1 SABRINA GREENS HOA RULES & REGULATIONS 2607, 2625 & 2639 Pirineos Way Carlsbad, CA It is important that all residents familiarize themselves with the following Rules and Regulations governing Sabrina Greens Condominiums. These rules along with our CC&R's and Bylaws exist to create a more enjoyable, peaceful, and safe environment for all residents. Violations will result in fines. Sabrina Greens is where we live and it is up to each and every one of us to take pride in the appearance and upkeep of our community. Owners, including absentee owners, are responsible for ensuring that tenants and guests abide by these Rules and Regulations. 1. MOVING IN AND OUT: A move in fee of $ will be required. The Property Manager will be responsible for collecting this fee on behalf of the HOA. You will receive security (common area keys) from your real estate agent. The cost is $ to replace lost or stolen keys. Arrangements must be made through HOA Business Solutions, LLC when residents are planning to move in/out or having furniture/appliances, etc., delivered or moved. HOA Business Solutions will make arrangements to have the elevator covers installed for when you move. Persons moving furniture/appliances or other large items in the elevators without having made such arrangements will be subject to fine. Lockboxes to be placed in stairwells, out of view of main entrances and not on individual unit doors. No padlocks to be put on any doors, except in garage storage areas. 2. MAINTENANCE OF UNITS: Water damage can be a tremendous expense to all parties involved. SABRINA GREENS suggests that each unit carry their own insurance. Please ensure that grouting and caulking of tile, showers, tubs, etc., is always in good repair. Please do not put items down the garbage disposal that will clog or swell. Stoppages due to faulty disposals and/or by using for items not recommended will be the responsibility of the homeowner. Do not operate washing machines, dishwashers, dryers while you are not present in the condo. Considerable damage can occur in a short period of time if a washing machine/dishwasher overflows or a dryer catches fire. Each owner of a separate interest is responsible for immediately (within hours) notifying the management company of any type of leak or water stain on ceiling, or any wall surface, or any sign of heat on any floor surface. A water stain or floor heat is an indication that a water leak is possible. The sooner a leak is reported the quicker it can be repaired with the resultant savings because of lack of damage to both the individual s, adjoining and Association property. Failure to report such stains or heat may result in fines to the owner. It is strongly recommended that you make arrangements to have someone check on your property if you are planning on being away for more than 48 hours. 3. COMMON AREAS: Common areas include but are not limited to, all exterior walkways, stairways, driveways, patios, landscaping, pool and Jacuzzi area, clubhouse, garages, trash rooms, elevators, as well as interior hallways, lighting, and security entry phones. 1
2 For your safety and others, skateboarding, skating, or bicycling are not permitted on these premises. Skateboards and skates must be carried and bicycles must be walked off the property. Absolutely no storage of any item is permitted in common areas, except inside the storage units rented for that purpose. All common area landscaping must be kept clear at all times of any personal items, i.e. clothing, towels, tools, pets, pots, etc. Any damage to common areas will be the responsibility of the homeowners. If you create a mess in a common area (like the hallway), it is your responsibility to clean it up A.S.A.P. This will include vacuuming up any debris you may have created. DO NOT drag trash bags through the hallways, they tear and leave stains on the carpeting. Bicycles are NOT allowed to be transported in the elevators, nor are they allowed to be ridden down the hallways. Do not prop open doors leading to the interiors of the buildings. 4. PATIOS AND BALCONIES: Patio and balcony areas are to be kept cleaned and maintained at all times. Hanging or draping anything over the balcony railings or patio fences is NOT permitted. Any items that are not "patio" items should not be in view of common areas or other residents. Balcony and patio leaks are a serious issue and may be caused by a variety of reasons. Please use caster cups on table legs, grills, or sharp objects. Potted plants must have trays or saucers underneath them and should be raised up to allow air to circulate and dry any water underneath them. Hanging plants are not allowed due to the damage they may cause. The Board reserves the right to inspect for damage upon a 7- day notice of such inspection. Repairs as needed would be performed at the owner's expense. No nails or hooks shall be attached to balconies. Any excessive watering of plants will jeopardize the integrity of balconies, patios, and wood areas. This will result in extensive, costly repairs at owner's expense. The use of hoses on balconies is not permitted. Indoor/outdoor carpeting is prohibited. Charcoal grills are also prohibited. Gas grills are allowed. 