2 Appendix L1 Policies relating to Archaeology, Architectural Heritage and Cultural Heritage Summary Meath County Development Plan and Kildare County Development Plan ( )

3 1. MEATH COUNTY DEVELOPMENT PLAN , STRATEGY FOR ARCHAEOLOGICAL ARCHITECTURAL AND CULTURAL HERITAGE 1.1. Archaeological Heritage Policies and Objectives Relevant policies regarding archaeological heritage CH POL 6 To promote awareness of, and access to, the archaeological inheritance of County Meath. CH POL 7 To ensure that development in the immediate vicinity of a recorded monument is sensitively sited and designed so that it does not significantly detract from the monument. Where upstanding remains exist, a visual impact assessment may be required. CH POL 8 To retain surviving medieval plots and street patterns in the villages and towns of Meath, where practicable, and in the course of development to record evidence of ancient boundaries, layouts, etc. CH POL 9 To inform and seek guidance from the National Museum of Ireland if an unrecorded archaeological object is discovered, or the National Monuments Service of the DoAHG in the case of the discovery of an unrecorded archaeological site, in accordance with National Monuments legislation Development in the UNESCO World Heritage Site of Brú na Bóinne CH POL 1 To work in partnership with the relevant agencies/organisations and the public to promote, understand, conserve and sustainably manage the UNESCO World Heritage Site of Brú na Bóinne. CH POL 3 To require that all development within the UNESCO World Heritage Site of Brú na Bóinne shall be subject to the Development Assessment Criteria set out in Volume 1, Chapter 9, Section 9.6.7, and elsewhere in the Development Plan. CH POL 4 To refer all planning applications within the UNESCO World Heritage Site of Brú na Bóinne to the Department of Arts, Heritage and the Gaeltacht for comment. These comments will be considered in the making of decisions on all such planning applications. World Heritage Tentative List Two sites in Meath have been included on the Tentative List as part of larger assemblies of sites: The Royal Sites of Ireland (Cashel, Dún Ailinne, Hill of Uisneach, Rathcroghan Complex and Tara Complex); Early Medieval Monastic Sites (Clonmacnoise, Durrow, Glendalough, Inis Cealtra, Kells and Monasterboice). CH POL 5 To recognise and respect potential World Heritage Sites in Meath on the UNESCO Tentative List Ireland-2010 and support their nomination to World Heritage status. Industrial Heritage Industrial heritage consists primarily of sites and structures associated with transportation, communications, manufacturing, public utilities, and materials extraction, but can also refer to archaeological sites and objects which demonstrate early evidence of industry such as metal working, or mining. Meath contains significant stretches of both operational and derelict waterways, railway structures, mills, lime kilns and milestones. Meath County Council commissioned an Industrial Heritage survey of the County in 2008 which may be seen on its website. Relevant objectives regarding archaeological heritage CH OBJ 7 To protect archaeological sites and monuments, underwater archaeology, and archaeological objects, which are listed in the Record of Monuments and Places, and to seek their preservation in situ (or at a minimum, preservation by record) through the planning process.

