This PPA is providing feedback in regards to the PPA application and plans submitted on July 29, This PPA letter identifies Planning Department review requirements for the proposed project, including those related to environmental review, approvals, neighborhood notification and public outreach, the Planning Code, project design, and other general issues of concern for the project. Please be advised that the PPA application does not constitute an application for development with the Planning Department. The PPA letter also does not represent a complete review of the proposed project, does not grant a project approval of any kind, and does not in any way supersede any required Planning Department approvals listed below. The Planning Department may provide additional comments regarding the proposed project once the required applications listed below are submitted. While some approvals are granted by the Planning Department, some are at the discretion of other bodies, such as the Planning Commission or Historic Preservation Commission. Additionally, it is likely that the project will require approvals from other City agencies such as the Department of Building Inspection, Public Works, the Municipal Transportation Agency, Department of Public Health, San Francisco Public Utilities Commission, and others. The information included herein is based on the PPA application and plans, the Planning Code, General Plan, Planning Department policies, and local/state/federal regulations as of the date of this document, all of which are subject to change.

3 PROJECT DESCRIPTION: The proposal is to demolish three, two-story existing structures totaling 13,748-square-foot (sf) of industrial and Production, Distribution, and Repair (PDR) uses and to construct a 4 to 7-story, 45-foot to 85-foot-tall mixed-use building. The three existing building at th Street, 210 and 212 Clara Street were constructed in 1945, 1928, and1924, respectively. The proposed new building would total 135,000 grosssquare-feet (gsf) and include 124 dwelling units and 3,000 sf of commercial/retail space along 5 th Street. Additionally, the proposed basement would provide 39 off-street parking spaces, 30 bicycle parking spaces with the parking accessed from a curb-cut located on Clara Street. Construction of the proposed project would require excavation to a depth of 15-feet and removal of 3,400 cubic yards of soil. The 23,125-sf project site consists of eight lots (Block 3753/Lots 005,147,006A,007,057,058,100,101) and is located on the southwest side of 5 th Street and is bounded by Clara and Shipley Streets, in the East South of Market (East SoMa) neighborhood. PLANNING CONTEXT: The proposed project is located within the Eastern Neighborhoods Area Plan, which was evaluated in the Eastern Neighborhoods Rezoning and Area Plans Programmatic Final Environmental Impact Report (Eastern Neighborhoods PEIR), certified in The project site also lies within the proposed Central SoMa Plan area, a community planning process initiated in The Central Corridor Plan Draft for Public Review 2 (Draft Plan) was released in April 2013, with proposed changes to the allowed land uses and building heights in the Plan area, including a strategy for improving the public realm within the Plan area and vicinity. The Draft Plan is available for download at The Central SoMa Plan will be evaluated in an Environmental Impact Report (EIR), which is currently underway. The Draft Plan and its proposed rezoning are anticipated to be before decision-makers for approval in The existing zoning for the project site is Mixed-Use Residential (MUR). The proposed Central SoMa Plan is proposing to change the zoning of the project site to Mixed Use- General (MUG). The intent of the MUG district is to allow small amounts of office in addition to retail and other uses, but development is expected to still be predominantly residential. Residential uses, as proposed under the project, are allowed within MUG Districts. The Draft Plan includes two height alternatives. The Central SoMa Plan EIR will study the Draft Plan s Mid-Rise Height Alternative and a modified High-Rise Height Alternative. Under the Mid-Rise Height Alternative and the modified High-Rise Height Alternative, the proposed height and bulk designation for the project site would remain as 85-X/45-X. At this point, it is unknown which height option, would ultimately be approved by the Planning Commission and Board of Supervisors. Further comments in this Preliminary Project Assessment (PPA) are based on the Draft Plan concepts published to date, which are contingent on the approval of the proposed Central SoMa Plan rezoning by the Planning Commission and Board of Supervisors. 1 Available for review on the Planning Department s Area Plan EIRs web page at: 2 Please note that the Central SoMa Plan was formerly called the Central Corridor Plan. 4 ENVIRONMENTAL REVIEW: The project initially requires the following environmental review. This review may be done in conjunction with the required approvals listed below, but must be completed before any project approval may be granted: Section of the California Environmental Quality Act (CEQA) Guidelines states that projects that are consistent with the development density established by a community plan for which an environmental impact report (EIR) was certified do not require additional environmental review, except as necessary to determine the presence of project-specific significant effects not identified in the programmatic plan area EIR. As stated above, the proposed project is located within the Eastern Neighborhoods Area Plan, which was evaluated in the Eastern Neighborhoods Rezoning and Area Plans Programmatic Final Environmental Impact Report EIR, certified in Because the proposed project is consistent with the development density identified in the area plan, it is eligible for community plan exemption (CPE). Potentially significant project environmental impacts that were identified in Eastern Neighborhoods Area Plan EIR and pertinent mitigation measures and CEQA findings from the area plan final EIR that may be applicable to the proposed project are included below, under the applicable environmental topic. However, it should also be noted that mitigation measures from the Eastern Neighborhoods Area Plan EIR (including those referenced below) could be refined, augmented or superseded under the Central Corridor Plan EIR. Below is a list of topic areas addressed through the environmental review process. Some of these would require additional study based on the preliminary review of the project as it is proposed in the PPA application. Within the CPE process, there can be three different outcomes, as follows: 1. CPE Only. All potentially significant project-specific and cumulatively considerable environmental impacts are fully consistent with significant impacts identified in the Eastern Neighborhoods PEIR, and there would be no new "peculiar" significant impacts unique to the proposed project. In these situations, all pertinent mitigation measures and CEQA findings from the Eastern Neighborhoods PEIR are applied to the proposed project, and a CPE checklist and certificate is prepared. With this outcome, the applicable fees are: (a) the CPE determination fee (currently $13,659) and (b) the CPE certificate fee (currently $7,580). 3 Available for review on the Planning Department s Area Plan EIRs web page: org/index.aspx?page=

