1 COUNTRY REPORT Slovak Republic (Observer) 9 th meeting of representatives from CEFTA countries responsible for conformity assessment Sofia, 7 th April Tasks and position of the Office in the field of conformity assessment and certification In the Slovak Republic, conformity assessment of products according to NAD s is performed according to the Act No. 264/1999 Coll. on technical requirements for products and on conformity assessment and on change and amendment of some Acts in the wording of Act No. 436/2001 Coll. and Act No. 254/2003 Coll. The Slovak Office of Standards, Metrology and Testing (hereinafter referred to as Office ) is a central body of state administration in the field of technical standardization and conformity assessment that: a) elaborates and submits to the government conceptions in the field of technical standardization and conformity assessment, b) co-operates with the ministries and other central bodies of state administration in the competence of which there is the issuance of a technical regulation (hereinafter referred to as ministry ) and with other legal entities at the process of assurance of uniform application of technical requirements, conformity assessment and surveillance execution, c) ensures in co-operation with the ministries international exchange of information in the field of Slovak technical standards, technical regulations and conformity assessment according to international agreements by which the Slovak Republic is bound, d) designates a legal entity to provide for the development, approval and issuance of the Slovak technical standards e) designates a Slovak technical standard suitable for conformity assessment, f) announces the changes in the lists of European standards harmonized with technical regulations of European Communities, g) grants and withdraws the authorization and regularly checks the existence and fulfilment of conditions given in the decision on authorization by authorized body under this Act, h) publishes information on Slovak technical standards, on Slovak technical standards harmonized with technical regulation and Slovak technical standards suitable for conformity assessment; information on authorization granting and withdrawal to authorized body, including the contents of authorization, i) keeps register of the identification codes. The Office, at execution of surveillance over conformity assessment is entitled to place the obligation on authorized body to remove ascertained imperfection in its work and determine adequate time limit for its removal and inflict fines. 2. Changes in the legislation Since the last CEFTA meeting, two GO s have been amended (GO No. 222/2002 Coll. on Cableways installations designed to carry persons by GO No. 26/2006 Coll. and GO No. 433/2000 Coll. on Hot-wather boilers fired with liquid or gaseous fuels by GO No. 69/2006 Coll. which are fully compatible with particular directives).

2 Other three GO were published this year, but they become effective in the course of years These are the following: - GO of the SR No. 194/2005 Coll. on Electromagnetic Compatibility of the Electric Equipment effective since 20 July 2007 (transposition of the Directive No. 2004/108/EC) - GO of the SR No. 294/2005 Coll. on Measuring Instruments - effective since 30 October 2006 (transposition of the Directive No. 2004/22/EC) - GO of the SR No. 79/2006 Coll. on Hot-water Boilers - effective since 11 August 2007 (transposition of the Directive No. 2005/32/EC) In non harmonized area SOSMT issued Decree No. 590/2004 on other determinate products. It contains only product from non harmonized area and determine the obligations for product from third countries. This measure (Decree on other determined products) and categorization of products in frame the other determined products failed its efficiency on December 31, 2005, so it is possible to place on the market 36 groups of products included in this legal regulation without conformity assessment procedure and certification. The review of the adopted governmental ordinances (see Annex II.). 3. Technical standardization The Slovak Office of Standards, Metrology and Testing has performed activities in the field of technical standardisation coming out of the conceptual intents determined in point 3.1 and in Appendix No.1 of the State Policy Concept of technical standardization, metrology, testing and accreditation until The Office ensured conditions for the performance of the technical standardization at the international as well as the national level and availability of standards as competition tool for the Slovak companies by signing of the Contract No. 1 between SOSMT and Slovak Standards Institute. In 2005, 2642 Slovak technical standards and amendments were issued frame of this Contract, 600 of them represented harmonized and mandate standards. Within these activities stress was put on improvement of activity of technical committees (TK), particularly in the field of working out of national viewpoints to the individual European standard proposals. To involve all interested parties, including state administration bodies, playing important role in identification of possible conflicts between the national legislation and proposal of European standards (deviation A), to the work on standards, the Office has requested relevant ministries by means of Chairman s council for state policy and harmonization in technical standards for cooperation. Attention was paid to publication of harmonized and mandated EN standards, which create the supporting component of technical legislation and represented priority in the field of comments and working out of technical standardization plan for The Office paid also attention to prompt publication of harmonized Slovak standards (STN) to individual Governmental Ordinances, implementing EC/EU Directives, in the Bulletin of the SOSMT in accordance with notifications in Official Journal of EU. Slovak Standards Institute, as the national standardization body, fulfilled its tasks following from the membership of the Slovak Republic in the international (ISO, IEC) and European organizations for standardization (CEN, CENELEC, ETSI) and provided with information public and entrepreneurial subjects on the higher level as in previous years, which is important for the Slovak economy. The offer of products in electronic form has increased and parameters of so-called virtual standards shop were improved from the point of view of users comfort.

3 SOSMT in cooperation with Slovak Standards Institute submitted to the Slovak Government proposal of the Project of introducing of the mark of conformity with European standards European mark of conformity - Keymark into practice on the national level, which was approved by the Government in its Resolution No. 194 from March 9, In accordance with this Resolution has the Office deputed the Slovak Standards Institute to realize this Project. The aim of all these activities is to ensure the goal given by the concept to contribute to strengthening of compositeness of plants and to help to use in a sustainable way sources in trade, industry and society. In October 2005 in commemoration of the World Standards Day the Slovak Society for Technical Standardization in co-operation with SUTN (Slovak Standards Institute) and under the auspices of the President of the Slovak Office of Standards, Metrology and Testing Mr. Arpád Gonda the SOSMT organized the seminar, on which the President of the SOSMT for the first time granted the Award of Vladimir List for standardization in five categories. Beginning with this year the award for standardization will carry the name of Vladimir List, the initiator of Czechoslovak standardization, who made an important contribution to the occurrence of national and international standardization. 4. Notified bodies Until now the Slovak Republic has implemented 33 New Approach directives (their list see in Annex I.) To execute conformity assessment pursuant these directives, the Slovak Republic notified 18 notified bodies. For Directive 97/23/EC we notified the other notified bodies for rest directives. They are responsible only for small part of this directive. They are as third competent party for non destructive testing and assessment of welding personal.
