March 29, 2017 Mr. & Ms. Retailer CEO & General Counsel X-mart 123 Main Street Everyville, USA RE: Opportunity for Improved Compliance, Reduced Brand/Litigation Risk, and Merchandising Flexibility Dear Mr./Ms. Retailer, Fire extinguishers are likely near the very bottom of the long list of things you manage and think about, and it s possible you never think about them at all. But now you have several important reasons to be proactive and do so. Underwriter s Laboratories recent approval of Oval Brand Fire Extinguishers can have a significant positive impact on your business, your brand, and retailers in the U.S. and Canada by: Ensuring your retail environment is compliant with the Americans with Disabilities Act. o Though compliance with the ADA is a federal requirement many, if not most, retail stores are currently in violation of the protruding object requirements. The reason being previously existing options were not tenable. With Oval, retailers now have a safe, practical solution to this serious issue. Most retail spaces are currently in violation of the protruding object regulations of not just the ADA, but the International Fire Code and local building codes as well. 1 Oval Brand s low-profile fire extinguishers are the industry s only 10-lb extinguishers which protrude less than 4 inches when surface mounted, thus being the only extinguishers which always comply with the protruding object limits no matter the height of installation. Guaranteeing your stores are compliant with NFPA-10 size and rating requirements for fire extinguishers. o Disturbingly, many national retailers are deficient in the required quantity of fire extinguishers installed in their stores by as much as 30%. Many stores rely upon 5-lb fire extinguishers with either a 2-A or 3-A rating, and they struggle to find suitable locations for extinguisher installations. 2-A & 3-A rated fire extinguishers are limited in their allowable square feet of coverage, often requiring more than one extinguisher within every 75 feet. o Oval Brand s 10-lb extinguishers 4-A rating, when used within Ordinary Hazard Occupancy, meets all relevant regulations for class A hazards, ensuring adequate protection when installed within 75 feet of travel distance for access. For retailers currently using 5-lb extinguishers, our 10-lb extinguishers reduce the number of extinguishers required to be purchased, installed, and maintained. Minimizing significant risks to your brand and bottom line by not complying with federal mandates. o Individual or class action complaints related to not being ADA compliant can occur. o Negative news/word-of-mouth hurts when directly linked to your brand s reputation if associated with not meeting code and/or safety requirements. This is particularly relevant given how Millennial s choose where to shop today. 1 Detailed explanations for all points can be found in the attachment. 1 Innovating Unparalleled Fire Protection Products

Eradicating damaged extinguishes and potential lawsuits by affixing extinguishers securely (and elegantly). o Currently fire extinguishers can easily fall from standard hooks and brackets when bumped. Even heavy duty brackets, if used, get damaged, bent, and often fail to securely hold an extinguisher resulting in a damaged unit when it hits the floor or a lawsuit if it lands on a child s or adult s foot. Our Button Hook dramatically increases safety by significantly reducing the likelihood of the fire extinguisher being bumped from, or knocked off, its hook. Only Oval s button hook allows an extinguisher s vertical axis to rotate nearly 180 degrees, side to side, without disengaging from its mount and falling. Safety is increased and accessibility is still maintained. Enhancing merchandising flexibility while maintaining, and ensuring, required protection. o You are in the business of selling. Best merchandising practices often result in extinguishers being placed on the floor, trapped between a column and goods, or it may be missing all together. Hooks and brackets for ordinary round extinguishers can become a hazard as hooks can be sharp and snag clothing or skin. Oval s patented button hook allows for easy and safe installation on multiple sides of a building column, allowing for optimal merchandising while maintaining code and safety regulations. Oval s hooks, if exposed, only protrude ½ and are smooth, posing insignificant risk of shopper or employee injury. Oval s hooks are also more durable than existing hooks and brackets, reducing replacement costs. Oval Brand is Here to Help Oval was founded to help save lives and property by innovating unparalleled fire protection products to improve accessibility, function, and design. This is particularly true for the retail environment. Should you, your Safety & Security Director, or others on your team find it responsible to solve or avoid any of these common problems, our brand is ready to help and make it easy. We are currently shipping our UL & ULC listed extinguishers across the USA and Canada. Please feel free to contact me and our sales team directly with any questions. As a courtesy, we are also attaching a list of other retailers that are receiving the same letter from us, addressed to them individually. Warm regards, Kevin M. Kozlowski Founder / CEO Oval Fire Products Corporation x Innovating Unparalleled Fire Protection Products

ATTACHMENT Compliance Building Codes The most common sizes and type of fire extinguishers installed in retail stores are 5-lb and 10-lb ABC extinguishers. Very often, when they are surface mounted to walls, building columns, and racking, they are violating protruding object requirements of the Americans with Disabilities Act (ADA), International Fire Code (IFC), and ANSI/ICC A While compliance with the ADA is a federal requirement, the IFC and ANSI/ICC requirements find their way into most all state and local building codes. These three regulations all require that if the bottom leading edge of any object is higher than 27 inches above the floor, and if someone walking can bump into them, then they cannot protrude greater than 4 inches. Presently, the ordinary round 5-lb and 10-lb extinguishers available all protrude greater than 4 inches when surface mounted. While some retailers do install their extinguishers with the bottom leading edge at or below 27 inches, many do not. If the bottom leading edge is below 27 inches, objects are allowed by the regulations to protrude greater than 4 inches. 3 Innovating Unparalleled Fire Protection Products

Many retailers prefer to install their extinguishers with the bottoms higher than 27 inches for various reasons. If the extinguisher is installed with its bottom at 44 inches or higher, it allows for most handles on shopping carts to travel beneath the extinguisher, thus reducing impacts and potential dislodgement from the hook or bracket. 4 Innovating Unparalleled Fire Protection Products

