1 HAMPTON CEMETERY RULES, REGULATIONS & RATES The Hampton Cemetery is owned and operated by the City of Hampton, Iowa. The management of the Hampton Cemetery shall be vested in the City Manager. The Hampton City Council, in order to insure an attractive cemetery, shall establish and enforce rule regulating the Hampton Cemetery. The rules shall conform with the rules in force in other modern cemeteries in the United States. General Rules 1. The Hampton Cemetery shall be open from 8:00 a.m. until sunset. Visitors must respect all property and grounds in the Hampton Cemetery. The Sexton has the right to request removal and deny admission to anyone who violates the rules established by the City of Hampton. 2. All children visiting the Hampton Cemetery are to be accompanied by an adult. 3. Pets are not allowed on the grounds in the Hampton Cemetery. 4. Bicycles, motorcycles, snowmobiles, and all-terrain vehicles and horses are prohibited in the Hampton Cemetery. 5. Flowers, live or artificial, may be removed at anytime by the Sexton or any employee of the Hampton Cemetery, if the flowers do not look fresh or in such condition that they hinder mowing and trimming. Only one container of flowers may be used for each lot, except for Memorial Day or special dates (anniversaries or birthdays), with special permission of the Sexton. 6. Glass flower containers are prohibited. If found, glass containers and flowers will be removed immediately. 7. All flowers, wreaths, sprays, bouquets, and other grave decorations placed on the mowing area must be removed within two weeks after Memorial Day. Cemetery Care 1. The City of Hampton has charge of the grounds of the Hampton Cemetery and is responsible for keeping the grounds in order. The Sexton shall direct all work to make the Hampton Cemetery attractive and beautiful. 2. The Sexton shall supervise the Hampton Cemetery under the direction of the City Manager. All work performed in the Hampton Cemetery shall be done under the supervision of the Sexton. Cemetery Lot, Burial & Setting Rates 1. Persons desiring to purchase a burial lot in the Hampton Cemetery shall contact the Sexton at the Hampton Cemetery. 2. The City of Hampton shall establish the selling price of burial lots. 3. All burial lots shall be sold at a price that shall include perpetual care. 4. All burial lots shall be paid for in full at the time of purchase. Burial will not be permitted on any burial lot until the purchase of the lot is paid in full.

Persons purchasing a burial lot in the Hampton Cemetery shall have the ground deeded to them and their heirs forever for use as the burial place of such person(s) the purchasers choose to admit. 6. The City Manager will prepare a deed for the purchaser of a cemetery lot, after the Cemetery Sexton has provided a description of the property, and the purchase price is paid in full. 7. The transfer of deed to any burial lot or part of a burial lot shall not be allowed, except through the legal transfer of property, approved by the City of Hampton. The consideration for the transfer of such burial lot(s) shall not exceed the original purchase price. The City of Hampton shall not be obligated to purchase any burial lot, but may do so at its discretion. 8. No transfer of burial lots is valid until entered into the records of the City of Hampton, and no transfer of a lot by a lot owner, without the consent of the City of Hampton, will be recognized. 9. Disinterment will be permitted only after the payment of a special fee, determined by the City of Hampton. The disinterment must conform to the laws of the State of Iowa. 10. Cemetery Pricing and Fee Schedule: One Standard Burial Space $ One Infant Burial Space $ Grave Opening/Closing Standard Weekday $ Grave Opening/Closing Infant Weekday $ Grave Opening/Closing Cremation Weekday $ Grave Opening/Closing Standard Saturday $ Grave Opening/Closing Infant Saturday $ Grave Opening/Closing Cremation Saturday $ Additional Fees: Burials beyond time restrictions (See Interments regulations) $300.00/Hour Memorial Setting Fee $ Perpetual Care A Perpetual Care Trust Fund has been established for the permanent maintenance and care of the Hampton Cemetery. Twenty percent (20%) of the purchase price of each lot sold shall be placed in this fund. The interest from this fund shall be expended for mowing the grounds, filling and reseeding the lots, maintenance of lots, paths, fences, building, equipment and for maintenance of the records of the Hampton Cemetery. Lot Improvement 1. No ground in the Hampton Cemetery shall be sold until it has been surveyed, platted and approved by the City of Hampton. 2. The City of Hampton reserves the right to itself and to those lawfully entitled thereto, perpetual right of ingress and egress over all lots.