4 CH OBJ 8 To seek to protect important archaeological landscapes from inappropriate development. CH OBJ 11 To encourage and promote the appropriate management and maintenance of the County s archaeological heritage, including historical burial grounds, in accordance with conservation principles and best practice guidelines. Development in the UNESCO World Heritage Site of Brú na Bóinne CH OBJ 1 To protect and enhance the Outstanding Universal Value of the cultural landscape in the UNESCO World Heritage Site of Brú na Bóinne in accordance with the relevant guidelines and national legislation, so that its integrity, authenticity and significance are not adversely affected by cumulative inappropriate change and development, and to enhance views within and adjacent to the site. CH OBJ 2 To protect the ridgelines which frame views within and from the UNESCO World Heritage Site of Brú na Bóinne from inappropriate or visually intrusive development. CH OBJ 3 To encourage and facilitate pre-planning consultation with applicants regarding the siting and design of developments affecting the UNESCO World Heritage Site of Brú na Bóinne, and the scope of any necessary impact assessments Strategy for Archaeological Heritage Aims (County Development Plan Section 2.5) To ensure that the unique cultural heritage of Meath is protected, conserved, enhanced and sensitively integrated into the sustainable development of the county for the benefit of present and future generations. To ensure that features of Meath s natural heritage and green infrastructure that provide ecosystem services are protected and that tourist and recreational uses are facilitated in a sustainable manner. To protect the landscape character, quality and local distinctiveness of County Meath. Strategies [Cultural Heritage: CDP Section 9.6] It is the strategic policy of Meath County Council: CSA SP 1 To ensure that the unique cultural heritage of Meath is protected, conserved and sensitively integrated into the sustainable development of the county for the benefit of present and future generations. CSA SP 3 To promote the understanding of County Meath s landscape in terms of its inherent and unique character and to recognise what elements should be preserved, conserved or enhanced. Architectural Heritage Policies and Objectives CH POL 10 To conserve and protect the architectural heritage of Meath. Relevant policies regarding protected structures CH POL 12 To encourage the retention, sympathetic reuse and rehabilitation of Protected Structures. In certain cases, land use zoning restrictions may be relaxed in order to secure the conservation of the protected structure. CH POL 13 To encourage the retention of original windows, doors, renders, roof coverings and other significant features of historic buildings. CH POL 14 To continue to develop the Council s advisory/educational role with regard to heritage matters and to promote awareness, understanding, and appreciation of the architectural heritage of Meath. CH POL 15 To encourage, where appropriate, the adaptive re-use of existing buildings and sites in a manner compatible with their character and significance. Relevant policies regarding Industrial Heritage Industrial heritage consists primarily of sites and structures associated with transportation, communications, manufacturing, public utilities, and materials extraction, but can also refer to archaeological sites and objects which demonstrate early evidence of industry such as metal-working, or mining. CH OBJ 17 To work with stakeholders to progress the phased restoration, maintenance and re-use for amenity purposes of the Boyne Navigation, towpath and associated structures within Meath. CH OBJ 18 To work with stakeholders to promote the maintenance and re-use for amenity purposes of the Royal Canal and associated structures within Meath. CH OBJ 19 To carry out phase two of the Industrial Heritage Survey, which will comprise a more detailed site inventory and assessment of surviving structures and sites. Relevant policies regarding vernacular structures CH POL 20 a) To encourage the retention, sympathetic maintenance, and appropriate re-use of the vernacular heritage of Meath, in both the towns and rural areas of the County, including the retention of the original fabric, such as windows, renders, shop fronts, gates, yards, boundary walls and other significant features where possible; b) To discourage the replacement of good quality vernacular buildings with modern structures; c) To ensure that new build adjoining, and extensions to, vernacular buildings are of an appropriate design and do not detract from the building s character. Relevant policies regarding Architectural Conservation Areas (ACAs) The Town Plans of Navan, Trim and Kells contain details of the ACAs in these towns. For the area of the County Plan the following 18 ACAs are designated: Ardbraccan Demesne, Athboy, Dunboyne, Dunsany Castle Demesne, Headfort Demesne, Julianstown, Kilmessan, Laytown, Longwood, Moynalty, Oldbridge Demesne, Oldcastle, Slane, Slane Castle Demesne, Slane Mill Complex, Somerville Demesne, Stackallen Demesne, Summerhill. CH POL 17 To identify places of special architectural, historical, archaeological, artistic, cultural, scientific, social or technical interest and where appropriate to define them as Architectural Conservation Areas.

6 CH POL 18 To require that all development proposals within an ACA should be appropriate to the character of the area, inclusive of its general scale and materials, and are appropriately sited and sensitively designed having regard to the advice given in the Statements of Character for each area. Relevant policies regarding Country Houses and Demesnes CH POL19 To encourage the protection, promotion and enhancement of heritage gardens and parks in the county and support public awareness, enjoyment of and access to these sites. Relevant objectives regarding Architectural Heritage CH OBJ 13 To protect all structures (or, where appropriate, parts of structures) within the county which are of special architectural, historical, archaeological, artistic, cultural, scientific, social or technical interest and which are included in the RPS. CH OBJ 14 To review and update the RPS when new information becomes available and to make additions and deletions as appropriate. CH OBJ 15 To identify and retain good examples of historic street furniture e.g. cast-iron post boxes, water pumps, signage, street lighting and kerbing. CH OBJ 20 To prohibit the demolition of a structure that positively contributes to the character of an ACA, except in exceptional circumstances. Meath County Council will require such applications to be accompanied by a measured and photographic survey, condition report and architectural heritage assessment of the structure. Where permission for demolition is granted within an ACA, an assessment of the impact of the replacement building on the character of the ACA will be required. CH OBJ 21 To ensure that any new development within or contiguous to an ACA is sympathetic to the character of the area and that the design is appropriate in terms of scale, height, plot density, layout, materials and finishes. CH OBJ 22 To discourage development that would lead to a loss of, or cause damage to, the character, the principal components of, or the setting of historic parks, gardens and demesnes of heritage significance. CH OBJ 23 To require that proposals for development in designed landscapes and demesnes include an appraisal of the landscape, designed views and vistas, and an assessment of significant trees or groups of trees, as appropriate. CH OBJ 24 To assist the retention and development of traditional building skills in Meath subject to the availability of resources.