5 2. Mitigated Negative Declaration. If new site- or project-specific significant impacts are identified for the proposed project that were not identified in the Eastern Neighborhoods PEIR, and if these new significant impacts can be mitigated to a less-than-significant level, then a focused mitigated negative declaration is prepared to address these impacts, and a supporting CPE checklist is prepared to address all other impacts that were encompassed by the Eastern Neighborhoods PEIR, with all pertinent mitigation measures and CEQA findings from the Eastern Neighborhoods PEIR also applied to the proposed project. With this outcome, the applicable fees are: (a) the CPE determination fee (currently $13,659) and (b) the standard environmental evaluation fee (which is based on construction value). 3. Focused EIR. If any new site- or project-specific significant impacts cannot be mitigated to a lessthan-significant level, then a focused EIR is prepared to address these impacts, and a supporting CPE checklist is prepared to address all other impacts that were encompassed by the Eastern Neighborhoods PEIR, with all pertinent mitigation measures and CEQA findings from the Eastern Neighborhoods PEIR also applied to the proposed project. With this outcome, the applicable fees are: (a) the CPE determination fee (currently $13,659); (b) the standard environmental evaluation fee (which is based on construction value); and (c) one-half of the standard EIR fee (which is also based on construction value). An EIR must be prepared by an environmental consultant from the Planning Department s environmental consultant pool ( consultant_pool.pdf). The Planning Department will provide more detail to the project sponsor regarding the EIR process should this level of environmental review be required. The environmental review may be done in conjunction with the required approvals listed below, but must be completed before any project approval may be granted. Note that until an entitlement application is submitted to the Current Planning Division, only the proposed Project Description will be reviewed by the assigned Environmental Coordinator. EEAs are available in the Planning Department lobby at 1650 Mission Street, Suite 400, at the Planning Information Center at 1660 Mission Street, and online at under the Publications tab. See Environmental Applications on page 2 of the current Fee Schedule for a calculation of environmental application fees. 4 In either case, based on our preliminary review the following topic areas would require additional study: 1. Historic Resources. The existing project site was previously evaluated in a historical resources survey and found ineligible for national, state, or local listing. The project site is also not located within a historic district. Thus, the proposed project is not subject to review by the Department s Historic Preservation staff; no additional analysis of historic architectural resources is required. 2. Archeological Resources. The project site lies within the Archeological Mitigation Zone J-2: Properties with No Previous Studies of the Eastern Neighborhoods PEIR. Therefore, the proposed project will require Preliminary Archeological Review (PAR) by a Planning Department archeologist. To aid this review the Department archeologist may request a Preliminary Archeological Sensitivity Assessment (PASS) by a Department Qualified Archeological Consultant, subject to the review and approval by the Department archeologist. 6 from the Qualified Archeological Consultant list if the PASS is required. The PAR will assess the archeological sensitivity of the project site based on in-house source material and will consider the potential for archeological impacts resulting from proposed soils disturbance. Please provide detailed information, including sections, proposed soils-disturbing activities, such as grading, excavation, installation of foundations, soils improvement, and site remediation in the EEA, and submit any available geotechnical/soils or phase II hazardous materials reports prepared for the project to assist in this review. If the Department archeologist determines that the project has a potential to adversely affect archeological resources, the PAR will identify additional measures needed to address the potential effect. These measures may include preparation of an archeological research design and treatment plan, implementation of project mitigation measures (such as archeological testing, monitoring, or accidental discovery), or other appropriate measures. 3. Tribal Cultural Resources. Tribal cultural resources (TCRs) are a class of resource established under the California Environmental Quality Act (CEQA) in TCRs are defined as a site, feature, place, cultural landscape, sacred place or object with cultural value to a California Native American tribe, that is either included on or eligible for inclusion in the California Register of Historical Resources or a local historic register, or is a resource that the lead agency, at its discretion and supported by substantial evidence, determines is a TCR. Planning Department staff will review the proposed project to determine if it may cause an adverse effect to a TCR; this will occur in tandem with preliminary archeological review. No additional information is needed from the project sponsor at this time. Consultation with California Native American tribes regarding TCRs may be required at the request of the tribes. If staff determines that the proposed project may have a potential significant adverse impact on a TCR, mitigation measures will be identified and required. Mitigation measures may include avoidance, protection, or preservation of the TCR and development of interpretation and public education and artistic programs. 4. Transportation. Based on the PPA submittal, a transportation impact study is not anticipated; an official determination will be made subsequent to submittal of the EEA. However, the project site is located on a high injury corridor as mapped by Vision Zero. 5 Planning staff have reviewed the proposed site plans and offer the following recommendations, some of which address the safety of persons walking and cycling to and from project site and vicinity: The Planning Department suggests that the bicycle parking area be moved to a more accessible area. The site plans need to clearly show the show the parking stalls in the garage, location and number of proposed Class 1 and 2 bicycle parking spaces, and the sidewalk widths around the project site. 5. Noise. Eastern Neighborhoods PEIR Noise Mitigation Measure F-1: Construction Noise addresses requirements related to the use of pile-driving. The project sponsor has indicated that the project may involve pile driving. Noise Mitigation Measure F-1 would apply to the proposed project if the project construction would include pile driving. This mitigation measure prohibits the use of impact pile drivers wherever feasible and requires that contractors use pile driving equipment with state-of-the- 5 This document is available at: 5

