1 RESOLUTION NO. R AUTHORIZING THE WAIVING OF COMPETITIVE BIDS AND A WARDING A CONTRACT WITH FOOT STONE, INC. OF GLENVIEW, IL FOR THE HERITAGE SQUARE BASIN RESTORATION PROJECT IN THE TOTAL AMOUNT OF $85,000 WHEREAS the Village of Bensenville has been granted a Stormwater Management Easement over the existing basin in Heritage Square subdivision; and WHEREAS it the responsibility of the easement grantee to perform maintenance of the basin; and WHEREAS the subdivision was recorded in the year 2000; and WHEREAS staff does not have any record of maintenance of the basin since its construction; and WHEREAS due to lack of maintenance the basin is dominated with mvasive species as well as woody vegetation; and WHEREAS this project was bid as an Alternate 2 as part of the 2014 Various Native Vegetation Management Contract; and WHEREAS due to budgetary reasons the Alternate 2 was rejected in 20 14; and WHEREAS due to environmental reason the construction must be split over three years; and WHEREAS staff recently solicited a proposal from Foot Stone, Inc. in the amount of$89,500 to restore the basin over next three years; and WHEREAS after negotiations the proposal is reduced to $85,000 to restore the basin over the next three years; and WHEREAS this negotiated price was over $15,000 less than the lowest bidder from the 2014 bid process on this alternate, and WHEREAS, the Village is authorized and empowered, pursuant to the Illinois Municipal Code, 65 ILCS 5/8-9-1, to enter into public works contracts in excess of $20,000.00, without advertising for bids, if authorized by vote oftwo-thirds of all Village Trustees holding Office; and WHEREAS the Village staff recommends waiving competitive bids and awarding the contract to Foot Stone, Inc.; and NOW THEREFOR BE IT RESOLVED by the President and Board of Trustees of the Village of Bensenville, Counties ofdupage and Cook, Illinois as follows:

2 THAT the Village Board authorizes waiving competitive bids and awarding the Heritage Square Basin Restoration contract to Foot Stone, Inc. of Glenview, IL in the total amount of $85,000, and THAT the Village Board authorizes the Village Manager to execute a purchase order and other associated documents necessary. Jefferson Street Bensenville, IL Attn: Mehul Patel, PE, mpatel@bensenville.il.us Subject: Proposal for Restoring Bensenville Heritage Square Basin Site Site Evaluation On April 24, 2015 Mehul Patel of Bensenville and Rob Sulski and Tom O'Bryan of Foot Stone, Inc. toured the Heritage Square Basin site. A Google Earth image of the site is attached for reference, the image was constructed from documents supplied by the Village. The basin is overgrown with mostly non-native invasive species. The wet areas are dominated by Phragmites, which contributes to clogging of the basin drainage culvert. Moderate to heavy stands of invasive cattail, Reed Canary Grass and Purple Loosestrife are also present in the basin and wet areas. The berm surrounding the basin is infested with a fairly dense canopy of invasive trees and shrubs not limited to buckthorn, honeysuckle, willow and multiflora rose. Open upland areas are covered with teasel rosettes. Last year's dead teasel and Purple Loosestrife spikes are present, indicating seeds of these species have dropped and created a seed bank that will require 3 to 5 years of diligent effort to bring these species under control. Very little native vegetation is present anywhere on site. Proposal For a total cost of $85, Foot Stone, Inc. will perform work at the Heritage Square Basin site over the next 3 years in order to: 1) eradicate invasive and non-native vegetation; 2) install a native vegetation matrix that will not impede basin drainage, will promote infiltration of stormwater, and will be relatively inexpensive to maintain; 3) provide an aesthetically attractive resource to the residents surrounding the basin; and 4) provide habitat for song birds, butterflies and other beneficial wildlife.

4 The work plan and costs for the project are as follows: 2015 Work... $67, Remove all trees and shrubs, and herbicide cut stumps. Eradicate most all visible invasive forbs and grasses by a combination of manual, mechanical and chemical methods tailored to specific weed species present. Deadhead new- and re-sprouts of invasive weeds that were missed or survived initial eradication efforts, and dispose of same offsite; no seeds of invasive species will be allowed to drop on site. Seed all areas above the low water line with purchased seed of appropriate wet and mesic species (See attached species lists) mixed with an annual rye cover crop. Cover all seeded areas with double-mesh erosion control blanket. Install a total of 5,500 plant plugs of native wetland forb and grass species (See attached species list) at a density 1 plug per square foot at the low water line around the entire basin and at the corners of the basin Work... $12, Control all invasive trees, shrubs, plants and grasses by a combination of manual, mechanical and chemical methods tailored to specific weed species present. Spot mow portions of the basin as appropriate to foster native plant growth and control weeds. Over-seed larger bare-soil areas with purchased seed of appropriate wet and mesic species mixed with an annual rye cover crop Work... $5, Control all invasive trees, shrubs, forbs and grasses by a combination of manual, mechanical and chemical methods tailored to specific weed species present. Spot mow portions of the basin as appropriate to foster native plant growth and control weeds. Over-seed larger bare-soil areas with a combination of purchased seed and seed collected on site, of appropriate wet and mesic species. It is recommended that that the village adopt an annual maintenance program following the 3-year restoration project. Maintenance would include spot control of weeds and prescribed burning of half the basin each year. Service Conditions 1. Foot Stone agrees to perform the outlined work in a safe, professional manner. 2. All workers will be trained in their tasks and will be supervised by a qualified ecological restoration professional. 3. Timing of work will be dependent upon vegetation and weather conditions. 4. All chemicals will be applied conservatively by licensed individuals in accordance with product label requirements. 5. Any work not described herein shall be detailed and presented as a separate quote. 2

5 Billing and Payment 1. Payment for work completed is due within thirty (60) days of receipt of an invoice. 2.