KILDARE COUNTY DEVELOPMENT PLAN Strategy for Architectural and Archaeological Heritage Aim To protect, conserve and manage the archaeological and architectural heritage of the county and to encourage sensitive sustainable development so as to ensure its survival and maintenance for future generations. Strategies Protect and conserve buildings, structures and sites of special architectural, historic, archaeological, artistic, cultural, scientific, social or technical interest. Protect and conserve the archaeological heritage of the county. Secure the preservation in-situ or by record of all sites and features of historical and archaeological interest. Protect and conserve areas that have particular environmental qualities that derive from their overall layout, design and character. Protect and conserve historic milestones, street furniture, and other significant features of interest wherever feasible. Encourage the rehabilitation, renovation and re-use of existing older buildings where appropriate. Legislation, policies and guildelines referenced in the plan Convention for the Protection of the Architectural Heritage of Europe (The Granada Convention; ratified by Ireland in 1997) Planning and Development Act, Architectural Heritage Protection, Guidelines for Planning Authorities (Department of the Environment, Heritage and Local Government, 2004) A Government Policy on Architecture A garden and demesne survey of historic designed landscapes is also being prepared by the Department of the Environment, Heritage and Local Government (NIAH Garden Surveys). The European Convention on the Protection of the Archaeological Heritage (Valetta, 1992; ratified by Ireland in 1997). National Monuments Acts Section 12 of the National Monuments (Amendments) Act The Framework and Principles for the Protection of the Archaeological Heritage (Department of Heritage, Gaeltacht and the Islands, 1999). National Heritage Plan (2002) County Kildare Heritage Plan Wind Energy Development Guidelines (DoEHLG, 2006) 2.2. Architectural Heritage Policies and Objectives Relevant policies regarding protected structures PS 1: To conserve and protect buildings, structures and sites contained on the Record of Protected Structures (RPS) of special architectural, historic, archaeological, artistic, cultural, scientific, social or technical interest.

8 PS 2: To protect the curtilage of protected structures or proposed protected structures and to refuse planning permission for inappropriate development within the curtilage or attendant grounds of a protected structure which would adversely impact on the special character of the protected structure including loss of or damage to the special character of the protected structure and loss of or damage to, any structures of architectural heritage value merit within the curtilage of the protected structure. Any proposed development within the curtilage and/or attendant grounds must demonstrate that it is part of an overall strategy for the future conservation of the entire built heritage complex and contributes positively to that aim. PS 3: To require that new works will not obscure views of principal elevations of protected structures. PS 16: To protect and retain important elements of the built heritage including historic gardens, stone walls, landscapes and demesnes, and curtilage features. Relevant policies regarding vernacular structures VA 1: To encourage the protection, retention, appreciation and appropriate revitalisation of the vernacular heritage of the county. VA 2: To resist the demolition of vernacular architecture, in particular thatched cottages and farmhouses and to encourage their sensitive reuse having regard to the intrinsic character of the structure. VA 4: To preserve the character and setting (e.g. gates and gate piers, courtyards etc.) of vernacular buildings where deemed appropriate by the planning authority. VA 5: To protect (through the use of ACAs, the RPS and in the normal course of development management) vernacular buildings where they contribute to the character of areas and/or where they are rare examples of a structure type. Relevant policies regarding Architectural Conservation Areas (ACAs) ACA 1: To investigate the designation of further ACAs at appropriate locations throughout the county to include Celbridge, Kildare Town, Johnstown, Ballymore Eustace, Kilcullen, Brannockstown, Rathmore, Clane and Newbridge. ACA 2: To ensure that any development, modifications, alterations, or extensions within an ACA are sited and designed appropriately, and are not detrimental to the character of the structure or to its setting or the general character of the ACA. Relevant policies regarding Country Houses and Demesnes CH 1: To promote appreciation of the landscape and historical importance of traditional and historic gardens, demesnes and parks within Kildare in general and particularly where they constitute an important setting to a protected structure. CH 2: To have regard to the historic gardens and designed landscape sites in County Kildare identified in the National Inventory of Architectural Heritage (NIAH). CH 3: To encourage conservation, renewal and improvement which enhances the character and the setting of parks, gardens, and demesnes of historic interest within the county. CH 4: To cooperate with owners in the protection, promotion and enhancement of heritage gardens and parks in the County, to support public awareness, enjoyment of and access to these sites and to seek the cooperation and assistance of other interested parties, including Government Departments and state agencies, in this regard. CH 5: To designate ACAs where considered appropriate, to preserve the character of a designed landscape.

