2 PROVINCE DE QUÉBEC VILLE DE ONTRÉAL ARRONDISSEENT DE PIERREFONDS-ROXBORO BY-LAW CA BY-LAW ON COLLECTION OF RESIDUAL ATERIALS At a regular council sitting of the Borough of Pierrefonds-Roxboro held in the council room situated at 13665, boulevard de Pierrefonds, in the city of ontreal, on December , at 7 p.m. in conformity with the Cities and Towns Act (L.R.Q., Chapter C-19), at which were present: ayor of the Borough Councillors rs. onique Worth rs. Ward all members of the council and forming a quorum under the chairmanship of the ayor of the Borough, rs. onique Worth. The Director of the Borough, r. Jacques Chan, and the Secretary of the Borough, e Suzanne Corbeil, were also present. THE BOROUGH COUNCIL ENACTS THE FOLLOWING: SECTION I DEFINITIONS 1. In the present by-law, the following words mean : proper authority : the Director of the Urban Planning and Business Services Department of the Borough or his authorized representative; R recycling container : Repealed mobile recycling container : rigid plastic container having a capacity of three hundred and sixty litres (360 l) adapted for mechanized collection; (CA ; ) recyclable materials collection : any operation that involves the removal of recyclable materials from a disposal site for delivery to a sorting or processing center; garbage collection : any operation that involves the removal from a disposal site of green waste placed in authorized containers for delivery to a processing site; green waste collection : any operation that involves the removal from a disposal site of green waste placed in authorized containers for delivery to a processing site; automatic collection : collection made by means of a robotic system that ensures manual or automatic taking up and proceeds mechanically to the lifting, disposal and taking down of a mobile recycling container; 1

3 garbage disposal container : a case, closed and watertight, of a maximum capacity of three cubic meters (3 m 3 ), made of metal, equipped with a stopping device and of a system allowing mechanical emptying and of which the cover must be kept closed; bulky items : old furniture, mattresses, household appliances such as ranges, washers, dryers, television sets, hot water tanks, excluding any appliance containing a coolant and tires; recyclable materials : residual material that can be recycled, mainly paper, cardboard, plastic, steel aluminium and glass containers; occupant : the owner, tenant or any other person occupying a one-family or multifamily dwelling, an office building, a commercial, industrial, institutional, manufacturing or public building; garbage : solid residues resulting from the handling, cooking, preparation and consumption of food, storage and sale of perishable goods, household waste, trash, empty containers and empty packages, bulky items and waste of any kind; Recyclable materials, solid, liquid, or gas residues from industrial or manufacturing and commercial operations exceeding the allowed quantities,, hot ashes, evergreen branches with a diameter exceeding five centimeters (5 cm) or longer than one meter (1m), construction or renovation materials, demolition materials, earth, concrete, pathological waste, and hazardous materials as defined in the Environment Quality Act (R.S.Q., c.q-2) are not considered garbage; hazardous domestic waste : any material having properties that may present danger for health or environment and which are, within the meaning of by-laws enforcing the Environment Quality Act (R.S.Q., c.q-2), corresponding to the definitions of corrosive residue, inflammable residue, leachable residue, reactive residue, toxic residue and any material or object likened to hazardous materials; green waste : residues composed of leaves, grass, gardening waste, evergreen or shrub clippings, trimming, weeding and dethatching waste, vegetable and fruit trees waste, branches shredded into chips of size less than 2.5 cm or other similar materials;. 2

4 SECTION II GARBAGE AND RECYCLABLE OR RE-USABLE ATERIALS CONTAINERS 2. Garbage intended for collection, except for bulky objects, must be placed in one of the following containers: 1 a close and watertight garbage receptacle, made of metal or plastic material, equipped with handles and a cover, having a maximum capacity of three hundred and sixty litres (360 l) if the collection is made manually. 2 a polyethylene bag tied or attached in such a manner as to hold the garbage load it contains. N 3. Green waste intended for collection of green waste must be placed in a paper bag, a non-waxed cardboard box or any other reusable container with a capacity of one hundred and twenty liters (120 l), two hundred and forty liters (240 l) or three hundred sixty liters (360 l) with the exception of a recycling bin. 4. The occupants of a residential building shall, for the collection of recyclable materials, place recyclable materials in a wheeled recycling bin. 5 Garbage collection is limited to one hundred and fifty kilograms (150 kg) per collection unit or to six containers complying with section 2, each one not exceeding a weight of twenty-five kilograms (25 kg) or bundles of branches not exceeding five centimetres (5 cm) in diameter and tied up in maximum lengths of one meter (1 m). Any combination of containers must not exceed six (6) units. The occupant of a building must remove at its own charge any quantity of garbage exceeding the limit provided for in the present by-law. He must also see that the garbage collection or recyclable materials collection be done at least once a week to prevent any accumulation. 6 Containers intended for garbage collection or recyclable materials collection should be clean, tight and in good condition. A container intended to be used in a repetitive manner, which is not in good functioning order and represents a danger while its manipulating or which is damaged to the point that it does not hold its load, is considered to be a garbage or recyclable material depending on the circumstances. 6.1 The containers and garbage containers must be maintained closed at all times by a lid. (CA ; ) 6.2 Anyone using a container installed on the public domain, in accordance with the by-law governing the occupation of public domain, to dispose of household waste, must use a sealed container, with a maximum capacity of 3 m 3 and a cover that must be kept closed. (CA ; ) 7. Any container intended to be used in a repetitive manner for the disposal of garbage or recyclable ore re-usable materials must bear the address of the owner. 3

