5 1.0 Introduction 1.1 Purpose of this document This document has been prepared pursuant to the Town and Country Planning Act An application has been submitted for planning permission for the development of a site to provide four semi-detached dwellings with parking spaces, shared access and associated landscaping. The Site, formerly known as The Common, is located off of Sweechgate, Sturry, Kent, CT2 0QR. Ordnance Survey grid reference TR Clifford Construction Ltd. have commissioned Lewis Ecology to prepare a great crested newt mitigation strategy document to support their planning application. 1.2 Site location The site is located northwest of the village of Sturry, near Canterbury, Kent (see Fig. 1.0). The site is west of the A291, and between Sweechgate to the north and Shalloak Road to the west. The site is surrounded by residential properties on all sides. Within the site itself are areas of amenity/ neutral grassland, parkland trees, hedgerows, and scrub borders. There are two garage buildings which are in use at the time of this report. There is a driveway leading to the garages at the north of the site. To the southeast is a wooded area with two ponds. There is a public footpath between the two ponds. 6 1.3 Site context Lewis Ecology carried out a number of ecological surveys throughout 2016 and a short synopsis of those reports is provided below: The site was subjected to an extended Phase 1 Habitat Survey in February 2016 (Lewis Ecology, 2016 [a]). A number of ecological constraints were highlighted and further surveys were recommended. Species reported to have potential to occupy the proposed development site include nesting birds, bats, hedgehogs, reptiles and amphibians. A number of recommendations for further ecological surveys and indicative enhancements are provided within the report. Lewis Ecology was commissioned by Clifford Construction Ltd. to carry out surveys for Great crested newts (Lewis Ecology, 2016 [b]). A total of 6 surveys were carried out in order to ascertain a population estimate of newts that inhabit a large, wooded pond, and a smaller garden pond immediately adjacent to the proposed development site. A population size class assessment (English Nature, 2001) was carried out and there is a medium size population of great crested newts within the two ponds. A peak count of 29 great crested newts was obtained on the 18th May Lewis Ecology was commissioned by Clifford Construction Ltd. to carry out surveys for reptiles (Lewis Ecology, 2016 [c]). Presence/likely absence surveys for reptiles were carried out between 26th April and 24th June The site was visited a total of 7 times to check artificial cover objects for the presence of reptiles. No observations of reptiles were recorded throughout the survey programme. Similarly no other herpetofauna, such as great crested newts, were observed during these terrestrial based surveys. During 2016, land adjacent to the application site has been developed for housing stock. The Site, formerly known as The Piggery, is located off of Chapel Lane, Broad Oak, Kent, CT2 0QR. Ordnance Survey grid reference TR Planning Application number: CA/14/02087/FUL. This development causes a significant barrier to dispersal for the extant newt population during their terrestrial phase and therefore contributes to the cumulative impacts on priority species and habitats within the landscape. Furthermore, as part of the wider scheme of the current proposed development, planning has been approved for two semi-detached dwellings on land east of 73 Sweechgate, Broad Oak, Sturry, CT2 0QR. See planning application number CA/13/01865/FUL. This scheme appears to have been granted planning permission by Canterbury City Council without due regard for the biodiversity interests of the site and its proximity to priority habitats known to support European Protected Species. However, this has since been addressed through the current project whereby Clifford Construction Ltd. have included the proposed development plot within the suite of recent ecological surveys described above. This site will now be included in all measures to mitigate potential developmental impacts on known ecological receptors as part of the current project. The site continues to be managed by the existing landowner and the grassland and scrub borders are strimmed to a regular height of < 200mm, all arisings are removed from site. 7 Continued management of the site helps to prevent potential colonisation of the site by protected species that may otherwise colonise the site from adjacent properties and landholdings. All work on site will be subjected to a Natural England European Protected Species Licence (EPSL) application. An EPS licence will be obtained prior to any developmental activities on site, as required by law, e.g. The Conservation of Habitats and Species Regulations (2010) and the Wildlife and Countryside Act (1981) as amended. All mitigation works will take account of other development and infrastructure projects in the local area and combine efforts to mitigate any potential cumulative impacts and seek to enhance the landscape for biodiversity and carry out post development monitoring surveys accordingly. 8 2.0 Survey Summary 2.1 Great crested newt survey assessment A population survey for great crested newts was carried out during April - May 2016, following best practice guidelines, e.g. English Nature (2001). 