9 Relevant objectives regarding Architectural Heritage AAO 7: To prepare a character appraisal and area specific policy for each ACA to preserve, protect and enhance the character of these areas. AAO 9: To assess the demesnes within Kildare and promote the conservation of their essential character, both built and natural, while allowing for appropriate re-use. AAO 10: To identify and retain good examples of historic street furniture in situ e.g. cast-iron postboxes, water pumps, signage, street lighting, kerbing and traditional road and street surface coverings. AAO 12: To co-operate with Waterways Ireland in the management, maintenance and enhancement of the Royal Canal and Grand Canal and associated structures/features. AAO 13: To carry out an audit of all historic rail and road bridges and disused railway lines in Kildare and liaise with Iarnród Eireann and the National Roads Authority regarding same. AAO 15: To ensure that in the event of a planning application being granted for development within the curtilage of a protected structure, the proposed works to the protected structure should occur in the first phase of the development to prevent endangerment, abandonment and dereliction of the structure. AAO 16: To require that planning applications take into consideration the impacts of the development on their landscapes and demonstrate that the development proposal has been designed to take account of the heritage resource of the landscape Archaeological Heritage Policies and Objectives Relevant policies regarding archaeological heritage AH 1: To have regard to the Record of Monuments and Places (RMP) and the Urban Archaeological Survey when assessing planning applications for development. No development shall be permitted in the vicinity of a recorded feature where it detracts from the setting of the feature or which is injurious to its cultural or educational value. AH 2: To seek to protect and preserve archaeological sites which have been identified subsequent to the publication of the RMP. AH 3: To ensure that development in the vicinity of a site of archaeological interest is not detrimental to the character of the archaeological site or its setting by reason of its location, scale, bulk or detailing and to ensure that such proposed developments are subject to an archaeological assessment. Such an assessment will seek to ensure that the development can be designed in such a way as to avoid or minimise any potential effects on the archaeological heritage. AH 4: To protect historic burial grounds within the county and encourage their maintenance in accordance with conservation principles in co-operation with the Historic Monuments Advisory Committee and National Monuments Section of the Department of the Arts, Heritage and the Gaeltacht (DoAHG). AH 5: To ensure that disturbance, removal and alteration of the line of town defences are suitably safeguarded within the historic towns and settlements of County Kildare. AH 6: To retain where possible the existing street layout, historic building lines and traditional plot widths where these derive from medieval or earlier origins. AH 7: To promote and support in partnership with National Monuments Section of the DoAHG, the concept of Archaeological Landscapes where areas contain several Recorded Monuments. AH 8: To encourage, where practicable, the provision of public access to sites identified in the RMP under the direct ownership, guardianship or control of the Council and/or the State. AH 9: To encourage the provision of signage to publicly accessible recorded monuments. Relevant objectives regarding archaeological heritage

10 AAO 14: To safeguard sites, features and objects of archaeological interest generally and to secure the preservation (in-situ or by record) of all archaeological monuments included in the Record of Monuments and Places as established under Section 12 of the National Monuments (Amendment) Act 1994, and their settings. AAO 16: To require that planning applications take into consideration the impacts of the development on their landscapes and demonstrate that the development proposal has been designed to take account of the heritage resource of the landscape. AAO 17: To carry out field surveys of Industrial Archaeological types in the County and make recommendations for their protection. SR 19 Views of Canal, River Slate and Surrounding Countryside from R414 at Rathangan, at Bonaghmore, Kilmoney North, Mullantine, Mount Prospect, Newtown. SR 28 Views from county roads (L5017 & L26) of Carbury Castle and Hill: Teelough road junction with the R402 and upland area at Mylerstown, Calfstown, Knockcor, Carbury, Coolcor. SR 38 Views of Allenwood to Lullymore Local Road. SR 39 Views of Lullymore to Rathangan Local Road. Views of the River Barrow from Bridges, Adjacent Lands and Roads RB 4 Bert Bridge, Tyrellstown RB 5 Dunrally Bridge, Lowtown RB 6 Pass Bridge, Passlands Views to and from all Bridges on the Grand Canal are protected Landscape Character Assessment Landscape Character Areas The Landscape Character Assessment of Co. Kildare (2004) focuses on characterisation i.e. the discernment of the character of the landscape based on its land cover and landform but also on its values such as historical, cultural, religious and other understandings of the landscape. Based on the findings of the Landscape Character Assessment a landscape sensitivity rating was developed for each of the Landscape Character Areas. Landscape sensitivity is a measure of the ability of the landscape to accommodate change or intervention without suffering unacceptable effects to its character and values, with ratings of low, medium or high sensitivity (L, M, H below). Major Landscape Type Uplands (Eastern Uplands Oughterard (H), South-eastern Uplands Corballis Hills (H), Northern Hills Newtown Hills (H), Chair of Kildare Red Hill, Dunmurry Hill, Allen Hill (H)) Lowland Plains and Boglands (Northern Lowlands Naas and environs (L), Southern Lowlands (L), North-western Lowlands Cadamstown and environs (L), Central Undulating Lowlands (M), Western Boglands (M)) Transition Lands (Eastern Transition Lands) (M) Transitional areas contain some elements of both the upland and lowland areas.

