24 Preliminary Draft Generic Environmental Impact Statement South Fourth Avenue-East Third Street Urban Renewal Plan Plan Adoption, Zoning Code and Map Amendments 4.3 Historic and Archaeological Resources This section evaluates the components of the Proposed Action that serve to protect or enhance the existing historic and archaeological resources Existing Conditions In an effort to preserve and enhance the character of its neighborhoods, several recommendations pertaining to historic preservation and historic resources were included in the 2011 Draft Comprehensive Plan. These recommendations include: the exploration of historic preservation ordinances and policies to preserve and maintain building quality and character; and updates to the City s inventory of historic resources utilizing New York State Office of Parks, Recreation & Historic Preservation (OPRHP) protocols. A 1986 study conducted by D Amore Design Studio Architects and Planners on behalf of the Department of Planning and Community Development may serve as a starting point. The study provides an inventory of structures deemed potentially eligible for inclusion on the National Register of Historic Places. The study pointed out that the south side of Mount Vernon possessed the oldest housing stock in the City, including many of the original 100 homes from the initial settlement of the City; however many of the homes no longer existed or were in a state of severe disrepair which precluded the area from being listed as an historic district. While the study concluded that there are no neighborhoods in Mount Vernon that would qualify as historic districts, it did identify some 30 individual structures as candidates for possible inclusion on the National Register. Though not officially designated on the New York State or National Historic Registers, five brownstone style urban flats (the Modern Flats ) within the proposed Urban Renewal Area were recognized in the Study as architecturally significant due to the good condition of the building cornice and the notable detail in the individual entrances to the buildings. While the intervening three decades have not been kind to the buildings, the proposed Townhouse Preservation Sub-District (UR-PUD-S4-TP) within the proposed Urban Renewal Area is designed to encompass and establish mechanisms to preserve the five Modern Flats on South Third Avenue (see Sections 3 and 4.1 of this GEIS). At present, no properties within the proposed Urban Renewal Area have been designated as a New York State Historic Site. Mount Vernon has already obtained National Register designation for several appropriate buildings in the City, several of which were identified in the 1986 Study. As of February 2014, there are five (5) officially designated properties), two (2) of which are located within the proposed project s Land Use Study Area: the John Stevens House and Trinity Episcopal Church Complex (see Table and Map 4.3.1). First Ave Source: Ferrandino & Associates Inc. & National Park Service, The John Stevens House Purchased by John Stevens in 1850, this home, which is one of two designated properties located within the Land Use Study Area, was constructed by Sylvanus Purdy, owner of one of the original five farms that constituted the land purchase of the Industrial Home Association No. 1. Since it was built before the subdivision of the original purchase, it did not conform to the original gridplan, and remains one of the few buildings in this section of the City that does not. Stevens House was the center of early activity of the new suburb. Meetings of the Association took place here, and the selection of lots from the subdivision took place in the barn on the property (no longer standing) in Trinity Episcopal Church Complex The second of two designated properties located within the Land Use Study Area, the Trinity Episcopal Church Complex consists of the church (1859), old parish hall (1892), new parish hall (1909; 1954) all connected to form an L shaped building, and rectory (1893). The church was built in the Gothic Revival style and enlarged and substantially redecorated in the 1880s. It is a one story masonry structure with a steeply pitched, slate covered gable roof. Ground that the present buildings stand on was originally part of the five farms purchased for the future Village of Mount Vernon. The site has also been used as a village green, a parade ground and the location of the City s first Fourth of July celebration. Ferrandino & Associates Inc Draft April 2014

27 Preliminary Draft Generic Environmental Impact Statement South Fourth Avenue-East Third Street Urban Renewal Plan Plan Adoption, Zoning Code and Map Amendments Anticipated Impacts As all of the nationally recognized historic structures in the City of Mount Vernon are located outside of the proposed Urban Renewal Area, the adoption and implementation of the Proposed Action by the City of Mount Vernon will not in and of itself adversely impact the City s historical and archaeological resources identified on the National Register. The Proposed Action also does not directly authorize any particular development project on or adjacent to the designated historic resources. The purpose of the UR-PUD-S4 Overlay Zone is to preserve the special character of architecturally and culturally significant structures while fostering the development