2 The ASFP - A brief background history When Originally known as the Association of Structural Fire Protection Contractors and Manufacturers (ASFPCM), the association was formed in 1975

3 The ASFP - A brief background history Why In recognition of a need to bring together passive fire protection (PFP) manufacturers, contractors and testing/certification bodies to encourage, develop and give guidance on essential standards in PFP.

4 The ASFP - A brief background history In 1996 the Association changed its name to the Association for Specialist Fire Protection To better reflect the diversity of the work then being undertaken in the fields of fire stopping, fire resisting ducting, fire dampers, fire resisting partitions and other elements used for compartmentation

5 The ASFP - A brief background history In 1996 the Association changed its name to the Association for Specialist Fire Protection The Association is responsible for and/or has had a significant input into the vast majority of guidance and standards that exist today across the whole spectrum of the PFP sector.

Today the ASFP is further broadening its membership and remit to reflect and respond to the significant changes and challenges that are taking place at many levels within the PFP sector in terms of technical innovation, regulatory direction, the changing political dimension, evolving commercial forces and geographic expansion of the industry.

Installations independently inspected Accredited Certificates of Conformity issued by the installer Essential supportive evidence in compliance with the Regulatory Reform (Fire Safety) Order 2005 Essential supportive documentation in accordance with Regulation 38 (formally Regulation 16b) of the Building Regulations

20 Four Key Issues Issue One Building Regulations such as Regulation 38 (formally 16b) There is no doubt that Government clearly expects that the duties of Building Regulation 38 (previously known as Regulation 16b) will be reliably carried out and the building user/owner will be fully informed of the fire protection provisions in the building he now occupies Regulation 38 requires that, where building work involves the erection or extension of a relevant building, fire safety information shall be given to the responsible person at the completion of the project or when the building or extension is first occupied Refer to Appendix G: Fire Safety Information

21 Four Key Issues Issue One Building Regulations such as Regulation 38 (formally 16B) Why is this essential?

22 Four Key Issues Issue Two Regulatory Reform (Fire Safety) Order 2005 Fire (Scotland) Act 2005 Under the Regulatory Reform (Fire Safety) Order 2005 the owner of the building, as the Responsible Person now takes on the ownership of liability for the fire safety of all those within his building and will appoint a Competent Person to ensure that an appropriate Risk Assessment is made and maintained for his building.

23 Four Key Issues Issue Two Regulatory Reform (Fire Safety) Order 2005 So who is defined as a Responsible Person? An employer A managing agent or owner of shared premises A charity or voluntary organisation A contractor with a degree of control over any premises

24 Four Key Issues Issue Two The order states that any fire-risk in a premises must be managed, for the life of the building. Fire authorities no longer issue fire certificates and those previously in force now have no legal status, therefore the responsible person must carry out a fire-risk assessment. Where expertise to carry out such a risk assessment is lacking this process may be passed to a competent person. None-the-less, the responsible person will still be responsible, in law, for meeting the order. The responsible person, either on their own or with any other responsible persons, must as far as is reasonably practical make sure that everyone on the premises, or nearby, can escape safely if there is a fire.

32 Four Key Issues Issue Four Construction Products Regulation Came into force in April 2011 but not mandatory until June 2013 The Construction Products Regulation (305/2011/EC - CPR) replaces the Construction Products Directive (89/106/EEC - CPD) and lays down harmonised conditions for the marketing of construction products.

33 Four Key Issues Issue Four Construction Products Regulation CE marking shows that the declared product performance has been obtained by the procedures set out in the relevant European Product Standards(hEN) or European Assessment Documents (EAD) Not a National mark Not a quality mark
