2 Tennessee Technology Corridor Development Authority Board of Commissioners Meeting Minutes Page 1 October 10, 2016 The Tennessee Technology Corridor Development Authority (TTCDA) Board of Commissioners met in regular session on Monday, October 10, 2016, at 4:00 p.m. in the Small Assembly Room of the City County Building, 400 Main Street, Knoxville, TN. DECLARATION OF QUORUM Chair David Collins called the meeting to order at 4:03 p.m. It was determined that a quorum of the TTCDA Board of Commissioners was present. A copy of the meeting agenda is attached to the record copy of these minutes. 2. ADOPTION OF MINUTES Orlando Diaz made a motion to approve the minutes for the September 6, 2016 meeting. Ed Brantley seconded the motion. The motion was adopted unanimously APPLICATIONS 9-C-16-TOB HARDIN VALLEY PLAZA Staff Recommendation: Staff recommends POSTPONEMENT of the request for a Certificate of Appropriateness for a building permit, as requested by the applicant, until the November 7, 2016 meeting. Ed Brantley made a motion to postpone until the November 7, 2016 meeting. Tammy White seconded the motion.
3 Tennessee Technology Corridor Development Authority Board of Commissioners Meeting Minutes Page 2 October 10, 2016 The motion carried unanimously A-16-TOS PAT BOLES Staff Recommendation: Based on the application and plans as submitted, the staff recommends APPROVAL of a Certificate of Appropriateness for a Sign Permit with the following conditions: 1) Meeting all relevant requirements of the Knox County Zoning Ordinance, as appropriate. 2) Obtaining approval from The Development Corporation of Knox County for the proposed wall sign. Tom Brechko explained the staff recommendation. Pat Boles, SignCo Inc., 3101 NW Park Dr., Knoxville, TN. Mr. Boles stated that he was in agreement with staff s recommendation and asked for the Board s approval. Orlando Diaz made a motion to approve the Certificate of Appropriateness per Staff recommendation. Ed Brantley seconded the motion. The motion carried unanimously B-16-TOS STUART ANDERSON Staff Recommendation: Staff recommends APPROVAL of the requested Waiver to: 1) Reduce the minimum setback for a yard sign from the street right-of-way, from 20 feet to 10 feet. Staff recommends APPROVAL of a Certificate of Appropriateness for a Sign Permit for the proposed yard and wall signs, subject to the following condition: 1) Meeting all relevant requirements of the Knoxville Zoning Ordinance, as appropriate. Tom Brechko explained the staff recommendation. Stuart Anderson, George Armour Ewart Architect, 404 Bearden Park Circle, Knoxville, TN. Mr. Stuart stated that the site as approved limited the available area for the yard sign due to the pavement areas and approved landscaping. The sign would still comply with the Knoxville

He asked that the Board approve the waiver and the sign plans. Ed Brantley made a motion to approve the waiver per Staff recommendation. Tammy White seconded the motion. North: BP (Business & Technology) / TO (Technology Overlay) - Mixed businesses South: PC (Planned Commercial) / TO (Technology Overlay) - Mixed businesses East: West: CA (General Business) / TO (Technology Overlay) - Vacant land CA (General Business) / TO (Technology Overlay) - Mixed businesses 1) This is a request for a shopping center with a proposed building area of approximately 16,281 square feet. The development site of 2.91 acres is located on the north side of Hardin Valley Rd. and the west side of Cherahala Blvd. Proposed access to the site includes a shared driveway from the Weigels store onto Hardin Valley Rd., and access to both Cherahala Blvd. and Pentwater Dr. The proposed driveway connection to Cherahala Blvd. includes a cut in the median of Cherahala Blvd. that will allow a north bound left turn into the site off of Cherahala Blvd. The exit from the site at that location will be a right turn only. 2) The minimum parking required for this shopping center by the Knox County Zoning Ordinance is 82 spaces. The TTCDA Design Guidelines have a minimum parking standard of 33 spaces and a maximum standard of 57 spaces for a shopping center with 16,281 square feet. The applicant is proposing 118 parking spaces which exceeds the maximum off-street parking requirements allowed by the Design Guidelines for a shopping center. A waiver will be required from the Design Guidelines. 