3 INTRODUCTION This report has been prepared with respect to the submissions received during the Draft Gibbstown Local Area Plan public consultation period and in accordance with Section 20(3)(c) of the Planning and Development Acts The purpose of this report is to: List the persons who made submissions or observations on the Draft LAP. Summarise the issues raised by the persons in the submissions or observations. Set out the opinion of the manager in relation to the issues raised, and his recommendations in relation to the proposed LAP, taking account of the proper planning and sustainable development of the area, the statutory obligations of the local authority and the relevant policies or objectives for the time being of the Government or any Minister of the Government. This report will be formally submitted to the Council for consideration at the County Council meeting held on the 28th of April Draft LAP Public Consultation As part of the public consultation process, the Draft Gibbstown LAP was placed on public display from the 2 nd of March to the 19 th of April A notice was placed in the Meath Chronicle on the 28 th of February 2009 stating that the Draft LAP would be available for inspection during this period at the following locations: Planning Department, Abbey Mall, Abbey Road, Navan Meath County Library / Navan Branch Library, Railway Street, Navan Kells Town Council and Area Office, Kells Kells Branch Library, Castle St, Kells Gibbstown Library, Gibbstown This notice also invited interested parties to make a submission on the Draft LAP before 3.30pm on the 13 th of April 2009 and that any submission made prior to this deadline would be taken into consideration by the Council before making the Local Area Plan. A total of 9 no. submissions were made. In addition, this report also identifies miscellaneous modifications and updates to the Draft LAP as appropriate. Next Steps Following the distribution of this report to the Elected Members, the Elected Members have a 6 week period to consider the Manager s Report and decide whether to make the Local Area Plan with or without modifications or not to make the Plan (28th of April to the 9th of June). The Draft shall be deemed to be made, amended or revoked in accordance with the Manager s Report, unless within a period of 6 weeks of the report, the members resolve to further make, amend or revoke the plan. Where the members resolve to further make material amendments to the Draft Plan, the Planning Authority shall publish details of the amendments not later than 3 weeks from making that decision. Amendments are placed on public display for a period of 4 weeks. Not later than 8 weeks from the publication of the amendments the Manager shall prepare a report on the submissions received and submit same to the Elected Members for their consideration. 3
4 The Members then have a further 6 weeks to consider this report and after consideration resolve to make, amend or revoke the plan. The formal making of the Local Area Plan is done by resolution of the Council. During the entire planmaking process, the Elected Members are restricted to considering the proper planning and sustainable development of the area. They must also take into account statutory obligations and any relevant Government policies and objectives in force. 4

6 RESPONSES AND RECOMMENDATIONS WITH RESPECT TO SUBMISSIONS RECEIVED AS A RESULT OF THE DISPLAY OF THE DRAFT GIBSTOWN LOCAL AREA PLAN This section refers to the submissions which were received during the display period of the Draft Gibbstown Local Area Plan All submissions received were allocated a reference number and are summarized below with respect to same. In addition, the Managers Response to individual submissions is included here. 001 Teresa Halloran, Development Applications Unit, Department of the Environment, Heritage and Local Government, Dún Scéine, Harcourt Lane, Dublin 2 This submission was made in response to the Strategic Environmental Screening Report forwarded to the DoEHLG. The submission notes that the River Blackwater (a csac/natura 2000 Site) is situated 2km south of Gibbstown and could be impacted by discharges / abstraction from same. In this regard it is submitted that the plan should be screened for Appropriate Assessment. It is submitted that cumulative impacts in combination with other proposed developments or land use plans within or outside the Local Authority area should also be examined. It is stated that impacts on archaeological heritage arising from the LAP can be dealt with in the normal planning process and the decision to carry out an SEA is for the local Authority. It is noted that a new local area plan could have a significant effect on the architectural heritage of the locality and the opportunity to consolidate the built form of the village and reinforce their individual sense of place and identity within the county at large. It is noted that the term architectural heritage includes structures and buildings together with their settings and attendant grounds, fixtures and fittings, groups of such structures and buildings and sites which are of architectural, historical, archaeological, artistic, cultural, scientific, social or technical interest. The term architectural heritage should not be confined to protected structures and architectural conservation areas. Reference is made to the DoEHLG Guidance on Architectural Heritage