Phillips, AICP, Planning & Zoning Division Manager SP1986 Zaxby s Restaurant DATE: December 6, 2010 BACKGROUND: REQUEST: This is a request for approval of a site plan for a 2,664 square foot restaurant with a drive through on a.807 acre property located on the north side of Sea Island Road, approximately 740 feet west of the Sea Island Road, Frederica Road intersection. The property is accessed from Market Street. APPLICANT: Carter Engineering Consultants, agent for Cordell Enterprises, owner. PARCEL NUMBER: 04-05141 (part). CURRENT ZONING: PD (Planned Development), part of the Old Stables Tract Planned Development. PROPOSED ZONING: No change. COMPREHENSIVE PLAN LAND USE DESIGNATION: This site is located in the St. Simons/Sea Islands Future Development Area. This designation permits commercial uses in mixed use centers. The Future Land Use Map shows this area as a Village Center. EXISTING LAND USE: Portion of the Sea Island Support Campus, with employee parking, maintenance facilities, etc. PROPOSED LAND USE: Freestanding restaurant. PLANNING: The proposal is part of the development of what was formerly used for various support functions for the Sea Island resort properties. In addition to consolidated employee parking, the site included a day care center for employees, maintenance support facilities, vehicle maintenance, and the computer center. The site received zoning approval (March 5, 2009 - ZM1373, Old Stables Tract Planned Development) to be developed as a mixed-use project including residential, hotel, and retail uses, along with a smaller support facility for the resort. The day care center is currently used by a private school. An area near the intersection of Frederica Road and Sea Island Road is being acquired by the St.

The proposed restaurant is consistent with the overall plan for the development of the Old Stables Tract project. A plan has also been approved for some of the infrastructure that serves this site, specifically including the driveways and water and sewer facilities. The site plan has been reviewed and meets all technical requirements except that the tree plan must be sealed by a landscape architect. The landscaping plan and treatment of the buffer area has been discussed and a revised plan has been submitted that meets all requirements, although the plant materials in the buffer area are to be changed to be consistent with the adjoining developments. In addition, staff suggests that final approval of the Building Permit and the Building Permit Site Plan should include a pre-construction meeting to ensure coordination of construction on this site with nearby infrastructure serving the project. ENGINEERING: Engineering comments are attached to this report. These are primarily technical comments that will be resolved before approval of permits. TRANSPORTATION: Compliant. UTILITIES: Comments, if any, will be addressed through the building permit review. SCHOOLS: N/A. FIRE / POLICE: N/A. FINDINGS Under Section 619.4 (a) of the Zoning Ordinance the Planning Commission review shall be guided by the following standards and criteria: 1) The application, site plan, and other submitted information contain all the items required under this Section. Staff comment: This requirement has been met. 2) The proposed uses, buildings and structures are in accordance with the requirements of this Ordinance and other ordinances of Glynn County. Staff comment: This requirement has been met. 3) Adequate provisions are made for ingress and egress, off-street parking, loading, and the flow of traffic, which may reasonably be anticipated. Staff comment: This requirement has been met. 4) Adequate provisions are made to control the flow of storm water from and across the site. Staff comment: This requirement has been met. 5) Adequate provisions are made to protect trees that are selected to remain as depicted on the site plan. Staff comment: This requirement has been met. 6) Adequate provisions are made to buffer intensive uses and to screen all service areas from view of the adjacent properties and streets. Staff comment: This requirement has been met. The landscaping and buffer plans have been revised to address staff concerns. 7) Adequate provisions are made to control the location, intensity, and direction of all outdoor lighting so that it will not have an adverse effect upon adjoining properties. Approve the request as submitted. 2. Deny the request as submitted. 3. Defer the request at the request of the applicant or at the request of staff. RECOMMENDATION: Staff recommends approval of application SP1986, subject to meeting all requirements and subject to final revisions of the tree plan and buffer landscaping.