7 art noise shielding and muffling devices. To reduce noise and vibration impacts, sonic or vibratory sheetpile drivers, rather than impact drivers, shall be used wherever sheetpiles are needed. Project sponsors shall also require that contractors schedule pile-driving activity for times of the day that would minimize disturbance to neighbors. Eastern Neighborhoods PEIR Noise Mitigation Measure F-2: Construction Noise requires that the project sponsor develop a set of site-specific noise attenuation measures under the supervision of a qualified acoustical consultant when the environmental review of a development project determines that construction noise controls are necessary due to the nature of planned construction practices and sensitivity of proximate uses. This mitigation measure requires that a plan for such measures be submitted to DBI prior to commencing construction to ensure that maximum feasible noise attenuation will be achieved. Eastern Neighborhoods PEIR Noise Mitigation Measure F-4: Siting of Noise-Sensitive Uses is intended to reduce potential conflicts between existing noise-generating uses and new sensitive receptors (i.e., residential). This measure would apply to the proposed project because the project includes a noisesensitive use. Noise Mitigation Measure F-4 requires that the project sponsor conduct a detailed analysis of noise reduction requirements for new development including noise-sensitive uses located along streets with noise levels above 60 dba (Ldn). The analysis must demonstrate with reasonable certainty that the California Noise Insulation Standards in Title 24 of the California Code of Regulations can be met. Eastern Neighborhoods PEIR Noise Mitigation Measure F-5: Siting of Noise-Generating Uses would apply to the proposed project because the project would propose commercial uses that could generate noise levels in excess of ambient noise in the project site vicinity. Finally, Eastern Neighborhoods PEIR Noise Mitigation Measure F-6: Open Space in Noisy Environments would apply to the proposed project because it includes new development of a noise-sensitive use. This mitigation measure requires that open space required under the Planning Code be protected from existing ambient noise levels. Implementation of this measure could involve, among other things, site design that uses the building itself to shield on-site open space from the greatest noise sources, construction of noise barriers between noise sources and open space, and appropriate use of both common and private open space in multi-family dwellings, and implementation would also be undertaken consistent with other principles or urban design. 6. Air Quality. The proposed project s 124 dwelling units does not exceed the Bay Area Air Quality Management District s (BAAQMD) construction screening levels for criteria air pollutants 6 and therefore, an analysis of the project s criteria air pollutant emissions is likely not required. In addition, project-related demolition, excavation, grading and other construction activities may cause wind-blown dust that could contribute particulate matter into the local atmosphere. To reduce construction dust impacts, the proposed project will be required to adhere to the dust control requirements set forth in the Construction Dust Ordinance contained in San Francisco Health Code 6 BAAQMD, CEQA Air Quality Guidelines, May 2011, Chapter 3. 6

8 Article 22B and San Francisco Building Code Section 106.A The proposed project is also required to prepare a Construction Dust Control Plan for review and approval by DPH. The project site is also located within an Air Pollutant Exposure Zone, as mapped and defined by Health Code, Article 38. The Air Pollutant Exposure Zone identifies areas with poor air quality based on modeling of air pollution, exposures, and health vulnerability from mobile, stationary, and area source emissions within San Francisco. The project proposes to construct new sensitive land uses (i.e., residential), which are subject to enhanced ventilation measures pursuant to Health Code Article 38. The project sponsor will be required to submit an Article 38 application to DPH prior to the issuance of any environmental determination. Please provide a copy of the Article 38 application with the EEA. 7 In addition, equipment exhaust measures during construction, such as those listed in Mitigation Eastern Neighborhoods PEIR Air Quality Measure G-1: Construction Air Quality will likely be required. If the project would generate new sources of toxic air contaminants including, but not limited to: diesel generators or boilers, or any other stationary sources, the project would result in toxic air contaminants that may affect both on-site and off-site sensitive receptors. Detailed information related to any proposed stationary sources must be provided with the EEA. Please provide detailed information related to any proposed stationary sources with the EEA. 7. Greenhouse Gases. The City and County of San Francisco s Strategies to Address Greenhouse Gas Emissions presents a comprehensive assessment of policies, programs, and ordinances that represents San Francisco s Qualified Greenhouse Gas (GHG) Reduction Strategy. Projects that are consistent with San Francisco s Qualified GHG Reduction Strategy would result in less-than-significant impacts from GHG emissions. In order to facilitate a determination of compliance with San Francisco s Qualified GHG Reduction Strategy, the Planning Department has prepared a Greenhouse Gas Analysis Compliance Checklist. 8 The project sponsor is required to submit the completed table regarding project compliance with the identified regulations and provide project-level details in the discussion column. This information will be reviewed by the environmental planner during the environmental review process to determine if the project would comply with San Francisco s Greenhouse Gas Reduction Strategy. Projects that do not comply with an ordinance or regulation may be determined to be inconsistent with the Greenhouse Gas Reduction Strategy. 8. Wind. The proposed project would involve construction of a building over 80 feet in height. The project will therefore require a consultant-prepared wind analysis, which may include wind tunnel analysis if needed. The consultant will be required to prepare a proposed scope of work for review and approval by the Environmental Planning coordinator prior to proceeding with the analysis. 9. Shadow. The proposed project would result in construction of a building over 40 feet in height. Planning Code Section 295 requires that a shadow analysis must be performed to determine whether a project has the potential to cast shadow on properties under the jurisdiction of the San Francisco Recreation and Park Commission. 9 project would not cast new shadow on any properties under the jurisdiction of the Recreation and Park Department, nor would it cast shadows on any other parks or open spaces (see attached). 10. Flood Notification. The project site is in a block that has the potential to flood during storms. The SFPUC will review the permit application to comment on the proposed application and the potential for flooding during wet weather. Applicants for building permits for either new construction, change of use, or change of occupancy, or for major alterations or enlargements must contact the SFPUC at the beginning of the process to determine whether the project would result in ground-level flooding during storms. Requirements may include provision of measures to ensure positive sewage flow, raised elevation of entryways, and/or special sidewalk construction and the provision of deep gutters. The side sewer connection permits for such projects need to be reviewed and approved by the SFPUC at the beginning of the review process for all permit applications submitted to the Planning Department, DBI, or the Successor Agency to the San Francisco Redevelopment Agency. For information required for the review of projects in flood-prone areas, the permit applicant shall refer to Bulletin No. 4: Geology. The project site is located within a Seismic Hazard Zone (Liquefaction Hazard Zone likely underlain by artificial fill). Any new construction on the site is therefore subject to a mandatory Interdepartmental Project Review. 