3 City of Auburn, New York SEQRA RESOLUTION #46 of 2016 DETERMINING THAT PROPOSED ACTION IS TYPE II ACTION FOR PURPOSES OF THE NEW YORK STATE ENVIRONMENTAL QUALITY REVIEW ACT By Councilor Giannettino April 7, 2016 WHEREAS, the City Council of the City of Auburn, New York (the "City") is considering undertaking the reconstruction of the City s water distribution system, including the reconstruction and improvement of the existing water distribution main on NYS Route 34, and the acquisition of replacement furnishings, equipment, machinery or apparatus required, (the Project ); WHEREAS, the Project activities consist of the reconstruction of the City s water distribution system, in kind, on the same site; and WHEREAS, pursuant to the New York State Environmental Quality Review Act (the "SEQR Act") and the regulations adopted pursuant thereto by the Department of Environmental Conservation of the State of New York, being 6 NYCRR Part 617, as amended (the "Regulations"), the City desires to comply with the SEQR Act and the Regulations with respect to the Project; NOW, THEREFORE, BE IT RESOLVED BY THE MEMBERS OF THE CITY COUNCIL OF THE CITY OF AUBURN, NEW YORK AS FOLLOWS: 1. The Project constitutes a "Type II Action" under 6 NYCRR 617.5(c) (2) and no further action under the SEQR Act and the Regulations is required. 2. This Resolution shall take effect immediately. The foregoing Resolution was thereupon declared duly adopted. We have reviewed the provided documentation in accordance with Section 106 of the National Historic Preservation Act of Please note these comments are those of OPRHP and relate only to Historic/Cultural resources. They do not include other environmental impacts to New York State parkland that may be involved in or near your project. Such impacts must be considered as part of the environmental review of the project pursuant to the National Environmental Policy Act and/or the State Environmental Quality Review Act (New York Environmental Conservation Law Article 8). Given the proximity of the rth Street Cemetery to the road right-of-way and potential project impacts, OPRHP recommends that the proposed water line not be installed east of the existing 6 gas line beneath the curb/sidewalk and adjacent to the cemetery. Submitted plans show the 6 gas line adjacent to the rth Street Cemetery and east of the existing 6 water main. OPRHP recommends that the new water main be placed only to the west of the existing gas line and towards the road centerline. If project impacts extend beyond and to the east of the existing 6 gas line, OPRHP recommends a boundary delineation study of the west side of the rth Street Cemetery along rth Street. This study would require geophysical prospection and topsoil stripping to identify any potential cemetery-related features or burials. 13 Smart Growth Assessment for the NY Water Grants Program & New York State Drinking Water State Revolving Fund Program MUST BE SUBMITTED WITH ALL NEW PROJECT LISTING FORMS DWSRF Applicant: Town, City, Village, or Water Company City of Auburn, New York DWSRF Project # if already Listed: Project Description: Water Distribution Improvements- NYS Route 34 and York Street Water Main: Replace 2,500 linear feet of corroded 6 cast iron distribution main that provides primary and secondary service to high service users in the City. Project Summary: The City of Auburn Department of Engineering Services has reviewed the current infrastructure surrounding the rth Street/York Street Service Area and has developed a preliminary mitigation plan to provide system reliability, increase volumetric capacity, and ease maintenance operations in the future. As illustrated below, the City is proposing to install a new 12" water main from Carpenter Street to the intersection of York Street. At the intersection the new main will connect to the existing 6" main that continues north along rth Street. In addition a new 12" water main will be installed westerly along York Street until meeting up with the existing 12" main on York Street. All existing services along this section will be abandoned from the existing 6" main and connected to the new 12" line. New valves, hydrants, and copper water services to the edge of the ROW will be provided. Additionally, the City proposes to install two (2) new 12" gate valves on either side of the existing Quarry Road 12" main. This will provide complete control over the direction of flow to Nucor Steel while maintaining the necessary volume required keeping the facility in operation. Abandonment of the northern 6" line along York Street is also proposed to minimize valving and elimination of redundant service mains in this area. The aforementioned strategy complements the health, sanitation, and security goals noted in section 4 while promoting a maintainable system in this service area. Please attach a map showing the location of the proposed project. SECTION 1 - SCREENING QUESTIONS 1. Prior Approvals a. Has the project been previously approved for DWSRF financing? If so, what was the DWSRF project number(s) for the prior approval(s)? b. If so, is the scope of the project substantially the same as that which was approved? t Applicable If the project was previously approved by EFC s Board and the scope of the project has not materially changed, the project is not subject to smart growth review. (te: An expanded infrastructure project results in an increase in the permitted water taking or the increase in the permitted flow capacity for the water treatment system.) SECTION 2 ADDITIONAL INFORMATION NEEDED FOR RELEVANT SMART GROWTH CRITERIA FOR DWSRF PROJECTS DOH has determined that the following smart growth criteria are relevant for DWSRF projects and that projects must meet each of these criteria to the extent practicable: 1. Uses or Improves Existing Infrastructure. a. Does the project use or improve existing infrastructure? Please indicate and describe below. 2. Serves a Municipal Center. Projects must serve an area in either a, b or c to the extent practicable. a. Does the project serve an area limited to one or more of the following municipal centers? Please select and describe all that apply: i) A City or Incorporated Village. ii) A central business district. iii) A main street. iv) A downtown area.

15 v) A Brownfield Opportunity Area. See for more information. vi) A downtown area of a Local Waterfront Revitalization Program Area. See for more information. vii) An area of transit-oriented development. viii) An Environmental Justice Area. See for more information. ix) A Hardship/Poverty Area. (te: Projects that primarily serve census tracts and block numbering areas which had a poverty rate of at least twenty percent according to the 2000 Census.) b. If the project serves an area located outside of a municipal center, does it serve an area located adjacent to a municipal center which has clearly defined borders, or is it in an area designated for concentrated development in a municipal or regional comprehensive plan and exhibit strong land use, transportation, infrastructure and economic connections to an existing municipal center? If yes, please describe and reference applicable plans. c. If the project is not located in a municipal center as defined above, is the area designated by a comprehensive plan and identified in zoning ordinance as a future municipal center? If yes, please describe and reference applicable plans. 3. Community- Based Planning. a. Provide a description of the plan to solicit community input regarding the project. b. Green infrastructure includes green wet weather practices which mimic natural hydrology and use, infiltrate, evaporate or evapotranspire rain near or where it falls. Some examples include rain gardens, green roofs, rainwater harvesting and reuse, and bioretention/bioinfiltration and porous pavement. t Applicable b.