11 River Valleys and Water Corridors (River Liffey Valley, River Barrow Valley, Grand Canal Corridor, Royal Canal Corridor) (H) Areas of High Amenity In addition to landscape character areas and the sensitivity of these areas to development there are certain special landscape areas within the county, some of which overlap with sensitive landscapes. For the purposes of the CDP these areas have been defined as Areas of High Amenity. They are classified because of their outstanding natural beauty and/or unique interest value and are generally sensitive to the impacts of development: River valleys The Grand and royal Canal Corridors Relevant Landscape Policies General Landscape LA 1: To ensure that consideration of landscape sensitivity is an important factor in determining development uses. In areas of high landscape sensitivity, the design, type and the choice of location of proposed development in the landscape will also be critical considerations. LA 2: To protect and enhance the county s landscape, by ensuring that development retains, protects and, where necessary, enhances the appearance and character of the existing local landscape. LA 4: To seek to ensure that local landscape features, including historic features and buildings, hedgerows, shelter belts and stone walls are retained, protected and enhanced where appropriate, so as to preserve the local landscape and character of an area, whilst providing for future development. Lowland plains and Boglands Character Area LL 5: To recognise that cutaway and cut-over boglands represent degraded landscapes and/or brownfield sites and thus are potentially robust to absorb a variety of appropriate developments. Upland Character areas included. East Kildare Uplands (area of high amenity) LU 1: To ensure that development will not have a disproportionate visual impact (due to excessive bulk, scale or inappropriate siting) and will not significantly interfere or detract from scenic upland vistas, when viewed from areas nearby, scenic routes, viewpoints and settlements. LU 2: To ensure that developments on steep slopes (i.e. >10%) will not be conspicuous or have a disproportionate visual impact on the surrounding environment as seen from relevant scenic routes, viewpoints and settlements. LU 3: To facilitate, where appropriate, developments that have a functional and locational requirement to be situated on steep or elevated sites (e.g. reservoir, telecommunication masts or wind energy structures) where residual adverse visual impacts are minimised or mitigated. Water Corridors (rivers and Canals) (areas of high amenity) WC 1: To seek to locate new development in the water corridor landscape character areas towards existing structures and mature vegetation. WC 3: To control development that will adversely affect the visual integrity of distinctive linear sections of water corridors and river valleys and open floodplains.

12 Scenic Routes and Protected Views SR 1: To protect views from designated scenic routes by avoiding any development that could disrupt the vistas or disproportionately impact on the landscape character of the area thereby affecting the scenic and amenity value of the views. WV 1: To curtail any further development along the canal and river banks that could cumulatively affect the quality of a designated view. WV 2: To preserve and enhance the scenic amenity of the river valleys and canal corridors and the quality of the vistas available from designated views. WV 4: To prevent inappropriate development along canal and river banks and to preserve these areas in the interests of biodiversity, built and natural heritage and amenity by creating or maintaining buffer zones, where development should be avoided. Relevant Landscape Objectives LO 1: To have regard to the Landscape Sensitivity Classification of sites in the consideration of any significant development proposals. LO 2: To ensure landscape assessment will be an important factor in all land-use proposals. LO 4: To protect the visual and scenic amenities of County Kildare s built and natural environment. LO 5: To preserve the character of all important views and prospects, particularly upland, river, canal views, views across the Curragh, views of historical or cultural significance (including buildings and townscapes) and views of natural beauty. LO 6: To preserve and protect the character of those views and prospects obtainable from scenic routes identified in this Plan, listed in Table 14.2 and identified on Map LO 7: To encourage appropriate landscaping and screen planting of developments along scenic routes. Where scenic routes run through settlements, street trees and ornamental landscaping may also be required Wind Energy Policies / Objectives Specific To Cultural Heritage It is the policy of the Council: WE 1: To have regard to the Department of the Environment, Heritage and Local Government Guidelines for Planning Authorities on Wind Energy Development (2006) in assessing all planning applications for wind farms. WE 2: To encourage the development of wind energy in suitable locations in an environmentally sustainable manner and in accordance with Government policy. WE 3: To ensure that the assessment of wind energy development proposals will have regard to: the sensitivity of the landscape; the visual impact on protected views, prospects, scenic routes, as well as local visual impacts; the impacts on nature conservation designations, archaeological areas and historic structures, public rights of way and walking routes; the visual and environmental impacts of associated development such as access roads, plant and grid connections; the scale, size and layout of the project, any cumulative effects due to other projects.