10 3.0 Impact Assessment 3.1 Great crested newt risk assessment Natural England have produced a risk assessment tool that helps determine whether development activities are likely to result in significant disturbance to great crested newts. When using the tool Natural England advise: This risk assessment tool has been developed as a general guide only, and it is inevitably rather simplistic. It has been generated by examining where impacts occurred in past mitigation projects, alongside recent research on newt ecology. It is not a substitute for a site-specific risk assessment informed by survey. In particular, the following factors are not included for sake of simplicity, though they will often have an important role in determining whether an offence would occur: population size, terrestrial habitat quality, presence of dispersal barriers, timing and duration of works, detailed layout of development in relation to newt resting and dispersal. The following factors could increase the risk of committing an offence: large population size, high pond density, good terrestrial habitat, low pre-existing habitat fragmentation, large development footprint, long construction period. The following factors could decrease the risk: small population size, low pond density, poor terrestrial habitat, substantial pre-existing dispersal barriers, small development footprint, short construction period. You should bear these mitigating and aggravating factors in mind when considering risk. It is critical that, even if you decide not to apply for a licence, you ensure that any development takes account of potential newt dispersal. Where great crested newts are present, land use in that area must ensure there is adequate connectivity. Retaining and improving connectivity will often involve no licensable activities. Surveys carried out in 2016 (see section 2.0, above) determined that ponds within the vicinity of the proposed development project support a medium population of great crested newts. 11 3.2 Guidance on risk assessment result "Amber: offence likely" indicates that the development activities are of such a type, scale and location that an offence is likely. In this case, the best option is to redesign the development (location, layout, methods, duration or timing; see Non-licensed avoidance measures tool) so that the effects are minimised. You can do this and then re-run the risk assessment to test whether the result changes, or preferably run your own detailed site-specific assessment. Bear in mind that this generic risk assessment will over- or under-estimate some risks because it cannot take into account site-specific details, as mentioned in caveats above. In particular, the exact location of the development in relation to resting places, dispersal areas and barriers should be critically examined. Once you have amended the scheme you will need to decide if a licence is required; this should be done if on balance you believe an offence is reasonably likely. 3.3 Pre and Mid-development impacts The proposed development site consists predominantly of short sward grassland offering little to no areas for overwintering/sheltering newts. The site is isolated on three sides by residential housing and then busy roads, save for the area in the vicinity of the nearby pond, which is located on the southeast boundary of the site. The pond and its immediate area will remain completely unaffected by the proposed development project. A recent residential development, to the south of the present site, has been carried out in which a partition fence has been installed with concrete gravel boards along its entire length. This fence line provides a complete barrier for newt dispersal from a south-north direction where this project is concerned. Terrestrial survey work undertaken by Lewis Ecology in 2016 did not reveal any great crested newts and it s therefore likely that potential encounters with individual newts will be extremely low. There is potential to encounter newts in the terrestrial environment during mitigation activities, such as creation of over wintering sites (hibernaculum), planting of hedgerows, construction of a new pond and associated aquatic habitat. However, this will only be undertaken under licence and all measures will be taken to avoid potential disturbance. Where new habitat is to be created, it will be done under the guidance of an experienced and licensed Ecological Clerk of Works (ECoW). It is proposed to create a 5 m buffer strip around the proposed development site that will provide a net gain for biodiversity, but designed specifically for great crested newts. If individual great crested newts are found during habitat creation works, they will be relocated to the terrestrial environment immediately surrounding the existing pond. Once construction works for habitat creation has been completed, the development site will then be enclosed using amphibian exclusion fencing. The fence will be erected using methods described in the great crested newt mitigation guidelines (English Nature, 2001) The fence will provide a complete barrier to any newts that may otherwise disperse towards to the development area. The entire exclusion fence will also be protected by heras fencing in order to avoid disturbance during the construction phase. Land off of Sweechgate, Broad Oak, Sturry, Kent 7

