A fire resistant cabinet helps: - to minimise the fire risk if storing flammable goods - to protect the flammable goods for a certain length of time in the event of fire - to guarantee sufficient protection of personnel in the event of fire, by enabling them to leave the workroom and the building safely - to guarantee sufficient protection of emergency medical personnel and fire men while entering the workroom before flammable goods inside can cause an uncontrollable fire. The proper and safe way to store Be prepared The new European standard EN Regulations in the European countries will change due to the forthcoming new European standard EN This new European standard requires fire resistant cabinets for storing flammable goods at workplaces without exception! The new EN divides the fire resistance quality of cabinets into four classes: Type 15 Type 30 Type 60 Type 90 (the numbers indicate the fire resistance in minutes) The use of cabinets without any fire resistance classification will no longer be permitted! Trusting is good, testing is better The EN requires a fire chamber test for each cabinet model. The fire resistance capability shall be investigated by a type test in an authorised material testing institute. The institutes of this procedure are documenting the chamber test with a detailed official test report. 83 Storing in workrooms 1 The term hazardous material originates from the sector/branch of Chemical Act and the Regulation for Hazardous Materials. This includes raw material, products/preparations or recyclings. These attributes are important for the way of storage. From the pie chart showing the quantity of hazardous materials transported, differentiating between different classes which are on the market you can see the quantitative importance of those classes, because the material transported also has to be stored. 1. the layout and the equipment of the workplace, 2. physical, chemical, and biological reasons, 3. the design, selection, and application of tools, particularly of certain substances, machines, and plants as well as through handling and operating them, 4. the design of production procedures, working processes, and the working hours as well as through their combinations and interactions, 5. insufficient qualifications of the employees and poor training. F Easy inflammable, substances or preparations that have the ability to heat up and eventually ignite when in contact with air at normal temperature, even without energy addition, or if they - ignite easily in solid state by brief contact with an ignition source and keep on bur ning or glowing after removing of the ignition source in dangerous fashion. - have a very low flashpoint in liquid state, - develop highly inflammable gases in dangerous quantities upon contact with water or with damp air. 73,6 % combustible liquids 13 "The persons responsible for the fulfilment of the duties besides the employer are those persons who have been nominated in writing by the employer. To protect people and environment, special regulations and laws (TrbF, TRGS, BGR and lots of others) have to be realised in those workshops which handle hazardous material. The responsibility for the realisation has to be taken over by the employer. Extract from the German Workers Protection Law (ArbSchG): 3 "The employer is committed to taking all relevant measures stated in the workers protection law. "Furthermore, the employer ( ) is committed to providing all necessary means. 5 Assessment of working conditions. (1) Taking into account the risks for the employees resulting from the working conditions, the employer has to determine through an assessment which means related to the workers labour protection are required and have to be taken. (2) The employer has to assess the risks on the basis of the activities done by the employee(s). If the working conditions at several workplaces are comparable, an assessment of the risks of one of the workplaces is sufficient. (3) A hazard to human health can be caused in particular through: Classification of dangerous substances Materials and preparations are considered dangerous if they have one or several of the properties specified in section 3a para 1 of the German Chemicals Act and in appendix VI of the guideline 67/548/EWG. 84 1 Storing in workrooms Extraction principle of the safety cabinets Solvents are usually heavier than air. Therefore, contaminating vapours settle near the bottom. DIN 12925, part 1 (4/98) EN Exhaustion has to be most efficient right above the bottom plate of the safety cabinet. EN Permanent technical exhaustion of the safety cabinets to protect the employees against health-hazardous vapours and to minimize the effects of contaminating vapours at the workplace. The effective ventilation of asecos safety cabinets is constructed as follows: Fresh air Exhaust air Connection piece (NW75) on top of the cabinet. The connection piece has to be attaced to a customer provided exhaust air ventilation system. The low pressure inside the cabinet due to the exhaustion process causes an automatic indraught of fresh air through the fresh air connection piece. The air duct integrated into the cabinet s side panels let fresh air flow into the cabinet at the upper left part of the cabinet. The air is withdrawn at the lower right part of the cabinet right above the bottom panel and directed to the exit air duct via the exit air valve. 85 Storing in workrooms 1 Approval documentation Safety cabinets for storing flammable liquids in workrooms (DIN /98) The safety related targets of a safety cabinet are unambiguously determined in the Technical Regulations for Flammable Liquids (TRbF). TRbF 22, which has been valid so far, was abolished by the publication of the Bundesarbeitsblatt Nr 6 (Federal Worksheet No. 6) on 15 May 2002 and has been fully and unrevisedly integrated into TRbF 20 as appendix L Definitions of safety-related target for safety cabinets TRbF 20 (Appendix L) l Safety for employees and third parties in workrooms, in particular protection against fire and explosions. l Most relevant assessment factor in terms of safety is the fire resistance classification (FWF) of a safety cabinet. EN/DIN /2002: l Sufficient safety for the staff to leave the workroom safely in the event of fire. l Sufficient protection of the rescue personnel and the fire-fighters while entering before flammable goods inside can cause an uncontrolable fire. l Protection for the material stored in the cabinet for a certain minimum period of time in the event of fire. l Preventing material from leaking out of the