14 National Monuments Legislation All archaeological sites have the full protection of the national monuments legislation (Principal Act 1930; Amendments 1954, 1987, 1994 and 2004). In the 1987 Amendment of Section 2 of the Principal Act (1930), the definition of a national monument is specified as: any artificial or partly artificial building, structure or erection or group of such buildings, structures or erections, any artificial cave, stone or natural product, whether forming part of the ground, that has been artificially carved, sculptured or worked upon or which (where it does not form part of the place where it is) appears to have been purposely put or arranged in position, any, or any part of any, prehistoric or ancient (i) tomb, grave or burial deposit, or (ii) ritual, industrial or habitation site, and any place comprising the remains or traces of any such building, structure or erection, any cave, stone or natural product or any such tomb, grave, burial deposit or ritual, industrial or habitation site... Under Section 14 of the Principal Act (1930): It shall be unlawful... or to demolish or remove wholly or in part or to disfigure, deface, alter, or in any manner injure or interfere with any such national monument without or otherwise than in accordance with the consent hereinafter mentioned (a licence issued by the Office of Public Works National Monuments Branch), to excavate, dig, plough or otherwise disturb the ground within, around, or in the proximity to any such national monument without or otherwise than in accordance... Under Amendment to Section 23 of the Principal Act (1930), a person who finds an archaeological object shall, within four days after the finding, make a report of it to a member of the Garda Síochána...or the Director of the National Museum... The latter is of relevance to any finds made during a watching brief. In the 1994 Amendment of Section 12 of the Principal Act (1930), all of the sites and places recorded by the Sites and Monuments Record of the Office of Public Works are provided with a new status in law. This new status provides a level of protection to the listed sites that is equivalent to that accorded to registered sites [Section 8(1), National Monuments Amendment Act 1954] as follows: The Commissioners shall establish and maintain a record of monuments and places where they believe there are monuments and the record shall be comprised of a list of monuments and such places and a map or maps showing each monument and such place in respect of each county in the State. The Commissioners shall cause to be exhibited in a prescribed manner in each county the list and map or maps of the county drawn up and publish in a prescribed manner information about when and where the lists and maps may be consulted.

15 In addition, when the owner or occupier (not being the Commissioners) of a monument or place which has been recorded, or any person proposes to carry out, or to cause or permit the carrying out of, any work at or in relation to such monument or place, he shall give notice in writing of his proposal to carry out the work to the Commissioners and shall not, except in the case of urgent necessity and with the consent of the Commissioners, commence the work for a period of two months after having given the notice. The National Monuments Amendment Act 2004 The National Monuments Amendment Act enacted in 2004 provides clarification in relation to the division of responsibilities between the Minister of Environment, Heritage and Local Government, Finance and Arts, Sports and Tourism together with the Commissioners of Public Works. The Minister of Environment, Heritage and Local Government will issue directions relating to archaeological works and will be advised by the National Monuments Section and the National Museum of Ireland. The Act gives discretion to the Minister of Environment, Heritage and Local Government to grant consent or issue directions in relation to road developments (Section 49 and 51) approved by An Bord Pleanála and/or in relation to the discovery of National Monuments 14A. (1) The consent of the Minister under section 14 of this Act and any further consent or licence under any other provision of the National Monuments Acts 1930 to 2004 shall not be required where the works involved are connected with an approved road development. (2) Any works of an archaeological nature that are carried out in respect of an approved road development shall be carried out in accordance with the directions of the Minister, which directions shall be issued following consultation by the minister with the Director of the National Museum of Ireland. Subsection 14A (4) Where a national monument has been discovered to which subsection (3) of this section relates, then: (a) the road authority carrying out the road development shall report the discovery to the Minister (b) subject to subsection (7) of this section, and pending any directions by the minister under paragraph (d) of this subsection, no works which would interfere with the monument shall be carried out, except works urgently required to secure its preservation carried out in accordance with such measures as may be specified by the Minister The Minister will consult with the Director of the National Museum of Ireland for a period not longer than 14 days before issuing further directions in relation to the national monument. The Minister will not be restricted to archaeological considerations alone, but will also consider the wider public interest. Architectural Heritage (National Inventory) and Historic Monuments (Miscellaneous Provisions) Act, 1999 This Act provides for the establishment of a national inventory of architectural heritage and historic monuments. Section 1 of the act defines architectural heritage as: (a) all structures and buildings together with their settings and attendant grounds, fixtures and fittings, (b) groups of such structures and buildings, and, (c) sites which are of architectural, historical, archaeological, artistic, cultural, scientific, social or technical interest. Section 2 of the Act states that the Minister (for Arts, Heritage, Gaeltacht and the Islands) shall establish the NIAH, determining its form and content, defining the categories of architectural heritage, and specifying

