6 ANNEX STATEMENTS FOR THE COUNCIL MINUTES Ad "B" item 4: Proposal for a Regulation of the European Parliament and of the Council on the financial rules applicable to the general budget of the Union and amending Regulation (EC) No 2012/2002, Regulations (EU) No 1296/2013, (EU) 1301/2013, (EU) No 1303/2013, EU No 1304/2013, (EU) No 1305/2013, (EU) No 1306/2013, (EU) No 1307/2013, (EU) No 1308/2013, (EU) No 1309/2013, (EU) No 1316/2013, (EU) No 223/2014,(EU) No 283/2014, (EU) No 652/2014 of the European Parliament and of the Council and Decision No 541/2014/EU of the European Parliament and of the Council (Omnibus proposal) [First reading] = State of play and exchange of views STATEMENT BY THE COMMISSION ON REGIONAL CRISES "The Commission confirms that Regulation (EU) 1308/2013 establishing a common organisation of the markets in agricultural products already contains, in Articles 219 and 221, the necessary legal base allowing it, subject to the availability of budgetary resources, to address market disturbances and other specific problems, including at regional level, with the possibility of granting direct financial assistance to farmers 2. Moreover, the Commission's proposal to add a sector-specific income stabilisation tool to Regulation (EU) No 1305/2013 on support for rural development will allow Member States to include in their rural development programmes the possibility of compensating farmers in a specific sector in the case of a significant drop in their income." STATEMENT BY THE COMMISSION ON PAYMENT REDUCTIONS "Article 11 of Regulation (EU) No 1307/ allows Member States to review their decision on a reduction of payments on an annual basis, including the possibility of introducing capping for the first time. When doing so, Member States should respect their other legal obligations under Union law. In particular, they should ensure that the amounts available for rural development as a result of the application of Article 11 are not reduced and that the legitimate expectations of the farmers are duly taken into account, which implies that a review decision should be taken sufficiently in advance before the start of the claim year to which it is supposed to apply for the first time." 2 3 Examples: Regulation (EC) No 1263/2014 (Baltics) and Regulation (EC) No 1370/2014 (Finland) OJ L 347 of , p /17 6 ANNEX

7 Ad "A" item 6: Commission Regulation (EU) No /.. of XXX amending Annex XIV to Regulation (EC) No 1907/2006 of the European Parliament and of the Council concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) = Decision not to oppose adoption STATEMENT BY GERMANY "Germany takes it that the recitals in the German version will be adapted as follows: In recital 19, the words 'zu vermeiden' will be added after 'nicht mehr hergestellt werden'. In recital 21, the second sentence will be replaced by the following: 'Es wurde ebenfalls nach Artikel 59 der Verordnung (EG) Nr. 1907/2006 als für die Aufnahme infrage kommender Stoff ermittelt und in die entsprechende Liste aufgenommen, und die Agentur sprach sich am 6. Februar 2014 in ihrer Empfehlung gemäß Artikel 58 der Verordnung für seine vorrangige Aufnahme in Anhang XIV der Verordnung aus.' In item 41, 'Pech, Kohlenteer, hohe Temp.' will be changed to 'Pech, Kohlenteer, Hochtemp.'. 8 Ad "A" item 7: Commission Regulation (EU) / of XXX amending Annex XVII to Regulation (EC) No 1907/2006 of the European Parliament and of the Council concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) as regards perfluorooctanoic acid (PFOA), its salts and PFOA-related substances = Decision not to oppose adoption STATEMENT BY GERMANY "Germany takes it that the recitals in the German version will be adapted as follows: In the penultimate sentence of recital 4, the words 'medizinische Geräte' will be replaced by 'Medizinprodukte'. In the last sentence of recital 6, the word 'Latextinte' will be replaced by 'Latexdruckfarbe', the words 'Medizinische textilien' will be corrected to 'medizinische Textilien', and 'medizinische Geräte' will be changed to 'Medizinprodukte'. In the first sentence of recital 7, the word 'Ausrüstung' will be replaced by 'Materialien'. Furthermore, in entry 68 in Annex XVII, Germany takes it that the following changes will be made: In paragraph 3, point (a)(ii), the word 'Latextinte' will be replaced by 'Latexdruckfarbe'. In paragraph 3, the content of point (b)(i) will be replaced by 'Arbeitsschutztextilien'. In paragraph 3, point (b)(ii), the spelling of 'medizinische Textilien' will be corrected. In paragraph 3, point (c) will be changed to '(c) [Datum 15 Jahre nach Inkrafttreten dieser Verordnung] für andere medizinische GeräteMedizinprodukte als implantierbare medizinische GeräteMedizinprodukte unter im Anwendungsbereich der Richtlinie 93/42/EWG.' In paragraph 4, point (d)(i) will be changed to '(i) in der Herstellung implantierbarer Medizinprodukte Im Anwendungsbereich der Richtlinie 93/42/EWG;'. In paragraph 5, point (b), the word 'gefahrlos' will be replaced by the word 'sicher'.
