REGULAR MEETING: a. Chairman Tyrrell convened the meeting at 7:30 p.m. b. Seated were Members Marty Newell, Mary Tyrrell, Susan Windesheim and Alternates Don Richards (for Charlie Lewis) and Wes Clow (for Ernest Werner). Reference was made to the Connecticut General Statutes regarding conflict of interest and the Town Regulations. PUBLIC HEARING: None PENDING APPLICATIONS: a) 17-IW-1704 / Regional School District 14 / 5 Minortown Road / High School Renovations Including: Area #1: Expansion of Existing Parking Area &Installation of Mechanical Utility Equipment Area #2: Expansion of Existing Handicap Parking Area for Athletic Events Area #3: Addition of ADA Accessible Walks to Athletic Facilities, Replacement of Ball Field Fencing & Addition of Dugouts Area #4: Resurfacing of Track, Replacement of Perimeter Fence & Addition of Spectator Fencing, Walks & Synthetic Turf Field Area #5: Addition of Post Tension Concrete Tennis Courts and Relocation of Existing Barn / Map 023 / Lot 019 It was noted that the Public Hearing was closed. A draft motion had been provided by the planner and was reviewed by the Agency. It was discussed that no topsoil would be removed from the site. The question of whether a soil and erosion bond was needed came up. Maryellen Edwards addressed this saying that she had discussed bonding with two attorneys. A bond would not necessarily be needed for this project as there Meeting June 26, 2017 Page 1 of 12
2 will be a performance bond with the contractors. They will be protected one way or another and will have immediate access to funds should the need arise. (There is a contingency fund for quick access if necessary.) The Chairman stated for the record that the performance bond held by the school from the contractor will be in lieu of the Agency posting a separate soil and erosion bond. The draft motions listed 48 hour notice twice and that was corrected. The final site plan will be reviewed and signed by Trinkaus Engineering and the Agency chairman once submitted. Northwest Conservation District, or similar designee, will check the plantings and bio-retention. Stormwater reporting and frequency was discussed. The Agency would like to receive the reports monthly. Preconstruction meetings shall include an Agency member or representative. As the construction sequence is not known at this time, the Agency would like an overview of the construction and phases of construction. The applicant can submit a written Phasing Plan which could be used for the Zoning Commission, as well. A final As-Built should be required at the end of the project. The Chairman reminded that there had been concerns regarding a tree discussed during the public hearings. A tree inspection report by a licensed arborist should be included in the conditions of approval. It was reminded that no wash out areas were indicated on maps. Construction equipment is not to be washed out in regulated areas. The washout areas need to be shown on the fmal plans. The addition of a date to have the site stabilized by throughout construction was also added to the motion conditions. MOTION: WHEREAS, the Woodbury Inland Wetlands and Watercourses Agency has received an application, 17-IW-1704 submitted by the Regional School District #14 for "Renovations to Nonnewaug High School including: Area #1 Expansion of existing parking area and installation of mechanical utility equipment; Area #2 Expansion of existing handicap parking area for athletic fields; Area #3 Addition to ADA accessible walks to athletic facilities, replacement of ball field fencing and the addition of dugouts; Area #4 Resurfacing of the track, replacement of perimeter fence and addition of spectator fencing, walks and synthetic turf field; Area #5 Addition of post tension concrete tennis courts and relocation of existing barn." at 5 Minortown Road, Woodbury, Connecticut (Map 023 / Lot 019) WHEREAS, the Agency has received the following material: a. Engineering review comments provided by Trinkaus Engineering, dated and received June 12, 2017 WHEREAS, the Agency classified the application as Plennary; and Public Hearings were held on April 24, 2017; May 8, 2017; May 22, 2017 and June 12, 2017 WHEREAS, the Agency conducted a site inspection on April 2, 2017 WHEREAS, the Agency has carefully considered all the information submitted; and WHEREAS, the Agency finds that the proposed activities will have minimal environmental impact on wetlands and watercourses, there are no significant offsite impacts, and that possible impact on wetlands and watercourses outside the area for which