1 Item # 1.01 Comment Seq # 1 UMC SUBMITTER: UMC Technical Committee Proposal Revise text as follows: Alternate Materials and Methods of Construction Equivalency. Nothing in this code is intended to prevent the use of alternate materials, systems, methods or devices of equivalent or superior quality, strength, fire resistance effectiveness, durability, and safety over those prescribed by this code. Technical documentation shall be submitted to the Authority Having Jurisdiction to demonstrate equivalency. The Authority Having Jurisdiction shall have the authority to approve or disapprove the system, method or device when determined by the Authority Having Jurisdiction to be equivalent or superior. When the code change for the 2003 passed to get rid of all the permissive language of may to shall the language took away the Authority Having Jurisdiction s ability to not disapprove various methods, materials or devices. The way it is worded now the Authority Having Jurisdiction SHALL accept any of the above if it is listed by any recognized testing agency. This wording will correlate with Section of the Uniform Plumbing Code. COMMITTEE ACTION: Accept as Submitted A PUBLIC COMMENT(S) WAS SUBMITTED FOR REVIEW AND CONSIDERATION. PUBLIC COMMENT (ASSEMBLY ACTION): Submitter: Leonard Ramiocotti, City of Reno, NV Request to reject the code change proposal by this public comment. Contrary to the substantiation, nothing in the current language limits the ability to not disapprove a method. Not disapprove is a double negative that simply means approve. Current code language expressly allows the Authority Having Jurisdiction ( AHJ ) to approve or disapprove and alternate material or method. The proposed language is ambiguous and inadvertently makes approval of alternate material mandatory rather than discretionary upon the submission of any claim of equivalency. By requiring approval, the proposed code language may be interpreted to require jurisdictions to be testing grounds for new methods and methods. Local jurisdictions should be allowed to determine for themselves if they want to be beta testers for new products. The proposed code-language appears to shift the burden of proof to the AHJ to rebut claims of equivalency even for unknown products that have not been field tested anywhere. This may lead to lawsuits over whether local jurisdictions have met their burden to rebut claims of equivalency. AHJs who may have doubts as to a proposal s equivalency, but don t have the resources or expertise to fully evaluate the proposal or design an appropriate test may feel compelled to err toward approval rather than disproval. The current mandatory code language oversteps the role of model codes by improperly restricting the AHJ s 1

2 authority to disprove alternatives based upon other governmental policy reasons such as energy efficiency, water efficiency or access issues. The current code language is stating that the AHJ shall have the authority to approve or disapprove an alternate material or a method that was recommended by the UMC Non-Specific Code Language Task Group for the 2006 edition of the UMC. Item # 2 Comment Seq # 2 UMC and SUBMITTER: Martin Cooper Central California Chapter IAPMO Revise text as follows: Alternate Materials and Methods of Construction Equivalency. Nothing in this code is intended to prevent the use of alternate materials, systems, methods, or devices of equivalent or superior quality, strength, fire resistance, effectiveness, durability, and safety over those prescribed by this code that meet the requirements of this section. Any alternate material, system, method, or device approved for use shall comply with the intent of this code and shall provide an equivalent or superior level of quality, strength, effectiveness, fire resistance, durability and safety to that prescribed in this code. The Authority Having Jurisdiction shall have the authority to approve or disapprove the system, method, or device for the intended purpose. Any approval of an alternate material, system, method, or device shall be at the discretion of the Authority Having Jurisdiction Intent. However, tthe exercise of this discretionary approval by the Authority Having Jurisdiction shall have no effect beyond the jurisdictional boundaries of said Authority Having Jurisdiction. Any alternate material or method of construction so approved shall not be considered as conforming to the requirements and/or intent of this code for any purpose other than that granted by the Authority Having Jurisdiction. Revisions to the alternate material and alternative engineered design provisions to clarify that approval is discretionary, to clarify the requirement to comply with the intent of the code, to remove vague and ambiguous language, and to ensure consistency between UPC and UMC code language Current Code language is unclear as to whether alternate materials and methods of construction must comply with the intent of the code. The 2006 UMC inadvertently removed the express requirement that alternate materials and methods must comply with the intent of the code. However, a reference to this requirement remains in the last sentence of UMC section The requirement to comply with the intent of the code is also contained in the Alternative Engineered Design provisions of UPC section The proposed amendment clarifies this issue. The proposed amendment also creates consistency in the codes by harmonizing the alternate