9 A geotechnical study prepared by a qualified consultant must be submitted with the EEA. The study should address whether the site is subject to liquefaction, and should provide recommendations for any geotechnical concerns identified in the study. In general, compliance with the building codes would avoid the potential for significant impacts related to structural damage, ground subsidence, liquefaction, landslides, and surface settlement. To assist Planning Department staff in determining whether the project would result in environmental impacts related to geological hazards, it is recommended that you provide a copy of the geotechnical information with boring logs for the proposed project. This study will also help inform the Planning Department Archeologist of the project site s subsurface geological conditions. 12. Hazardous Materials. The proposed project would disturb in excess of 50 cubic yards of soil in an area with artificial fill and known prior industrial use. Therefore, the project is subject to Article 22A of the Health Code, also known as the Maher Ordinance. The Maher Ordinance, which is administered and overseen by the Department of Public Health (DPH), requires the project sponsor to retain the services of a qualified professional to prepare a Phase I Environmental Site Assessment (ESA) that meets the requirements of Health Code Section 22.A.6. The Phase I ESA would determine the potential for site contamination and level of exposure risk associated with the project. Based on that information, soil and/or groundwater sampling and analysis, as well as remediation of any site contamination, may be required. These steps are required to be completed prior to the issuance of any building permit. 10 oversight of projects subject to the ordinance would apply. Please refer to DPH s fee schedule, available at: Please provide a copy of the submitted Maher Application and Phase I ESA with the EEA. Eastern Neighborhoods EIR Hazardous Materials Mitigation Measure L-1: Hazardous Building Materials would be applicable to the proposed project. The mitigation measure requires that the project sponsor ensure that any equipment containing polychlorinated biphenyls (PCBs) or di(2-ethylhexyl) phthalate (DEPH), such as fluorescent light ballasts, and any fluorescent light tubes containing mercury be removed and properly disposed of in accordance with applicable federal, state, and local laws. In addition, any other hazardous materials identified, either before or during work, must be abated according to applicable federal, state, and local laws. Because the existing building was constructed prior to 1980, asbestos-containing materials, such as floor and wall coverings, may be found in the building. The Bay Area Air Quality Management District (BAAQMD) is responsible for regulating airborne pollutants including asbestos. Please contact BAAQMD for the requirements related to demolition of buildings with asbestos-containing materials. In addition, because of its age (constructed prior to 1978), lead paint may be found in the existing building. Please contact the San Francisco Department of Building Inspection (DBI) for requirements related to the demolition of buildings that may contain lead paint. 13. Tree Planting and Protection. The Department of Public Works Code Section requires disclosure and protection of landmark, significant, and street trees located on private and public property. Any such trees must be shown on the site plans with the size of the trunk diameter, tree height, and accurate canopy drip line. Please submit the Tree Planting and Protection Checklist with the EEA and ensure that trees are appropriately shown on site plans. Also see the comments below under Street Trees. 14. Disclosure Report for Developers of Major City Projects. The San Francisco Ethics Commission S.F. Camp. & Govt. Conduct Code et seq. requires developers to provide the public with information about donations that developers make to nonprofit organizations that may communicate with the City and County regarding major development projects. This report must be completed and filed by the developer of any major project. A major project is a real estate development project located in the City and County of San Francisco with estimated construction costs exceeding $1,000,000 where either: (1) The Planning Commission or any other local lead agency certifies an EIR for the project; or (2) The project relies on a program EIR and the Planning Department, Planning Commission, or any other local lead agency adopts any final environmental determination under CEQA. A final environmental determination includes: the issuance of a Community Plan Exemption (CPE); certification of a CPE/EIR; adoption of a CPE/Final Mitigated Negative Declaration; or a project approval by the Planning Commission that adopts CEQA Findings. (In instances where more than one of the preceding determinations occur, the filing requirement shall be triggered by the earliest such determination.) A major project does not include a residential development project with four or fewer dwelling units. The first (or initial) report must be filed within 30 days of the date the Planning Commission (or any other local lead agency) certifies the EIR for that project or, for a major project relying on a program EIR, within 30 days of the date that the Planning Department, Planning Commission, or any other local lead agency adopts a final environmental determination under 9

11 CEQA. Please submit a Disclosure Report for Developers of Major City Projects to the San Francisco Ethics Commission. This form can be found at the Planning Department or online at PLANNING DEPARTMENT APPROVALS: The project requires the following Planning Department approvals. These approvals may be reviewed in conjunction with the required environmental review, but may not be granted until after the required environmental review is completed. Note that the subject parcels are within the Central SoMa Plan area. The draft Plan was published in April The Central SoMa Plan process is anticipated to be completed by mid The proposals in the draft Plan are subject to change and are contingent upon the eventual approval by the Planning Commission and Board of Supervisors. 1. Rezoning. The project site is located within the Mixed-Use Residential (MUR) District. The proposed residential and commercial retail components of the proposed mixed-use project are permitted land uses under both the existing MUR zoning and the Draft Central SoMa zoning controls being considered for the subject site, Mixed-Use General (MUG). There is no maximum residential Floor Area Ratio (FAR) within either the MUR or MUG zoning districts; rather, the maximum building envelope and associated floor area is governed by the maximum height limit and setback requirements. The zoning concepts included in the Draft Central SoMa Plan indicate that a zoning reclassification from MUR to MUG is being considered for the site. The proposed uses are generally consistent with the zoning concepts outlined in the Central Corridor Draft Plan; however, please note that the specific property development standards associated with the Central SoMa Plan have not yet been established. 2. Height District. The project site is located partially within both the 45-X and 85-X Height and Bulk District. The height of the proposed project appears to adhere to the respective applicable Height and Bulk Districts (45-X/85-X). The zoning concepts published in the Draft Plan indicate that there is no change to the Height and Bulk District of the site. 3. Large Project Authorization from the Planning Commission is required per Planning Code Section 329 for the new construction of a building greater than 75 feet in height or greater than 25,000 gross square feet. As proposed, the project would be required to seek specific Planning Code modifications from the Planning Commission for the following provisions: a. Rear yard b. Open Space c. Dwelling unit exposure d. Off-street accessory parking 10

