2 Revised Business Plan of CEN/TC Characterization of waste Introduction CEN Technical Committees and Business Planning The extension of formal business planning to CEN Technical Committees (CEN/TCs) is an important measure, which forms part of a major review of business processes (known as Optimization ). The aim is to align the CEN work programme with expressed market needs and to ensure the adequate resourcing of projects through their development stages in the CEN/TCs. Your role in the implementation of the Business Planning concept will contribute significantly to the overall effectiveness of European standardization. We express our sincere appreciation and thanks for your time in reviewing this Business Plan. European standardization and the role of CEN The foremost aim of European standardization is to facilitate the exchange of goods and services though the elimination of technical barriers to trade. The use of standards by industry and the social and economic partners is always voluntary; however, European standards are sometimes related to European legislation (Directives), and conformity to such standards may constitute a presumption of conformity to the legal requirements of the Directives (which must be met by manufacturers before certain products can be traded legally within the Single Market). Three bodies are responsible for the planning, development and adoption of European standards: CEN (European Committee for Standardization) is responsible for all sectors excluding electrotechnical, which is the responsibility of CENELEC (European Committee for Electrotechnical Standardization), and most of the Information and Communications Technologies, which are largely the responsibility of ETSI (European Telecommunications Standards Institute). CEN is a legal association, the members of which are the National Standards Bodies (NSBs) of nineteen European countries and six Associates (organizations representing social and economic interests at European level), supported by a Central Secretariat based in Brussels. It is the European counterpart of ISO (International Organization for Standardization) with which it has a standing protocol (the Vienna Agreement ) to facilitate technical co-operation. The principal deliverable of CEN is the European standard (EN), which must be published by each of NSBs as an identical national standard, with any pre-existing national standards in conflict being withdrawn. A European standard embodies the essential principles of global openness and transparency, consensus, technical coherence and national commitment. These are safeguarded through its development in a CEN Technical Committee (CEN/TC), representative of all interested parties, supported by a public comment phase (the CEN Enquiry). CEN and its Technical Committees are also able to offer the European prestandard (ENV) and the informative CEN Report (CR) as solutions to market needs. More recently, CEN has created the CEN Workshop Agreement (CWA) as a deliverable which aims to bridge the gap between the activities of consortia and the formal process of standardization represented by CEN and its national members. An important distinction is that the CWA is developed by CEN Workshops, comprising only participants with direct interest, and so it is not accorded the status of a European standard. Recognising the importance of market certainty in the use of European standards, CEN and CENELEC jointly offer a European Mark (the Keymark), which is a third-party certification mark through which compliance with European standards can be demonstrated. Proposals for European Mark Schemes may proposed by the CEN national members, the CEN Technical Committees or any European organization. 1

3 Scope of the CEN/TC Standardization of procedures to determine the characteristics of waste and waste behaviour, as sampling, pre-treatment, leaching properties, determination of total content of species, determination of sum parameters, assessment of ecotoxicity, proposition of test reports and subsequent terminology. ExcludedStandardization of procedures to determine the characteristics of waste and waste behaviour, especially leaching properties and standardization of subsequent terminology. Excluded from this scope are: - radioactive waste; - exhaust gases; - waste water; - explosives; - animal carcasses. Also excluded from the scope of this TC are: - the setting of limit values; - the setting of specifications for products and processes. Market, Environment, and Objectives of the CEN/TC This section establishes a sequential development of thoughts regarding the Market for which the CEN/TC aims to fulfil the needs. This sequence of thoughts starts from a description of the current market situation relevant to the product or product grouping under consideration by the CEN/TC, continues on to an analysis of the different factors motivating/influencing the activities of the CEN/TC, to come to clear description of objectives for the CEN/TC, together with an accompanying strategy how to reach those objectives. Finally, a general risk analysis is included highlighting issues that may delay or stop the CEN/TC achieving its set objectives. Market Situation Although bulk waste streams are not likely to be transported over big distances; trans-national trade does take place, and thus a European problem exists. Apart from economic reasons this trans-national transport is caused by to different environmental legislation in the member states. These differences concern the limit values for treatment and disposal facilities and the variance in prices of treatment and final destination options as well. Also the lack of clarity in the interpretation of the term waste gives rise to big economical and social problems in and between European countries regarding whether the materials in practice are treated as waste and whether they may be re-used or not. In the last decade re-use of some waste streams has become increasingly important, like coal fly ash in concrete which is often regarded as an industrial by-product. Although the term waste has been defined in a European directive and this definition has been clarified and completed by extensive jurisprudence of the European Court of Justice, the divergent interpretation of the EU legal definition of waste is still a problem. In several European countries waste management is based on characteristics of the waste e.g. total concentration of important parameters like heavy metals and organic components, behaviour in short and long term, especially leaching behaviour to soil and ground water. The participants in the work of TC 292 come from a very divers background. Interested parties are: - national governments/legislators; - research institutes; - laboratories; - private companies dealing with production, (trans-national) transport or treatment of waste; - companies dealing with use of secondary raw materials. - owners of landfills or incineration plants. 2