5. PARKING. GARAGE AREAS AND RAMPS: Only vehicles that do not touch the height limit bars at the entrance to the garages are allowed. Should your vehicle touch these bars, your vehicle is not allowed to enter the garage. Any person seen manipulating or removing these height limit bars will be fined. Keep speed limit under 5mph! Park only in the space assigned to your unit or you will be subject to be towed at your expense. (It is typically a different space # than your unit). Please use headlights while driving in the garage as it helps others to see you. Cars entering the garage have the right of way (it is hard for them to back up the driveway or onto a busy street). 2
3 On entering/exiting the garage, please turn stereos down to a minimum level so as not to disturb residence or live above or around the garage areas. No smoking in the garage. Do not block fire lanes, elevators, passageways, or other vehicles. Oil changes, repair work or washing vehicles are not permitted at any time. Any oil leaks or drips are to be cleaned and absorbed at all times. Only oil pans, or 3M Zorband devices or pads are permitted in the garage. Inspections of the garage will occur on a constant basis. In the event of a problem, the resident assigned the space will be notified in writing and will have 7 days from date of notice to correct and clean up the leak. Failure to do so will result in the Property Management having it cleaned and the expense billed to the homeowner as well as a fine. Storage of any items in the parking spaces or stalls and garage areas is not permitted at any time except for in designated, assigned areas. Pets are only allowed in the garage to commute to and from vehicles. 6. PETS: The number of pets allowed per unit is Two (2). All pets must be leashed and under constant personal control at all times, (San Diego County Code (a), (d) and (y). Cats are not permitted to roam the common areas. All pet owners are responsible for cleaning up after their pets at all times in all areas. This includes but is not limited to all common areas (see common areas page 1), patios, garages, sidewalks, and landscape. Responsible homeowners, residents and the Homeowners Association will not tolerate any irresponsible pet owners that do not comply with this rule. It has been an on going issue and we ask that you consider your neighbors, and the health issues in allowing pets to urinate and defecate in surrounding areas, and hope that you will take part in cleaning up after them. Do not allow any pets to become a nuisance due to barking or other noises. Pets are not allowed in the Pool area, Jacuzzi area, or Clubhouse. Any damages caused by a pet in any common areas will be the responsibility of the pet owner. If the pet owner is not a homeowner and fines and/or repair bills cannot be collected from them, it becomes the financial responsibility of the homeowner. 7. POOL. JACUZZI AND SAUNA: HOURS: Sunday-Thursday 9AM-10PM. Friday-Saturday 9 AM-11 PM The pool is heated from April 1 st through November 30 th. For the safety of children. pool and Jacuzzi gates are to be kept closed and locked at all times. GATES LEFT PROPPED OPEN WILL RESULT IN A FINE ON THE FIRST OFFENSE. SPECIFIC POOL RULES ARE POSTED IN THE POOL AREA. Children under the age of 14 years must be accompanied by their parent(s), guardian, or a responsible adult of 18 years of age or older while using the pool area. It is not recommended that children under the age of 14 years use the Jacuzzi at any time. 3
4 No glass containers allowed. Trash and cigarettes are to be placed in containers. No diving allowed. No loud noise permitted. No rafts or toys permitted when there are 5 or more people occupying the pool. All radios and CD players must be used with earphones. No pets. Swimwear required at all times when using pool and jacuzzi. Residents must accompany their guests at all times. If you have more than 2 guests in the pool or Jacuzzi areas, please be considerate about what chairs and/or tables are available when other residents are about. 8. ROOFS: Air-conditioning units are located on the roofs of the buildings. Access to the roofs is not allowed. Any resident wanting to have work done which requires access to the roof, such as maintenance of air-conditioning units or cleaning of dryer vents, must make arrangements with Pete Dominguez Monday through Friday 7:30 am to 1:30 pm. Satellites are not allowed. 9. CLUBHOUSE: The clubhouse is available for rental to members. Hours are 9 AM -11 PM on a first come first serve basis. Please contact the Property Manager to reserve a time and day. A $ deposit and a $25.00/use fee is required when you pick up the keys. Deposit will be refunded upon completion of an inspection for cleanliness and damages. No pets allowed in the clubhouse. 