4 General Regulations 1. Tenant is responsible for storage and removal of its trash, refuse and garbage. Tenant shall not dispose of the following items in sinks or commodes: plastic products (plastic bags, straws, boxes); sanitary napkins; tea bags; cooking fats, cooking oils; any meat scraps or cutting residue; petroleum products (gasoline, naphtha, kerosene, lubricating oils); paint products (thinner, brushes); or any other item which the same are not designed to receive. All Store Floor Areas of Tenant, including vestibules, entrances and returns, doors, fixtures, windows and plate glass, shall be maintained in a safe, neat and clean condition. 2. Other than as permitted, Tenant shall not permit any advertising medium to be placed on exterior windows, on the sidewalks, parking lot areas, or light poles. No permission, expressed or implied, is granted to exhibit or display any banner, pennant, sign, and trade or seasonal decoration of any size, style or material within the shopping center, outside the Premises. 3. Tenant shall not permit or suffer the use of any advertising medium which can be heard or experienced outside of the Premises, including, without limiting the generality of the foregoing, flashing lights, searchlights, loud speakers, phonographs, radios or television. No radio, television, or other communication antenna equipment or device is to be mounted, attached, or secured to any part of the roof, exterior surface, or anywhere outside the Premises, unless Landlord has previously given its written consent. 4. Tenant shall not permit merchandise of any kind at any time to be placed, exhibited or displayed outside its Premises, nor shall Tenant use the exterior sidewalks or exterior walkways of its Premise to display, store or place any merchandise. No sale of merchandise by tent sale, truckload sale or the like, shall be permitted on the parking lot or other common areas unless the Landlord has previously given its written consent. 5. Tenant shall not permit any portion of the Premises to be used for lodging purposes. 6. Unless given approval, Tenant shall not, in or on any part of the Common Area: a) Vend, peddle or solicit orders for sale or distribution of any merchandise, device, service, periodical, book, pamphlet or other matter whatsoever. b) Exhibit any sign, placard, banner, notice or other written material, except for activities as approved by Landlord. c) Distribute any circular, booklet, handbill, placard or other material, except for activities as approved by Landlord. d) Solicit membership in any organization, group or association or contribution for any purpose. e) Create a nuisance. f ) Use any Common Area for any purpose when none of the other retail establishments within the Center is open for business or employment, except for activities as approved by landlord. g) Throw, discard or deposit any paper, glass or extraneous matter of any kind except in designated receptacles, or create litter or hazards of any kind.
5 h) Deface, damage or demolish any sign, light standard or fixture, landscaping materials or other improvement within the Center, or the property of customers, business invitees or employees situated within the Center. Management Changes If the store s manager or any upper management people change, please notify the operations department immediately so we can update our records. It is necessary for us to have current addresses and phone numbers of all these people in case of an emergency. Deliveries Parking in the fire lanes for deliveries is strictly prohibited. Vehicles left unattended are subject to towing at owner s expense. Employee Parking To guarantee our customers the most convenient parking locations possible, please make an effort to leave the front spaces open. Trash Removal All tenants are required to take their refuse from their stores out to the dumpster/compactor. Remember, trash left outside your rear entrance is a fire hazard and lease violation, unsightly and prevents maintenance personnel and delivery people from having clear access. All refuse must be separated. All trash in the trash bins and all cardboard in the cardboard containers. Trash service is provided by Brask Enterprises (for in-line tenants). Store Maintenance The general upkeep of each storefront is the Tenant s responsibility. Each Tenant will, at his own expense, keep the premises in good order and repair and in a clean, sanitary, and safe condition according the lease agreement. Repair Work All non-emergency routine repair work that may inhibit shoppers or affect neighboring tenants is prohibited during regular store hours. If an emergency arises, please notify the Operations Department so that arrangements can be made. They are willing to assist you in emergency situations within the limits of their abilities. HVAC Maintenance Tenants are required to maintain their own HVAC unit(s) unless the Tenant s Lease specifies otherwise. It is your responsibility to work with a qualified contractor who will set up a maintenance program. Workers needing access to the roof must check in and out with the Operations Department. Most Tenant Leases require that the HVAC units must be serviced a minimum of four (4) times per year.
6 Building Fire Safety Features Automatic Sprinkler System Your store is equipped with an automatic sprinkler and fire alarm system. The sprinkler system is designed to extinguish a fire with adequate water when a fire with sufficient heat activates a sprinkler head. Only the sprinkler head over the immediate fire area will flow water. When a sprinkler head is activated it will also activate the fire alarm system for the entire building. When the fire alarm activates, please have all customers and employees exit the store immediately and move away from the building. If time allows, lock your store and stay in the area in case emergency responders need access to your store. Fire Extinguishers Check your extinguisher for last date of inspection. Fire extinguishers should be inspected annually. Class ABC Fire extinguishers may be used on all types of fires - flammable liquid, electrical, paper, wood, cloth, etc. The Fire Department has the right to demand to see your extinguisher at any time to check on its expiration date. Types of Fires Class A - Fires in ordinary combustibles as paper, wood, cloth, rubber, and many plastics. Class B - Fires in flammable liquids such as grease, oil, paint, and gasoline. Class C -Fires involving energized electrical equipment where there is a risk of shock. (When electrical equipment is deenergized, Class A fire extinguisher may be used safely.) Class D -Fires in combustible metals, such as magnesium, titanium, zirconium, etc. Multi-purpose ABC extinguishers can be purchased to handle all classes of office fires. These chemical-based extinguishers can cause damage to electronic equipment. However, water extinguishers must not be used if an electrical current is present because of the danger of electrical shock. A fire in electronic equipment rooms will almost always require the use of an ABC rated fire extinguisher. A because there is likely to be paper nearby, B because there may be oil or grease involved, and C because it is electrical equipment.
