LIMITED WARRANTY POLICY January 1, 1997 Page 1 of 2 USED BALER MANUFACTURER'S WARRANTY C&M Baling Systems, Inc. warranty on the used CM3050V-7-15 with used Toter Dumping System to be free of defects in material and workmanship under normal use and service for a period of ninety (90) days, based on an eight-hour day, five days per week operation. This warranty applies to the original purchaser only and the manufacturer's obligation under this warranty is limited to ninety (90) days for repair or replacement of parts to manufacturer's mechanical and hydraulic equipment. Electrical components are not warranteed. Manufacturer's warranty or obligation in connection with the sale of this equipment: 1. Warranty on all purchased parts will carry the same warranty as extended to C&M by its suppliers. All parts shipped against a warranty claim will be invoiced when shipped and will be credited only when the original manufacturer has returned the part for inspection and approval for claim. The obligation of C&M is expressly limited to repair or replacement as approved by the original manufacturer. 2. Warranty on manufacturer defects or workmanship shall be limited to a lack of items necessary for completeness or an imperfection in materials fabricated and assembled by C&M Baling Systems, Inc. 3. All repair or service work must be approved by C&M and must be performed by manufacturer, distributor, or approved service organization and factory approved parts must be used for repair or replacement of original factory supplied equipment. The use of unapproved parts or service personnel will void manufacturer's warranty. 4. Warranty shall not apply to any failure or damage incurred through neglect, lack of maintenance, misuse, accident, fire, vandalism, improper installation, redesigning of assemblies, or through any other cause beyond the control of the manufacturer. This includes any failure or damage incurred through improper electrical feed to the system or any of its components. 5. Warranty shall not apply if the equipment has been operated beyond the factory recommended maximum capacity. 6. In no event shall C&M be held responsible for incidental or consequential damages. 7. Warranty shall not cover labor by the customer or outside contractor to install components and shall not cover any charges for lost production. 8. Warranty shall not cover shipping and special handling charges to expedite parts.
C&M WARRANTY POLICY January 1, 1997 Page 2 of 2 9. Cleanliness must constantly be enforced during and after the installation to maintain the maximum efficiency of the hydraulic system. When routine maintenance of the equipment is neglected or when proper cleanliness procedures are not followed, as per the manual, the manufacturer's warranty shall be void. 10. No claim under this warranty shall be valid unless such claim is submitted within twelve (12) months after the date of sale for all parts or service labor. It has been the continuous policy of C&M to ensure complete customer satisfaction. This is your assurance that you can expect prompt, efficient service on your equipment from C&M and the C&M distributor/dealer organization. NOTICE: Certain parts used on C&M balers are only under warranty by the manufacturer for repair, NOT replacement. Electronic and electrical parts are not covered under this warranty after initial startup. C&M balers are factory assembled, tested, and cycled to assure quality and condition of electrical and hydraulic components. C&M accepts no responsibility for damage to electrical components caused by improper electrical connections, wrong voltages, low voltage, or voltage surges.
