1 VILLE DE MONTRÉAL BY-LAW BY-LAW CONCERNING THE DESIGNATION OF THE MAISON ROBERT- BÉLANGER BEARING NUMBER , CHEMIN DU BOIS-FRANC, AS A HISTORIC MONUMENT In view of sections 70 to 83 of the Cultural Property Act (R.S.Q., chapter B-4); At the city council meeting of June 15, 2009, it was enacted: CHAPTER I OBJECT OF DESIGNATION 1. The Maison Robert-Bélanger bearing number , chemin du Bois-Franc, and the land on which it stands as shown on schedule A, are designated as a historic monument. 2. The cadastral designation of the historic monument is lots and in the cadastre of Québec. CHAPTER II REASONS FOR DESIGNATION 3. The city designates the Maison Robert-Bélanger for the following reasons: (1) the documentary value of the Maison Robert-Bélanger: (a) erected on farm land operated by several generations of Robert and Bélanger family members, the Maison Robert-Bélanger bears witness to farming activities before the urbanization of Côte Saint-Louis-du-Bois-Franc and the island of Montréal; (b) the Maison Robert-Bélanger is the last stone farm house remaining on the former Chemin de la côte Saint-Louis-du-Bois-Franc; (c) built between 1803 and 1806, the Maison Robert-Bélanger is among the oldest farm houses in Montréal and the oldest constructions in Saint-Laurent borough; (d) inhabited by several generations of Robert and Bélanger family members, the Maison Robert-Bélanger is representative of a common practice in rural environments of Québec during that period, namely the transmission of property, through donation, from father to son; /1
2 (e) inhabited successively by François Isaïe, Prime and Émile Bélanger, who played a role on the political municipal scene of Saint-Laurent, the house served as the office of the secretary treasurer of the parish of Saint-Laurent in the 1940s and 1950s; (2) the architectural value of the Maison Robert-Bélanger: (a) Maison Robert-Bélanger is representative of stone farm houses on the island of Montréal in the early 19th century; (b) the Maison Robert-Bélanger has a high degree of authenticity, and has retained its volume and main original architectural features, such as openings and siding materials; (c) the wood construction added in the early 20th century behind the house bears witness to its evolution and its adaptation to the needs of its occupants by allowing the cohabitation of two families; (3) the contextual value of the Maison Robert-Bélanger: (a) the Maison Robert-Bélanger is laid out on land whose features, in particular the size of the house, its layout along the road and the tall trees on the property, recall the former rural character of the sector and favor the enhancement of the house; (b) this former farm house is erected along Chemin du Bois-Franc, one of the main stretches of land serving farm lands of Côte Saint-Louis-du-Bois-Franc; (c) the Maison Robert-Bélanger constitutes a physical landmark contrasting with the recent built environment; (4) the symbolic value of the Maison Robert-Bélanger: (a) the Maison Robert-Bélanger symbolizes the appropriation of land for farming purposes by families of farmers for more than two centuries, and bears witness to the rural past of the parish of Saint-Laurent and the island of Montréal; (b) through its donation, from generation to generation, it symbolizes the common practice in Québec in the mode of transmission of family heritage in rural environments in the 18th and 19th centuries; (c) the Maison Robert-Bélanger constitutes the last stone farm house of the former Côte Saint-Louis-du-Bois-Franc /2
3 CHAPTER III EFFECTS OF DESIGNATION 4. The designated historic monument must be kept in good condition. 5. Any person who alters, restores, repairs or modifies the designated historic monument must abide by the conditions in chapter IV, as well as the conditions relating to the preservation of characteristics specific to the historic monument that the council may impose and that are added to municipal by-laws. In addition, no person may perform one of the acts referred to in the first paragraph without giving the city notice of at least 45 days. Where a municipal permit is required, the permit application serves as an advance notice. Before imposing conditions, the council seeks the advice of the advisory committee. A copy of the resolution setting out the conditions accompanies, as the case may be, the municipal permit that is issued and that authorizes the act concerned. 6. No person may, without the council s authorization, demolish all or part of the designated historic monument, move it or lean a construction against it. Before ruling on an application for authorization, the council seeks the opinion of the advisory committee. Every person who performs an act referred to in the first paragraph must abide by the conditions that the council may determine in its authorization. CHAPTER IV CONDITIONS OF PRESERVATION AND DEVELOPMENT SECTION I INTERVENTIONS ON THE DESIGNATED HISTORIC MONUMENT 7. All work relating to the designated historic monument must have a minimum impact on the integrity, legibility, clearances, and predominance of the original stone building. 8. All work relating to the designated historic monument must favor the maintenance of essential historic elements, including in particular: (1) the stone volume of the original house; (2) the location, shape and dimensions of openings in the masonry walls; (3) the type, texture, color and matching of masonry of gable walls, eaves walls, and chimney stacks; (4) the woodwork elements around openings; /3
4 (5) the shape of the two-pitched roof and dormer windows. 9. The following work is also authorized: (1) work to consolidate the present aspect of the building; (2) work to restore its original aspect, in particular as to the architectural composition, the architectural elements, materials, and construction techniques, such a restoration being based on solid documentary research; (3) volume changes or addition of elements, under the following conditions: /4 (a) every volume change or addition must be justified by the adaptation of the building to a use compatible with its qualities and features, to ensure its perennial preservation; (b) all volume changes or additions must be in keeping with the initial layout and not alter the perception of the overall volume. The elements added must appear as secondary in relation to the main body of the building; (c) every volume change or addition must be in harmony with the original building, be inspired by the traditional process of extension and conversion process of old farming houses, and be inspired by traditional ways of doing things, as to form and layout, details, materials and techniques used; (d) every intervention must bear the mark of its time to subtly distinguish it from the initial construction; (e) any alteration to the wood addition must be preceded by a detailed evaluation of the historical and architectural value of the addition, to better define its heritage interest and guide interventions; (4) the upgrading work required for a project ensuring the perennial value of the designated historic monument, including the recourse to different measures, if required. SECTION II ACCESSORY BUILDING 10. An accessory building may be set up on the lot referred to in article 2, under the following conditions: (1) it must be in harmony with the site and serve to enhance the designated historic monument; (2) its location, volume and scale must ensure the maintenance of the predominance of the designated historic monument;
5 (3) its architectural treatment must be compatible with the elements observed on the designated historic monument, without necessarily copying them. SECTION III LANDSCAPING 11. All landscaping work carried out on the site referred to in article 2, including the development of parking spaces, must serve to enhance the designated historic monument and maintain the character of the site and landscape features of the site, in particular the alignment of trees, the cartway, the lane leading to the main door, and the mature trees planted on the site, namely silver maples and apple trees. SECTION IV EXCAVATION 12. All excavation work performed on the lot referred to in article 2 must be covered by archeological research and technical specifications describing the measures taken to protect the trees and vegetation during the work. SECTION V SIGNS 13. A sign may be installed on the lot referred to in article 2, under the following conditions: (1) every sign must serve to enhance the designated historic monument; (2) only a non-luminous sign maybe authorized; (3) the dimensions, shape, graphics, colors of the sign must be clean and simple, and compatible with the architectural features of the designated historic monument SCHEDULE A DELIMITATION OF THE TERRITORY OF THE HISTORIC MONUMENT OF THE MAISON ROBERT- BÉLANGER The public notice relating to this by-law was posted at city hall and published in The Gazette on June 20, /5