12 4. A Building Permit Application is required for the demolition of the existing buildings on the subject property. 5. A Building Permit Application is required for the proposed new construction on the subject property. Applications are available in the Planning Department lobby at 1650 Mission Street Suite 400, at the Planning Information Center at 1660 Mission Street, and online at Building Permit applications are available at the Department of Building Inspection at 1660 Mission Street. NEIGHBORHOOD NOTIFICATIONS AND PUBLIC OUTREACH: Project Sponsors are encouraged to conduct public outreach with the surrounding community and neighborhood groups early in the development process. Additionally, many approvals require a public hearing with an associated neighborhood notification. Differing levels of neighborhood notification are mandatory for some or all of the reviews and approvals listed above. This project is required to conduct a Pre-application meeting with surrounding neighbors and registered neighborhood groups before a development application may be filed with the Planning Department. The Pre-application packet, which includes instructions and template forms, is available at under the Permits & Zoning tab. All registered neighborhood group mailing lists are available online at under the Resource Center tab. PRELIMINARY PROJECT COMMENTS: The following comments address specific Planning Code and other general issues that may significantly impact the proposed project: 1. Existing Zoning/Height and Bulk. The subject property is located within the MUR Zoning District, which allows for residential above ground floor commercial retail uses. It is located within a 45-X and 85-X Height and Bulk District which allows for the project s proposed height and bulk. The zoning concepts published in the Draft Plan indicate that the height and bulk controls of the project site would remain the same. 2. Central SoMa Plan. The subject property falls within the ongoing Central SoMa Plan study area generally bounded by 2nd, 6th, Townsend and Market Streets. The Draft Plan, published in April 2013, will be evaluated in an Environmental Impact Report (EIR). The Draft Plan will propose changes to the allowed land uses and building heights, and will include a strategy for improving the public realm in this area. The EIR, the Draft Plan, and the proposed rezoning and affiliated Code changes are anticipated to be before decision-makers for approval in mid The Draft Plan includes recommendations for new land use zoning controls (from MUR to MUG); however, no change to the Height and Bulk controls for the subject property. The Draft Plan is available for download at Further comments in this section of the PPA are based on the Draft Plan concepts published to date. 11

13 3. Land Use. The Draft Plan recommends rezoning the subject property to the Mixed-Use General (MUG) zoning district, in which the proposed residential and retail uses would still be allowed. These uses are generally consistent with key objectives of the Draft Plan, which include providing support for substantial development in a transit-rich area. In order to create a diverse and dynamic 24-hour neighborhood characteristic of SoMa, the Draft Plan s preliminary land use principles envision a mixed-use neighborhood in which a diversity of residential development, especially below-market rate units, is balanced with office, retail, arts, entertainment, and industrial uses. The proposed ground floor retail with upper floors devoted to residential uses support this vision of a mixed-use neighborhood and are strongly encouraged. 4. Interim Moratorium on PDR Conversion. There is currently an interim zoning moratorium that prohibits the conversion or replacement of Production, Distribution, and Repair (PDR) uses in the proposed Central South of Market Plan Area bounded by Market Street on the north, Townsend Street on the south, 2 nd Street on the east, and 6 th Street on the west. As cited on the Preliminary Project Application Project Summary Table, the project proposes to replace 13,748 sf of existing PDR uses; therefore, currently the project would not be permitted. 5. Floor Area Ratio (FAR). While there is no maximum Floor Area Ratio (FAR) for the residential component of the project under either the existing or contemplated zoning, the MUR zoning district (under current Code) does establish a maximum floor area for retail as 25,000 sf per lot, above which a Conditional Use Authorization would be required. As proposed, the project s retail area of 3,000 sf would be permitted as-of-right within both the MUR and MUG zoning districts. The specific FAR controls of the Central SoMa Plan have not yet been established. Department staff will continue refining the proposal for the Plan and working with Project Sponsors to develop projects that would be compliant with the proposed FAR controls. 6. Eco-District. An Eco-District is a neighborhood or district where residents, community institutions, property owners, developers, and businesses join together with City leaders and utility providers to meet sustainability goals and co-develop innovative projects at a district or block-level. The Planning Department has identified the Central SoMa Plan area as a Type 2 Eco-District. All major new development in the Plan area will be expected to participate in the Eco-District program and the Sustainability Management Association set up to guide it. Please see for more information. 7. Large Project Authorization. Planning Code Section 329 outlines the requirements for a Large Project Authorization in Eastern Neighborhoods Mixed Use Zoning Districts. A Large Project Authorization is required of new building construction exceeding 75 feet in height or 25,000 gross square feet. All large projects within the Eastern Neighborhoods Area Plan are subject to review by the Planning Commission in an effort to achieve the objectives and policies of the General Plan, the applicable Design Guidelines and the Planning Code. To the extent possible, the project should be designed to minimize deviations and should strive to comply with all Planning Code requirements. As proposed, the project will be required to seek specific Code modifications from the Planning Commission, for the following provisions: 12

14 a. Rear Yard. Planning Code Section 134 requires a minimum rear yard setback of 25% of the lot depth to be provided at the lowest story containing a dwelling unit, and at each succeeding level or story of the building. As proposed, all residential floors of the project encroach into the required rear yard; therefore, the project does not comply. As such, the project would be required to seek and justify an exception from the Planning Commission as a component of the Large Project Authorization review process. As proposed, the courtyard is approximately 14% of the lot area, a major deviation. The Planning Department strongly recommends increasing the area of the courtyard to provide an equivalent amount to what would have been provided in a compliant rear yard which is consistent with the development plans of other large projects and would provide a courtyard space that is more appropriately scaled relative to the site and the adjacent structure. b. Open Space (Residential/Non-Residential). Planning Code Section 135 requires the project to provide 80 sf of open space for every dwelling unit (if non publically-accessible) and 54 sf of open space for every dwelling unit (if