activities are proposed can be further mitigated by the conditions listed below and the proper use of soil erosion and sedimentation controls during construction; NOW THEREFORE BE IT RESOLVED that the Woodbury Inland Wetlands and Watercourses Agency Approves the application submitted by Regional School District #14 for "Renovations to Nonnewaug High School including: Area #1 Expansion of existing parking area and installation of mechanical utility equipment; Area #2 Expansion of existing handicap parking area for athletic fields; Area #3 Addition to ADA accessible walks to athletic facilities, replacement of ball field fencing and the addition of dugouts; Area #4 Resurfacing of the track, replacement of perimeter fence and addition of spectator fencing, walks and synthetic turf field; Area #5 Addition of post tension concrete tennis courts and relocation of existing barn." at 5 Minortown Road, Woodbury, Connecticut (Map 023 / Lot 019)), as described on the submitted Inland Wetlands and Watercourses Agency application form dated March 7, 2017 and revised April 24, 2017 and May 8, Subject to the following conditions: 1. Limits of disturbance shall be marked before inspection. The applicant shall provide the Land Use Office with 48 hour notice prior to construction and shall not commence approved work until soil erosion and sedimentation control devices have been installed and inspected. 2. There shall be no burying of any tree stumps or tree materials including but not limited to branches, wood chips and the like. The stumps of all significant trees shall be left in place for stabilization of the affected area(s). 3. The construction equipment shall not be washed out in the regulated area. Washout material shall be contained in a washout pit or equal containment system and hardened material removed from the site for disposal at an acceptable location elsewhere. 4 4. The site shall be kept clean of all loose debris, litter and similar materials to prevent such from entering wetlands or watercourses. 5. All paths used for site access will be reestablished to original condition. 6. Stockpiles of earth materials shall be stored outside the 100' regulated area. 7. Removal of silt fences shall take place only after the silt build-up along the fence line has been removed. This material shall be removed from the site or placed as acceptable fill in areas that will not allow the material to migrate. 8. Storage of any fuel/lubricants and the refueling/lubrication of any equipment are forbidden within 100 feet of the affected area(s). The Land Use Office is to be notified immediately of any spillage, discharge or loss of oil/petroleum/chemical liquids or solids which have occurred or will likely occur as a result of the activity. 9. Disturbed soils will be stabilized in a timely fashion to minimize erosion. Specifically, if grading operations at a site will be suspended for a period of thirty (30) days or more, the applicant will accomplish seeding or other appropriate measures to stabilize the area within seven (7) days. Also, upon completion of any grading activity, the applicant will seed/stabilize the area(s) within seven (7) days. Stabilization of all stockpiles and open work areas shall occur by October 15 th of any year during construction. 10. All aspects of the plan currently shown as alternatives need to be combined on one plan so that there is a single comprehensive plan showing all requested work. 11. Construction details for the by-pass structures need to be added to the final plans as a condition of approval so there is a record copy of this information. 12. A General Permit for the Discharge of Stormwater and Dewatering Wastewaters from Construction Activities shall be applied for the by applicant prior to the commencement of construction activities and a copy of the permit shall be filed with the Town of Woodbury Land Use Office. 