Oval Brand s low-profile fire extinguishers are the industry s only 10-lb extinguishers which protrude less than 4 inches when surface mounted, thus being the only extinguishers which always comply with the protruding object limits no matter the height of installation. Compliance Proper Quantities & Ratings While the ordinary, round, 5-lb extinguishers protrude greater than 4 inches as well when surface mounted, just like their 10-lb brethren, 5-lb extinguishers present another common compliance challenge for retailers, particularly within big-box stores. Many of us in the construction, facilities, and fire safety business know about the 75 foot rule. We use this rule-of-thumb to guide us in the proper location and placement of fire extinguishers within a facility. The NFPA edition, section E.3.3 states the travel distance (actual walking distance) from any point to the nearest fire extinguisher shall not exceed 75 ft (22.9m). This rule is clearly understood and is usually applied correctly and enforced by the local Authority Having Jurisdiction (AHJ). What often gets missed, even by many AHJ s, is the next sentence in E.3.3 It is necessary to select fire extinguishers that fulfill both the calculation requirement and travel distance requirements for a particular class of occupancy. NFPA 10 Table E.3.5, Maximum Area in Square Feet to Be Protected per Extinguisher, allows for a 5-lb extinguisher with a 3-A rating to cover 9,000 square feet when that area is classified as Light Hazard Occupancy, however only 4,500 square feet when the area is classified as Ordinary Hazard Occupancy, which is the classification of most retail stores. What happens when one efficiently distributes 5-lb fire extinguishers per the 75 foot rule into a facility that is classified as Ordinary Hazard Occupancy? Here s a good example. 5 Innovating Unparalleled Fire Protection Products

Even when not accounting for pathway obstructions such as fixtures and aisles, which all effect the foot travel distances, each of the extinguishers in the graphic is responsible for protecting 5,625 square feet. Remember, each 5-lb 3-A rated fire extinguisher can only cover 4,500 square feet. It gets even worse if the 5-lb extinguisher being used has a 2-A rating, as it can only cover 3,000 square feet. Many stores struggle to even meet the 75 foot rule due to aisles, fixtures and locations of building columns. By relying upon 5-lb 3-A rated fire extinguishers, and struggling to find suitable locations for extinguisher installation, a store may find it needs to install an additional 20 to 30 percent more 5-lb fire extinguishers just to meet the NFPA-10 Standard for Portable Fire Extinguishers. It is an unsettling fact that many national retailers may be deficient in the quantity of fire extinguishers installed in their stores by as much as 30%. Oval Brand is not yet manufacturing a 5-lb fire extinguisher; however, we suggest that our 10-lb extinguishers are the most responsible choice for retailers. Our 10-lb extinguisher s 4-A rating, when used within Ordinary Hazard Occupancy, provides 6,000 square feet of coverage per extinguisher. When facilities classified as Ordinary Hazard Occupancy install our 10-lb 4-A rated extinguisher and follow the 75 foot rule, they should never find themselves short of the required quantity of extinguishers. Plus, they don t need to buy and maintain as many extinguishers, as compared to the quantity required if relying upon 5-lb extinguishers in lieu of 10-lb models. Risk There are risks associated with the compliance issues listed above. Whether it is individual ADA complaints, a potential class action, or an embarrassing news report on lack of code required fire safety elements, all these things can be damaging to a brand s name and reputation. When Oval Brand set out to create the world s slimmest fire extinguisher, we were determined to identify and solve as many problems with the old fire extinguisher design as possible. One other major problem we saw was that fire extinguishers fall from their standard hooks and brackets much too easily when bumped into. Even heavy duty brackets get damaged, bent, and often fail to securely hold an extinguisher. Often the fire extinguisher gets damaged when it hits the floor. Even worse is when an extinguisher lands on a child or a person s foot. 6 Innovating Unparalleled Fire Protection Products

We thought that the current state of the art for wall hooks and hangers could use improvements for long-term durability and better aesthetics. Our patented Button Hook solution increases safety and lowers risk by drastically reducing the likelihood of the fire extinguisher being bumped from or knocked off the hook. Our solution is very simple and tough, yet elegant when compared to our competition. Another great feature of our Button Hook is that it allows the fire extinguisher s vertical axis to rotate around the button hook nearly 180 degrees, side to side, without the fire extinguisher easily disengaging from the hook and falling. If one simply grabs the handle and lifts, the Oval Brand fire extinguisher easily releases from the button hook. The applied force on the button hook s single fastener is mostly shear, rather than in tension. This means that the button hook is not pulling the fastener away from and out of the wall or column, which is commonly found in faulty hook installations. 7 Innovating Unparalleled Fire Protection Products

Merchandising Flexibility At their designated and marked locations, it is very common to find fire extinguishers either missing, on the floor, or trapped between a column and goods due to merchandising practices. Rarely are additional fire extinguisher hooks or brackets installed on multiple sides of a building column. In addition, the hooks and brackets for ordinary round extinguishers can become a hazard if the extinguisher is missing, as the hooks can be sharp and snag clothing or skin. 8 Innovating Unparalleled Fire Protection Products

With Oval s innovative and patented button hook, it is easy to install additional hooks on 1, 2, or 3 additional sides of a building column. When merchandising practices require that the fire extinguisher be moved, simply move it from one side of a column to another so that it is always accessible. Plus, the additional hooks only protrude ½ inch, are smooth, and pose insignificant risk of injury to shoppers and employees. Lastly, our button hooks are extremely durable and are much less likely to require repair than competing hooks and brackets. 9 Innovating Unparalleled Fire Protection Products