3 3. The City of Hampton reserves the right to take over parts of lots for the purpose of grading or relocating roads, walks, pipelines, gutters, sprinkler systems and drainage. If parts of lots are taken, adjustment shall be made with the owner of the lot, as the City of Hampton deems proper. 4. Burial lots shall remain at the grade established by the City of Hampton. Terraces, curbs, steps, walls, fences, hedges or flowerbeds are not permitted on or around any burial lot. The landscaping of sections or blocks shall be determined by the City of Hampton, whose master landscape plan shall govern all plantings. 5. Should any trees or shrubs situated on any burial lot become detrimental to adjacent burial lots or alleyways, unsightly or inconvenient to passengers of cemetery staff or equipment, it shall be the duty of the City of Hampton to order removal of such trees or shrubs. 6. The City of Hampton shall have right to enter on any burial lot and put the burial lot in proper order or repair. The City of Hampton has the right to perform this work without notice to the burial lot owner. 7. If any monument or structure or any inscription or any other thing placed in or upon any burial lot is determined to be offensive or improper or injurious to the appearance of the Hampton Cemetery, the City of Hampton shall have the right and duty to remove the object. Interments 1. No interment shall be allowed in the Hampton Cemetery without the proper and timely notification of Cemetery Staff and interment fee payment is provided in advance. 2. The Sexton has the right to deny the interment, if payment is not made in full prior to the time the funeral director leaves the Hampton Cemetery. 3. All burials must be made in vaults of water-sealed cement, approved steel, or sectioned vaults of approved concrete. 4. No grave shall be opened without at least forty-eight (48) hours advanced notice to Cemetery Staff. The City of Hampton shall confirm as soon as possible with the funeral director that the message to open a grave has been received. It is recommended that a representative of the funeral home or the family come to the Hampton Cemetery and show the Sexton which grave space to open. In the event of need for clarification, the Sexton may require this. 5. Interment Hours and Additional Fees: All interments shall be held between 8:00 a.m. and 3:00 p.m., Monday through Friday, and between 9:00 a.m. and 12:00 noon on Saturdays. It is requested that those involved with interments enter the Hampton Cemetery prior to 11:00 a.m. on Saturdays. Burials extending beyond above stated hours will be subject to an additional fee of $ for each hour beyond the routine hours (no fractioning of hour for fee calculation); minimum charge of $ Sunday burials are prohibited. 6. The City of Hampton will allow a Saturday afternoon interment only in the event of a holiday weekend, when the following holidays occur on the subsequent Monday: Memorial Day, Fourth of July, Labor Day and Christmas. Such burials must conclude by 3:00 p.m., or additional fees will apply.
4 7. All graves must be opened and closed by employees of the Hampton Cemetery; and the graves shall be opened in accordance with the laws of the State of Iowa. The Sexton must be present on the grounds during all committal services. The Sexton must stay on the grounds until the grave is filled. Anyone opening or closing a grave in the Hampton Cemetery, who is not an authorized Cemetery employee, shall be subject to the same fees assessed for work performed by Hampton Cemetery employees. There will be no exceptions. 8. All committal services and processions while in the cemetery shall be under the supervision of the Sexton. 9. No firearms shall be allowed on the grounds of the Hampton Cemetery, except those authorized for military funerals or Memorial Day services. Foundations and Monuments 1. Soliciting work in the Hampton Cemetery is prohibited. 2. Approved monument companies that guarantee their work shall perform all memorial work in the Hampton Cemetery. 3. The Sexton shall be informed in advance of any memorial work done in the Hampton Cemetery, by presenting for Sexton approval a completed Memorial Setting Authorization form, and the required $50.00 setting fee. 4. No work installing or repairing foundations of monuments may be done on Sundays. 5. No memorial shall be placed on any burial lot until the burial lot has been fully paid for and deed has been issued by the City of Hampton. 6. Memorials shall be of approved granite, marble or bronze material and must conform with the surrounding memorials. 7. Any special feature memorial markers must have the approval of the City of Hampton in advance of purchase and erection of a memorial on any lot in the Hampton Cemetery. 8. In North Lawn Section, only one family memorial shall be allowed per lot on such lots as plans designate. 9. It is the duty of the Sexton to see that all memorial foundations are placed correctly and durably. All memorial foundations shall have not less than a four (4) inch flange of cement bordering the memorial. This shall include resetting of existing memorials. 10. Setting new memorials in wet cement is prohibited. 11. Persons erecting monuments or other structures are prohibited from attaching ropes to trees, shrubs, or monuments without permission from the Sexton. 12. The Sexton has the power to deny admission to the Hampton Cemetery to any person, who does not obey all the rules of the Hampton Cemetery. Private Mausoleums 1. Private mausoleums may be erected on special feature burial lots or combination of burial lots with permission of the City of Hampton. 2. Private mausoleums shall not cover more than twenty (20) percent of the burial lot area.
5 3. Permission shall not be granted to erect a private mausoleum until plans and specifications for proposed mausoleum have been submitted to the City of Hampton for consideration and approval. The City of Hampton shall then secure the opinion of a competent architect and engineer as to design, durability, expense of upkeep and other related matters. 4. Each private mausoleum shall be insured by a special perpetual care fund, making sufficient money available to pay for all future upkeep and maintenance of the mausoleum. 5. The special perpetual care fund shall pay for regular opening, airing, sweeping and dusting of the private mausoleum. 6. The special perpetual care fund must provide a sufficient amount of money to permit an accumulation of enough additional money to enable the City of Hampton to replace the private mausoleum, due to deterioration.