approval code-language found in the UPC and UMC. Proposed amendment clarifies the discretionary nature of the approval and harmonizes the language with the proposed changes in the UPC. Proposed amendment clarifies that alternate materials and methods of construction must comply with the intent of the code. A reliable conductor to ensure the required electrical conductivity between metal parts required to be electrically connected. [NFPA 70] Grounding Electrode. A device that establishes an electrical connection to the earth. Gas piping systems installed inside buildings have demonstrated a propensity to become energized from nearby lightning strikes. Conventional bonding of gas piping through the equipment grounding conductor has proven inadequate (in these circumstances) to prevent arcing between the gas piping and other nearby electrically conductive systems. CSST manufacturers collectively report dozens of damaged systems caused by improper or inadequate bonding resulting in fire damage or loss of property. Therefore, modifications are proposed to allow alternative methods for direct bonding of gas piping to the grounding system to insure a minimum threshold of protection from all threats (including indirect lightning strikes) that are likely to energize the piping. Current bonding of gas piping to the equipment grounding conductor will continue 3

4 to be permitted. Similar language has been submitted to the NEC (National Electrical Code) for the 2008 cycle. The proposed text is consistent with CSST systems manufacturers recommendation. [NFPA 70:100.1] CSST correlates with revision to section (A) Grounding Electrode is revised text extracted from NFPA 54 that was revised in the 2008 edition. The definition is revised by using the definition in the National Electrical Code. As this is an electrical term, the NEC definition is used to avoid any potential conflicts. The elevation of the design flood, including wave height, relative to the datum specified on the community s legally designated flood hazard map F Flood Hazard Area. The greater of the following two areas: 1. The area within a floodplain subject to a 1 percent or greater chance of flooding in any given year. 2. The area designated as a flood hazard area on a community s flood hazard map, or otherwise legally designated. 4

5 Flood Hazard Area Subject to High Velocity Wave Action. Area within the flood hazard area which is subject to high velocity wave action, and shown on a Flood Insurance Rate Map or other flood hazard map as Zone V, VO, VE or V Location Protection Against Damage. (Make existing text a subsection with title; remainder unchanged) Protection Against Flood Damage. For buildings located in flood hazard areas, heating, ventilating, air-conditioning, refrigeration, miscellaneous heatproducing, and energy-utilizing equipment and appliances shall be elevated at or above the design flood elevation. Exception: Equipment and appliances are permitted to be located below the design flood elevation provided that they are designed and installed to prevent water from entering or accumulating within the components and to resist hydrostatic and hydrodynamic loads and stresses, including the effects of buoyancy, during the occurrence of flooding to the design flood elevation in compliance with the flood-resistant construction requirements of the building code Walls below buildings in flood hazard areas subject to high velocity wave action. In flood hazard areas subject to high velocity wave action, equipment and appliances, including piping, shall not be mounted on or penetrate walls intended to break away under flood loads Air Exhaust and Intake Openings. Outside air exhaust openings and air intake openings shall be located at or above the design flood elevation Protection Against Flood Damage. Except for the floor immediately above the under-floor plenum, supply ducts shall be provided extending from the plenum to registers on other floor levels. Exception: In flood hazard areas, under-floor spaces shall not be used as supply plenums unless the flood opening requirements in the building code are satisfied In flood hazard areas tanks shall be elevated to or above the design flood elevation or they shall be designed, constructed, installed and anchored to resist all flood-related and other loads during the design flood, or lesser floods, without release of contents into floodwaters or infiltration by floodwaters into the contents. The code change provides consistency with the regulations of the National Flood Insurance Program (NFIP) and the flood resistant provisions of ASCE 24, which is referenced by the NFPA 5000 and the International Building Code. In particular, the NFIP regulations require that service systems and equipment be elevated above the design flood elevation, but also provide an option to elevating. The alternative is set forth in reg- 5

