1 TOWN OF BURLINGTON Conservation Commission MINUTES OF Approved April 27, 2017 Members Present: Chair L. Cohen, Vice-Chair W. Boivin, E. LoTurco, K. Melanson, G. Lima, I. Deb Members Absent: Also Present: A. McNamara Conservation Administrator J. Keeley, Assistant Conservation Administrator H. Charles Lis 1. Call to Order L. Cohen called the meeting to order at 7:00 pm. 2. Citizens Time No one spoke. 3. Approval of Minutes March 23, 2017 Tabled to the next meeting. 4a. Request for Determination of Applicability 208 Fox Hill Road Philip J. Abramo Filling, grading, landscaping Owner Phillip Abramo and his landscaper represented the application. J. Keeley commented: Retroactive permit for work done last summer Site visit could not occur today because of the locked gate A fence is blocking the view of the wetlands from the yard This matter will continue at the April 27, 2017 Conservation Commission meeting. 4b. Request for Determination of Applicability 8 Sears Street Laurent & Rachel Placidi
2 2 Install in-ground pool Owner Laurent Placidi represented the application. J. Keeley commented: In-ground pool is approx. 50 feet from the wetlands Plans needs to have pool drawn on it Conservation Commission discussed: Dirt removed from the hole, will be used for re-grading and the rest will be removed Hardscape and landscaping will be included around the pool There is no backwash since a cartridge filter will be used A fence will go around the pool J. Keeley reviewed the finding and conditions. A MOTION TO ISSUE A CONDITIONAL NEGATIVE DETERMINATION OF APPLICABILITY FOR THE PROPOSED WORK AT 8 SEARS STREET WAS MADE BY W. BOIVIN. THE MOTION WAS SECONDED BY G. LIMA AND APPROVED (6-0-0). 4c. Continued Request for Determination of Applicability 17 Brantwood Lane Arthur C. Faranda Construct residential addition and garage No testimony taken on this matter. This matter will continue at the April 27, 2017 Conservation Commission meeting. 5. Public Hearing Erosion & Sedimentation Control Permit 16R Briarwood Lane Pandolfo Company, Inc. Construct new residential dwelling Contractor Joe Pandolfo of the Pandolfo Company represented this application. Mr. Pandolfo explained this site has an administrative Erosion and Sedimentation Control permit, but the project is now going to exceed the 20,000 square foot threshold, so the applicant had to file. The applicant is currently over the threshold because last summer the town fireworks lit the woods on fire, and the applicant is replanting the buffer area. H. Charles Lis commented: Recently the erosion controls along the driveway and roadway were replaced and enhanced Everything pitches to the street, so during construction the applicant needs to maintain the street by sweeping frequently Conservation Commission discussed: Details about the driveway drainage Minimizing water runoff into the street
3 3 Mr. Pandolfo agreed to pitch the driveway to one side with a stone trench along the side, and at the end of the driveway have a trench drain. This hearing will continue at the April 27, 2017 Conservation Commission meeting. 6. Public Hearing Notice of Intent 4 Willow Way Scott Mitchell Demolish existing dwelling & construct new residential dwelling DEP # Owner Scott Mitchell and wetlands consultant Maureen Harold of Environmental Services represented the application. Ms. Harold explained the changes since the last meeting: Driveway runoff will be infiltrated Added the pitch of the driveway to the plans Submitted drainage calculation and square footage of the restoration area Replacing the four trees being removed H. Charles Lis commented: Wetland flag 2a needs to be moved further out approximately 5 feet Suggested using boulders for demarcation rather than post and rail fence Yard waste needs to be removed near the wetlands Conservation Commission had no comments. H. Charles Lis reviewed the findings and conditions. A MOTION TO CLOSE THE HEARING FOR THE PROJECT AT 4 WILLOW WAY, DEP # , WAS MADE BY W. BOIVIN. THE MOTION WAS SECONDED BY E. LOTURCO AND APPROVED (6-0-0). A MOTION TO APPROVE THE FINDINGS FOR THE PROJECT AT 4 WILLOW WAY, DEP # , WAS MADE BY K. MELANSON. THE MOTION WAS SECONDED BY G. LIMA AND APPROVED (6-0-0). A MOTION TO ISSUE THE ORDER OF CONDITIONS FOR THE PROJECT AT 4 WILLOW WAY, DEP # , WAS MADE BY W. BOIVIN. THE MOTION WAS SECONDED BY I. DEB AND APPROVED (6-0-0). A MOTION TO REQUIRE A $5,000 PERFORMANCE BOND FOR THE PROJECT AT 4 WILLOW WAY, DEP # , WAS MADE BY I. DEB. THE MOTION WAS SECONDED BY W. BOIVIN AND APPROVED (6-0- 0). 7. Public Hearing Notice of Intent 38 Grant Avenue Town of Burlington Department of Public Works Demolish existing salt shed & install new salt shed DEP # Town engineer Thomas Hayes of the Town of Burlington and engineer Tyler Cofelice of Weston and Sampson represented the application.