12 The development area will undergo a complete strip of grass and topsoil to allow for the proposed development. This will be carried out under a watching brief by an experienced ECoW. All materials arising from the clearance works will be removed from site. Only when the clearance operations have been completed will the site be released for development. An ecologist will frequently visit the site, at least weekly during the construction period, to inspect the amphibian exclusion fenceline and monitor compliance with any licensing requirements. The proposed works during the pre and mid-development periods are likely to have a lowmoderate impact on the extant newt population. 3.4 Long-term impacts The proposed development will destroy approximately 1.5 ha of a 3.0 ha area of short sward (<200 mm) grassland that is within the core range of a great crested newt breeding pond, e.g. < 100 m. The remaining area will be landscaped according to an ecological enhancement strategy which will include several hibernaculum, a new pond and associated terrestrial/aquatic habitat. All garden fences will be permeable to allow movement of great crested newts and other wildlife across the site. Development activities are likely to have a low-moderate negative impact on the extant newt population, but mitigation will provide net gains for biodiversity and ultimately benefit the newt population at large and help to expand their range locally. 3.5 Post-development interference impacts An introduction of fish and invasive aquatic plants due to the creation of extra residential development adjacent to the existing ponds. Disposal of garden waste in or around the pond area creating eutrophic water conditions. Potentially serious negative impacts on the newt population, however with appropriate education and mitigation this threat is likely to be low-moderate. There is potential for habitat creation areas to be vandalised or become dumping areas for garden waste. Residents will be made aware of the presence of protected species and of the mitigation in place. Appropriate signage will be supplied to demarcate wildlife areas and protected species. 3.6 Other impacts Potential for amphibians and other wildlife to become trapped in gully pots or drainage systems for the proposed development. Also, grey water run off from buildings, roads and paths may become polluted and enter the aquatic system which could potentially have a serious negative impact on the extant newt population. These impacts will be minimised by providing ladders within the drainage system (gully pots), no curbs where possible and a sustainable urban drainage system installed throughout the development. 13 4.0 Mitigation and compensation For ecological enhancements please refer to the Ecological Enhancement Statement document (Lewis Ecology, 2016[d]), submitted to planning. Original design ideas for the proposed project include up to five residential properties, however the client has allowed for ecological enhancement areas to be provided within the scheme footprint, which has reduced the number of potential houses to four. This reduction in the development footprint has allowed the scheme to embrace the advice of the National Planning Policy Framework regarding biodiversity and especially paragraph 118, which states - opportunities to incorporate biodiversity in and around developments should be encouraged. At the present time the proposed development site offers little more than foraging and/or dispersal habitat for newts, but with sympathetic changes to the project design the net gain for biodiversity can be positively achieved. Those actions are discussed in the ecological enhancement strategy document and are provided here: 4.1 Terrestrial habitat To maximise the opportunities for wildlife within the development, the ornamental planting proposed on site will include only native species that provide a rich source of nectar and pollen for insects, and berries for birds. A comprehensive planting strategy will be provided by an appointed landscape team. Some examples of tree species that will be planted include: Field maple (Acer campestre), common hornbeam (Carinus betulus), hawthorn (Crataegus laevigata), hazel (Corylus avellana), spindle (Euonymus europaeus), cherry (Prunus sp.), dogrose (Rosa canina), rowan (Sorbus aucuparia), elder (Sambucus nigra) and crab apple (Malus sylvestris). Some examples of flowering plants that will be planted include species such as: Foxglove (Digitalis purpurea.), cowslips (Primula veris), knapweed (Centaurea sp.), ox eye daisy (Leucanthemum vulgare), bluebells (Hyacinthoides non-scripta), and wood anemone (Anemone nemorosa). Avoid planting any species listed on Schedule 9 of the Wildife and Countryside Act 1981 (amended 2010). Section 14 of the Wildlife and Countryside Act 1981 (amended 2010) is to prevent the release into the wild of certain plants and animals which may cause ecological, environmental, or socio-economic harm. It is Section 14A (2) that refers to Plants, and specifically plants listed on Part 2 of Schedule 9 of the Wildlife and Countryside Act. Land off of Sweechgate, Broad Oak, Sturry, Kent 9

