizeofthesiteandrelated structures. (b) SelectionofPlantMaterial: Plantmaterialshallbeselectedforitsform,texture,color,patternofgrowth,andsuitabilityto localconditions.theuseofinvasiveplantspeciesisstrictlyforbidden.alllandscapeplansshall incorporateatleastthirtypercent(30%)ofnativetreesandshrubsintorequiredplantmaterials toprovidehabitatforwildlifeandreduceirrigationrequirements. (1) Allsingletrunktreesmusthaveaminimumcaliperoftwo(2)inchesimmediatelyafter planting. (2) Multitrunktreesmusthavemainstemswithaminimumone(1)inchcaliperpertrunk immediatelyafterplanting.allmultitrunktreesmusthaveaminimumofthree(3) trunks.themultitrunktreemustmeasureaminimumoften(10)totwelve(12)feettall immediatelyafterplanting.alltreeheightsmustbemeasuredfromthetopoftheroot balltothetipofthebranch. (8) TheDirectorofPublicWorksmayorderthatatreeorvegetationthatwasplantedon publicpropertyberemovedfromthepublicpropertyattheexpenseofthepersonor entity,whichplantedsuchtreeorshrub. (9) Anypersonwhoinjures,damagesordestroysanytree,orothervegetationorproperty onpublicpropertyunderthecareofthecityofkenner,shallpromptlynotifythe DepartmentofPublicWorksofsuchfactandthatpersonshall,withinsuchreasonable timeasspecifiedbythedepartmentofpublicworks,repairorreplacesuchdamaged tree,othervegetationorpropertytothesatisfactionofthedirectorofinspectionsand CodeEnforcement. (b) PermitforTreeandShrubPlanting,Pruning,RemovalandOtherMaintenance: (1) Noperson,includingpublicutilitycompanies,ispermittedtoremoveanytreeorshrub growingwithinadedicatedstreetareaofapublicrightofwayorotherpublicproperty withoutapermitfromthedirectorofthedepartmentofpublicworks.unlessapermit isobtainedfromthedirectorofthedepartmentofpublicworks,itisunlawfultocut, trim,remove,spray,treatorplantanytree,shrub,hedge,orotherplantuponapublic rightofwayorotherpublicpropertywithinthecity.violationofthissectionofthe comprehensivelandscapeordinancewillsubjecttheownertopenaltiesasoutlinedin Section9.09(e)Enforcement,Appeals,andPenalties. a. Incaseswhereaprivatepersonorcompanyhasmaintainedpublicproperty priortotheeffectivedateofthisordinance,theprivatepersonorcompany shallbeexemptfromthepermitrequirementforthemaintenanceofthe property, including grass cutting, trimming, spraying, treatment and replacementofdeadplants.thisexemptiondoesnotapplytotheremoval oftreesortonewtreeorshrubplanting. b. Exemption:Ifapublicutilitycompanyhasafranchiseagreementwiththe CityofKenner,itshallbeexemptfromthepermitrequirementsofthis ordinance. (3) Theapplicationmustincludeanotarizedaffidavitinwhichtheapplicantagreesto compensatethecityforanydamagestopublicpropertyandtowaiveallclaimsagainst thecityforpersonalandpropertydamagesustainedbytheapplicantthatmaybe relatedinanywaytosaidpermitandalsoagreetoindemnifythecityagainstanyclaims ofthirdpartiesforpersonalinjuryandpropertydamagethatmayberelatedinanyway tosaidpermit. (4) Theapplicationpermitfeeshallbetwentyfivedollars($25.00)perpermitforall activitiesinvolvingtreesandshrubswithtrunkslessthanfour(4)inchesindiameter.a separatepermitshallberequiredforeachtreeorshrubwithatrunkfour(4)inchesor greaterindiameter. (5) Apermitmaybeconditionedonthefurnishingofabondorotheradequatefinancial assuranceforthepaymentofdamagesincurredasaresultofapermitviolation. (6) ApprovalofatreeorshrubremovalpermitbytheDirectoroftheDepartmentofPublic Worksmaybeconditionedonreplacementwithanewtreeorshrubofanapproved varietyifitisfoundthatsuchreplacementisnecessarytomaintainanornamentaltree systemonthestreet,block,parkorotherpublicproperty. (7) ApprovalbytheDirectoroftheDepartmentofPublicWorkswillbegivenfortree removalwhenitisfoundthattheparticulartreeshouldberemovedorisunsafebecause ofgrowthwhichcannotbecorrectedbypropertrimming,becauseofdamagecausedby theelementsorbecauseofage,diseaseorotherdebilitatingcause,becauseofinsecure root system which might cause the tree to fall, because of existing or potential interferencewithstreetuse,becauseofrootinterferencewithsubsurfaceseweror utilityfacilitieswhichreasonablerootpruningmaynotcorrect,orbecauseofanyother conditionswhichhefindswherebysuchremovalwillbeinthepublicinterest. (8) AllrequestsforpermitsrequiredbythisArticleanddeniedbytheDepartmentofPublic Workswillbeaccompaniedbyalistofreasonsfordenial.