7 Recommended Fire Safety Features for Tenant Spaces Fire Prevention Tips Unplug electrical appliances like coffee pots or water heaters when not in use. Arrange for proper use and storage of adhesives, cleaning fluids, and other flammable liquids and, where possible, substitute with less flammable products. NO EXTENSION CORDS OR MULTI-JACKS SHOULD BE UTILIZED. These items are not permitted as a replacement of permanent wiring by the Fire or Electrical Codes. Eliminate extension cords by providing more power outlets or relocating some electrical equipment. Make sure the power is shut off on all office equipment such as copiers, calculators, computers, etc., at the close of the business day. Provide adequate ventilation for office equipment like copying machines, printers or computers. Electrical closets within tenant spaces should be kept locked at all times. Nothing should be stored in these closets due to fire hazard. Storage areas should be kept clear at all times to provide for an adequate exit and access for emergency equipment. Tenant belongings, deliveries or trash may not be stored in hallways. Fire Marshalls will from time to time be in to inspect the backrooms for direct access to back doors.
8 Tenant Sign Criteria In conjunction with local and state requirements, aesthetic quality, quantity, finishes; size and method of installation shall be at Landlord s discretion. The purpose of the sign criteria is to ensure a consistent and quality fabrication and installation of all Tenants exterior signs located on this property. Tenant shall not commence any sign work, permitting or procurement of signs without first obtaining such consent in writing from Landlord and local authorities. The allowable Project Sign Area permitted is as follows: Wall Sign Calculation Formulas Area: One square feet of sign per running front foot of front building wall. Length: The length of any wall sign shall be no longer than 1/3 of the front building wall length. Height: 0-13,999 sf, maximum letter height 36 ; 14,000 70,000 sf, maximum letter height 48 ; Over 70,000, sf, maximum letter height 60 Definitions Lineal Building Frontage: The length of a ground level straight line or lines parallel to and equaling the length of the building front that includes the main public entrance/s the side of the building fronting on the principal roadway. A tenant s linear building should be as defined above from centerline of lease line to centerline of lease line. Wall Sign: Any sign affixed to the outside wall of a building in the plane parallel to the wall. The sign cannot extend more than 5-0 from the building façade, and cannot extend above the rooflines. Sign Placement Panel: The area in which the Tenants signage may be installed and affixed to the building façade. Allowable materials and dimensions are designated herein. Lease Line: The area in which the Tenants premises is calculated for square footage and as noted on Tenant s Lease Outline Drawing. Procedures The tenant shall submit 2 copies of shop drawings, scale ¼ = 1-0 location plan and, at the option of the Landlord, perspective views of the sign and complete storefront. Shop drawings must show sign materials, illumination, fastening, colors, details, and full artwork. Location plan must show exact placement and limits of all signage. Storefront elevations must include the store sign completely delineated. All applications for a sign permit shall include the following information as part of the complete submission, to the Building Department: a) An application form that is complete and signed. b) Description of all sign lighting; internal illumination or other.
9 Tenant Sign Criteria c) A sign shop drawing signed by the Landlord Representative approving and authorizing the specific sign design, including use of logos as part of sign designs, and location (s); and d. A check, made out to the Town of Mansfield, for the Sign Permit Fee. It is the responsibility of the individual tenants to obtain all necessary permits prior to the installation of any and all tenant signs. Design Standards, Exterior Storefront Signs All letters used on signs shall be individual channel letters with internal illumination; All signs shall be professionally made; including UL rating requirements and any health or safety codes met; Sign letters, light sources and all materials and hardware shall be durable and suitable for exterior use; selected from standard catalogues of commercial quality; Sign lettering shall be restricted to the Tenant s trade name. Such designation shall not include any specification of the merchandise offered for sale or the services rendered, and shall not contain advertising devices or slogans. The Tenant s logo or other trade identification may be incorporated with the Landlord s prior approval. Wall signs shall not extend beyond the ends or over the top of the walls to which attached. Sign Types Specifically Not Permitted As Tenant Signs Box or Cabinet type signage Unshielded direct glare onto pedestrian or roadway areas or unnecessary brightness produced from any light source Any directly exposed neon Any flashing or dimming light sources Any translucent cabinet faces enclosing any light cabinet (excepting individual letters) Intermittently lighted signs Roof signs Any banner, pennants, ribbons, streamers, spinners of similar moving, fluttering or revolving devices, or whirligigs used for display as signs. Any overly large or garish temporary signs indicating on sale merchandise. Illuminated signs that cause glare distracting to drivers, or are in such a position or of such color as to hamper the readability of traffic lights or other traffic signs. Signs in excess of twelve (12) square feet, which overhangs public ways. Animated signs except for bar poles
10 Awning Criteria Fixed devices, attached to the building wall, constructed of fabric or metal and which are located above the storefront and designed to shade the sidewalk and storefront. Awnings with text printed affixed to the flat surface are not permitted. Preferred awning fabric colors are Black, Navy Blue, Kelly Green and Tan. The bottom edge of awnings must be at nine (9) feet above finish floor/sidewalk. Placement of all awnings is subject to approval. No sign shall be projected from an awning.