Protection. It is submitted that new development should enhance the local environment, and in doing so contribute to creating a place of distinction. It is stated that an architectural framework should be developed in this regard. It is recommended that the LAP make use of existing features of build heritage merit in the locality to engender an evolving new identity as a familiar and recogniseable place to trade and reside. It is noted that the LAP affords an opportunity to identify additional structures of architectural merit which may or my not be included on the record of protected structures but should nevertheless be identified for their valuable contribution to the village. The Department notes that it will be pleased to advise on the contents of the Scoping Report should the Local Authority decide to undertake a Strategic Environmental Assessment of the Gibbstown LAP. Managers Response An Appropriate Assessment Screening Report of the Draft Gibbstown LAP has been undertaken and forwarded to the relevant authorities. The DoEHLG has confirmed that an Appropriate Assessment is not necessary for said the Gibbstown LAP. A decision not to carry out a Strategic Environmental Assessment of the Gibbstown LAP has been made. The Gibbstown LAP recognizes the importance of the villages architectural heritage and seeks to protect and enhance same through the implementation of its policies and objectives and the identification of an indicative masterplan. 7 002 Seána McGrearty, Coordination Unit, Department of Communications, Energy and Natural Resources, Elm House, Earlsvale Road, Co. Cavan This submission was made in response to the Strategic Environmental Screening Report forwarded to the DCENR. In this regard it was noted: With respect to the protection of water quality and fishery status of the receiving waters, the status objectives set out in the Water Framework Directive should not be compromised as a result of the LAP Any development proposed on foot of this LAP shall be considered premature until suitable sanitary services infrastructure (incl. treatment plant capacity) is in place to take and treat satisfactorily the anticipated increased loading (both organic and hydraulic) that are expected as a result of the population increases projected in the LAP Manager s Response The Gibbstown LAP states that the long term development of new housing in Gibbstown will be contingent upon the augmentation of the existing water supply. The proposed additional households will be provided for by the completion of the Athboy Sewerage Scheme in No Change 003 Michael Owens, Environmental Protection Agency, Regional Inspectorate, Inniscarra, County Cork This submission was made in response to the Strategic Environmental Screening Report forwarded to the EPA. The submissions made by the EPA with respect to the Gibbstown SEA Screening report are as follows: Provisions should be made in the Plans for the incorporation of the specific objectives and measures set out in Draft Eastern River Basin District (RBD) River Basin Management Plan The Plan should implement and include, as appropriate, the relevant recommendations set out in The Provision and Quality of Drinking Water in Ireland A report for the Years It is noted that the Navan and Mid Meath Public Water Supply is currently on the EPA s Remedial Action List This Plan should ensure the supply of safe drinking water in the Plan area Specific policies and objectives regarding the provision of adequate and appropriate wastewater treatment to service lands should be included within the Plan Water conservation measures should be included within the Plan The Plan should include a clear policy and objective for the protection of groundwater resources and associated habitats and species Consideration should be given to policies and objectives regarding the enforcement of Planning Conditions related to installation, operation and maintenance of septic tank systems and the connection of all dwellings within the Plan area to a wastewater treatment plant when available Appropriate zoning of lands and restriction of use should apply in areas liable to flooding Provisions should be made for Climate Change and the likely increased risk of flooding arising from predicted changes in weather The Plan should provide for protection, management and as appropriate enhancement of existing wetland habitats where flood protection/management measures such as arterial drainage works are necessary Measures to promote the use of adequate and appropriate Sustainable Urban Drainage Systems should be included within the Plan Where zoning/rezoning lands the adequacy of existing water supply/wastewater treatment facilities should be assessed The Plan should contain a clear policy to protect non-designated habitats, species and local biodiversity features including rivers, hedgerows, individual trees, streams and grassland etc. The Plan should provide for the enhancement of local features of biodiversity value where opportunities arise Infill development should be encouraged over the development of greenfield sites 7
