Also regarding having a system where vehicles are backed up onto the road waiting to enter whilst collecting a ticket. Highways North Yorkshire Environment Agency Harrogate Police Station CEHO Craven Area Ranger (Wharfedale & Littondale) Any system allowing cars freely into the car park and charging upon exit or at a discrete ticket machine would be a major improvement on road safety and congestion. Whether this could be achieved without visible barriers for example, Automatic Number Plate Recognition does appear to appease more residents. design standard for the site is MfS and the required visibility splay is 60 metres by metres. available visibility is 60 metres by metres. Consequently the Local Highway Authority recommends that the following Conditions are attached to any permission granted in relation to: (i) Gates and Barriers; (ii) Land Gradient; and, (iii) Visibility Splays. No comments. site is located within a low crime and disorder area. Observations: Pay Stations can be vulnerable to attack and it is therefore advisable that they are emptied on a regular basis and collection times are varied. No response received. Proposed development directly affects the Public Right Of Way. If approved: permission does not authorise the doing of anything which interferes with Public Right of Way
3 PUBLIC RESPONSES Schedule No: Number /7 which crosses the site. development authorised must not be started until a section 47 of the Highways Act 980 to erect a new barrier (pedestrian gate) across a public right of way is authorised by the YDNPA Area Ranger. Unless and until this happens the right of way must remain free of obstruction and be available for use at all times. None to date. RELEVANT PLANNING POLICIES SP(5) - Presumption in favour of Sustainable Development SP(5) - National Park Purposes SP4(5) - Development Quality OFFICER OBSERVATIONS REASON FOR COMMITTEE CONSIDERATION This application is reported to Committee for the following reason: the application has been called to Committee by Mr Robert Heseltine and the public interest reason given is it appears that the application has strong support locally and is a logical and sensible improvement to the access to and egress from this facility. APPLICATION SITE application concerns an agricultural field located to the south east of Bridge between and Hartlington. field is situated within an open pastoral landscape and is visible from close and long distance views from many vantage points on higher ground. A public footpath crosses the site. site is accessed from the to Appletreewick road. It appears that the access has recently been widened to double gate width and hardstanding laid from the highway into the field. PROPOSAL proposal is for the installation of a car park pay station machine and two automated control barriers in and out. application includes an additional triangle of tarmac hardstanding; a walled 'island' within which the barrier and pay machines would be set and timber fencing to enclose the installation. RELEVANT PLANNING HISTORY planning history for the site includes the following applications: - YD/SN/604 Erection of Public Conveniences the National Park sub-committee decided to grant permission subject to the receipt of amended plans which were not submitted and therefore a decision was not issued (3/8/973). - YD5/38/ Erection of toilet block for use on existing car park. Installation of septic tank approved 4/9/ C/38/A Extension and wheel chair facilities to toilet block approved 3//05 use of the site as a car park is addressed below.
4 KEY ISSUES: - principle of car park use - impact on character and appearance of area - parish council comments Schedule No: PRINCIPLE OF CAR PARK USE proposal for a car park pay machine and barrier installation is justified on basis of the use of the land as a car park. However the site does not have planning permission for use as a car park. Permitted development rights (Class B, Part 4, Schedule of the Town and Country Planning (General Permitted Development) Order 05 (as amended)) allow for the temporary use of land for not more than 8 days in any calendar year. A letter from the Area Planning Officer dated 3/8/973, in relation to application YD/SN/604, states use of O.S. field 7 for occasional parking and picnic purposes has subsisted for many years. It is opened at the discretion of the owner at weekends and more generally during the summer months, and a charge is made. re has never been a planning permission for the use, which has of course increased steadily over the years It may be that the time will come when some planning control over the periods of use should be sought." applicant confirms that the field is open to car parking from Easter to early September "on the days when the ground is suitable to accommodate cars without damaging the field"". applicant estimates that car parking on the field is only available on approximately 60% of the days during the period it is open. applicant also suggests that the number of vehicles using the field can vary between 0 and 000 and that it provides a service for village businesses and visitors alike. provision of the automated barrier installation is also seen as necessary to avoid congestion arising from cars entering and exiting the field. Clearly this field has been used for many years for occasional car parking during the summer months but is otherwise used for agricultural purposes. It does not have a lawful use as a car park. IMPACT ON CHARACTER AND APPEARANCE OF AREA character and appearance of the area is a typical pastoral setting to an attractive dales village situated on the River Wharfe. fields around the village are enclosed by dry stone walls, with an occasional field barn and are used for pasture. area around has great scenic value which is appreciated by thousands of visitors every year. site forms part of this landscape and the setting to the village. proposed barrier and pay machine installation is typical of an urban car park dealing with high volumes of traffic. y would be set within an access that appears to have been constructed to facilitate the car park use - the access has been widened and a large area of hardstanding laid. Works of this nature that are 'reasonably necessary for the purposes of agriculture' are permitted development however that does not seem to be the case here. Although the barriers and pay machine would be set within a stone structure they, in conjunction with the access works that have already been undertaken, would be an incongruous feature in this highly sensitive landscape.
5 RECOMMENDATION It is recommended that permission is refused for the following reason: Schedule No: PARISH COUNCIL COMMENTS Hartlington Parish Council has some concerns about the visual impact of the proposed automated barriers in what is an agricultural field and also having a system that results in vehicles backed up onto the road waiting to enter whilst collecting a ticket. Parish Council would prefer a discreet system, without barriers, that improves road safety and congestion. Parish Council does not expressly refer to support or objection but is clearly concerned over the visual impact of the proposed barriers and would prefer a 'less visible' system. ANALYSIS OF MATERIAL CONSIDERATIONS It is clear that the applicants manage the car parking useage of the site to ensure that the field is not damaged, whether for agricultural reasons or visual, or both. It may also be fair to say that provision of car parking outside of the village helps to prevent congestion within the village and provide access to the river and village for visitors, benefitting them and local businesses. However this application is not about whether car parking should be allowed on this particular site or not, it is about whether the proposed automated barrier and a pay machine system is acceptable or not. Members are reminded that national planning guidance (para 5, NPPF) gives 'great weight' to conserving the landscape and scenic beauty in National Parks, which have 'the highest status of protection in relation to landscape and scenic beauty'. Members are advised that this proposal requires a judgement to be made on its impact on landscape and scenic beauty. principle of protecting the visual quality of the landscape is enshrined in the first Statutory Purpose of National Parks and in policies SP, SP and SP4 of the Yorkshire Dales National Park Local Plan (05-030). high visual quality of the landscape around and the fact that it is unspoilt by unsightly modern development is one of the 'special qualities' of the National Park and the reason why so many people visit the area. Although this proposal is small in scale it is development of this nature which has a negative impact that erodes the visual quality and farmed landscape character of the area. In the opinion of the Local Planning Authority, the proposed automated barrier and pay station installation and associated works would, by reason of its design and appearance, and by adding to existing works to the field access, have a significant harmful impact on the scenic beauty of the landscape and setting of and the traditional farmed character of the area. proposal would detract from these features which are 'special qualities' of the National Park. As such the proposal is contrary to the first Statutory Purpose of National Parks, to the guidance contained in para. 5 of the National Planning Policy Framework that great weight should be given to conserving landscape and scenic beauty in National Parks, and to policies SP, SP and SP4 of the Yorkshire Dales National Park Local Plan (05-030).