6 ulation at 44 CFR 60.3(a)(3)(iii) and (iv), and requires that buildings and structures be constructed with methods and practices that minimize flood damages and, specifically, that electrical, heating, ventilation, plumbing and air conditioning equipment and other service facilities be designed and/or located so as to prevent water from entering or accumulating within the components during conditions of flooding. Local jurisdictions that have been identified as subject to flooding as indicated on maps prepared for the National Flood Insurance Program (NFIP) are required to regulate development in flood hazard areas in order to qualify for certain forms of federal disaster assistance and for their citizens to be able to purchase federal flood insurance. To protect citizens and their property, it is important that the codes that govern construction include provisions to minimize damage and exposure to flooding. In addition, many local jurisdictions participate in the NFIP s Community Rating System (CRS). The CRS offers discounts on federal flood insurance premiums in communities that administer floodplain management programs that exceed the NFIP minimum requirements. The U.S. Department of Homeland Security/FEMA has determined that the proposed changes to the UMC will result in consistency with the NFIP regulations. Because of the multi-hazard benefits that accrue from administration of building codes, especially codes that include flood-resistant provisions, communities that adopt the UMC and other NFIP-consistent codes will qualify for additional points under the CRS. COMMITTEE ACTION: Accept as Submitted A PUBLIC COMMENT(S) WAS SUBMITTED FOR REVIEW AND CONSIDERATION. PUBLIC COMMENT: Submitter: David Delaquila, AHRI Request to reject the code change proposal by this public comment. AHRI disagrees with the proposed code change and urges the Committee to reverse its action to accept as submitted. AHRI is unaware of any type of residential heating equipment, or associated components, that are designed to meet the exception that would prevent water from entering the device or the equipment. In addition, current product standards do not contain testing requirements that would provide a mechanism for equipment and components to meet such a requirement. It would most likely take many years before equipment could be available on the market that would meet such a requirement. Residential heating appliances need to have access doors to allow for servicing and maintenance of the equipment, which would make this proposal extremely impractical. As such, being unable to meet the exception the equipment would need to be elevated as proposed and in many cases the installation would become cost prohibitive. In addition, there are no requirements that accompany this proposal that indicates how the equipment should be elevated and how it should be securely and safely mounted in its elevated position. Although well intended, the proposal does not go far enough to ensure for the safe and proper installation of the equipment as it would be elevated. This proposal is impractical for any residential heating appliances to meet and is unenforceable. 6

7 Item # 9 Comment Seq # 5 UMC , Excess Flow Valve SUBMITTER: Sidney Cavanaugh Cavanaugh Consulting Add new text as follows: EXCESS FLOW VALVE - A valve designed to close when the fuel gas passing through exceeds a prescribed flow rate. A needed definition duplicating same definition in the UPC for devices used in fuel gas systems and applications covered by both the plumbing and mechanical codes. COMMITTEE ACTION: Accept as Submitted A PUBLIC COMMENT(S) WAS SUBMITTED FOR REVIEW AND CONSIDERATION. PUBLIC COMMENT 1: Submitter: Ted Lemoff, NFPA Request to accept the code change proposal as modified by this public comment EXCESS FLOW VALVE (EFV) - A valve designed to close activate when the fuel gas passing through it exceeds a prescribed flow rate. This comment proposes a revision consistent with NFPA The definition is revised to recognize that excess flow valves, of the type used for gas piping systems, do not close completely. They allow a small bypass flow, which is used to reopen the valve. PUBLIC COMMENT 2: Submitter: Bryan Popp, Dormont Manufacturing Co Request to accept the code change proposal as modified by this public comment. Excess Flow Valve A valve designed to close when the fuel gas passing through exceeds a prescribed flow rate. Bypass Excess Flow. EXCESS FLOW VALVE (EFV) A valve installed in a fuel gas piping system to close when the rate of fuel gas through the device exceeds a set limit. 7

8 EXCESS FLOW VALVE BYPASS (EFVB) Excess flow valve designed to reduce the flow of fuel gas after the device is alarmed to a set limit and to reset automatically after the pressure in psi is equalized. EXCESS FLOW VALVE NON-BYPASS (EFVNB) Excess flow valve designed to prevent any flow of fuel gas after the device is alarmed and it has to be reset manually. The committee adopted a definition that can be inaccurate, misleading and insufficient to adequately describe these devices and the concepts associated with excess flow valves. This comment improves the proposed language of the standard. Item # 13 Comment Seq # 6 UMC Group A, B, E, F, H, I, M, R, S, and U SUBMITTER: John Taecker IAPMO Correlation Task Group, Chairman The following was recommend by the Correlation Task Group. (See Correlation Task Group Report Item 7) Delete all occupancy classifications from Section (Group A, B, E, F, H, I, M, R, S, and U) including their sub-divisions in their entirety from the UMC and amend the definition of Occupancy Classification as follows: OCCUPANCY CLASSIFICATION Classifications are defined in the Building Code. For the purpose of this code certain occupancies are defined as follows: Group A Occupancies Group A Occupancies include the use of a building or structure, or a portion thereof,for the gathering together of fifty (50) or more persons for purposes such as civic, social, or religious functions, recreation, education