13. The stormwater management system for the four existing tennis courts and proposed two new tennis courts shall be modified as stated below: a. Eliminate the structural drainage on the north side of the existing tennis courts and east side of the proposed additional tennis courts and replace this drainage with a grade to drain swale discharges to both the east (northeast corner of existing courts) and to the north (northeast corner of the proposed tennis courts) as the only runoff which may ever get here is from the existing vegetated slope. b. The grade to drain swale shall be 2-3' in top width and 6" in depth at centerline (assume parabolic cross section) with a minimum pitch of 1.0% and shall be vegetated. c. The proposed water quality swale shall be properly renamed as a Bioretention system and the full water quality volume shall be held as a fixed storage volume above the soil surface only for the contributing impervious area of all the tennis courts below the elevation of the overflow catch basin structure. This may require the size and shape of the Bioretention system to be modified, d. As the bottom of the Bioretention system is dead level, only the top (324') and bottom contour (323') shall be used for the calculation determining the fixed storage volume for the water quality volume. No storage shall be taken in the media or gravel layer (if proposed) or any infiltration rate. e. As needed, the size of the Bioretention system shall be modified to achieve the above requirements. f. A proper construction detail for the Bioretention system shall be provided on the final plans as well as a detailed construction sequence and maintenance requirements. 5 g. Two deep test holes and one Double Ring Infiltration test shall be performed in the area of the Bioretention system after approval and prior to the bidding process. The results of the soil tests shall be included on the bid plans. h. A detailed planting plan shall be proposed for the Bioretention system. 16. A final site plan, which incorporates all changes referenced above, shall be submitted to the Woodbury Land Use Office and approved by the Agency Chair and Trinkus Engineering prior to commencement of construction. 17. A Northwest Conservation District representative, or similar person appointed by the Agency, shall inspect the plantings in the bio-retention area, as well as, the area of the stream where multiflora rose removal and willow planting will occur. 18. Stormwater reports shall be sent to the Inland Wetlands & Watercourses Agency (as discussed during the May 8, 2017 hearing) at intervals not to exceed monthly. 19. Preconstruction meetings shall include an Inland Wetlands & Watercourses Agency member(s) or Agency representative (as discussed during the May 8, 2017 hearing), and a construction sequencing or phasing plan shall be provided. 20. No topsoil shall be removed from the site (as discussed during the May 8, 2017 hearing). 21. An As-Built plan shall be signed and sealed by the engineer and submitted to the Land Use office upon completion of construction. 22. A tree inspection report by a licensed arborist shall be submitted to the Land Use Office. Made by Newell, Seconded by Windesheim. Vote 5-0 in favor. b) 17-IW-1710 / Novak / 253 Transylvania Road / Installation of 12' X 24' Floating Dock Chained to Property / Map 48 / Lot 007A No one was present for the application. The item was tabled. It was requested that the Land Use Office contact the applicant to see if they are going to pursue the application. a) 17-IW-1714 / Turoczi / 212 Grassy Hill Road / Build Temporary 10' X 12' Temporary Wooden Bridge for Stream Crossing for Early Successional Habitat Development/Management / Map 064 / Lot 013 Lisa Turoczi came forward and noted that they didn't have the plans depicting the exact location of the bridge or a larger plan, yet. They are working on it. b) 17-IW-1716 / Kosky / 17 Hyland Avenue / Replace Existing Failed Septic System within a Regulated Area / Map 019 / Lot 019 Ian Kosky was present and submitted the Health Department plan approval and submitted it for the file. The draft motion was reviewed and read. Don Richards requested that an As-Built be required. MOTION: WHEREAS, the Woodbury Inland Wetlands and Watercourses Agency has received an application, 17-IW-1716 submitted by Ian Kosky to "Replace an existing failed septic system, within a Regulated Area", at 17 Hyland Avenue, Woodbury, Connecticut (Map 019 / Lot 019) WHEREAS, the Agency has received the following material: a. An application dated June 5, 2017 and received June 6, 2017 b. Vote 5-0 in favor. c) 17-IW-1718 / Flanders Nature Center & Land Trust / 596 Flanders Road / Drain & Dredge Botany Pond / Map 096 / Lot 023 / ED: 06/26/17 Kyle Turoczi of Earthtones was present for the application. Soil placement was questioned and discussed. Silt fences and hay bales will be used around the back of the pond. Approximately cubic yards will be removed from the pond re-placed on the property. They are looking to start in August when it should be drier. The pond will be drained as low as possible. This project occurs about every 7-9 years. MOTION: WHEREAS, the Woodbury Inland Wetlands and Watercourses Agency has received an application, 17-1W-1718 submitted