I. Background The National Urban Upgrading Program (NUUP) approved by the Prime Minister at Decision No.758/QD-TTg dated 08/6/2009 is expected deploy Class IV cities/ towns on a national scale for a period of 2009 2020. To conduct the assigned role, for past years, the Ministry of Construction (MoC) has planned and designed a list of annual urban upgrading investments and submitted to the Government for approving implementation under this Program Framework. The Mekong Delta Region Urban Upgrading Project (MDR-UUP) has received a financing from the World Bank (WB) with total investment of 398 million USD, including 292 million USD from ODA fund and been implemented from 2012 to 31/12/2017. The NUUP has been deployed in 6 cities of Can Tho, Ca Mau, Cao Lanh, My Tho, Rach Gia and Tra Vinh. In 2015 and early 2016, the MoC has formulated evaluation report on urban upgrading demands on a national scale (MoC 01A). The MoC has conducted urban upgrading demand investigation on a national scale and field surveys in some cities/ towns in the Central Coastal Region, the Central Highlands Region and the Mekong Delta Region (in the cities/ towns without urban upgrading projects). One of the priorities for next phase has attached importance to the Mekong Delta Region cities as evaluated to significantly lack urban infrastructures but to be greatly affected by climate change and where there are many urban poor people and low ODA funds. In the context of the limited concessional ODA funds and high public debts, while demands of urban upgrading investment are more (according to Report MoC 01A), it is necessary to update contents of the National Urban Upgrading Program (NUUP) in new situation and clarify role of the Ministry of Construction (MoC) and the local governments. Under Official Letter No.1888/TTg-QHQT dated 27/10/2016 of the Prime Minister on approving proposed Scaling-up Urban Upgrading Project (SUUP), funds allocated to the MoC are non-refundable. Thus, it is required to study and update necessary activities for the NUUP and proposals to mobilize capital aid fund to ensure the MoC s conducting the assigned tasks according to Decision No. 758/QĐ-TTg. This Terms of Reference provides tasks of package on International individual consultant to support in deploying coordination, capacity development of the cities participating in the urban upgrading development programs/ projects (MOC 01H). Selected consultant will directly sign contract with the Management of Urban Development Project (MUUP) to conduct this task. The MUDP under the Urban Development Agency (UDA) Ministry of Construction (MOC) is located in Hanoi and assisted by the field office in Can Tho. Package MoC 01H will be conducted in close coordination with consultants implementing other relevant packages under Component 5 and tasks undertaken by the UDA and the MoC. II. Objective Independent consultant having international experiences in supporting the MoC in limiting, identifying and deploying coordination and capacity development of the cities participating in the urban upgrading development programs/ projects. 4

III. Scope of work In general, the Technical Assistance (TA) Consultant will conduct the following tasks: A. Assess role of the MoC in deploying the National Urban Upgrading Program. B. Support in identifying and deploying the MoC s task in urban upgrading development programs in the new context. C. Support in designing documents to serve for mobilization of non-refundable aids to conduct urban upgrading development related tasks. IV. Detailed tasks The TA Consultant will conduct the following tasks (contents of reports are considered to be completed after the submission of Consultant is agreed by MUDP) Inception Report. 1. To conduct the task, the Consultant will study the NUUP and projects having been deployed under this Program (Vietnam Urban Upgrading Project VUUP, Mekong Delta Region Urban Upgrading Project MDR UUP, Northern Mountains Urban Program), other projects, international experiences, deliverables of Consultant MoC 01A, Reports of NUUP VUF for overall assessment of the Program as overview to orientate the MoC s role in this Program in next phase, especially in the context of the limited concessional ODA funds and high public debts. 2. The Consultant is required to design the Inception Report including contents, programs and plans to conduct the task. Task A: Assessment of the Ministry of Construction s role in deploying the National Urban Upgrading Program (NUUP) 1. The Consultant is required to assess the MoC s role in the NUUP since the Prime Minister approved at Decision No.758 dated 8/6/2009 to now. It includes at least contents as follows: - Study actual situation, social impact, capacity building of the projects being deployed in the NUUP and research reports of the Consultant MoC 01A and Cities Alliance (CA) Consultant. - Assess the MoC s role in deploying the NUUP through projects having been implemented and highlight specific lessons learnt as well as areas of further institutional learning; - Assess conformity of the Programs/ Projects being implemented and the MoC s role in the NUUP approved by the Prime Minister; - International experiences in deploying the urban upgrading programs in the world and how they can be adapted to building the capacity of MoC. Task B: Support in identifying and deploying the MoC s role in facilitating and informing urban upgrading development programs in new context 1. Based on the Task A report on the assessment of NUUP implementation, the Consultant will develop a report proposing recommendation and orientation for the 5

