3 I. INTRODUCTION Peninsula Lakes is envisioned as a place for people to live, socialize and enjoy the Delaware shore and its unique natural features. Water serves as the backdrop and spiritual wellspring of the community with lakes providing a connection throughout. The landscape character of Peninsula Lakes is an essential item in the integration of nature, human habitation and recreation. Peninsula Lakes, LLC is dedicated to creating a community where people and nature harmoniously coexist. The commitment to protecting nature is an important unifying factor. Environmental sensitivity and stewardship of nature create the foundation for the development of Peninsula Lakes. The public realm of Peninsula Lakes, consisting of streetscapes, lakes, open space, and community recreation, has been designed to create an integrated community while creating continuity. Great care has been taken to reinforce architectural vernaculars with the appropriate streetscapes, landscape and hardscape materials and elements. The individual residences of Peninsula Lakes will be required to be landscaped to a similarly appropriate level. The level of landscaping will have an integral role in developing community patterns and sense of place within Peninsula Lakes. Each home landscape should reflect the surrounding public spaces with the appropriate uses of landscape and hardscape materials. This document is intended solely to provide landscaping guidelines regarding plant material, plant size, fencing and other landscape design characteristics relevant to the planning and design of the community. This document is independent of all other controlling laws and regulations including, but not limited to, local and statewide building codes, zoning ordinances, fire codes, and any other applicable codes or laws. Compliance with these guidelines does not give relief from the obligation to adhere to other controlling laws and regulations. Peninsula Lakes, LLC or their design consultants, assume no responsibility or liability for the quality, safety or adequacy, structural or otherwise, of any of the referenced design or design elements referenced herein. 4 II. SIGNAGE All signs, whether temporary or permanent, and associated landscaping must receive approval of the Review Committee/Developer. Signs, whether temporary or permanent, shall be of materials and colors that complement those of the overall community. Identification Signs. All Community identification/entry signage shall be designed as an integral part of both the architectural and landscape design of the Community. The Developer will be responsible to design and install the Community identification signs. Temporary Builder Identification Signs. All temporary builder identification signage shall be designed as an integral part of both the architectural and landscape design of the Community. The Developer will be responsible to design and install all temporary builder identification signs. Temporary Community Feature Signs. All temporary community feature signage shall be designed as an integral part of both the architectural and landscape design of the Community. The Developer will be responsible to design and install all temporary community feature signs. Builder Model Home Signs. All temporary builder model home signs shall be designed as an integral part of both the architectural and landscape design of the Community. The Builders will be responsible to design and install all temporary builder model home signs on their model lots. All builder model home signs and associated landscaping must receive approval of the Review Committee/Developer. Builder Lot Signs. The Builders will be responsible to design and install all temporary lot signs on their lots. All builder temporary lot signs must receive approval of the Review Committee/Developer. 5 III. SITING In order to create unique and diverse streetscapes and to avoid sterile or monotonous settings, no homes of identical style or colors may be built next to each other. In order to ensure this, elevation and color selections for each home will be subject to the "Triangle Rule". The Peninsula Lakes homes will be carefully placed on each lot to create individual neighborhoods, define public open spaces and interesting streetscapes. Typically, each single family home lot type has a front yard setback of 15' from the front property line to the front facade of the home. Structures and porches may not encroach in the front yard setback. Porch steps, provided that they are not covered by any overhead structure, may encroach in this setback. The consistent front setbacks throughout the neighborhoods create uniform massing of the streetscape. The individual character and style of each home will provide the unique and interesting streetscapes. The side yard setbacks provide a minimum distance that all structures must be placed from the side property line. The side yard setbacks throughout Peninsula Lakes are established at 10' for all homes. No accessory structures, decks or porches may encroach into this setback. The rear yard setbacks are established at 10' for single family and twin homes. No accessory structures or porches may encroach into this setback. Corner lots typically have two front setbacks facing each street in order to maintain the massing of the streetscape. Builder will employ an engineer to site homes, develop grading plans, develop soil erosion plans, provide top of foundation wall in accordance with established community wide standards. Builder will provide Developer with those documents for his approval, which approval will be approved or denied within 3 business day. Builder will also provide Developer with an as-built survey certifying that final elevation and grading is in accordance the approved plans. In order to preserve the quality of the lakes, Builder cannot encroach on common area or cause any silt to run off into the lakes. Canuso Communities 4