4 Market Environment Political, economical, social, technical, legal and international factors that either directly require some or all of the standardization activities proposed by the CEN/TC, or significantly influence the way these activities are carried out are the following : Political and legal factors Comment: The cited European directives should be actualised. For waste the following directives apply: - Waste Framework Directive (Directive 75/442/EEC); - European Waste Catalogue (Commission decision 94/3/EC); - Hazardous Waste Directive (Directive 91/689/EEC); - Hazardous Waste list (Council decision 94/904/EC); Test methods for the properties that render waste hazardous, include total content of specific parameters, tests for leaching behaviour, ecotoxicological tests, etc. - Incineration of hazardous waste (Directive 94/67/EC) and Incineration of non-hazardous waste (Directive 89/429/EC in revision) No limit values are set for the waste to be burnt. In practice several parameters are measured for process control, like total organic carbon. - Landfill of waste (99/31/EC) Methods will be described for compliance with limit values. This concerns: basic characterization tests, compliance tests and on site verification tests. Also methods for leaching behaviour and the determination of total content and parameters like total organic matter will be required. Comment: The sentence However is no longer valid (e.g. landfill directive) However, non of these directives make use of (references to) standardized test methods. In the European Directive on Construction Products also environmental aspects of construction materials are mentioned such as leaching tests and determination of total content. Mandates to different CEN/TCs are given to develop the required test methods, also for the dangerous substances. Technological developments Comment: add new technical developments: Biodegradability, new techniques for total content as XRF, emission into air, physical properties (for landfilling), ecotoxicity parameters for treatment, density for treatment Leaching tests are used to assess the effect of waste on the environment. The development of these tests is very expensive, and therefore duplication of work should be avoided. Experience from e.g. the Harmonization Network on Leaching has shown that leaching tests may be applicable not solely to waste but also to other materials. TC 292 favours horizontal co-ordination within CEN on the development of standardized leaching tests and the exchange of technical information on these tests. Economical factors As already addressed in the chapter on Market Situation the divergent interpretation of the term waste gives rise to economical problems on a national and European level regarding the status of materials (waste or product) and possible re-use. Environmental factors In the near future CEN/TCs will have to assess the environmental impact of their standards. This may concern the products they are working with or the tests being developed. For TC 292 this may mean that for the analytical procedures more attention should be given to the chemicals used. The 3

5 procedures to be developed have to characterize waste in the way that possible impact on the environment can be estimated.whether a complete environmental assessment of waste is required is unclear. Standardization within other committees: TC 292 has identified several fields were cooperation and/or harmonization of activities is advisable: add construction sector, solid recovered fuels, water TCs, compost biological treatment of waste - terminology; Various TCs have their own working group or task group dealing with the product specific waste, its terminology and sometimes even test methods. Examples are: biomedical waste, packaging waste, shoe manufacturing waste, etc. In 1995 PC 7 (Environment) took a recommendation that in their opinion TC 292 -as a more generic TC- should take the lead in waste terminology standardization. To achieve this leading role, a recommendation of BT is necessary - leaching tests; (see technological developments) - sludge; CEN/TC 308 deals with the characterization of sludge. In some countries this material is regarded as a waste, while in others useful applications for the material are investigated and chosen. In the past these overlapping scopes and unclear responsibilities sometimes caused duplication and divergence of work. In May 1999 agreements have been made on a closer cooperation and harmonization of work programs. Financial factors For the development and validation of standardized test methods additional funds are lacking, which are necessary to reach validated standards. At this moment (Summer 1999) TC 292 is negotiating with DG XI on a closer cooperation (mandate and financial support) in relation to the recently adopted Landfill Directive. DG XI has decided to discuss the possibility of a mandate when the Technical Adaptation Committee of the Landfill Directive is set up. This means that negotiations may resume at the end of Until now, DG XI has not been financially involved in the work of TC 292. Until now the validation of draft standards has been financed by individual members or national governments. At present an extensive validation program is set up where national (governmental) organisations have promised funding. Furthermore, research needs of CEN/TC 292 are registered on CEN-level for submission to STAR and DG XII. For more information see chapter on Strategies. Objectives of the CEN/TC and Strategies for their Achievement Based on the considerations above, the CEN/TC proposes the following objectives and strategic directions for its future work: Objectives of the CEN/TC To support European parties in waste management (legislators, private companies dealing with production, (trans-national) transport or treatment of waste, laboratories), by providing them with standardized terminology on waste and waste management and standardized and validated test methods to characterize the waste materials under consideration. The test results will enable the European parties to make environmental sound choices for the (final) destination of the materials, which may be treatment, re-use, incineration or landfill. To support European legislation in the field of waste and secondary raw materials: general directives on waste and hazardous waste, (draft) directives for incineration of waste and hazardous waste, and the directive on the landfill of waste. To create permanent links with the Environment Institute (EI) of the Joint Research Centre of the European Commission. 4