4 4 Mr. Hayes stated the change since the last meeting is they are replacing an existing catch basin in the roadway with a deep sump hooded catch basin to help with TSS removal. He added the Planning Board may require a fence around the entire site. Conservation Commission staff had no comments. Conservation Commission requested: More protection of the stream Remove the sand pile, leaf pile, and miscellaneous debris J. Keeley reviewed the findings and conditions. A MOTION TO CLOSE THE HEARING FOR THE PROJECT AT 38 GRANT AVENUE, DEP # , WAS MADE BY E. LOTURCO. THE MOTION WAS SECONDED BY W. BOIVIN AND APPROVED (6-0-0). Public Hearing Notice of Intent 28 Francis Wyman Road Lot 1 Richfield Company LLC Construct new residential dwelling DEP #pending 9. Public Hearing Notice of Intent 28 Francis Wyman Road Lot 2 Richfield Company LLC Construct new residential dwelling DEP #pending 10. Public Hearing Notice of Intent 28 Francis Wyman Road Lot 3 Richfield Company LLC Construct new residential dwelling DEP #pending Items 8, 9, and 10 were taken together for discussion purposes. Attorney James Juliano of Scafidi Juliano, LLP, and developer Gary Litchfield of Litchfield Company, Inc. represented the application. Mr. Juliano noted the changes since the last meeting: Submitted a planting plan, and list of trees being removed Boulder demarcation rather than post and rail fence Pitch the driveways to the trench drains Added decks to the plans After the existing house is demoed, the erosion controls will be moved toward the street, suggested adding to the conditions After the shed is removed, they will take out the debris, and adjust the erosion controls Alternatives analysis was submitted

Charles Lis commented: Wetland delineation was reviewed Erosion controls location once the structures are demoed can be conditioned as subject to staff approval, because the site may need the initial row to remain as well till the area is stabilized depending on the season Distance between the boulders is vague and likely too large, and needs to be more specific Additional information on the paper streets and whether these are buildable lots Conservation Commission discussed: Trees are all going in lot 3 with no trees in lot 1 or 2 because the intent is to stay out of the no disturb Improvement to the riverfront area, such as removing invasives and the existing dwelling Conservation Commission requested: Add maximum distance between boulders and condition to not allow lawn mowers or similar equipment Seasonally high ground water information Mr. Juliano requested the Conservation Commission consider the bond amount be $7,500 for all three lots, not $7,500 per lot. If all three lots are given one bond, then the applicant would not request partial release until all three lots are done. This hearing will continue at the April 27, 2017 Conservation Commission meeting. 11. Continued Public Hearing Notice of Intent 22 Corcoran Road Henry Turnquist Grading & residential addition DEP # Owner Henry Turnquist represented the application. Mr. Turnquist explained Hayes Engineering reviewed the property and gave several recommendations. He distributed and reviewed the recommendations. J. Keeley and H. Charles Lis commented: Wetland flags are from Steve Eriksen and were done after the fill Conservation Commission needs some of the fill pulled back to determine if the fill extends into the wetlands. This was requested previously and has not been done. The 20 foot no disturb should be vegetated not rip rap, even if sloped Conservation Commission requested: Something in writing from the wetlands consultant once wetlands are flagged
6 6 This matter will continue at the April 27, 2017 Conservation Commission meeting. 13. Continued Public Hearing Notice of Intent (WPA only) 10 & 20 Corporate Drive Burlington Centre Twenty Corporation c/o The Davis Companies Construct multi-unit residential building with walkways, courtyards and utilities DEP # Developer Christopher Chandor of the Davis Company, and attorney Robert Buckley of Riemer and Braunstein, LLP, represented the application. Mr. Buckley is before the Conservation Commission to finalize the Order of Conditions. Board of Appeals has not voted yet, their next meeting Tuesday, April 18 at 7:30pm. The applicant has a draft conservation restriction for the vernal pool and adjacent wetlands and uplands, and in the next 10 days, he will submit it to staff for review and comments. Conservation Commission had no comment. J. Keeley reviewed the findings and conditions. A MOTION TO CLOSE THE HEARING FOR THE PROJECT AT 10 & 20 CORPORATE DRIVE, DEP # , WAS MADE BY G. LIMA.