by Flanders Nature Center and Land Trust to "drain and dredge the existing botany pond" at 596 Flanders Road, Woodbury, Connecticut (Map 096 / Lot 023) WHEREAS, the Agency has received the following material: a. An application dated June 1, 2017 and received June 7, 2017 WHEREAS, the Agency classified the application as Summary; and WHEREAS, the Agency has carefully considered all the information submitted; and WHEREAS, the Agency finds that the proposed activities will have minimal environmental impact on wetlands and watercourses, there are no significant offsite impacts, and that possible impact on wetlands and watercourses outside the area for which activities are proposed can be further mitigated by the conditions listed below and the proper use of soil erosion and sedimentation controls during construction; NOW THEREFORE BE IT RESOLVED that the Woodbury Inland Wetlands and Watercourses Agency Approves the application submitted by Flanders Nature Center and Land Trust to drain and dredge the existing botany pond at 596 Flanders Road, Woodbury, Connecticut, Map 096/ Lot 023, as described on the submitted Inland Wetlands and Watercourses Agency application form dated June 1, 2017 and received June 7, Subject to the following conditions: 1. MOTION: WHEREAS, the Woodbury Inland Wetlands and Watercourses Agency has received an application, 17-IW-1719 submitted by Lisa Turoczi, Earthtones, LLC for "a landscaping project, which will include planting native vegetation, the construction of two rain gardens, the installation of a buffer along the existing shoreline and the placement of three boulders against the seawall within a Regulated Area", 108 West Lake Road, Woodbury, Connecticut (Map 004 / Lot 009A/D6) WHEREAS, the Agency has received the following material: a. An application dated May 31, 2017 and received June 12, 2017 b. First Draft Planting Plan designed by Earth Tones, dated May 3, 2017, received at the Inland Wetlands & Watercourses Agency meeting on June 26, 2017 WHEREAS, the Agency classified the application as Summary; and WHEREAS, the Agency has carefully considered all the information submitted; and WHEREAS, the Agency finds that the proposed activities will have minimal environmental impact on wetlands and watercourses, there are no significant offsite impacts, and that possible impact on wetlands and watercourses outside the area for which activities are proposed can be further mitigated by the conditions listed below and the proper use of soil erosion and sedimentation controls during construction; NOW THEREFORE BE IT RESOLVED that the Woodbury Inland Wetlands and Watercourses Agency Approves the application submitted by Lisa Turoczi, Earthtones, LLC for "a landscaping project, which will include planting native vegetation, the construction of two rain gardens, the installation of a buffer along the existing shoreline and the placement of three boulders against the seawall within a Regulated Area", 108 West Lake Road, Woodbury, Connecticut (Map 004 / Lot 009A/D6) as described on the submitted Inland Wetlands and Watercourses Agency application form dated May 31, 201 and received June 12, Subject to the following conditions: Meeting June 26, 2017 Page 8 of 12

Chairman Tyrrell informed the applicant's that this is not just flood zone, but a flood way. Water runs through it like a torrent. When the applicant asked how recently it flooded, it was indicated about five years ago. It was noted that three major river ways come together in the area. Chairman Tyrrell stated that it is all flood plain so it is all wetlands. They had denied a similar application for the Lions to build a structure with a cement floor at Three Rivers Park. A cement floor in flooding there would cause erosion. This property floods regularly. The Chairman noted that an approval for a hay barn on Weekeepeemee Road was approved recently; however there are differences in the properties. 