or instruction, food or drink consumption, or awaiting transportation. A room or space used for assembly purposes by less than fifty (50) persons and accessory to another occupancy shall be included as a part of that major occupancy. Assembly occupancies shall include the following: Division 1. A building or portion of a building having an assembly room with an occupant load of 1,000 or more and a legitimate stage. Division 2. A building or portion of a building having an assembly room with an occupant load of less than 1,000 and a legitimate stage. Division 2.1. A building or portion of a building having an assembly room with an occupant load of 300 or more without a legitimate stage, including such buildings used for educational purposes and not classed as a Group B or E Occupancy. Division 3. A building or portion of a building having an assembly room with an occupant load of less than 300 without a legitimate stage, including such buildings used for educational purposes and not classed as a Group B or E Occupancy. 8

9 Division 4. Stadiums, reviewing stands, and amusement park structures not included within other Group A Occupancies. Specific and general requirements for grandstands, bleachers, and reviewing stands are in the Building Code. Exception: Amusement buildings, or portions thereof, that are without walls or a roof and constructed to prevent the accumulation of smoke in assembly areas. Group B Occupancies Group B Occupancies shall include buildings, structures, or portions thereof for office, professional, or service-type transactions that are not classified as Group H Occupancies. Such occupancies include occupancies for the storage of records and accounts and eating and drinking establishments with an occupant load of less than fifty (50). Group E Occupancies Division 1. Any building used for educational purposes through the 12th grade by fifty (50) or more persons for more than twelve (12) hours per week or four (4) hours in any one day. Division 2. Any building used for educational purposes through the 12th grade by less than fifty (50 persons for more than twelve (12) hours per week or four (4) hours in any one day. Division 3. Any building or portion thereof used for day-care purposes for more than six (6) persons. Group F Occupancies Group F Occupancies shall include the use of a building or structure, or a portion thereof, for assembling, disassembling, fabricating, finishing, manufacturing, packaging, repair, or processing operations that are not classified as Group H Occupancies. Division 1. Moderate-hazard factory and industrial occupancies shall include factory and industrial uses that are not classified as Group F, Division 2 Occupancies. Division 2. Low-hazard factory and industrial occupancies shall include facilities producing noncombustible or nonexplosive materials that, during finishing, packing, or processing, do not involve a significant fire hazard. Group H Occupancies Group H Occupancies shall include buildings or structures, or portions thereof, that involve the manufacturing, processing, generation, or storage of materials that constitute a high fire, explosion, or health hazard. For definitions, identification and control of hazardous materials and pesticides, and the display of nonflammable solid and nonflammable or noncombustible liquid hazardous materials in Group B, F, M, or S Occupancies, see the Fire Code. Division 1. Occupancies with a quantity of material in the building in excess of those listed in the Building Code, that present a high explosion hazard. Division 2. Occupancies where combustible dust is manufactured, used, or generated in such a manner that concentrations and conditions create a fire or explosion potential. Occupancies with a quantity of material in the building in excess of those listed in the Building Code that present a moderate explosion hazard or a hazard from accelerated burning. Division 3. Occupancies where flammable solids, other than combustible dust, are manufactured, used or generated. 9

10 Division 4. Repair garages not classified as Group S, Division 3 Occupancies. Division 5. Aircraft repair hangars and heliports not classified as Group S, Division 5 Occupancies. Division 6. Semiconductor fabrication facilities and comparable research and development areas in that hazardous production materials (HPM) are used and the aggregate quantity of materials is in excess of those listed in the Building Code. Division 7. Occupancies having quantities of materials in excess of those listed in the Building Code that are health hazards. Group I Occupancies Division 1.1. Nurseries for the full-time care of children under the age of six (each accommodating more than five children). Hospitals, sanitariums, nursing homes with nonambulatory patients, and similar buildings (each accommodating more than five (5) patients). Division 1.2. Health care centers for ambulatory patients receiving outpatient medical care that may render the patient incapable of unassisted self-preservation (each tenant space accommodating more than five (5) such patients). Division 2. Nursing homes for ambulatory patients and homes for children six years of age or over (each accommodating more than five patients or children). Division 3. Mental hospitals, mental sanitariums, jails, prisons, reformatories, and buildings where personal liberties of inmates are similarly restrained. Group M Occupancies Group M Occupancies shall include