14 A full list of species listed on Schedule 9 are available at - All non-native, but particularly invasive species such as Cherry Laurel (Prunus laurocerasus) will be avoided. 4.2 Aquatic habitats The existing ponds, described section 2.0, are located to the south and southeast of the proposed development site and are outside of the footprint of this scheme. Clifford Construction Ltd. have been granted access to the ponds for the purposes of carrying out protected species surveys only and do not have control over the management of these important habitats. Clifford Construction Ltd. have no means by which to guarantee the protection of these priority habitats in the future but acknowledge their importance as breeding and sheltering habitats for great crested newts. Clifford Construction Ltd. will create new aquatic habitats and enhance existing terrestrial habitats within the proposed scheme for the benefit of protected species and to meet their obligations under the National Planning Policy Framework. Clifford Construction Ltd. are committed to carrying out post development monitoring surveys of the great crested newt population within the existing ponds, together with a newly created pond, in line with current published guidelines, e.g. medium sized population/medium impact - 4 years post development monitoring. 4.3 Mitigation specifically relating to great crested newts In addition to the enhancements that will be undertaken in relation the aquatic habitats (see section 4.2 above), the following enhancements will be undertaken throughout the terrestrial habitats associated with the development site and built environment: A 5m buffer zone is proposed to allow newts to move around the development areas freely and undisturbed. The buffer zone will be planted with native species of shrubs and trees and will include the creation of specially designed hibernacula and a pond. Please see annotated drawing number 1085/05 (25/10/16) shown in Appendix A. 4 hibernacula will be built in the southern and western aspects of the properties. The design of each hibernacula will accurately follow guidance provided in the great crested newt mitigation guidelines (Natural England, 2001). 2 hibernacula will also be built to the south of the proposed parking bays. 15 fences separating each property. This will make the fencelines more permeable and will allow free movement by newts across the entire site, during their terrestrial lifecycle phase. Creation of a new pond that will provide additional aquatic habitat for the extant newt population and other herpetofauna found in the wider area. The pond will measure 10m x 12m and will have a depth of 1.5m leading to a shallow shelving beach at one end. Pond construction will follow the design principles available through the Freshwater Habitats Trust - Following initial groundworks for habitat creation an amphibian exclusion fence will be erected to enclose the entire development footprint. This will offer protection to newts from wondering in to the live working area, during the construction phase, and will also act as a barrier to ground workers and offer protection of the newly created habitat areas. All amphibian exclusion fences will be erected according to the great crested newt mitigation guidelines (Natural England, 2001). In addition to amphibian exclusion fence, heras fencing will be erected around the site to provide security for the development and also protect the newly created habitat areas and sensitive aquatic areas nearby. Once the fences have been erected and before development activities occur, a destructive search of the area will be carried out under a watching brief provided by an ECoW. It is deemed unnecessary to carry out lengthy trapping sessions with pitfall traps and artificial cover objects since no newts were detected during the terrestrial survey period in 2016 and the grassland area is currently being maintained at a height of no more than 200mm. Therefore the likely encounter rate of individual newts is likely to be nil or low. Any newts that are found during the clearance works will be safely relocated to terrestrial habitat around the existing ponds. Post development monitoring will be undertaken for a minimum of four years following the completed development. A total of six survey visits will be undertaken per annum to determine the status of the newt population within two ponds, adjacent to the development site and to monitor colonisation of a newly created pond. Surveys will be carried out according to published guidelines e.g. The results of surveys will be submitted to the statutory licensing authority (Natural England), the county recording group (Kent Reptile and Amphibian Group) and the Kent and Medway Biological Records Centre at the end of each survey period. At the time of the surveys the appointed ecologist will also advise on any further management works that may be required to the mitigation/enhancement areas together with management to the aquatic habitat areas. 16 4.4 Mechanism for delivery All development operations on site will be undertaken in accordance with the terms of a Natural England EPS Licence. The licence will be held by Clifford Construction Ltd. for the duration of the development and include any active monitoring period thereafter. A mitigation strategy will ensure no great crested newts come to harm as a result of the proposals, that the habitat is enhanced for biodiversity and in line with statutory planning advice. Additional aquatic habitat will be a key provision in ensuring that Favourable Conservation Status of great crested newts will not only be maintained but enhanced within the local area.