10 Road is high and dry and not in a flood plain. She has never seen it flood there. Agency members indicated that the fencing &/or barn may need to be replaced frequently due to the common flooding. Photos of the flooded property and areas nearby were shown to the applicants from the Chairman's cell phone. The applicants were appreciative of the information received at the meeting and indicated that they would withdraw the application. It was asked that they provide a letter of withdrawal for the record. e. 17-IW-1720 / Town of Woodbury / Old Sherman Hill & Middle Quarter Road / Intersection reconstruction / Maps 102 & 86 / Lots 033, 042, 043 & 031 Maps of the project were reviewed. A "t" intersection will be created, eliminating the angular intersection that exists now. This will help to slow down the speed of travel. It was noted that there is an intermittent watercourse nearby and that is why the Agency was seeing the application. MOTION: To classify the application as summary. An application dated and received June 12, 2017 b. A map prepared by Cardinal Engineering Associates, titled "Reconstruction of Old Sherman Hill Road and Middle Quarter Road Intersection Woodbury, Connecticut Roadway Plan" dated March 2016 and received June 12, 2017 WHEREAS, the Agency classified the application as Summary; and WHEREAS, the Agency has carefully considered all the information submitted; and WHEREAS, the Agency finds that the proposed activities will have minimal environmental impact on wetlands and watercourses, there are no significant offsite impacts, and that possible impact on wetlands and watercourses outside the area for which activities are proposed can be further mitigated by the conditions listed below and the proper use of soil erosion and sedimentation controls during construction; NOW THEREFORE BE IT RESOLVED that the Woodbury Inland Wetlands and Watercourses Agency Approves the application submitted by the Town of Woodbury for "Safety improvements, which will include the reconstruction of the Old Sherman Hill & Middle Quarter Road, within a Regulated Area", Old Sherman Hill Road & Middle Quarter Road, Woodbury, Connecticut (Map 102/ Lots 003, 042 and 043 and Map 086/ Lot 031), as described on the submitted Inland Wetlands and Watercourses Agency application form dated and received June 12, Subject to the following conditions: Meeting June 26, 2017 Page 10 of 12

The applicant shall provide the Land Use Office with 48 hour notice prior to construction and shall not commence approved work until soil erosion and sedimentation control devices have been installed and inspected. 2. There shall be no burying of any tree stumps or tree materials including but not limited to branches, wood chips and the like. The stumps of all significant trees shall be left in place for stabilization of the affected area(s). 3. The construction equipment shall not be washed out in the regulated area. Washout material shall be contained in a washout pit or equal containment system and hardened material removed from the site for disposal at an acceptable location elsewhere. 4. The site shall be kept clean of all loose debris, litter and similar materials to prevent such from entering wetlands or watercourses. 5. All paths used for site access will be reestablished to original condition. 6. Stockpiles of earth materials shall be stored outside the 100' regulated area. 7. Removal of silt fences shall take place only after the silt build-up along the fence line has been removed. This material shall be removed from the site or placed as acceptable fill in areas that will not allow the material to migrate. 8. The limits of disturbance shall be clearly marked before construction and the Land Use Office will be given notice 48 hours before construction begins. 9. Storage of any fuel/lubricants and the refueling/lubrication of any equipment are forbidden within 100 feet of the affected area(s). The Land Use Office is to be notified immediately of any spillage, discharge or loss of oil/petroleum/chemical liquids or solids which have occurred or will likely occur as a result of the activity. 10. Disturbed soils will be stabilized in a timely fashion to minimize erosion. Specifically, if grading operations at a site will be suspended for a period of thirty (30) days or more, the applicant will accomplish seeding or other appropriate measures to stabilize the area within seven (7) days. Also, upon completion of any grading activity, the applicant will seed/stabilize the area(s) within seven (7) days. Made by Richards, Seconded by Newell. Vote 5-0 in favor. OTHER BUSINESS: Discussion regarding Tree Clearing & Brush Maintenance: The Agency members offered no recommendations for how the Land Use staff should handle this question. Maryellen Edwards stated that there was an individual who had called the office and was asking about the removal of trees. She noted that from her experience, if you don't take the stumps out and you're just cutting the trees and it's not clear-cutting, that this would not be a regulated activity. The Agency discussed that it is really a case by case judgement. The Land Use Office will continue to bring anything in question to the Agency for discussion.