Program in conformity with new context. Contents of the report include at least the followings: - Enabling or redraw the line of existing policy frameworks and the room for improvement to ensure the implementation of sustainable urban upgrading and development objectives, green growth and climate change resilience, and also including urban planning to adapt with sustainability and climate change resilience; - Gaps and/or contradictions in the regulatory frameworks regarding above; - Propose detailed action plan of MOC to implement urban upgrading and development programs; - Propose MoC s role as a facilitator for urban planning agenda; - Propose criteria to select city participating in urban upgrading and development program; 2. Organize seminars to present results of the Consultant s task with participation of relevant stakeholders (donors, ministries and local governments, think tanks, academia etc.). Cost for travel and accommodation of the Consultant will be paid from the package expenditures. Cost related to organizing seminars will be paid by the MUDP. MoC and WB will facilitate the identification of the participants to the workshop, potentially leveraging the National Urban Forum. Task C: Support the MoC in designing documents to serve for mobilization of non-refundable aids to conduct urban upgrading development related tasks 1. Assess the potential donors ability in continuously deploying the NUUP and the MoC activities such as WB, ADB, AFD, JICA... 2. Develop work plans, and connect and mobilize non-refundable aid sources for the MoC activities to deploy the NUUP in new context 3. Support the MoC in drafting organization profile and project documents to mobilize non-refundable aid source; 4. Support in the form of TORs development for consultants to support the for cities in the implementation of the new urban upgrading operations with regard to enhancing integrated urban planning (such as Vietnam Scaling Up Urban Upgrading under preparation- SUUP). Final report The Consultant is required to submit to the MUDP for approving the final report including contents and recommendations for next works to resume the Consultant s task and other necessary works from the MoC. V. Consultant inputs Consultant possesses at least a Master in Urban Planning, Land management, Spatial Planning or related fields with a minimum of 10 years of relevant experience. International experience is a must. 6

Consultant will preferably have many experiences in (i) regional planning, urban planning and urban technical infrastructures; (ii) working for multi-lateral and bilateral organizations on ODA; (iii) mobilizing ODA and preparing project documents; (iv) working in Vietnam related to ODA as an advantage. VI. Duration of services (Continuous) consultant will have 4 months to conduct this package and it is expected to be started from 4/2017 to 8/2017. Subject to actual situation, the duration of services may be adjusted and prolonged but ensure 4 man-months. VII. Reporting schedule The TA Consultant will submit the following reports to the MUDP for approval. All reports will be submitted in 5 originals in English and 5 originals in Vietnamese, including electronic copies in English and Vietnamese. It is noted that Inception Report will be submitted within 2 weeks as from the commencement date. Other reports will be submitted as planned in the Inception Report. Dates of submission are relative and may be adjusted as planned in the Inception Report. Reports Deadline Quantity 1. Inception Report 2 weeks after the signing date 5 originals in English 5 originals in Vietnamese 2. Assessment of NUUP deployment 1 month after the 5 originals in English signing date 5 originals in Vietnamese 3. Report on recommendation proposal for the NUUP in line with new situation 4. Project documents to serve for mobilizing non-refundable aid sources (including reports in deploying service) 2 months after the signing date 4 months after the signing date 5. Final report 4 months after the signing date VIII. Implementation Arrangements 5 originals in English 5 originals in Vietnamese 5 originals in English 5 originals in Vietnamese 5 originals in English 5 originals in Vietnamese The selected Consultant will directly sign a contract with the Project Coordination Unit Mekong Delta Region (PCU-MDR) to conduct this task. It is expected that the Consultant will participate in 2 missions in the field and each mission will last at least 7 days. Thus, international consultant residing in Vietnam will be an advantage to deploy this service. The MUDP may assist working space in the MUDP head office in Hanoi to enable the Consultant to work during the duration of service (4 months) and in Can Tho Office of the PCU, upon required, to work in the field. However, subject to actual situation, depend on quality of the reports related to donors, the duration for service may be 7

prolonged but ensure 4 man-months, specific contents will be agreed during contract negotiation. The MUDP may arrange the Consultant to work with the agencies at central and local level during the duration of service. During the duration of service, the Consultant will directly report to the MUDP, and in some circumstances, at his request, will directly report to the UDA and the WB. Costs for the Consultant will be lump-sum in the specialist s man-months, including costs for travel, accommodation, printing and translation, other relevant tax and costs. 8

Overview of Project: The Socialist Republic of Vietnam has received a grant of about 292 million USD from the International Development Association (IDA) of the World Bank for urban upgrading investment in 6 Mekong Delta Region Cities and for coordination and capacity development of the Ministry of Construction. An agreement was signed on 11/5/2012 between the Government of Vietnam and the World Bank and effective as from 09/8/2012 to 31/12/2017. 2. Service: The Ministry of Construction is a coordination unit of the National Urban Upgrading Program NUUP and expects to select an individual consultant to conduct package MoC01H International individual consultant to support in deploying coordination, capacity development of the cities participating in the urban upgrading development programs/ projects. Duration of service is expected to be from 4/2017 to 8/2017. 3. Consultant inputs: Consultant possesses at least a Master in Urban Planning, Land management, Spatial Planning or related fields with a minimum of 10 years of relevant experience. International experience is a must. Consultant will preferably have many experiences in (i) regional planning, urban planning and urban technical infrastructures; (ii) working for multi-lateral and bilateral organizations on ODA; (iii) mobilizing ODA and preparing project documents; (iv) working in Vietnam related to ODA as an advantage. 4. Consultant selection method: International individual consultant will be selected in accordance with Guideline Selection and employment of consultants by the World Bank Borrowers, 5/2004, Revised 10/2006 and 5/2010. 5. The Management of Urban Development Project under the Urban Development Agency now invites eligible consultants to submit Expressions of Interest for the above package.