buildings, structures, or portions thereof, used for the display and sale of merchandise, and involving stocks of goods, wares, or merchandise incidental to such purposes and accessible to the public. Group R Occupancies Division 1. Hotels and apartment houses. Congregate residences (each accommodating more than ten 10) persons). Division 2. Not used. Division 3. Dwellings and lodging houses. Congregate residences (each accommodating ten (10 persons or less). Group S Occupancies Group S Occupancies shall include the use of a building or structure, or a portion thereof, for storage not classified as a hazardous occupancy. Division 1. Moderate -hazard storage occupancies shall include buildings or portions of buildings used for storage of combustible materials that are not classified as Group S, Division 2 or Group H Occupancies. Division 2. Low-hazard storage occupancies shall include buildings or structures, or portions thereof used for storage of noncombustible materials such as products on wood pallets or in paper cartons with or without 10

11 single-thickness divisions, or in paper wrappings, and shall include ice plants, power plants, and pumping plants. Division 3. Division 3 Occupancies shall include repair garages where work is limited to exchange of parts and maintenance requiring no open flame or welding, motor vehicle fuel -dispensing stations, and parking garages not classed as Group S, Division 4 open parking garages or Group U private garages. Division 4. Open parking garages. Division 5. Aircraft hangars where work is limited to exchange of parts and maintenance requiring no open flame or welding, and helistops. Group U Occupancies Division 1. Private garages, carports, sheds, and agricultural buildings. Division 2. Fences six (6) feet (1,829 mm) high, tanks, and towers. Occupancy Classifications should be the same as those in the local building code. COMMITTEE ACTION: Accept as Submitted A PUBLIC COMMENT(S) WAS SUBMITTED FOR REVIEW AND CONSIDERATION. PUBLIC COMMENT: Submitter: April Trafton, UMC Access Task Group The following is recommended by the Access Task Group (see Access Task Group Report for Item # 1). Request to reject the code change proposal by this public comment. The occupancy classifications should not be deleted as they are specific to UMC requirements and may not be used consistently in all of the building codes where the UMC would be used (globally). Additionally, every instance where specific occupancies and occupancy classifications are mentioned in the UMC would need to be modified to address the deletion of the term. 12 Revise text as follows: Liquefied Petroleum Gas Facilities. Containers, container valves regulating equipment, and appurtenances for the storage and supply of liquefied petroleum gas shall be installed in accordance with the Fire Code Chapter 13. In Section Liquified Petroleum Gas Facilities, the more appropriate reference would be Chapter 13, which defines Liquid Petroleum Gas Facilities in Section and references NFPA 58 in Section COMMITTEE ACTION: Accept as Amended by the TC Amend proposal as follows: Liquefied Petroleum Gas Facilities. Containers, container valves regulating equipment, and appurtenances for the storage and supply of liquefied petroleum gas shall be installed in accordance with the Fire Code and Chapter 13. PUBLIC COMMENT: Submitter: Ted Lemoff, NFPA Request to accept the code change proposal as modified by this public comment Liquefied Petroleum Gas Facilities. Containers, container valves regulating equipment, and appurtenances for the storage and supply of liquefied petroleum gas shall be installed in accordance with the Fire Code and Chapter 13 NFPA 58. This comment proposes to remove a conflict in the UMC. Propane systems are referenced here and in Section In Chapter 3 if the UMC, the Fire Code and Chapter 13 are referenced, while in Chapter 13 of the UMC, NFPA 58 is referenced. The recommended change will make these 2 sections with apparently identical intent the same. NFPA 58 is the American National Standard for LP-Gas facilities, and is adopted in all states and used in many other countries. Alternately, Section could be deleted to remove the conflict. 12

13 Item # 23 Comment Seq # 8 UMC SUBMITTER: Pennie Feehan Cast Iron Soil Pipe Institute Add new text as follows: Equipment on Roofs General Equipment on roof shall be designed or enclosed so as the withstand climatic conditions in the areas in which it is installed. Where enclosures are provided, each enclosures shall be of reasonable height, and shall have at least a thirty (30) inch (760 m) clearance between the entire service access panel(s) of the equipment and the wall of the enclosure Roofs on which equipment is to be installed shall be capable of supporting the additional load or shall be reinforced to support the additional load All access locks, screws, and bolts shall be of corrosion-resistant material Installation of Equipment on Roofs Equipment shall be installed on accordance with its listing and the manufacture s installation instructions Equipment shall be installed on a well-drained surface of the roof. At least 6 ft. between any part of the equipment and the edge of a roof or similar hazard, or rigidly fixed rail, guards, parapets, or other building structures at least forty-two (42) inches (91.1 m) in height shall be provided on the exposed side All equipment requiring an external source of electrical power for its operation shall be provided with (1) readily accessible electrical disconnecting means within sight of the equipment, and (2) a 120 V AC grounding-type receptacle outlet on the roof adjacent to the equipment. The originally proposed text may have been in conflict with Section Section entitled Design of Product Conveying Ventilation Systems covers primarily ducts conveying flammable and explosive vapors or fumes. Our previously proposed new category Noxious or dangerous exhaust in Section Environmental Air Ducts may have been in conflict with Section 505. In our revised proposed text we have removed this category. However, we noticed that by eliminating this category, modifications needed to be made to Section Product Conveying Ducts and more specific to Section where separation distances are listed. 