cabinet. Fire protection in accordance with the law Perfect approval documentation is the basic condition for the safety of the employees and the legal usage of the safety cabinets. The core issue for acceptance procedures besides GS and CE conformity certificates is the test report stating the achieved fire resistance classification. Officially authorised material testing institutes (MPA) test the fire resistance of the cabinets in fire chamber through so-called "destructive tests (type tests). These institutes do so with good reason, as DIN part 1, issue 04/1998 (safety cabinets for flammable liquids) and DIN part 2, yellow print 09/1998 (safety cabinets for pressure gas bottles) state that there is an obligation to determine the fire resistance classification in a type test. How does a fire chamber test work? l The cabinet is exposed to fire in a closed fire chamber according to standard temperature line DIN 4102 part 2. l The duration of the exposure depends on the fire resistance classification set by the manufacturer. l The cabinet is equipped with several gauges to measure the temperature of the cabinet panels and the air temperature. l Most flammable liquids feature an inflammation temperature of at least 200 C. When the inside of the cabinet is heated up, the vapour / air mix ture ignites. Therefore, the fire chamber test is to show that the inside temperature does not exceed 180 C at the measurement spots during the test. l The fire chamber test is regarded successful if the above mentioned temperature of 180 C is not exceeded. The duration of the exposure to the fire (15, 30, 60 or 90 minutes) is clearly determined in DIN/EN and defines the fire resistance of the cabinet. The material testing institutes document the tests they have carried out with an official test report. Such a test report confirms the highest possible fire resistance classification FWF90 as state-of-art technology. Perfect approval documentation According to the slogan "trusting is good tested is better, asecos attaches great importance to these fire chamber tests. All cabinet models have to undergo the type test, and a test report has been issued for each model. Voluntary monitoring In addition, production is subject to permanent monitoring by an authorised material testing institute. What does that mean? l An MPA test engineer comes to our premises without prior announcement, l The engineer checks materials used for the production of the safety cabinets and also the trueness of the products (comparing the data with the data as stated in the type test documentation), l picks a cabinet from the current production line or from the warehouse, l seals this cabinet, l and carries out a fire chamber test with this particular cabinet. l If the test results differ from the results of the type test, immediate corrective actions will be generated by the MPA. 141 Conditions of sales and delivery 7 1. Quotation and Conclusion of the Sales Contract All quotations, sales, and deliveries are subject to the below mentioned terms and conditions. Any order will be regarded as accepted when confirmed in writing by us, and our offer shall be regarded as non-binding until we have confirmed the order in writing. Orders made on the phone or submitted telegraphically or orally as well as any amendments, changes, etc. require our written confirmation to become effective. Any regulations, comments, etc. which do not match these terms and conditions and which have been issued by the customer shall not be considered valid unless accepted in writing by us. Any dimensions, weights, illustrations, descriptions, and drawings shall not be binding for the execution of the order unless explicitly confirmed in writing by us. Any illustrations, drawings, sketches, and other documents shall remain our intellectual and legal property. These documents must not be made accessible to any third party without our prior approval in writing and have to be handed back to us upon request. The customer has to make sure that implementing documents provided by the customer do not infringe the rights of any third party. We are not committed against the customer to checking whether the provision of quotations due to implementing documents provided by the customer and in the event of an execution of an order will infringe any protective rights of a third party. However, if we are to be held liable for any claims made by a third party, the customer shall indemnify us in the event of any right of recourse. 2. Prices All prices are quoted ex works, they are euro net prices and do not include packaging unless stipulated to the contrary. All former prices shall become ineffective on the publication of this catalogue. Prices are based on the costs incurring on the date of the order confirmation and on the costs incurring on the date of the confirmation of the quotation respectively. If the costs for material, auxiliaries, freight, energy, wages, etc. have risen until the date of delivery, we shall 3. Delivery Times The delivery times stated are not binding and shall be regarded as approximate deadlines. If further questions relating to the execution of the order need to be discussed, the delivery time shall start on the date when such enquiries were settled and both parties agreed on all terms and conditions for the conclusion of the sales contract. The delivery time stated refers to the date of completion of the product in our factory, and keeping to this delivery deadline is subject to the customer s meeting his contractual obligations and his keeping to the stipulated payment dates. Acts of God, which are beyond our control, such as mobilization, war, blockades, riots, import or export bans, fire, strikes, lockouts, machine breakdowns, power failures, lacks of raw material or commodities due to delayed delivery by the supplier, spoiled works on our premises or at the supplier s shall extend the stated delivery time in a reasonable way also when such Acts occur during a possible delay in delivery. The above Acts shall entitle us to fully or partially withdraw from the contract if the execution of the orders is impeded or significantly complicated due to these Acts. Partial deliveries shall be permitted. 