BACKGROUND 192 Stanley Avenue is a two storey flat roofed house built circa 1894 and located in the New Edinburgh Heritage Conservation District (HCD). The building is a category three building in the HCD (Document 7). This report has been prepared because alterations to designated heritage buildings require the approval of City Council.

5 31 COMITÉ DE L URBANISME DISCUSSION The New Edinburgh Heritage Conservation District was designated by City Council in 2001 for its historic value as a former village initially purchased by Thomas MacKay and incorporated in 1867 and annexed by the City of Ottawa in The village was mainly settled by the people who worked at MacKay s mills at Rideau Falls. The prominence of the village was increased by its proximity to Rideau Hall, originally a country estate built by Thomas MacKay in the 1830s and leased to the Governor General beginning in 1867 (Document 6). New Edinburgh features a lively mix of building types dating from as early as the 1840s. 192 Stanley Avenue is a flat roofed house built circa 1894 and is representative of the early intensification of the village at the end of the 19 th century. The building was converted to a duplex in 1937 and has remained a duplex since then. The house is located on a through lot on the east side of Stanley Avenue and running through to River Lane. There was a garage on the lane that was demolished in The neighbouring properties on Stanley Avenue include a two-storey apartment building to the north and a gable roofed two and one half-storey house to the south. On the lane, there is a two-storey semi-detached house to the north and a single garage to the south of the property (Documents 1 and 2). The proposed alterations to the building include the demolition of an existing addition that was constructed beginning in 1967 and the construction of a two-storey addition at the rear of the building that will add two units to it. The project also includes the replacement of the existing non-original front porch with a more historically accurate wooden porch. City Council adopted the Standards and Guidelines for the Conservation of Historic Places in Canada in The Standards and Guidelines are published by Parks Canada and provide guidance related to the conservation of heritage resources and cultural landscapes. The Standards and Guidelines have been used in analyzing this application. The following standards are applicable for this application: Standard 1: Conserve the heritage value of an historic place. Standard 11: Conserve the heritage value and character defining elements when creating any new additions to an historic place or any new construction. Make the new work physically and visually compatible with, subordinate to and distinguishable from, the historic place. Standard 12: Create any new additions or related new construction so that the essential form and integrity of an historic place will not be impaired if the new work is removed in the future.

6 32 COMITÉ DE L URBANISME The New Edinburgh Heritage Conservation District Study has guidelines related to additions to existing buildings: 1. According to the City of Ottawa Zoning By-law 1998, additions are permitted if the proposed addition is located entirely in the rear yard the height of the walls and the height and slope of the roof do not exceed those of the building; the side yard setback is at least 30cm greater than that of the building. This is to ensure that the existing building remains the dominant presence in the streetscape. 2. Additions should complement, not copy, the original building so that there is a clear distinction between the new part of the building and the old. 3. Every attempt should be made to reduce the impact on the historic fabric of the building. The HCD Study also has a guideline related to porches: The verandah and balconies of many New Edinburgh buildings have been removed. If a property owner wishes to reinstate his/her original porch, the new design should be based on documentary evidence. If there is no evidence, other porches in the neighbourhood should be used as models, subject to the approval of a City of Ottawa heritage planner. The proposed addition to the building is a two-storey, flat roofed addition clad primarily in red brick that complements the existing building. Sections of the addition will be clad in tan coloured cement board panels to break up the façade. The south and east elevations of the new addition will feature rectangular sash windows similar to those in the original building. These windows will be metal clad wood and will have concrete sills and lintels. The north elevation of the addition will feature four horizontal rectangular windows. The addition is setback 60cm from each side of the original building. (Documents 3, 4, 5). The brick veneer on the original building will be cleaned (using a non-abrasive method), restored and repointed as necessary. The existing historic windows in the building will be retained and restored. The existing cornice and fascia board is to be restored to a more historically accurate style. The existing front porch is a later addition and is proposed for removal and replacement with a more appropriate wooden porch. The design of the cornice and the porch will be determined through historical research and consultation with staff. The existing driveway on Stanley Avenue will be retained and rebuilt with pavers instead of asphalt. A gravel walkway will run along the south façade of the building. A parking space for one vehicle will be provided off the lane. While the rear of the property is currently very green, there are no trees required for removal for this proposal. The tree canopy is provided by trees on other properties. There will be plantings of shrubs and flowers at the front and rear of the building (Document 3). The proposed addition will require an application for minor variance to allow the addition to be 66 per cent of the existing gross floor area where 30 per cent is allowed.