5 SECTION III PREPARATION OF GARBAGE AND RECYCABLE OR RE-USABLE ATERIALS 8. The preparation of garbage for the collection day must be done as follows: 1º garbage must be drained and wrapped; 2º garden waste must be crushed or smashed and if it cannot be placed in a container complying to section 2, it must be tied up in bundles; 3º ashes must be extinguished and cool; 4º no garbage must have sharp or cutting edges Bundles mentioned in sub-section 2 of the first paragraph must not be longer than one meter (1 m) and not more than fifty centimetres (50 cm) in diameter and must not have any element of more than five centimetres (5 cm) in diameter. 9. The occupant of a residential building must dispose of recyclable or re-usable materials in a container as mentioned in section 4. Newspapers, papers and cardboards, once crushed, shall be tied up or placed in a paper bag; glass, metal and plastic containers must be emptied, cleaned and rinsed and lids must be removed before they are placed in the container. Notwithstanding the second paragraph, newspapers, papers and cardboards do not have to be tied up or placed in a paper bag when they are placed in an authorized mobile container by virtue of section 4. (CA ; ) Only recyclable materials must be taken out for the recyclable materials collection. 10. It is forbidden to put hazardous household waste for the garbage or the recyclable materials collection. 11. Whoever places for removal or disposes in any way of a refrigerator, freezer, case, suitcase, chest or any other container with a latching mechanism must have first removed the said mechanism. SECTION IV COLLECTIONS 12 The council will fix by ordinance the collection schedules. 13. Containers intended for garbage collection or the collection of recyclable materials must be placed in front of the building where they come from, along the street, within the limits of the sidewalk, curb, ditch or a place where the contractor can approach it, the container for the recyclable materials collection must have its wheels and handle facing the house. 4

6 14. Containers intended for garbage collection or the collection of recyclable materials must be placed no later than 7 a.m. on collection day but not before 8 p.m. the night before it. After the collection, containers must be removed on the same day before 7 p.m. Notwithstanding the first paragraph, containers intended for garbage collection or the collection of recyclable materials for the use of industrial, institutional and commercial establishments may be placed between 7 a.m. and 9:30 a.m. on the collection day. 15. It is prohibited: 1 to deposit garbage or recyclable or re-usable materials in front of the property of another party or in the container or bin of another party; 2 to place garbage or green waste in bins designated for recyclable materials. 3 to place recyclable or re-usable materials in garbage containers; 4 to place for garbage collection anything different from garbage; 5 to place for selective collection anything different from recyclable or reusable materials; R 16. Repealed 17. Anyone who wants to dispose of a refrigerator, an air conditioner, a cooler or any other device functioning with Freon, bulky items with coolants, evergreen logs and branches of conifers exceeding the allowable volume must contact the Borough, report that such an object must be collected and pay the prescribed fee, if any. Whoever wants to get rid of hazardous domestic garbage must do it on the hazardous garbage collection days scheduled by the Borough. SECTION V OFFENCES AND PENALTIES 18. Anyone contravening the present by-law is committing an offence and is liable: 1 in the case of physical person : for the first offence, to a fine from $100 to $1,000; for a subsequent offence, to a fine from $200 to $2,000; 2 in the case of a legal person: for the first offence, to a fine from $200 to $2,000; for a subsequent offence, to a fine from $400 to $4,000. 5

7 SECTION VI FINAL PROVISION 19. The present by-law replaces by-law number 1079 regarding waste collection and selective collection of recyclable and re-usable materials of the former Ville de Pierrefonds and by-law number 325 to establish types of garbage containers that may be used and the hours for placing such containers on the street for collection of the former Ville de Roxboro, and its amendments. 20. The present by-law comes into force according to Law. 6