of high-rise mixed use buildings within the proposed Urban Renewal Area. Additionally, the proposed UR- PUD-S4-TP Overlay Zone is designed to preserve the special character of the five Modern Flats, identified by the City as architecturally significant structures. As all but one of these structures are in poor condition with multiple code violations, the Proposed Action will further enhance the existing historical resources within the City of Mount Vernon by establishing a framework for preserving, maintaining and restoring the Modern Flats. In Section 4.2, a Shadow Study analysis under full build-out conditions was undertaken to assess the impact of potential shadows on the historic, cultural and institutional resources, determining an impact only if shadows affect the character, use, survival or enjoyment of the resources. The full build-out analysis, which represents a worst-case-scenario, will have no impact on the sunlight that reaches the two National Historic Register places which are located within the Shadow Study Area and are considered to be sunlight sensitive, the John Stevens House and the Trinity Episcopal Church Complex. However, the proposed Urban Renewal Area will allow for significantly taller buildings adjacent to the Modern Flats, which, if fully built out, will completely shade the Modern Flats during the morning and evenings throughout the year. As there will be some increased shading there will be some impact on historic resources within the Land Use Study Area; however, the additional shading will not adversely impact the architectural qualities of the Modern Flats and is thus not considered significant. A packet with detailed background information on the Proposed Project, dated February 5, 2014, was submitted to the Division of Historic Preservation at the New York State Office of Parks, Recreation and Historic Preservation (NYS OPRHP). The response from NYS OPRHP, dated February 18, 2014, required an inventory of properties within and immediately adjacent to the proposed Urban Renewal Area, with images and construction dates. Compliance with this request required extensive research and compilation, including researching construction dates for buildings sited on over 110 individual properties in the City of Mount Vernon Department of Assessment and going out into the field to take images of over 40 properties immediately adjacent to the proposed Urban Renewal Area. This supplemental information has been submitted to NYS OPRHP, and a response is pending. See Appendix L for the initial February 5, 2014 submission to NYS OPRHP and official February 18, 2014 letter of response from the NYS OPRHP Proposed Mitigation While the adoption and implementation of the Proposed Action by the City of Mount Vernon will not, in and of itself, impact land use because it does not directly authorize any particular development project, several mitigation measures for the adverse impacts discussed above are recommended below. 28 Preliminary Draft Generic Environmental Impact Statement South Fourth Avenue-East Third Street Urban Renewal Plan Plan Adoption, Zoning Code and Map Amendments explored in the site-specific environmental impact statements required for each individual development project within the Urban Renewal Area prior to approval by the appropriate authority. Focused density. The Urban Design Guidelines recommend that the highest-density development in the Urban Renewal Area be focused at the intersection of the South Fourth Avenue-East Third Street commercial corridors. Development density would then taper off along South Fourth Avenue and East/West Third Streets and along South Third and Fifth Avenues. This tapered density could come from reduced building heights, increased building step-backs and yard setbacks or some combination thereof. This scenario would keep properties abutting the Modern Flats at a height of approximately 70 feet, significantly less than the UR-PUD-S4 Zoning Overlay maximum allowable height of 120 feet. Revisions to yard requirements. Revisions to the front yard setbacks to make them more contextual and the addition of maximum side yard setbacks could mitigate some of the adverse impacts from additional shading. These changes could potentially help to mitigate some of the shadow impacts by allowing the street wall to be broken at strategic places to allow sunlight through to the Modern Flats, the only historic resources identified that could experience adverse impacts from increased shading. Site-specific architectural mitigations. Additional site-specific architectural mitigations could also help to offset the visual and community character impacts of individual development projects. It is important to note that the shadow models analyzed in Section 4.3 are based upon a worst case scenario for the design of the building on the Site. Any building design proposed for these Sites would have to comply with the bulk and design regulations under the proposed UR-PUD-S4 Overlay Zone, which could mitigate some of the potentially adverse shadow impacts observed for the Modern Flats. Though the potential additional shading will not adversely impact the architectural qualities of the Modern Flats, any additional measures to mitigate adverse shadow impacts on these historical resources would be examined in detail during a site-specific SEQR analysis.
