19 INFLATABLE RENTAL AGREEMENT INSTRUCTIONS: To order an inflatable, please fill out the entire form and fax or to: , The inflatable will be shipped from and serviced by Inflatable Images, a division of Scherba Industries, Inc., 2880 Interstate Parkway, Brunswick, Ohio Basic, per-day and freight charges will be prepaid to Scherba upon reserving the unit. The unit will be considered reserved only after the payment has been received. Freight charges are based on the mode of shipment, size of inflatable and destination location. Inflatable Images will bill $200-$400 for roundtrip charges. Units are shipped out freight prepaid, and returned to Inflatable Images freight collect. For return shipments, unit ships in one (1) container, and is designated as Class 125 / Item # Inflatable Images will arrange pick-ups Monday thru Friday from 8 a.m. to 5 p.m. Dealer will be contacted on day of pick up directly at the number provided for the Ship To location. Proper shipping documents will be ed or faxed directly to dealer. They will NOT be included in the crate up on arrival. Forms must be received at least 2 weeks in advance notice to confirm delivery guarantee and availability. Last minute requests are not guaranteed. TERMS AND CONDITIONS Dealer, by signing below, agrees to perform and comply with the following terms and conditions. 1. Accept delivery, provided arrival occurs within 24 hours of scheduled delivery date. Units refused will be subject to all rental costs from line Item C (Subtotal) below and roundtrip freight charges. Immediately contact Inflatable Images if the inflatable is not received in proper working order or missing any equipment. Call x Control the inflatable while in the dealer s possession. Inflatables are NOT to be moved from the ship to address unless authorized approved my Michelin Corporate or Scherba Industries. 3. Properly setup and takedown the inflatable per instructions included inside the shipping container. If an instruction manual is not included, contact x 154 immediately before attempting to set up the inflatable. 4. Take reasonable care of and provide security for the inflatable while in dealer s possession. 5. Provide continuous supervision to insure that the inflatable is not tampered with, and to deflate and secure if severe weather conditions warrant. (See instruction manual for deflate instructions) 6. All inflatable requests must be received at least 2 weeks prior to event start date. We will honor last minute requests but shipping and delivery dates are not guaranteed. Additional expedited shipping charges may apply. 7. The attached rental agreement must be completed in its entirety. Missing information will result in a return of the form and the form is not processed as a rental request until all information is provided. Each reservation request must be accompanied with each dealer s Michelin Alliance Association Number (AAN) or Ship -To Number. Without this information, reservations will not be processed. 8. Keep the inflatable under security watch at all times while the unit is inflated. If inflatable is not in use, it must be kept under lock and key. 9. Dealer shall be charged the actual costs of damage occurring to the inflatable while it is in the dealer s possession. Dealer shall be charged full replacement cost if the inflatable and/or any of the provided equipment is not returned. Inflatable Images shall be notified immediately should any damage to the inflatable be incurred. DO NOT ATTEMPT TO REPAIR THE INFLATABLE YOURSELF. Inflatable Images is solely responsible for making any and all repairs that are to be performed to the inflatable. Damage includes, but is not limited to, the following: a. Any cuts or tears or a puncture of the inner lining of the inflatable. Note: Minor cuts and tears up to 6 inches in size will be repaired by Inflatable Images free of charge. b. Scuffs and scrapes requiring touch up work. c. Burn holes, including, but not limited to, those caused by friction (from dragging), heat (hot metal, electrical sources), etc. d. Mold / mildew, including, but not limited to, those caused by chemicals, tar, paints, etc. 10. Cancellations must be received at least 10 days prior to the event. If the inflatable has already been shipped when cancellation is received, the dealer is still responsible for all freight charges. 11. The inflatable must be returned on time to avoid additional daily rental charges. The inflatable MUST be packed up in the condition that it was received on the date of pick up. You will be contacted directly for the pick up from our logistic company. Missed pick ups or change of pick up address will result in additional charges. 12. Upon completion of the rental, all components including the inflatable, storage bag, inflation fan, tarp, tie down straps, stakes, stake bag, extension cord, etc. are to be repackaged in the original shipping container for transport back to Inflatable Images. Any dealer that returns an inflatable with missing equipment, you will be notified directly from Scherba Industries. You will be given 30 days to return the missing equipment to our Brunswick, OH facility or the requesting dealer will be billed for the cost of the replacement items. 13. Dealer acknowledges that Michelin North America is the owner of the inflatable and agrees not to do anything, which will adversely affect Michelin North America s rights to the inflatable Michelin program. Dealer further acknowledges that Michelin North America and/or Inflatable Images will hold Dealer responsible for any breach of the Rental Agreement.
