2 CROATIAN GENERAL NATIONAL MARKET SURVEILLANCE PROGRAMME FOR Introduction This document is the Croatian annual general National Surveillance Programme for the sectors covered by community harmonization legislation as required by Article 18(5) of Regulation (EC) No. 765/2008, setting the requirements for accreditation and market surveillance relating to the marketing of and repealing Regulation (EEC) No 339/93. The program covers Surveillance programs of the all competent Authorities in Croatia for non-food within the scope of this regulation. 2. General objectives of Surveillance The objective of the market surveillance framework of the set out in the regulation is to ensure that those fulfill requirements providing high level of protection of public interests, such as general health and safety and consumer protection. In the sense, the market surveillance overall aims is to ensure that only safe circulate in community market. This achievement is ensured by and surveillance procedures and proactive methods as well as reactive ones. If the product presents a risk, it is necessary to adopt appropriate measure (withdrawal, recall, etc.) and to inform the public, the Commission and the Member States. 3. Organization of Surveillance in Croatia In Croatia there are several Authorities competent for Surveillance of different in frame of the Regulation (EC) No. 765/2008 and they have to cooperate in their and synchronize their plans and programs as specified in the Act on the State Administration System. They work as Surveillance s within different ministries according to the type of the product. The market surveillance authorities and their competence areas are as follows: 1., sector of the Economic Inspections Directorate, in the Economy is a general Surveillance authority in the field of consumer protection on the internal market for non-food (for example: electrical equipment, electromagnetic compatibility, energy labeling, textile, personal protective equipment, the production and placing and making available on the market construction while construction in use are in the scope of the Building the Construction and Physical Planning, etc.). 2. : a) Directorate for is supervising compliance of general use items, cosmetic, toys, tobacco and that come in contact with food, manufacturing, sale, use and treatment of chemicals. 2

3 b) Protection Directorate, Pharmaceutical Inspection s medicinal and medical devices. 3. The Croatian Post and Electronic Communications Agency (HAKOM) is supervising radio and telecommunication terminal equipment in use and placed on the market. 4. Maritime Affairs, Transport and Infrastructure, the Maritime Safety Directorate is ling recreational crafts, while Cableway Inspection s passenger cableways. 5. Surveillance of explosive substances is supervised by Interior, Production and Traffic of Explosive Substances, while the ATEX is under of Inspection for Fire Protection, Labour Inspection, Electric power Inspection and Mining Inspection. 6. State Office for Metrology, Service for Metrological Inspection is supervising administrative and professional tasks referring to official measurements, of legality of work of authorized legal entities, authorized services and users of legal measuring instruments and and surveillance of the situation in the field of legal metrology and undertaking measures for good quality activity performance, of precious metals articles and type approval of vehicles. 4. Priorities Contact point in Croatia for the system has been established in Economy which coordinates all other market surveillance authorities (, Maritime Affairs, Transport and Infrastructure, Interior, Ministry of Finance Customs and State Office for Metrology). The contact point has started with its work in July Croatia is also using ICSMS since The most active user of the system is Economy. Also the other competent authorities have started with using the system. The following will be prioritized in 2014: - Strengthening cooperation among different and customs authorities, - Encouraging the active use of the ICSMS and system according to the article 23 and article 22 of the Regulation (EC) No. 765/2008, - Preparation for challenges from the new EU legislation (Product Safety and Surveillance Package).