16 to which category each entry belongs. The information contained within the inventory will be made available to planning authorities, having regard to the security and privacy of both property and persons involved. Section 3 of the Act states that the minister may appoint officers, who may in turn request access to premises listed in the inventory from the occupiers of these buildings. The officer is required to inform the occupier of the building why entry is necessary, and in the event of a refusal, can apply for a warrant to enter the premises. Section 4 of the Act states that obstruction of an officer or a refusal to comply with requirements of entry will result in the owner or occupier being guilty of an offence. Section 5 of the Act states that sanitary authorities who carry out works on a monument covered by this Act will as far as possible preserve the monument with the proviso that its condition is not a danger to any person or property, and that the sanitation authority will inform the Minister that the works have been carried out. The provisions in the Act are in addition to and not a substitution for provisions of the National Monument Act ( ), and the protection of monuments in the National Monuments Act is extended to the monuments covered by the Architectural Heritage (National Inventory) and Historic Monuments (Miscellaneous Provisions) Act (1999). The Local Government (Planning and Development) Act, 1999, which came into force on 1st January 2000, provides for the inclusion of protected structures into the planning authorities development plans and sets out statutory regulations regarding works affecting such structures, thereby giving greater statutory protection to buildings. All structures listed in the development plan are now referred to as Protected Structures and enjoy equal statutory protection. Under the 1999 Act the entire structure is protected, including a structures interior, exterior, the land lying within the curtilage of the protected structure and other structures within that curtilage. This Act was subsequently repealed and replaced by the Planning and Development Act, 2000, where the conditions relating to the protection of architectural heritage are set out in Part IV of the Act. Protected Structures, Curtilage & Attendant Grounds A protected structure is defined in the Local Government (Planning and Development) Act 2000 as any structure or specified part of a structure, which is included in the planning authorities Record of Protected Structures (RPS). Section 57 (1) of the 2000 Act states that the carrying out of works to a protected structure, or a proposed protected structure, shall be exempted development only if those works would not materially affect the character of (a) the structure, or (b) any element of the structure, which contributes to its special architectural, historical, archaeological, artistic, cultural, scientific, social or technical interest. By definition, a protected structure includes the land lying within the curtilage of the protected structure and other structures within that curtilage and their interiors. The notion of curtilage is not defined by legislation, but according to Architectural Heritage Protection Guidelines for Planning Authorities (2004) and for the purposes of this report it can be taken to be the parcel of land immediately associated with that structure and which is (or was) in use for the purpose of the structure. The attendant grounds of a structure are lands outside the curtilage of the structure but which are associated with the structure and are intrinsic to its function, setting and/or appreciation. The attendant grounds of a country house could include the entire demesne, or pleasure grounds, and any structures or features within it such as follies, plantations, lakes etc.