2. The originally proposed text would have been in conflict with the published language of Section if our proposed changes to Section were not accepted: Also, a cooling tower exhaust may or may not be considered as an Environmental Air Duct depending on the cooling tower construction. In our revised proposed text we have removed this category. We strongly believe that separation distances between environmental air/product conveying ducts and building intakes should be increased in the UMC based on current knowledge. We note that the separation distances listed in Table 5-1 of ASHRAE Standard for significantly contaminated exhaust were developed based on a consensus process. We also point out that Note 1 of Table 5-1 (ASHRAE Standard ) states that: Significantly contaminated exhaust is exhaust air with significant contaminant concentration, significant sensory-irritation intensity, or offensive odor. The language in this Note is consistent with Class 3 air as described in Section Classification of the ASHRAE Standard The definitions for all air classes are indicated on the following page: 24

The revised language is extracted from NFPA 96 section The paragraph is based on ASHRAE Research Project 1033-RP Final Report, Effects of air velocity on grease deposition in exhaust ductwork, documented that grease deposition is reduced as air velocity is reduced, primarily due to less turbulence at the duct surface. Tests were performed at velocities of 500 fpm, 1,000 fpm, 1,500 fpm, and 2,000 fpm. The 500 fpm velocity maintains or improves the safety aspect of minimizing grease buildup, while allowing engineers more flexibility in both retrofit and new kitchen design that include variable flow kitchen exhaust systems. According to the report, grease deposition in uninsulated ducts exposed to cold outdoor climates can increase with lower duct velocities, and insulation of R-10 or greater was recommended. [NFPA 96: ] An airflow switch or transducer shall be provided after the last filter component to ensure that a minimum airflow is maintained. This device opens the interlock circuit when the airflow falls 25 percent below the system s normal operating flow or 10 percent below its listed minimum rating, whichever is lower. This switch or transducer shall be a manual reset device or circuit. [NFPA 96: ] Location and Application Restrictions. The location of recirculating systems shall be approved by the Authority Having Jurisdiction. Items to be reviewed in the fire risk assessment shall include, but not be limited to, life safety, combustibility of surroundings, proximity to air vents, and total fuel load. [NFPA 96: ] Additional Fire Safety Requirements In addition to the appliance nozzle(s), a recirculating system shall be listed with the appropriate fire protection for grease filters, grease filtration, odor filtration units, and ductwork where applicable. In 2003, the CAN/CSA B149.1 committee reviewed information on the failure of metal connectors on radiant tube heaters and determined that the desirability of a flexible connector capable of adjusting to the constant vibration and expansion/contraction characteristics of the radiant tube heater thereby preventing crack, leaks, or fractures due to work hardening outweighed concerns that the hose material may soften or burn in the event of a fire. In fact it could be interpreted that the equipment must be located outside the building. Also, the change will bring the definition in line with ASHRAE 15 where the definition of occupied space specifically excludes machinery rooms. Item # 92 Comment Seq # 22 UMC SUBMITTER: Leon Alevantis California Department of Health Services Revise text as follows: Location. Cooling towers, evaporative condensers and fluid coolers shall be located such that their plumes cannot enter occupied spaces. Plume discharges shall be at least twenty five (25) feet above or and twenty five (250) feet horizontally away from any ventilation inlet to a building. Location on the property shall be as required for buildings by the Building Code. Buildings designed with 5 feet of vertical separation greatly increase the liability of the designer and place the building occupants in immediate danger of contracting Legionnaires Disease as well as various other health effects from inhaling pollutants emitted by the chemicals used to treat the cooling tower water. There is strong evidence both in the scientific literature as well as in the form of recommendations by expert organizations on separation distances between cooling towers and building air intakes. This evidence strongly contradicts the code minimum requirement of 5 feet vertical