10. NOISE LEVELS: Please be conscious and considerate of others. We all live very close to each other, and although you may not realize it, but noise travels very well around here. If your window is open, your neighbor can hear your conversation, television, radio, etc. loud and clear! Frustrations run high when someone is disturbed or awakened. If you are not sure if you are being to loud, go ask your neighbors before they have to come to you or send in a complaint. At the same time, we all have to understand that we need to put of with some noise that falls within reasonable limits. 11. TRASH No dragging of trash bags down the hallways. Please take items down to the dumpster that will not fit in the chute. Do not leave them in the compactor rooms. NO DUMPING OF UNWANTED ITEMS All items to be securely bagged and tied before placing in the chute or dumpster. Bulky items such as furniture (couch, chair, dresser, cabinet, bookshelf, mattress, etc ) or appliances (toilet, washer, stove, sink, etc ) can be disposed of at no charge (up to (2) per quarter). To schedule an appointment, please call Waste Management at (760) In addition, throughout the year residents may schedule other pick-up appointments, which cost $35 for the first item and $5 for each subsequent item. 12. RENTALS: Units may not be rented for a period of less than thirty (30) consecutive days. 4

OWNER/TENANT CONTACT INFORMATION: All Owners and Tenants of Sabrina Greens must fully complete an Occupant Registration form within ten (10) days of occupancy and submit to HOA Business Solutions, LLC, P.O. Box San Diego, CA , or to Failure to register and provide complete contact information with the Association within ten (10) days of a new occupancy will result in the assessment of a fine in accordance with the fine policy. Continuing failure to register and provide complete contact information can result in additional fines for each month not registered, at the discretion of the Board of Directors. Contact information shall include telephone numbers and addresses. 15. CONTACT WITH MEMBERSHIP: In order to be green, cost-conscious and efficient, all correspondence between membership and management and board of directors, except for the secret ballot process or other notifications the method of delivery of which are regulated by law, will be via DRYER VENT CLEANING: Each owner is responsible for contracting to have the dryer vent cleaned, unless using the inhouse type vent. The owners of each unit shall provide proof of cleaning upon request of management. 17.FINES POLICY: All written complaints involving rules violation should be sent directly to the Property Management Company. They will be reviewed at the regular monthly Board Meeting. At that time, the Board will review them and determine if a violation letter, and/or fines are warranted. The violation letters will outline the rule(s) violated and be mailed certified, return receipt requested within 2 days after the review to both the resident and owner. A hearing may be set up by violators within 10 days from receipt of letter to discuss violations. Hearings are provided for residents so that both sides may represent themselves. The Board has the responsibility to be fair to all residents and will try to accommodate both parties in coming to an understanding and an agreement. Failure to appear at a hearing by the violators will result in fines being levied as stated in the letter. After a hearing, fines (if any) will be due within 4 working days by the responsible party. All violation letters will remain on record. FINE SCHEDULE: (EXCEPT AS OTHERWISE STATED) 1 st OFFENSE - Hearing. 2 nd OFFENSE- $ fine 3 rd OFFENSE- $ fine 4 th OFFENSE- $ fine 5 th AND ALL OTHERS- will be decided by the HOA Board of Directors. 5
6 STORAGE: There are storage units for rent by the members of the HOA; no more than one storage unit per condominium. Although not limited to this list, the following items are strictly prohibited from being stored in the storage units: Among other things: a. Combustible, Flammable, Hazardous or Toxic Materials: Considered inherently dangerous, these include gasoline, compressed gas, propane tanks, kerosene, lamp and motor oil, acid, grease, corrosives, fertilizer, paint, cleaners, chemicals, narcotics, or hazardous, toxic or biological waste. Asbestos or products containing asbestos are not allowed. You also cannot store fireworks, explosives, weapons or ammunition. b. Perishable Food and Animal Products: Canned foods can be stored in storage units, but perishable food products such as cereals, produce or meats are not allowed. These may spoil or attract pests. c. Miscellaneous Prohibited Items: Any animals or plants alive or dead cannot be stored. Nor can any stolen items. People are not allowed to plug in or use refrigerators, freezers, generators, space heaters or live in storage units. If you have any question about the items you wish to store, consult the manager or HOA board. Storage of items in the storage units is at your own risk and Sabrina Greens HOA is not responsible for the loss or destruction of any items stored in your storage unit. You should consult with your homeowners insurance agent as to coverage of any items in your storage. Any damage to your storage unit will be fixed at your expense.