publically-accessible). Therefore, the minimum required open space amount for the residential component is either 9,840 sf if not publically accessible or 6,642 sf if publically accessible. Planning Code Section requires this project to provide 1 sf of open space for every 250 sf of retail space. With a total proposed retail floor area of 3,000 sf, 12 sf of open space is required. As proposed, the project provides only 9,589 sf of non-publically accessible open space which includes 3,275 sf at the Level 1 courtyard and 6,314 sf at the Level 5 roof deck. As such, the project would be required to seek and justify an exception from the Planning Commission as a component of the Large Project Authorization review process. Please be aware that while under the current Planning Code, the non-residential open space is not required to be open to the public, the Draft Central Corridor Plan proposes to require open space to be open to the public. As such, required non-residential open space should be preferably at-grade, easily accessible and visible to the public, and activated with adjacent uses, and at minimum should meet the design and access requirements of Planning Code Section 138. c. Dwelling Unit Exposure. Planning Code Section 140 outlines requirements for all dwelling units to face an open area. All dwelling units shall feature a window that directly faces a public street, public alley, or side yard at least 25 feet in width, or a Code-compliant rear yard. As proposed, it appears that a number of the proposed dwelling units (facing the narrower portion of the inner courtyard) do not meet the exposure requirements; therefore, the project would be required to seek an exception from the Planning Commission as a component of the Large Project Authorization review process. Please note that the Planning Department generally encourages that code-compliant exposure be provided for each dwelling unit. If an exposure modification is sought as part of the Large Project Authorization, the Planning Department generally encourages that the number of dwelling units seeking a modification be minimized. d. Off-Street Accessory Parking. Under current zoning (MUR) and the potential zoning under the Central Corridor planning process (MUG), no parking would be required. However, each of these zoning districts would have parking maximums, as listed in Planning Code Section

15 Within the MUR and MUG zoning districts, parking is limited to up to one parking space for every four dwelling units. Parking is permitted up to one car for each dwelling unit, only for those units that are at least 2-bedrooms and at least 1,000 sf in size, subject to Conditional Use Authorization (CU) and subject to the conditions and procedures of Planning Code Section 151.1(g) which includes space efficiency parking requirements. Up to one parking space for every 1,500 sf of retail is permitted. With 124 dwelling units and 3,000 sf of retail, the project is permitted up to 33 parking spaces (by-right). As proposed, with 39 parking spaces, the project exceeds the maximum by-right amount permitted; and therefore, the project would be required to seek and justify a modification from the Planning Commission as a component of the Large Project Authorization review process. Such a request would also be subject to parking space efficiency criteria listed in Planning Code Section 151.1(g). However, based on the existing and future transit accessibility of the site and the need to limit traffic volumes in the area, parking should be minimized on site. 8. Interdepartmental Project Review. The subject property falls within a seismic hazard zone. An Interdepartmental Project Review is required for all proposed new construction in seismic hazard zones. An application is available in the Planning Department lobby at 1650 Mission Street, Suite 400 or at the Planning Information Center (PIC) at 1660 Mission Street, and online at 9. Permitted Obstructions. Planning Code Section 136 establishes specific dimensional and glazing requirements for bay window projections in addition to a variety of other architectural features. As proposed, there is not sufficient detail provided to determine whether any such elements comply. Please ensure that the project plans provide adequate detail in order for staff to determine compliance. 10. Streetscape Plan. Pursuant to Planning Code Section 138.1, since the project is on a lot that is greater than one-half acre in total area, contains 250 feet of total lot frontage on one or more publiclyaccessible rights-of-way, and has a frontage that encompasses the entire block face between the nearest two intersections with publicly-accessible rights-of-way, and includes new construction, the project requires the submittal of a Streetscape Plan to the Planning Department to ensure that the new streetscape and pedestrian elements are in conformance with the Department s Better Street Plan. This Streetscape Plan shall be submitted to the Planning Department no later than 60 days prior to any Planning Commission action, and shall be considered for approval at the time of other project approval actions. The Streetscape Plan should show the location, design, and dimensions of all existing and proposed streetscape elements in the public right-of-way directly adjacent to the fronting property, including street trees, sidewalk landscaping, street lighting, site furnishings, utilities, driveways, and curb lines, and the relation of such elements to proposed new construction and site work on the property. Please see the Department s Better Street Plan and Section 138.1(c)(2)(ii) for the additional elements that may be required as part of the project s streetscape plan. 11. Vision Zero Program. The project is located on a 'high-injury corridor', identified through the City s Vision Zero Program. The Sponsor is encouraged to incorporate pedestrian and bicycle safety streetscape measures into the project. The required streetscape plan will be subject to review by the Streetscape Design Advisory Team within the Planning Department. 14

16 12. Bird Safety. Planning Code Section 139 outlines the standards for new construction to reduce bird mortality and bird hazards. Please refer to these standards to ensure compliance with the Standards for Bird-Safe Buildings. 13. Rooftop Screening. Planning Code Section 141 establishes specific rooftop screening requirements. As proposed, there is not sufficient detail provided to determine whether the project meets the rooftop screening requirements. Please ensure that the project plans submitted with the Large Project Authorization application provide adequate detail in order for staff to determine compliance. 14. Parking Screening. Planning Code Section 142 requires parking areas to be screened from view from the public right-of-way. As proposed, there is not sufficient detail provided to determine whether the project meets the parking screening requirements. Please ensure that the project plans submitted with the Large Project Authorization application provide adequate detail in order for staff to determine compliance. 15. Street Frontage. As new construction located within an Eastern Neighborhoods Mixed Use District, the proposed project would be subject to the requirements for street frontage as outlined in Planning Code Section 145.1, including the requirements for active uses, ground floor ceiling heights, transparency and fenestration, among others. As proposed, there is not sufficient detail provided to determine whether the project meets the parking screening requirements. Please ensure that the project plans submitted with the Large Project Authorization application provide adequate detail in order for staff to determine compliance. 