3 What is Type Approval? An official confirmation by a government or a regulatory body that a manufactured product meets required minimum specifications Type Approval is granted to a product that meets a minimum set of regulatory, technical and safety requirements Normally, Type Approval is required before a product is allowed to be sold in a particular market; the regulatory requirements for a given product vary around the world 3

5 The Technical requirements Minimum requirements that telecommunication network/devices must meet before they are granted Type Approval. Such requirements are defined developed or adopted national/international standards. Different requirements for EMC, RF, EMF, SAR 5

8 Essential Requirements European Union Directive 2014/53/EU (RED) on radio and telecommunication terminal equipment Article 3 Essential Requirements: 3.1(a) User protection and safety 3.1(b) Electromagnetic Compatibility 3.2 Radio/RF aspects related with the efficient use of the allocated radio-electric spectrum, without causing radio interference 8

9 Legal & Regulatory requirements Legal Framework: Relevant legal provision that empowers Administrations to certify and ensure the testing of communications equipment for compliance with national and international standards; environment, health and safety standards including electromagnetic radiation and emissions. Sections 66 and 67 of the Electronic Communications Act of 2008, Act 775, on developing standards for Terminal Equipment Regulations 78 and 79 of the Electronic Communications Regulations, 2011, L.I empowers the Authority to approve communications equipment and also put in place both the standards and mechanism for the approval. 9

10 Regulatory Requirements Manufacturers, Dealers or Authorized Agents of Electronic Communication Equipment (ECE) require Authorization and Dealership before they can sell ECE s in Ghana. The Authorized Equipment come with Authorization Certificate (Type Approval Certificate) NCA must be informed prior to the importation of any ECE Upon arrival of equipment, clearance including physical examination at the ports is a required-as part of the market surveillance activities 10

13 Application Requirements 1/2 Application Letter on a Company letter head RF, EMC and Safety Test Reports in compliance with adopted Standards Technical description of equipment Certificate of Compliance by Conformity Assessment Body or National regulatory Authority 13

17 Proxy & Administrative approvals Third Party Approvals for entities on behalf of the manufacturers. E.g. Registered Dealers, Large scale corporate deployment(use). Mainly Administrative based on test reports from laboratories recognized by the NCA. 17

18 Dealership Licensing framework Dealership Licence is a permit granted to a dealer of Electronic Communications Equipment (ECE) to import and/or sell type approved ECE. In Ghana Dealership Licence is required before any ECE is imported, sold and used in the Ghanaian market. This is in accordance with Section 3 (c) of the NCA Act, Act 769 of

19 Dealership Licence categories Class A Class B Sales, installation, repairs and maintenance of: fixed line phones, mobile and fixed cellular phones, low power cordless phones, PABX with capacity of up to 50 lines, TVRO (free on air) Class A Sales, installation, repairs and maintenance of: Digital TV, Set top Box, HF/VHF/UHF Radio equipment, minor network installation including switching equipment of up to 300 line capacity, ISM band equipment and its accessories. 19

Class C Class A & B Plus sales installation, repairs and maintenance of: Class D major network installation and transmission equipment such as VSATs, Hubs etc. Class A, B & C Plus Vendors, manufacturers, and sub-contractors providing engineering managed services, operations and maintenance, installations & integration services in the telecommunications industry 20

21 Who needs a Dealership Licence? Importers of Electronic Communications Equipment for marketing/commercial/corporate use. Entities selling Electronic Communications Equipment Installers of Electronic Communications Equipment Manufacturers and assemblies of ECE Sub-contractors providing managed services 21

22 TYPE APPROVAL DEALERSHIP DEALERSHIP TYPE APPROVAL Whereas a Type approval Certificate confirms that a particular model of an ICT device that is to be used in Ghana complies with national & international standards. A Dealership Licence is granted to entities to import, sell, install and service only type approved ICT device on the Ghanaian market. 22

26 Market Surveillance This procedure is conducted to ensure that electronic communications equipment placed or used on the market conform to the pre-market approved standards Two-pronged Approach: Entry clearance procedures physical port inspection and clearance Post market surveillance activities 26