8 The Plan should provide for promotion, where appropriate, of the use of renewable energy systems (e.g. solar, wind, geothermal etc.) within the Plan area and energy conservation within buildings The Plan should provide for sustainable modes of transport All water services authorities wastewater discharges, including surface (or storm) water discharges will be subject to new regulations Zoning for development should be linked to availability of waste water infrastructure and capacity Opportunities for waste prevention should be maximised Manager s Response The Meath County Development Plan provides for the implementation of the Water Quality Management Plans which would include the Draft Eastern River Basin District (RBD) River Basin Management Plan. The MCDP sets the policy context for the Gibbstown LAP. The Draft LAP contains a policy which seeks to facilitate the provision of adequate water supply to Gibbstown. It is a policy of the Draft LAP to provide an adequate waste water collection and treatment facility to provide for the existing and future population of the village. The Draft LAP contains a policy which seeks to connect dwellings operating on septic tanks systems to a public sewerage scheme. New development shall be contingent upon connection to same. It is a policy of the Draft LAP to encourage water conservation measures which reduce demand on existing water supplies. Lands liable to flooding have not been zoned for development in the Draft LAP. The Draft LAP contains policies which promote the use of permeable surfaces where hard landscaping is proposed on the ground plane and the development of attenuation cells for the collection, attenuation and treatment of surface water run-off within new developments. The Draft LAP is cognisant of water supply and waste water treatment constraints and reflects same where zoning/rezoning is proposed. The Draft LAP includes policies for the protection of mature trees and hedgerows that make a significant contribution to the landscape setting of Gibbstown. The Plan proposes that development would occur in logical phases in accordance with Variation No. 2 of the County Development Plan. As such, village centre consolidation would occur in the first instance. No change 004 Shirley Kearney, Higher Executive Officer, Forward Planning Section, Department of Education and Science This submission was made with respect to Draft Local Area Plans for Gibbstown and Gibbstown. It is noted that there is one primary school in Gibbstown, with a current enrolement of 95 pupils. It is stated that the criteria identified by the Department should be used to calculate any additional educational requirements in Gibbstown. Manager s Response Community, recreation and education zoned lands in excess of those required to cater for the potential expansion of the primary school in Gibbstown has been identified to reflect the methodology used by the Department to calculate the extent of lands required. 9 005 Tomás Ó Maonaile & Michael Munnelly This submission was made with respect to lands east of Scoil Ultain Naofa and south of the main road and in the ownership of Tomás Ó Maonaile and Michael Munnelly. It is stated that: There is a current valid planning permission on these lands and development is at an advanced stage. This development was impeded by an enforcement order issued by the Planning Authority and subsequently declared void by the High Court. It is intended to make further planning applications for these lands and it is of importance that the Order of Priority does not adversely affect these applications. A development known as Brúgh na Mí has been designed and built using low energy building concepts and approved for grants under the Sustainability Energy Ireland (SEA) house of Tomorrow scheme. Part of the lands is suitable for a sewerage treatment plant. An underground cast iron pipeline formerly used to pump water from the river Blackwater to Belsaw hill for gravity feed to the Gibbstown estate is still intact and could be used as a conduit to run a polypropylene pipe to take treated waste water from a new sewerage treatment plant to the river Blackwater. It is submitted that these lands should be prioritized for development to reflect the above. Manager s Response The development of low energy housing is welcomed. It is an objective of the Draft LAP to investigate the feasibility of providing a waste water treatment plant at Gibbstown in conjunction with major land owners / developers. The Order of Priority for Gibbstown shall be reviewed at a later stage to reflect the policies and objectives of the Gibbstown Local Area Plan. No Change 006 Frances Heaslip, Department of Communications, Energy and Natural Resources This submission was submitted subsequent to a submission having been made on the 2 nd of March at the pre-draft consultation stage. It is stated that the Department has no further comments to add at this time. Manager s Response No response necessary. Submission noted. 007 John O Dwyer, Gibbstown, Navan, Co. Meath This submission was made with respect to lands to the west of the village and north of the turning gates to Gibbstown Demesne. This submission appended related submissions with respect to the review of Gibbstown Development Plan, Variation No. 2 of the County Development Plan and the preparation of the Draft Gibbstown LAP. The main points of this submission are summarized here: It has been previously submitted that the current F1 zoned lands to provide for and improve open spaces for active and passive recreational amenities should be rezoned A3 zoning objective to conserve and protect the character and setting of institutional complexes and heritage buildings in residential redevelopment and infill proposals in accordance with an approved framework plan. The proposed rezoning is not in conflict with the Council s stated aims for the Gibbstown area. Road frontage of the subject lands has effectively had its zoning changed when planning permission was granted on the site. The Draft Gibbstown LAP rezoning of subject lands to Green Belt devalues the said lands. 9
