FSANZ has received an Application to amend the Australia New Zealand Food Standards Code to approve the voluntary addition of fluoride to packaged water. Specifically, it seeks permission to permit the addition of fluoride to non-carbonated packaged water to between 0.6 and 1 mg/l (total of naturally occurring and added fluoride) and to require mandatory labelling to indicate that fluoride has been added. The aim of the notified Regulation is to establish provisions governing the sanitary registration and control of veterinary drugs and related products and establishments in this sector. This Regulation applies to all food products marketed in Central American countries. 12/06/ TBT Notification No G/TBT/N/EEC/230 European Communities Foodstuffs suitable for people intolerant to gluten. Draft Commission Regulation concerning the composition and labelling of foodstuffs suitable for people intolerant to gluten (6 pages, in English). This draft Commission Regulation is necessary because a specific group of the population, people with coeliac disease, suffer from a permanent intolerance to gluten and, therefore, need the labelling of products in order to make appropriate food choices. Article 4a of the framework Directive on dietetic foods (89/368/EEC) foresees the setting of rules for the use of terms concerning the absence of gluten in foodstuffs. The setting of such rules at Community level will ensure the same high level of protection for consumers and allow for the free movement of the concerned products. This draft presents sensible and proportionate rules on composition and labelling to enable people with gluten intolerance to find on the market a variety of food suitable to their needs and to their level of sensitivity. 12/27/ TBT Notification No G/TBT/N/EEC/232 European Communities - Ozone depleting substances (ODS), in particular those covered by the Montreal Protocol on substances that deplete the ozone layer (listed in Annex I of the Proposal) and others (listed in Annex II); and - s and equipment containing or relying on those substances. Proposal for a Regulation of the European Parliament and of the Council on substances that deplete the ozone layer (Recast) (COM(2008) 505) (94 pages, in English and French). The proposal consolidates all successive changes to Regulation (EC) No 2037/2000 on substances that deplete the ozone layer and contains the following main changes to the current legislation:

7 - Removing obsolete provisions and associated procedures for achieved phase-out steps, for essential and critical uses of ODS, and streamlining reporting obligations where possible in view of the obligations stemming from the Protocol. - Bringing forward the phase-out date for production of HCFCs from 2025 to 2020 to align the Regulation with the recent Decision XIX/6 of the Parties to the Montreal Protocol on substances that deplete the ozone layer to accelerate the phase-out of HCFCs, and introducing measured amendments to facilitate the enforcement, notably by customs authorities, to prevent illegal trade and use of ODS in the EU. - Addressing future challenges in particular by allowing for a tightening of provisions on recovery and destruction of ODS contained in products and equipment, to tackle the ODS banks; requiring the listing of new ODS in the Regulation and the reporting of volumes produced and imported; lowering the existing cap on the use of methyl bromide for quarantine and pre-shipment purposes and completing a full phase-out in the EU by 2015 whilst in the meanwhile making the use of recapture technologies mandatory. 02/12/ TBT Notification No G/TBT/N/EEC/233 European Communities 2-Naphtyloxyacetic acid (plant protection products active substance) Draft Commission Decision concerning the non-inclusion of 2- Naphtyloxyacetic acid in Annex I to Council Directive 91/414/EEC and the withdrawal of authorisations for plant protection products containing that substance (3 pages, in English). This draft Commission Decision provides that the substance is not included in the positive Community list and that Member States have to withdraw authorisations for plant protection products containing that substance within 6 months from the date of adoption. This decision only concerns the placing on the market of the substance and does not affect the Community or national Maximum Residue Levels (MRLs) for residues of the concerned pesticides. 01/18/ TBT Notification No G/TBT/N/EEC/234 European Communities External power supplies Draft Commission Regulation implementing Directive 2005/32/EC of the European Parliament and of the Council with regard to ecodesign requirements for no-load condition electric power consumption and average active efficiency of external power supplies (21 pages, in English) This draft Commission Regulation sets mandatory requirements for no-load condition power consumption and average active efficiency of external power supplies, which

8 become effective in two stages one year /two years after entry into force of the Regulation, respectively. The aim is to tap costeffective improvement potentials to reduce the energy losses in external power supplies due to converting mains power to low voltage DC or AC power. The draft Regulation is based on the findings of a technical, environmental and economic study which has been carried out with stakeholders from around the world. Definitions and energy levels are largely in line with further initiatives as e.g. the federal US Energy Bill and the US Energy Star programme. In accordance with Framework Directive 2005/32/EC products not meeting these requirements will not be allowed to be placed on the internal market. 01/18/ TBT Notification No G/TBT/N/EEC/235 European Communities Batteries and accumulators. Draft Commission Decision establishing requirements for registration of producers of batteries and accumulators in accordance with Directive 2006/66/EC of the European Parliament and of the Council (4 pages, in English). This draft Commission Decision concerns the registration of producers of batteries and accumulators. In order to avoid unnecessary administrative burden for those producers, it is necessary to establish procedural requirements that are applicable throughout the EC. The draft decision specifies the requirements for registration of producers, information to be provided by the producers and the registration fees to be applied, while avoiding any overlapping with requirements relating to other registration procedures. 01/21/ TBT Notification No G/TBT/N/FIN/33 Finland This decree shall apply to smoke alarms. Draft Decree issued by the Government: Technical requirements for the smoke alarms and the placing for smoke alarms (3 pages, in Finnish). Smoke alarms to be sold in Finland must be tested in an accredited laboratory in accordance with harmonized standard, EN Smoke alarm devices. In order to declare the conformity with the Decree the smoke alarm must bear the marking that consists of the letters CE based on Council Directive 89/106/EEC on construction products. CE marking should also cover requirements from all other applicable directives. The draft relies on practices in Hungary and on technical norms required and based on several decades of experiences in neighbouring countries. This draft Decree states that all primary battery products produced within the country and imported, distributed and marketed in the country shall fulfil SNI requirements. The producer and or importers therefore shall have a product certificate for the use of SNI Marking and Comply the requirements of SNI. The Certificate on SNI Marking shall be issued by a Certification Body which has been accredited by National Accreditation Body of Indonesia namely Komite Akreditasi Nasional (KAN) through: a. Testing of the conformity of quality of primary battery against SNI requirements; b. Audit on the application of QMS SNI /ISO or its revision or other recognized quality management system. The testing can be subcontracted to testing laboratories within Indonesia which have been accredited by KAN or accredited by accreditation body which has signed Mutual Recognition Arrangement (MRA) with KAN. Directorate General of Transportation Equipment and Telematics Industries, Ministry of Industry is the institution that is responsible for the implementation of this decree and shall provide a technical guidance of the decree, which covers Procedure of Certification and SNI Marking.