7 33 COMITÉ DE L URBANISME The proposed addition to the existing building is sympathetic to and distinguishable from the existing building. The use of materials is appropriate and the setback of the addition allows the original building to retain its dominant presence in the streetscape, which is the primary goal of all interventions in HCDs. The planned restoration work for the original building will have a positive impact for the building and the streetscape. The Department supports the proposed alterations because they meet the Standards and Guidelines and the Guidelines in the New Edinburgh Heritage Conservation District Study approved by City Council. RURAL IMPLICATIONS There are no rural implications associated with this report. CONSULTATION The New Edinburgh Community Alliance was notified of the application and provided comments as attached in Document 8. Heritage Ottawa is aware of the application. Adjacent property owners were notified of the application by way of letter and offered the opportunity to make written or oral submissions. COMMENTS BY THE WARD COUNCILLOR Councillor Clark is aware of and supports the application. LEGAL IMPLICATIONS There are no direct legal implications associated with this report. 16 42 COMITÉ DE L URBANISME STATEMENT OF HERITAGE CHARACTER DOCUMENT 6 New Edinburgh began as a small hamlet initially purchased by Thomas MacKay and settled primarily by those who worked in his mills at Rideau Falls. The Village of New Edinburgh was incorporated in 1867 and annexed to the City of Ottawa in The village s proximity to Rideau Hall, a large country house built by MacKay in the 1830s and leased to the Governor General in 1867 increased the social prominence of New Edinburgh. Vestiges of New Edinburgh s status as a self-sufficient village still exist and contribute to is special character. Former storefronts, churches and a public school (now closed) attest that this was once a thriving community. Early inhabitants who worked for a local business had little reason ever to leave the area. Better transportation links to downtown Ottawa encouraged the middle classes to move here and commute downtown for work but the vibrant commercial core persisted into the 1950s. A lively mix of building types dating from as early as the 1840s until the present characterizes New Edinburgh. Building types range from large Queen Anne-style structures, row-house, single family houses and doubles to small apartment buildings. The one-or two-and-a-half-storey, front gable-roofed structure is by far the most common housing type in the District. Two green spaces, the Governor-General s Grounds and Stanley Park, flank the neighbourhood. The green, tree-lined character that once typified the streets had disappeared because of Dutch elm disease and urban deforestation, but the remaining street trees, laneways and large landscaped back yards still create a pleasant green atmosphere. New Edinburgh is a stable, sought after community. It has a clear sense of identity and purpose and has proved its strong community spirit in its battles to stop the Vanier Parkway Extension and to save its neighbourhood school.

21 47 COMITÉ DE L URBANISME NEW EDINBURGH COMMUNITY ALLIANCE COMMENTS DOCUMENT Stanley Avenue NECA Response to Proposed Development Plan 42 Block 18 Lot3 PIN: Plans Reviewed A1.1, 2.1, 3.1 (submitted to City July 13, 2012) Developer: ARC Associates These comments are submitted by the New Edinburgh Heritage and Development Committee on behalf of the New Edinburgh Community Alliance (NECA), an incorporated, non-profit organization with a mandate to make representations on matters affecting this community and its residents. The NE H&D committee reviewed the proposed development plans for 192 Stanley Avenue using City of Ottawa criteria developed in the: City of Ottawa Official Plan - Section 4 Review of Development Applications; City of Ottawa Zoning By-law - Zoning R4S[900], Section 60 - Heritage Overlay; New Edinburgh Heritage Conservation District Study: Guidelines; 2012 Infill Housing Design Guidelines.

22 48 COMITÉ DE L URBANISME In this review we will focus on the heritage elements being reviewed by OBHAC 192 Stanley Avenue is located in the New Edinburgh Heritage District on a typical long lot (30 X 155 feet) extending from Stanley Avenue to River Lane. The building is two storeys with a flat roof and a two storey metal porch facing Stanley Avenue. The building is currently duplexed. A unique pressed tin and wood double garage used to sit at the end of the lot on River Lane. It was demolished on April 24, It appears that the developer proposes to retain two thirds of the home, demolishing a 1 storey portion to the rear and 2 storey metal sided portion to the east. The developer proposes to erect an addition to the rear of the remaining 2/3 of the original building. The proposed addition would contain two separate dwelling units. The NE H&D committee provides the following comments and recommendations. Existing home at 192 Stanley Avenue Front Porch Replacement: It appears from the front elevation that the developer wishes to replace the two-storey metal-wood porch with one that is more in keeping with the overall character of the property. No materials were provided. The NE H&D committee supports the replacement of the extant porch to something resembling the original using sympathetic materials. Proposed addition to the rear of 192 Stanley. The proposed 2 storey brick addition to the rear is 66% the size of the original building. Therefore the mass exceeds the 30 % as required in the Heritage Overlay, and also exceeds in mass neighbouring properties along the lane and street. The position of the existing and proposed addition would cover 3/4 of the lot eliminating landscaped and recreational space. The western side of the proposed building has few windows presenting a 'fortress' appearance and will block light into the back garden to the neighbours to the North west on Stanley Avenue. A total of 17 windows/doors overlook the neighbour to the South East, thus eliminating any privacy. City of Ottawa Official Plan - Section 4 Review of Development Applications Heritage Buildings and Area 9. When reviewing applications for zoning amendments, site plan control approval, demolition control, minor variance, or the provision of utilities affecting lands/properties adjacent to or across the street from a designated heritage resource, adjacent to or across the street from the boundary of a heritage conservation district, or within heritage conservation district, the City will ensure that the proposal is compatible by: a. Respecting the massing, profile and character of adjacent to or across the street from heritage buildings; b. Approximating the width of nearby heritage buildings when constructing new buildings facing the street; f. Having minimal impact on the heritage qualities of the street as a public place in heritage areas; g. Minimizing the loss of landscaped open space; City of Ottawa 2012 Infill Guidelines