16. Off-Street Loading. Planning Code Section requires a minimum of one off-street loading space that meets minimum dimensional requirements for a total gross floor area between 100, ,000 square feet. As proposed, there is not sufficient dimensional detail provided to determine whether the project complies. Please ensure that the project plans provide adequate detail in order for staff to determine compliance. 17. Bicycle Parking. Planning Code Section provides requirements for bicycle parking and associated facilities (i.e. showers and lockers) in new development. Based on the proposed areas which includes 124 dwelling units and 3,000 sf of retail, the proposed project is required to provide a minimum of 124 Class I bicycle parking spaces and 8 Class II bicycle parking spaces. As proposed, there is not sufficient detail provided to determine whether the project meets the bicycle parking requirements. Please ensure that the project plans submitted with the Large Project Authorization application provide adequate detail in order for staff to determine compliance. Generally, Code complying bicycle parking should be provided. 18. Car Share. Planning Code Section 166 requires 1 car share space for projects containing between 50 to 200 dwelling units. As proposed, with 124 dwelling units the project would be required to provide one car share space. As proposed, there is not sufficient detail provided to determine whether the project meets the car share requirement. Please ensure that the project plans submitted with the Large Project Authorization application provide adequate detail in order for staff to determine compliance. 15

17 19. Unbundled Parking. Pursuant to Planning Code Section 167, all off-street parking spaces accessory to residential uses in new structures of 10 dwelling units or more shall be leased or sold separately from the rental or purchase fees for dwelling units for the life of the dwelling units, such that potential renters or buyers have the option of renting or buying a residential unit at a price lower than would be the case if there were a single price for both the residential units and the parking space. 20. Additional Height Limits for Narrow Streets in the Eastern Neighborhoods Mixed Use Districts. The street along the property s northern boundary, Shipley Street, is 35 feet wide and therefore considered a narrow street per Planning Code Section Pursuant to Planning Code Section 261.1, a building (for only that portion more than 60 feet from the corner) on the southern side of an east-west narrow street within an Eastern Neighborhood Mixed Use District must not encroach into a 45 degree sun access plane extending from the most directly opposite northerly property line. As proposed (as depicted on the building section on Sheet KH), no portion of the building encroaches into the required 45 degree sun access plane; therefore, the project complies. 21. Shadow Analysis. For purposes of Planning Code Section 295, based upon the preliminary analysis and submitted materials, the project does not appear to have potential shadow impacts on nearby property owned by the San Francisco Recreation and Park Department; however additional analysis will be confirmed during the environmental review. Pursuant to Planning Code Section 147, new buildings in the Eastern Neighborhoods Mixed Use District whose building height exceeds 50 feet shall be shaped, consistent with the dictates of good design and without unduly restricting the development potential of the site in question, to reduce substantial shadow impacts on public plazas and other publicly accessible spaces other than those protected under Planning Code Section Transit Impact Development Fee. Pursuant to Planning Code Section 411 et seq., the Transit Impact Development Fee will apply to the retail component of this project. Please be aware that an ongoing process the Transportation Sustainability Program may eventually replace the Transit Impact Development Fee. You can find more information about this program here: Affordable Housing. Pursuant to Planning Code Section 415, any housing project which consists of ten or more dwelling units shall satisfy the Inclusionary Housing Program requirements outlined in Planning Code Section 415.3(b), Table Table provides alternatives which include payment of a 20% fee, providing 12% (of the total # of units) on-site as affordable, or 20% (of the total # of units) off-site as affordable; however, pursuant to Planning Code Section A, any project subject to Section 415 et seq. in excess of 45 feet in height within the Youth and Family Zone Special Use District shall be subject to the Tier C affordable housing requirements of Sections 419 et seq. Tier C requires 17.6 percent of the total units constructed shall be affordable to and occupied by qualifying persons and families. Please see Planning Code Section 415 for further Inclusionary Housing Program Code requirements which may also include submission of an Affidavit of Compliance to the Planning Department depending on the alternative sought. Any on-site affordable dwelling-units proposed as part of the project must be designated as owner-occupied units, not rental units. Affordable units 16

18 designated as on-site units shall be sold as ownership units and will remain as ownership units for the life of the project. For your information, if a project proposes rental units, it may be eligible for an On-site Alternative to the Affordable Housing Fee if it has demonstrated to the Planning Department that the affordable units are either: 1) ownership only or 2) not subject to the Costa Hawkins Rental Housing Act (a Costa Hawkins exception). Affordable units are not subject to the Costa Hawkins Rental Housing Act under the exception provided in Civil Code Sections through one of the following methods: a. Direct financial construction from a public entity b. Development bonus or other form of public assistance A Costa Hawkins exception agreement is drafted by the City Attorney. You must state in your submittal how the project qualifies for a Costa Hawkins exception. The request should be addressed to the Director of Current Planning. If the project is deemed eligible, we may start working with the City Attorney on the agreement. 24. Eastern Neighborhoods Impact Fees. Pursuant to Planning Code Section 423, the Eastern Neighborhoods Impact Fee applies to the Project. Impact fees shall be assessed per net new gross square footage on residential and non-residential uses within the Plan Area. Impact fees shall be assessed on mixed-use projects according to the gross square feet of each use in the project. Please note that the Eastern Neighborhoods Fee Tier applicable to this project will be revised upon any rezoning of the property to increase height limits, density allowances, or allowed uses, such as would be necessary for the proposed project to proceed. The Central Corridor Plan as envisioned will maintain the Eastern Neighborhoods Impact Fee structure and add, as necessary, one or more additional higher fee Tiers, reflective of the greater heights and densities envisioned in the Central Corridor Plan. The Eastern Neighborhoods Impact Fee shall be paid before the City issues a first construction document, with an option for the project sponsor to defer payment to prior to issuance of the first Certificate of Occupancy upon agreeing to pay a deferral surcharge in accordance with Section 107A.13.3 of the San Francisco Building Code. Option for In-Kind Provision of Community Improvements and Fee Credits. Project sponsors may propose to directly provide community improvements to the City. In such a case, the City may enter into an In-Kind Improvements Agreement with the sponsor and issue a fee waiver for the Eastern Neighborhoods Impact Fee from the Planning Commission. This process is further explained in Section 412.3(d) of the Planning Code. Other programs that are being considered as part of the Central Soma Plan include Eco-Districts. An Ecodistrict is a neighborhood or district where residents, community institutions, property owners, developers, and businesses join together with city leaders and utility providers to meet sustainability goals beneficial to the stakeholders, the district, and the City by formulating a portfolio of innovative 18