6 Strategies adopted to reach the Objectives As stated in the scope, the European standards under development will not include (environmental) limit values, nor product specific requirements regarding maximum content of (hazardous) components, which is seen as the responsibility of (national or) European legislation. The European standards will provide tools (test methods, calculation models and measurement methods) for the user to demonstrate whether the material under consideration complies with limit values or specifications set. In order to address specific needs of legislation TC 292 intends to keep an open dialogue with the Commission, in particular with DG XI and the Environment Institute. Giving the amount of different waste materials and the various test methods that have to be described, a more generic approach is chosen to cover the field. The total characterization is split into several modules: sampling, physical and chemical testing and analysis. Only two items are more generic, which are dealing with terminology of waste. It is the policy of the TC to place only new work items on the current programme of work, if financial and technical resources are sufficient to finalize the standards (or at least pre-standards (ENVs)) within a reasonable time. If a standard cannot be established within reasonable target dates, standstill of work on the national level should be avoided. Some items need standardized methods for which already similar standards have been developed by other technical committees. TC 292 has decided to avoid duplication of work and to refer to - wherever possible- of standards produced by other TCs. These standard methods will be checked on their applicability for waste, e.g. by round robin testing and other laboratory research. Test methods can only give reliable results - and thus will only be accepted by all parties involved - if they are validated (inclusion of information on the detection limit, precision, repeatability, reproducibility, robustness etc). In order to obtain this information interlaboratory trials are necessary. TC 292 has decided that if no statistical information is available, the methods can only be published as ENV instead of EN. In some cases the validation of draft standards has been financed by individual members or national governments. At present an extensive validation program is set up in order to obtain statistical data on the compliance leaching standards (pren to 4) and the eluate analysis standards (pren and pren 13370). Several national (governmental) organisations have promised funding, while contributions of DG XI and DG XII are pending. Target is to finish the project at the end of In order to support new standardization work in WG 7 recently also a proposal has been submitted to CEN/STAR on co-normative research for eco-toxicological characterisation of waste. In future additional proposals to STAR and/or contact with EI/JRC can be expected for the validation of the following draft standards: hydrocarbons by GC (WI ); hydrocarbons by gravimetry (WI ); halogen and sulphur (WI ); sampling standards (WIs , , , , ); compliance test monolithic materials (WI ); percolation simulation test (WI ) and ph stat test (WI ). 5

7 Structure of the TC CEN/TC 292 was created end 1991 and had its first meeting in April The frequency of TCmeetings is in principle once per nine months. For management reasons meetings with convenors and secretaries are organized between TC-meetings. CEN/TC 292 consists of 6 7 WG's. In the WG's almost all active countries are represented by at least one expert; most WG's meet three to four times per year. Editing committees have been installed per WG (instead of one EC for the complete TC). When considering new work items which cannot beaddressed by an already existing working group, an ad hoc group is installed to study the feasibility of the project and propose a scope and justification of the new work. If this task is completed, the ad hoc group is converted to a regular working group or disbanded. At present 3 ad hoc groups have been installed. CEN/TC 292 reports about twice per year to SABE (former PC 7) on its work program, progress made and other major internal decisions. 8 Risk analysis As mentioned before, TC 292 has decided that methods can only be published as ENs if sufficient data on performance characteristics of the method are available. This means that interlaboratory trials have to be carried out to obtain these data. For some draft standards national authorities supplied the necessary means to carry out interlaboratory trails. However, for several other methods no funding is available. These methods can therefore only be published as ENVs. Due to lack of human and financial resources progress in WG 1 has been very slow. Fortunately, funds have become available in 1999, which is expected to lead to draft standards rather soon. This is especially important since these (sampling ) standards are the basis for many of the other standards developed within TC

9 Work Programme This section gives an overview of existing and planned standardisation projects, called Work Items (WI). The aim of this listing is to demonstrate the adequacy of the proposed programme of work with the actual market or stakeholders needs. You will find that the projects are listed according the Working Group that is responsible for the drafting of the documents. The glossary also gives the source of the information provided. Glossary intends to help with the understanding of the terms used. Whenever any of these terms are used by contributors to this Business Plan, they are requested to use them coherently as foreseen in the glossary. Term Abbrev. Definition Standardization 4) --- The activity of establishing, with regard to actual or potential problems, normative documents for common and repeated use, aimed at the achievement of the optimum degree of order in a given context. New Approach Directives --- Essential Requirements Directives that have been put into force since May 1985 by the Council of the European Communities which define legislative harmonization in those sectors where barriers to trade are created by justified divergent national regulations concerning the health and safety of citizens and consumer and environmental protection, will be confined to laying down the essential requirements, conformity with which will entitle a product to free movement within the Community. --- Requirements that represent the core of European Union law around which an effective policy has been developed in matters of safety, health and other measures for those areas covered by the new approach directives. Harmonized standard --- Technical specification adopted by European Standards Organizations, developed under a mandate given by the European Commission and/or European Free Trade Association, in support of essential requirements of a New Approach Directives 18