separation as being unsafe. More specifically, the American Society of Heating Refrigeration and Air-Conditioning Engineers (ASHRAE), the leading international association of professionals in the field, recommends in their Standard (entitled Ventilation for Acceptable Indoor Air Quality) a 25-ft minimum separation between cooling tower exhaust and building intake (Table 5-1). This distance refers to the shortest distance from the intake to any specific potential outdoor contaminant source. The California Department of Health Services (CDHS) in a publication entitled Minimizing the Risk of Legionnaires Disease in Public Buildings published in 1995 also recommends a 25 ft separation distance between cooling towers and building air intakes (this publication is available from the Division of Environmental and Occupational Disease Control, Environmental Health Laboratory Branch, California Department of Health Services, Richmond, CA). This recommendation is not limited to any specific building type. The above recommendations from ASHRAE and CDHS are in direct conflict with the code minimum requirements. In the 2001 California Mechanical Code, Section immediately after the code section I quoted above states for hospitals: [For OSHPD 1,2,3, &4] Plume discharge shall be at least twenty-five (25) feet from any ventilation inlet to a building. 63

64 Therefore, Section of the Uniform Mechanical Code should be consistent with Section of the California Mechanical Code (not just for hospitals) as well as the recommendations of Table 5-1 in ASHRAE and those of the California Department of Health Services. COMMITTEE ACTION: Reject COMMITTEE STATEMENT: The proposed text is overly restrictive and may conflict with ASHRAE 62. A PUBLIC COMMENT(S) WAS SUBMITTED FOR REVIEW AND CONSIDERATION. PUBLIC COMMENT: Submitter: Leon Alevantis, CA Dept of Pub Health Request to accept the code change proposal as modified by this public comment Location. Cooling towers, evaporative condensers, and fluid coolers shall be located such that their plumes cannot enter occupied spaces. Plume discharges shall be at least five (5) feet (1,524 mm) above or twenty (20) feet (6,096 mm) 25 feet (7,620 mm) away from any ventilation inlet to a building. Location on the property shall be as required for buildings by the Building Code. We disagree with the TC s action and statement. However, in an effort to address the TC s concerns and protect public health, we have presented compromise language under Item 3: Comment. Below we have addressed separately the two concerns that the TC raised. 1. The proposed text is not overly restrictive. Cooling towers are installed in buildings with large footprints where designers have the option of locating cooling towers away from building intakes. Buildings with small footprints are usually cooled with packaged HVAC systems which do not require cooling towers. We would like to point out that in the few cases where the proposed requirement may appear overly restrictive the designer has the option of requesting an exemption from the local Administrative Authority. In such cases, the designer may provide calculations, wind tunnel modeling, computer simulations, or Computational Fluid Dynamics (CFD) proving to the local Administrative Authority that reentrainment of cooling tower exhaust in to a building s intake(s) is not a concern when shorter separation distances are used in a specific project. In fact the California Mechanical Code (CMC) has a very good demonstration of such exemption. The CMC for hospitals (i.e., OSHPD) requires that outdoor air intakes be located at least 25 feet away from exhaust outlets, including cooling towers. However, Exception 1 of Section Outdoor Air Intakes states that: These dimensions may be reduced if it is demonstrated by the submission of details and calculations that location of intakes with respect to exhausts and their orientation, or the use of special filters, provides equal performance. 2. The proposed modified text does not conflict with ASHRAE 62: The ASHRAE 62.1 Standard is a consensus standard. To our knowledge, the 25 foot separation distance between cooling tower exhaust and building intakes recommended by ASHRAE Standard 62.1 since 2004 (Addendum aa to ASHRAE Standard available at has not been considered overly restrictive by building professionals and other interested parties because no one: (a) commented negatively during the 64

65 public review process in ; or (b) has requested that this distance be reduced since the publication of Table 5-1 in The Foreword to Addendum aa (not part of the addendum but the chairman s summary of the addendum language) when it was published in 2004 stated the following: This addendum converts requirements related to outdoor air intake location and intake protection into mandatory and enforceable language. Because outdoor contaminant sources can lead to unacceptable indoor air quality, this addendum adds requirements for minimum separation distances between common outdoor sources and outdoor air intakes. Also, because liquid water in the air distribution system can lead to microbial growth, this addendum includes requirements intended to limit the intrusion and entrainment of precipitation. The above information is based on the fact that: (a) the author of this comment has been an active member of ASHRAE s 62.1 committee since the public review and publication of Addendum aa ; and (b) communications on this matter