20 projects at a district or block-level. The Planning Department has identified the Central SoMa Plan area as a Type 2 Eco-District an area composed of many smaller parcels and property owners. Benefits to the district include greater resilience, economic prosperity, higher quality built environment, and community cohesion and capacity. The volunteer Central SoMa Task Force produced a set of Recommendations in November of 2013 ( All major new development in the Central Corridor Area Plan area will be expected to participate in some capacity in the Eco-District program and the Sustainability Management Association set up to guide it once the program is formulated in parallel with the Area Plan process. For more information please see: Affordable housing requirements may also be increased as part of the Central Soma Planning effort. For more information, please see the Central SoMa Memo entitled Potential Public Benefits ( PRELIMINARY DESIGN COMMENTS: The project is located in the Central SoMa Area Plan currently in progress. The existing context includes primarily two to four story industrial and residential buildings with retail at the base. The architectural character is mixed with a predominance of masonry structures. The following comments address preliminary design issues that may significantly impact the proposed project: 1. Site Design, Open Space, and Massing. The Planning Department supports the project massing and open spaces as shown. 2. Street Frontage. The Planning Department recommends providing a visual or spatial connection from the 5th Street entry to the rear yard. Office uses are also not considered an active use in the Central SoMa Area Plan. The residential entries should be individual to encourage more interaction with the public realm. Please review the Department s Ground Floor Residential Guidelines for examples of raised entries and landscape buffers that promote active use at the street level. Please provide a 12 maximum driveway width. Per Planning Code Section 138.1, the project sponsor will be required to submit a Streetscape Plan illustrating the location and design of streetscape improvements appropriate to the street type, including site furnishings, landscaping, corner curb extensions, and sidewalk widening as appropriate. The Planning Department may require these elements as part of conditions of approval. See to identify relevant street types for the project frontage. 3. Retention of PDR Space. The Planning Department encourages the retention of PDR use in its current location. 19

As the project is diagrammatic, the Planning Department has little comment on the architecture at this time but recommends that the project should express significant façade depth and high-quality materials and be compatible with the architectural detailing and character of the neighborhood. PRELIMINARY PROJECT ASSESSMENT EXPIRATION: This Preliminary Project Assessment is valid for a period of 18 months. An Environmental Evaluation, as listed above, must be submitted no later than July 19, Otherwise, this determination is considered expired and a new Preliminary Project Assessment is required. 23 INTERDEPARTMENTAL PROJECT REVIEW Effective: February 1, 2009 Interdepartmental Project Reviews are mandatory for new construction projects that propose buildings eight stories or more and new construction on parcels identified by the State of California Department of Conservation, Division of Mines and Geology as Seismic Hazard Zones in the City and County of San Francisco. Projects identified as such, must request and participate in an interdepartmental project review prior to any application that requires a public hearing before the Planning Commission or new construction building permit. Project Sponsors may elect to request an interdepartmental review for any project at any time, however, it is strongly recommended that the request is made prior to the submittal of the abovereferenced applications. The Planning Department acts as the lead agency in collaboration with the Department of Building Inspection (DBI); the Department of Public Works (DPW); and the San Francisco Fire Department (SFFD). Staff from each of these disciplines will attend your meeting. Interdepartmental Project Review fees: 1. $1,059 for five or fewer residential units and all affordable housing projects. 2. $1,530 for all other projects. Please note that $345 of these fees are non refundable. If your project falls under the second type of fee, and you cancel your meeting, $1,185 will be refunded to you. To avoid delays in scheduling your meeting, provide all information requested on this form and submit your request with a check in the appropriate amount payable to the San Francisco Planning Department. 27 PLANNING BULLETIN DATE: TITLE: April 1, 2007 (V1.3) Review of Projects in Identified Areas Prone to Flooding PURPOSE: This bulletin alerts project sponsors to City and County review procedures and requirements for certain properties where flooding may occur. BACKGROUND: Development in the City and County of San Francisco must account for flooding potential. Areas located on fill or bay mud can subside to a point at which the sewers do not drain freely during a storm (and sometimes during dry weather) and there can be backups or flooding near these streets and sewers. The attached graphic illustrates areas in the City prone to flooding, especially where ground stories are located below an elevation of 0.0 City Datum or, more importantly, below the hydraulic grade line or water level of the sewer. The City is implementing a review process to avoid flooding problems caused by the relative elevation of the structure to the hydraulic grade line in the sewers. PERMIT APPLICATION PROCESS: Applicants for building permits for either new construction, change of use (Planning) or change of occupancy (Building Inspection), or for major alterations or enlargements shall be referred to the San Francisco Public Utilities Commission (SFPUC) at the beginning of the process, for a review to determine whether the project would result in ground level flooding during storms. The side sewer connection permits for such projects need to be reviewed and approved by the PUC at the beginning of the review process for all permit applications submitted to the Planning Department, the Department of Building Inspection, or the Redevelopment Agency. The SFPUC and/or its delegate (SFDPW, Hydraulics Section) will review the permit application and comment on the proposed application and the potential for flooding during wet weather. The SFPUC will receive and return the application within a two-week period from date of receipt. The permit applicant shall refer to PUC requirements for information required for the review of projects in flood prone areas. Requirements may include provision of a pump station for the sewage flow, raised elevation of entryways, and/or special sidewalk construction and the provision of deep gutters.