17 Archaeological, Architectural and Cultural Heritage Designations Archaeological Heritage Record of Monuments and Places (RMP) Archaeological monuments are protected under the National Monuments Acts Section 12 (1) of the 1994 Act provides that the Minister shall establish and maintain a record of monuments and places where the Minister believes there are monuments, such record to be comprised of a list of monuments and relevant places and a map or maps showing each monument and relevant place in respect of each county in the State. This is referred to as the Record of Monuments and Places and monuments are entered into it are referred to as Recorded Monuments. Section 12(3) of the 1994 Act provides that where the owner or occupier (other than the Minister) of a monument or place included in the Record, or any other person proposes, to carry out, or to cause or permit the carrying out of, any work at or in relation to such monument or place, he or she shall give notice in writing to the Minister of the proposal to carry out work and shall not, except in the case of urgent necessity and with the consent of the Minister commence the work until two months after the giving of notice. This time will allow the National Monuments Service to consider the proposed works and how best to proceed to further the protection of the monument. National Monuments in State Care: Ownership and Guardianship Section 16 of the 1930 Act provides that where the Minister is the owner of a national monument then the Minister shall admit the public to enter on and view such monument upon payment of such (if any) admission charge and subject to such conditions and limitations as the minister shall prescribe. Section 11 of the 1994 Act provides that the Minister may acquire by agreement or compulsorily any monument that is in his or her opinion a national monument or any part of such monument. The provisions of Section 14 of the 1930 Act regarding prohibition of injury to national monuments which apply to national monuments subject to a Preservation Order apply similarly to national monuments of which the Minister is guardian. Section 12(1) of the 1930 Act provides that the Minister shall maintain a national monument of which he or she is the guardian. According to the National Policy on Town Defences (2008), within the meaning of the National Monuments Acts, all town defences are considered national monuments by reason of the historical, architectural, and archaeological interest attaching to them. This status relates as much to their protection as to the nature of consent and management of works on, or close, to them. National Monuments with a Preservation Order or Temporary Preservation Order Where it appears to the Minister that a monument, considered to be a national monument, is in danger or is actually being destroyed or falling into decay the minister may by preservation order or temporary preservation order, undertake the preservation of the monument. A temporary preservation order will remain in force for six months and then expire. National Monument in Local Authority Ownership/Guardianship Monuments which may be defined as national monuments are also in the ownership or guardianship of Local Authorities which have similar responsibilities under the National Monuments Acts ( ) to the DAHG. These monuments are not included in any specific dataset. Each Local Authority will make a determination whether the preservation of a monument in its ownership/guardianship, is a matter of national importance because of the archaeological, architectural, historical, traditional or artistic importance attaching to that monument. There are no definitive lists of these sites available; such determinations are generally made on a site by site basis as the need arises.

18 United Nations Educational, Scientific and Cultural Organisation (UNESCO) World Heritage Sites (including candidate UNESCO World Heritage Sites on Tentative List) Ireland ratified the World Heritage Convention in 1991 and as such pledges to conserve not only the World Heritage sites situated on its territory, but also to protect its national heritage. Ireland has two World Heritage Sites that are considered to have outstanding universal value (OUV) namely Skellig Michael, an island monastery off the west coast of Kerry and Brú na Bóinne, or the Bend of the Boyne Ensemble in the Boyne Valley, County Meath World Heritage sites are sites that have an international value that has been clearly articulated. They are cultural properties considered to be of Outstanding Universal Value that are part of the world heritage of Mankind as a whole and deserve protection and transmission to future generations (2). A Tentative List is an inventory of those properties which each State Party (i.e. those signed up to the convention) intends to consider for nomination on to the World Heritage List. States Parties submit a tentative list of their properties which they consider to be cultural and/or natural heritage of outstanding universal value and therefore suitable for inscription on the World Heritage List. Architectural Heritage Protected Structures A protected structure is a structure that is considered to be of special interest, which is broadly defined by the Planning and Development Act, 2000 as structures of architectural, historical, archaeological, artistic, cultural, scientific, social or technical point interest. The 2000 Act requires each planning authority to compile and maintain a Record of Protected Structures (RPS). The RPS is a mechanism for the statutory protection of the architectural heritage and is listed in every County Development Plan and Town Development Plan. By definition, a protected structure includes the land lying within its curtilage and other structures within that curtilage and their interiors. The notion of curtilage is not defined by legislation, but according to Architectural Heritage Protection Guidelines for Planning Authorities (2011) it is that parcel of land immediately associated with the structure and which is (or was) in use for the purpose of the structure. The attendant grounds of a structure are the lands outside the curtilage of the structure but which are associated with the structure and are intrinsic to its function, setting and/or appreciation. Architectural Conservation Areas Architectural Conservation Areas (ACA) are places, groups of structures or townscapes that are of special architectural, historical, archaeological, artistic, cultural scientific, social or technical interest/value or contribute to the appreciation of Protected Structures. ACAs and candidate ACAs are listed in every County Development Plan and Town Development Plan. National Inventory of Architectural Heritage (NIAH) The National Inventory of Architectural Heritage (NIAH) places a statutory basis under the provisions of the Architectural Heritage (National Inventory) and Historic Monuments (Miscellaneous Provisions) Act The NIAH s role is to identify record and evaluate the post-1700 architectural heritage of Ireland. It aims to promote the appreciation of, and contributes to the protection of, the built heritage by systematically recording a representative sample of that built heritage on a nationwide basis. The surveys provide the basis for the recommendations of the Minister to the planning authorities for the inclusion of particular structures in the Record of Protected Structures (RPS). The NIAH Historic Garden and Designed Landscape Survey Historic landscapes, gardens and demesnes are usually, but not always, associated with Protected Structures and therefore do not always have statutory protection. The NIAH designed landscapes and

19 historic gardens survey is a preliminary non-statutory survey, based on a paper study using historic map sources and aerial photography, some of the sites that have been identified on it have long since been subsumed into a farming landscapes particularly when the principal house has been demolished