6 IV. LANDSCAPING General Guidelines Plant material should be used to create and frame outdoor spaces, reinforce major building entries, enhance the design of the house, street and neighborhood. The use of plant material native to the Delmarva Peninsula is strongly encouraged. Plants should be located in such a way as to allow them to reach their natural mature size with minimal cosmetic pruning. Hedge material would be an exception to this recommendation and routine pruning and trimming would be required. The mature spread of all trees should be taken into consideration when making selections. If planted too close to structures, trees will need continuous maintenance and may cause damage to the structure. Trees that are known to have invasive or shallow root systems should be avoided when making selections for areas near structures, patios, driveways and walks. Due to sandy soils and often windy conditions, native plants that become established quickly and require less water are recommended. Annual flowers, except at some highly visible common areas, are avoided to reduce ongoing installation and maintenance costs to the Association. By using the appropriate plants for the vernacular, style, region and microclimate, the selected plant material will be allowed to provide the maximum benefit and enjoyment for the homeowners. Please refer to the plant palette matrix for plant recommendations. Mailboxes Each home will be required to have individual decorative mailboxes. All mail boxes must receive approval of the Review Committee/Developer Irrigation All lots must be irrigated. Irrigation must be connected to central irrigation control system provided by the Developer. Builder will pay a one-time connection fee of $2, to the Developer. Plans must be submitted with irrigation designs including pipe size, number of valves, and number of heads and must be approved by the Developer. Lawn irrigation must provide head to head total coverage. Planting beds may be irrigated with drip lines or spray heads which provide complete plant coverage. Canuso Communities 5

7 Home landscaping package minimums Each home is required to have a planting bed across the entire front (4' minimum width from foundation to edge). Where possible the bed should wrap around both front corners a minimum of 6. If a corner lot, the planting bed should extend on the street facing side a minimum of 60%. Beds should be graded with topsoil and raised three inches at foundation to achieve positive grade from house. Beds must be spade edged and mulched with natural colored shredded hardwood mulch. Black and red colored mulch is prohibited. Plant material must meet American Standards for Nursery Stock for southern Delaware. Prototypical design should include a minimum number 25 shrubs, 15 perennials, 1 ornamental tree and 2 shade trees, 3 if a corner lot. Actual number may vary subject to approval by Developer based on actual dimensions of home types. Plantings shall, generally, be installed at the following minimum sizes to ensure adequate initial appearance. o Shade Trees: Minimum 2-2½ caliper o Ornamental/Flowering Trees: Minimum 1-1½ caliper o Evergreen Trees: Minimum 6 8 height o Large Shrubs: Minimum 24 hgt. x 24 sprd. (3 Gallon) o Small Shrubs: Minimum 18 hgt. x 18 sprd. (3 Gallon) o Perennials: Minimum 1 qt. container o Seasonal Color: Minimum 1 gal. container o Groundcovers: Minimum 4 pot At least one house corner must be planted with an upright ornamental evergreen with a minimum of 6' in. At least two shade trees must be planted per lot, three if a corner lot. Shrubs should be an approximately even ratio of evergreen and flowering deciduous. Shrubs should be planted according to growth habit but at least 2' from foundation. All lawns will be installed with Tall Fescue and Blue Grass Blend sod or sod suitable for use in coastal southern Delaware. Canuso Communities 6

8 Fencing All fencing must be attractive, well designed, well-constructed and compatible with the architecture of the dwelling units. Gates shall match the design, material, and color of the associated fence. All fence posts shall have finished tops or caps. No fencing is permitted in the front of any lot. Fencing is only permitted on the side of any lot at the midpoint of the house to the rear of the lot. No fencing is permitted closer to the front of any lot than the midpoint of the side elevation of the dwelling unit. At corner lots, any fencing on the street facing side of the home must be no higher than three feet (4-0 ) from the midpoint of the side elevation of the home to the rear of the lot. All fence tops shall be level and fence panels shall step with grade. Split rail and open type fences (i.e. three rail and cross buck fences) as well as stockade or board-on-board fencing are prohibited. All fencing on front of homes, street facing sides of corner lots or the rears of homes facing the lakes must be picket style fencing. Acceptable types of fencing are shown attached. All fences shall be stained or painted opaque white as approved by Developer. The finished side of the fence shall face the street or exterior of the dwelling unit. The maximum fence height is four feet (4 0 ). Open type fencing is recommended. Canuso Communities 7

13 V. REVIEW PROCESS New Construction 1. Review Committee/Developer Review Committee is to be determined by Peninsula Lakes, LLC. 2. Process Submittal Package Builders constructing new homes must submit plans and elevations, one time, for review. Said submittal must include: A. Application B. Typical site plans, elevations, material samples, color palette, exterior light fixtures, decking and rail, fencing and landscaping. All drawings to be at appropriate scale. Two copies are required. C. Review Committee will review the complete package within two weeks. The applicant will receive a letter of: a. Approval b. Approval with conditions c. Request for more information d. Letter of disapproval The review committee may at its discretion enforce or modify in whole or in part any or all of these guidelines. Canuso Communities 12