23 49 COMITÉ DE L URBANISME Locate and build infill in a manner that reflects the existing or desirable planned neighbourhood pattern of development in terms of building height, elevation and the location of primary entrances, the elevation of the first floor, yard encroachments such as porches and stair projections, as well as front, rear, and side yard setbacks Maintain rear yard amenity space that is generally consistent with the pattern of the neighbouring homes. Do not break an existing neighbourhood pattern of green rear yards by reducing required rear yard setbacks. Heritage Overlay (3) Despite the provisions of the underlying zone, an addition to a building in an area to which an heritage overlay applies is permitted only if: (a) (b) the height of the walls and the height and slope of the roof of the addition do not exceed those of the building; the gross floor area of the addition does not exceed 30% of the gross floor area of the building; (c) In Areas A, B and C on Schedule 1, (i) the side yard setback of the addition is at least 60 cm. greater than that of the wall of the building located closest to the side lot line, Despite some modifications to the design, the NE H&D committee does not support the current design based on the following criteria: its non-adherence to the Heritage Overlay its mass and size that are inconsistent with New Edinburgh's historic lanes Loss of green space Loss of privacy and light to immediate neighbours Precedence of future infill along New Edinburgh's historic lanes and streetscapes Additional notes regarding vehicular access are provided in Appendix A for the Committee's information. Considering the precedence impact of this type of development along the historic lanes, NECA recommends that a Cultural Heritage Impact Study be conducted as well as a shadow study.

24 50 COMITÉ DE L URBANISME Appendix A Additional Notes for the Information of the Committee Regarding Proposed Vehicular Access off River Lane 1. The NE HD committee notes that there is a parking pad to the right of the duplex on Stanley Street and the lot has vehicle access on River Lane (a pre-existing double garage on River lane was demolished in 2010). The NE HD Committee cautions re challenges arising from the respective increase in vehicular traffic along the lane. Heritage garage prior to demolition in Aside from zoning, the NE H&D committee also raised concerns regarding additional construction along the narrow historic lanes of New Edinburgh: a. Although contrary to city by-law many New Edinburgh residents plow or shovel their snow into the street or onto the lanes. This causes considerable problems and anxiety for residents and makes it difficult for emergency vehicles, garbage trucks, delivery trucks and Paratranspo. There is no provision for snow 'storage' in this proposal; b. River Lane in this location has only one fire hydrant. Placing additional properties on the lane would increase the stress on the emergency response services; c. Traffic is becoming increasingly difficult along already congested lanes.

Lesley Collins, Heritage Planner, provided an overview of the report. Maggie Butcher, owner of a neighbouring property, strongly opposed the proposal as she felt it is not in keeping with the heritage nature of the area, given the size of the structure and the lack of greenspace being retained.

26 52 COMITÉ DE L URBANISME Lesley Maitland, Heritage Ottawa, spoke to the heritage aspects of the application, noting although it is supportive of many of the heritage values in New Edinburgh, Heritage Ottawa is concerned with the size of the structure as it does not follow the guidelines of the heritage overlay, and stressed that guidance is needed on the development on the laneways. Further, Ms. Maitland indicated Heritage Ottawa supports the New Edinburgh Community Alliance (NECA) in requesting a Cultural Heritage Impact Statement be undertaken. Gail McEachern, New Edinburgh Community Alliance (NECA) spoke to the importance of protecting the principle elements outlined in the conservation plan and in the heritage overly zoning for New Edinburgh and discussed the importance of landscape and open space in the area. She noted this development is large and does not meet the sections of the City of Ottawa s Official Plan that speak to respecting the character and massing of adjacent lots and minimizing the loss of landscape and open space. Subsequently, she strongly encouraged members to not approve this application in its current form. Dennis Kane, ARC Associates Inc. was present and available to respond to questions. Members acknowledged the importance of intensification and were pleased with the appropriate use of materials in the proposal. However they expressed concern with the size of the proposed building and significant reduction in greenspace and questioned the guidelines related to development on the laneways. The following delegation spoke in support of the recommendations: Mr. Dennis Kane, Project Designer, ARC Associates Inc., explained that much had been done to alter the drawings in an attempt to be more compatible with the neighbourhood and to comply with by-law setback requirements. He also noted that efforts would be made to match original photographs where possible. Written correspondence was received from the following, as noted. Mrs. Beverley and Mr. Paul McConnell*, in opposition to the recommendations, citing that oversized projects and overdevelopment were negatively affecting the New Edinburgh area.