3) Staff is recommending approval of the waiver request based on the following analysis: a. The Design Guidelines maximum number of spaces is less than the minimum requirements of the Knox County Zoning Ordinance for a shopping center; and b. The shopping center parking standards do not clearly account for restaurant space within the center. The applicant has indicated that approximately 7675 square feet (47%) of the center may be leased for restaurant use. Under the Guidelines, the maximum number of spaces for a shopping center is 3.5 spaces per 1000 sq. ft. of Gross Floor Area (GFA) versus 15 spaces per 1000 sq. ft. of GFA for a restaurant. 6 Guidelines would be 146 spaces which would support the request for 118 spaces. 4) The proposed development is within the limits for Ground Area Coverage, Floor Area Ratio and Impervious Area Ratio. 5) The proposed landscape plan is consistent with the Design Guidelines. 6) The building's exterior siding will be primarily a mix of brown and tan brick, with a tan EIFS cornice. The dark bronze storefront systems will include a mix of dark bronze cantilevered and shed canopies over the store entrances. The proposed dumpster enclosures will match the materials and colors used in the shopper center building. The mechanical equipment will be located on the ground behind the building and will be screened from view from the street. 7) The proposed lighting for the development includes full cut-off LED fixtures. The proposed site lighting falls within the maximum intensity limits. 8) The building which has approximately 200 feet of frontage on Hardin Valley Rd,, will allow a sign area of up to 100 square feet for the proposed yard sign. The yard sign meets the 20 foot setback requirement from Hardin Valley Rd. The proposed sign is 8 feet in height and has approximately 47 square feet of sign message area per side for a total of 94 square feet. The sign structure includes brick on a cultured stone base with colors to match the colors in the building facade. The lighting for the yard sign will be shielded LED ground mounted lights. 9) A waiver is required to allow an increase in height of the yard sign from 6 feet to 8 feet. Staff is recommending approval of the waiver since the sign is consistent in height with the sign approved for the shopping center directly across Hardin Valley Rd., and the sign is subject to approval by The Development Corporation of Knox County. 10) The building signs for the individual tenants will require a separate TTCDA applications and approval. 11) The proposed development will require review and approval by The Development Corporation of Knox County, since the retail center is subject to the Development Corporation s design requirements. Design Guideline Conformity: Waivers and Variances Requested: With the approval of the requested waivers, this request complies with the TTCDA Design Guidelines. Waivers to: 1) Exceed the maximum number of parking spaces allowed for a shopping center under the Design Guidelines by allowing an increase from 57 spaces to 118 spaces as identified on the development plan. 2) Increase the height of the yard sign from 6 feet to 8 feet. Staff Recommendation: Staff recommends APPROVAL of the requested Waivers to: 1) Exceed the maximum number of parking spaces allowed for a shopping center under the Design Guidelines by allowing an increase from 57 spaces to 118 spaces as identified on the development plan. 2) Increase the height of the yard sign from 6 feet to 8 feet. Contractor shall verify all existing conditions in the field and report any discrepancies to the Owner's Representative prior to starting work. 2. No planting shall occur until soil sample results have been received from all planting areas and soils are properly amended based on the results of the soil tests. See this sheet for soil sampling instructions. 3. No planting shall occur until percolation testing has been completed and soils have been properly amended to drain. See this sheet for percolation testing procedures. 4. All new plant material shall conform to the guidelines established for nursery stock published by the American Association of Nurserymen, Inc. In addition, all new plant material for the project shall be of the highest specimen quality. 5. Do not assume trunk flare will be exposed at the nursery. Contractor to expose trunk flares to check for root girdling. Pull mulch away from the trunk flare of trees and from the base of all shrubs. 6. All new plants shall be balled and burlapped or container grown unless otherwise noted on the plant list. 7. The Contractor shall locate and verify all existing utility lines prior to planting and report any conflicts to the Owner's Representative. 