4. Dispatch Dispatch shall be made for the customer s account and risk even if the goods are delivered DDP. Selection of the transportation route and of the means of transport will be made at our best discretion unless specific regulations have been submitted. There will be no liability assumed for the least expensive carriage of goods. The risk shall be transferred to the customer as soon as a note has been issued that the goods are ready for dispatch. If the dispatch is delayed and the customer is to be blamed for such delay, we shall be entitled to effect insurance against any possible risks at the customer s expense. The freight charges quoted in the catalogue shall exclusively apply to deliveries made on the mainland in Germany. 5. Packaging Necessary and required packaging will be invoiced on the lowest basis unless included in the sales price. Any packing material shall not be taken back unless returned to us in perfect condition and free of charge. 6. Liability When an order has been placed, we shall not be held liable for any defective design we are to blame for, for any insufficient execution, or for material defects unless the detection of such failures would have been subject to professional care. If products are made to the customer s specifications, we can only be held liable for non-obedience to the specifications, if applicable. If we have been requested to find a solution for a design, we cannot be held liable for any product liability claims unless the customer can give evidence that the product does not comply with general technology standards and that this non-compliance is due to our culpability. Any possible complaints concerning the consignment shall be submitted in writing not later than 8 (eight) days after receipt of the goods. The customer may claim free repair of the defective parts or a replacement on the basis of the product liability terms. The decision whether to replace the defective goods or to repair them shall be made at our discretion. Any costs incurred due to an unjustified complaint will have to be covered by the customer. We shall not be committed to remedying the failure if the customer has not fully met his financial obligations. Product liability shall become ineffective if the customer has modified the product without our prior approval. A lack of any guaranteed feature(s) shall be regarded as a defect in the sense of the terms of delivery. Any further claims lodged by the customer shall be excluded. This especially applies to claims concerning conversion, reduction, or replacement due to any kinds of defect. 141

142 7 Conditions of sales and delivery 7. Terms of Payment Payment shall be effected within 10 (ten) days granting a 2% cash discount or within 30 (thirty) days net unless stipulated to the contrary. The costs for manual labour shall be paid without any deduction immediately on receipt of the invoice. If there is some time given to effect a payment or if a payment is effected later than stipulated, we shall be entitled to charge interest 2% above the current Deutsche Bank discount rate for the meantime without being committed to demanding overdue payment. Any repayment of payments, a retention of funds due to justified or unjustified complaints, and any set-offs due to possible counter-claims lodged by the customer and rejected by us shall be excluded. Any unsatisfactory information about the customer s solvency as well as justified doubts concerning the customer s solvency shall entitle us to claim for all and any pre-payments for all deliveries to be effected under current contracts or to cancel all or some delivery contracts through a unilateral statement. However, any partial delivery shall be regarded as an independent contract. 8. Reservation of Owner s Title All and any deliveries will be effected ex works or ex warehouse of dispatch, and the seller s owner title shall be reserved until all payments according to the sales contract have been effected and all other terms and conditions affecting the deal between the customer and us have been fulfilled. The our reservation of owner s title as well as any possible distraint of the subject of delivery by us shall not be regarded as a cancellation of the sales contract. We shall be entitled to effect insurance for the subject of delivery at the customer s expense for all possible risks unless the customer has evidently effected insurance for the goods. The reservation of owner s title shall also apply when the customer has processed the goods. Our property claim will then be extended to the item created through the processing procedures. This item shall then be handled with commercial care on our behalf. If the goods delivered are resold to a third party, even after being processed, the claim of the customer of the resale deal shall be regarded as transferred to us. This transfer also includes the seller s claim, which the customer may assert against a third party, if required. The customer is committed to informing us about the resale of the delivered goods stating the name and address of the buyer of the resale deal. The customer shall grant us the right as of the beginning to inform the third party about the transfer of all claims resulting from the resale process. Required documents and information shall be made available. If the financial situation of the customer worsens significantly and if judicial or out-of-court insolvency proceedings or bankruptcy proceedings have been filed against the customer s property, the financial claims including all and any payments resulting from the business relation to be made in favour of the supplier shall be due for payment immediately. 9. Place of Performance and Place of Jurisdiction As soon as the contract has been concluded, the contractual parties shall explicitly agree on the current domicile of our firm to be the place of performance and the place of jurisdiction for any delivery and any payment. If the customer is not regarded as a merchant in the sense of 4 German Commercial Code (HGB), this stipulation shall at least be effective for the assertion of our pecuniary claims in the framework of a summary proceedings for recovery of debt or liquidated demand. 10. General Items The above terms of sale are in compliance with German legislation. All contracts concluded on this basis and the interpretation of such contracts are exclusively subject to German legislation. Any conditions of purchase stated by the customer and contradicting the above terms and conditions shall not be regarded as binding for us even if the customer regards his conditions as the basis for the sales contract and we have not explicitly rejected his conditions. If any of the above agreements or arrangements is or will become invalid, the validity of all other agreements or arrangements will not be affected by this. Any invalid agreement or arrangement has to be substituted by a valid corresponding agreement or arrangement. 142