10 The reduction of the development area of Gibbstown will have a negative effect on the future development of the area and in particular the vicinity of Gibbstown cross. Gibbstown cross should be included in the development area of Gibbstown to ensure traffic safety on the lead in to the village. The proposed rezoning is sought to allow a family member live in the village. An appendix in response to the Manager s report with respect to the pre-draft Plan was also submitted. Manager s Response The site subject to this submission is located in a predominantly undeveloped character area comprising the former entrance gate to the Gibbstown Demesne, the cemetery and the GAA playing fields and having an open character. The zoning of the subject side would provide for the further extension of the village to the west. It is considered appropriate that the development of the village would occur between the primary school and employment areas to the east in advance of any further expansion to the west. The green belt objective to the west of the village seeks to ensure that an appropriate edge to the village is formed whilst protecting the open landscape character of the entrance to Gibbstown demesne. The granting of a planning application for the purposes of rural housing does not constitute the rezoning of land but rather reflects a demonstrated need for rural housing in accordance with the criteria of the County Development Plan. Notwithstanding this, it is a policy of the Draft LAP that planning applications for individual one off rural dwellings in the Green Belt will be assessed on their merits for compliance with the CDP rural housing policy. As such, applications for one off rural housing in this area are not precluded by the plan subject to compliance with the rural housing policy of the CDP, this is reinforced by objective LU OBJ 6 (Page 24 of draft LAP) which states as follows: Planning Applications for individual one off rural dwellings in the green belt will be assessed on their merits for compliance with the CDP rural housing policy. No change. 008 Patrick O Sullivan, Spatial Policy, Department of the Environment, Heritage and Local Government This submission was made bon behalf of the Minister for the Environment, Heritage and Local Government. It is stated that: The Department notes the limitation on future development posed by the lack of adequate water and waste water infrastructure and the policies which are set out with respect to phasing to deal with same. It is suggested that the Council include a statement which indicates that the Council reserves the right to refuse permission for development on the basis of a lack of adequate water and / or waste water infrastructure. It is not clear from the LAP whether or not an Appropriate Assessment screening report has been undertaken. The Council s attention is drawn to the Department s circular SEA 1/08 and NPWS 1/08 dated the 15 February Manager s Response The Council will seek to ensure all development is contingent upon adequate social and physical infrastructure being in place prior to commencement. Strategic Environmental Assessment and Appropriate Assessment Screening Reports have been prepared and submitted to the Department for comment. The DoEHLG has accepted that an Appropriate Assessment is not necessary for said the Gibbstown LAP. Include statement in Section 6.2 of the LAP that the Council reserves the right to refuse permission for development on the basis of a lack of adequate water and / or waste water infrastructure. 10
11 009 Micheal McCormack, National Roads Authority, St. Martin s House, Waterloo Road, Dublin 4 This submission welcomed consultation with the NRA with respect to the preparation of Local Area Plans and noted the following: The NRA supports the overall aim of consolidating the network of towns and villages through the preparation of local area plans in the interest of providing for linked trips and reducing the demand for car based travel. These draft guidelines outline best practice and advice in relation to the sustainable development of existing urban areas. The Draft LAP will be was on display for a period of six weeks from the 19th of January to the 2nd of March, On the 17th of January 2009 a notice was published in the Meath Chronicle advertising the display of the Draft Gibbstown Local Area Plan and inviting written submissions from interested parties and members of the public on the Draft LAP. 5 no. submissions were received and these submissions were taken into consideration in making the Plan Sustainable Development in Urban Areas Draft Guidelines for Planning Authorities In December 2008, the Department of the Environment, Heritage and Local Government issued draft adopted guidelines for planning authorities entitled Sustainable Residential Development in Urban Areas. These draft guidelines outline best practice and advice in relation to the sustainable development of existing urban areas. Planning Authorities are required to have regard to these guidelines in the performance of their functions.