8. No plant material shall be planted before acceptance of rough grading. The finished grade shall not cover any part of the tree trunk flare. See tree planting detail. 9. All lawn areas disturbed by construction operations inside and outside the limit of work shall be prepared and seeded as specified. 10. Prepare all shrub beds with planting soil to a minimum depth matching the depth of shrub root balls; prepare perennial beds with a minimum of 12" planting loam; prepare groundcover beds with a minimum of 6" planting loam. 11. All plant beds are to receive one and a half inches (") of double shredded hardwood mulch. 12. Thoroughly water trees and shrubs during the first 24 hours after planting. Wet the soil to a depth of 18-24". When runoff starts, stop watering, let the water soak in and repeat until the proper depth is wet. 13. Any proposed substitutions of plant species shall be made with plants of equivalent overall form, height, branching habit, flower, leaf, color, fruit, and culture only as approved by the Owner's Representative. 14. All areas to be seeded or sodded shall receive soil preparation as specified prior to seeding or sodding, unless otherwise noted on plan. 15. Contractor's base bid to include all materials, labor, permits, equipment, tools, insurance, etc. to perform the work as described in the contract documents. 16. Contractor to complete work within schedule established by Owner. 17. Contractor to provide one year warranty for all material from date of substantial completion. Plant material delivered to the site that does not meet the requirements stated herein may be rejected by the Owner's Representative. 18. Contractor to provide interim maintenance (watering, pruning, fertilizing, guying, mowing, trimming, adequate drainage of ponding areas, edging, weeding, mulching, and general landscape clean-up) until substantial completion notice is provided by the Owner's Representative. Application of insecticides/herbicides must be approved by Owner's Representative prior to use on site. 19. See civil drawings for further information regarding: Erosion and sediment control. Locations of existing and proposed structures, paving, driveways, cut and fill areas, and retention areas. Limits of construction. Locations of existing and proposed utilities or easements. 20. Plant beds to join walks or walls at an angle between 90 & Shade trees to be planted a minimum of 5' from sidewalks, water line, sewer line or manholes. Evergreen and ornamental trees to be planted a minimum of 3' from sidewalks, water line, sewer line or manholes. 22. Mulch rings around shade trees to be a minimum diameter of 4' and a minimum of 3' around ornamental and evergreen trees. If evergreen trees are specified as full to ground, mulch ring to extend a minimum of 12" beyond the edge of plant. 23. Planting plans are not layout plans. Plants may need to be shifted in the field, based on the existing conditions. Coordinate with the Owner's Representative prior to any changes. 24. Square footage of sod and seed quantities are approximate and is an estimate of the disturbed areas. Contractor to verify quantities prior to purchase and installation. 1. Using a spade, dig a v-shape hole to a 6" depth; then cut a thin slice of soil from one side of the hole. Place the slice in a plastic bucket, do not use a metal bucket. Mix slices together and fill a plastic sample bag with three (3) cups of dirt. The sample bags can be ziploc bags that are labeled with the project name and sample number. 2. A well mixed composite from 10 to 20 random locations should be subsampled to make the three (3) cup sample. 3. Mark the plan to show soil sample locations. 4. Send samples to A & L Analytical Labs, Inc., 2790 Whitten Road, Memphis, Tennessee 38133, , 5. Results to be copied to the Owner. Percolation Test Notes 1. Dig a hole 18-24" deep & a minimum of 6" wide. 2. Fill hole with water to the top and let drain for several hours. Ideally let the hole pre-wet over night and test the following day. 3. Refill hole to within a couple inches of the top. 4. To aid in measurement, place a stick across the top of the hole and use a second stick to mark periodic drops in water level; mark side of hole; or mark soil on side of hole with nail or stick. 5. Measure drop in water level after 30 minutes and one hour. If possible measure drop in water level the next day. 6. Determine drop in water level per hour.