with the present and past chairmen of the 62.1 committee. Table 5-1 of ASHRAE Standard clearly requires designers to place: (a) cooling tower exhausts at least 25 feet away from any building intakes; and (b) cooling tower intakes or basins at least 15 feet away from building intakes. Furthermore, Section of ASHRAE Standard states the following: Location. Outdoor air intakes, including doors and windows that are required as part of a natural ventilation system, shall be located such that the shortest distance from the intake to any specific potential outdoor contaminant source shall be equal to or greater than the separation distance listed in Table 5-1. Based on: (a) ASHRAE s language on separation distances between cooling towers and building intakes; and (b) the UMC TC s comments, we have modified our proposal to be consistent with ASHRAE Standard 62.1 while addressing the TC s concerns and protecting public health. As such, we are proposing that cooling tower exhausts be located at least 25 feet away from any building intakes and that cooling tower intakes or basins be at least 15 feet away from building intakes. Evaporative condensers and fluid coolers are also included in this requirement since they are designed similar to cooling towers. Therefore, it is clear that the proposed modified changes are consistent with Standard and if adopted would make the UMC consistent with ASHRAE on the issue of separation distances between cooling towers and building intakes. In our opinion to the extent possible and practical, there should be consistency between the UMC and other consensus standards. CSST gas piping systems shall be bonded to the electrical service grounding electrode system at the point where the gas service enters the building. [NFPA 54:7.13.1] Informational Note: In order to correlate with references extracted from NFPA 54 in Chapter 13, gas utilization equipment and references made to equipment that utilizes or burns gas is replaced with appliances. Gas piping systems installed inside buildings have demonstrated a propensity to become energized from nearby lightning strikes. Conventional bonding of gas piping through the equipment grounding conductor has proven inadequate (in these circumstances) to prevent arcing between the gas piping and other nearby electrically conductive systems. The attached technical article describes (in detail) the arcing damage inflicted on gas piping caused by indirect lightning strikes. CSST manufacturers collectively report dozens of damaged systems caused by improper or inadequate bonding resulting in fire damage or loss of property. Therefore, modifications are proposed to allow alternative methods for direct bonding of gas piping to the grounding system to insure a minimum threshold of protection from all threats (including indirect lightning strikes) that are likely to energize the piping. Current bonding of gas piping to the equipment grounding conductor will continue to be permitted. Similar language has been submitted to the NEC (National Electrical Code) for the 2008 cycle. PUBLIC COMMENT: Submitter: Ted Lemoff, NFPA Request to accept the code change as modified by this public comment Electrical Bonding and Grounding. (A) Pipe and Tubing other than CSST. Each aboveground portion of a gas piping system other than CSST that is likely to become energized shall be electrically continuous and bonded to an effective groundfault current path. Gas piping, other than CSST shall be considered to be bonded when it is connected to appliances that are connected to the appliance grounding conductor of the circuit supplying that appliance. [NFPA 54: ] (B) CSST gas piping systems shall be bonded to the electrical service grounding electrode system at the point where the gas service enters the building. The bonding jumper shall not be smaller than 6 AWG copper wire. [NFPA 54:7.13.4] (BC) Gas piping shall not be used as a grounding conductor or electrode. This does not preclude the bonding of metallic piping to a grounding system. [NFPA 54: ] Lightning Protection System. Where a lighting system is installed, the bonding of the gas piping shall be in accordance with NFPA 780. (renumber remaining sections). The revision to (B) clarifies that the requirement is not intended to prohibit bonding of metallic piping systems. 79 Revise text as follows: Appliance Shutoff Valves and Connections. Each appliance connected to a piping system shall have an accessible, approved manual shutoff valve with a nondisplaceable valve member or a listed gas convenience outlet installed within six (6) feet (1.8m) of the equipment it serves. Where a connector is used, the valve shall be installed up-stream of the connector. A union or flanged connection shall be provided downstream from this valve to permit removal of controls. Shutoff valves serving decorative gas appliances shall be permitted to be installed in fireplaces if listed for such use. [NFPA 54:9.6.4] Exceptions: (1) Shutoff valves may be accessibly located inside or under an appliance when such appliance can be removed without removal of the shutoff valve. (2) Shutoff valves may be accessibly located inside wall heaters and wall furnaces listed for recessed installation where necessary maintenance can be performed without removal of the shutoff valve Where installed at a manifold, the appliance shutoff valve shall be located within 50 ft (15 m) of the appliance served, measured in a straight line and shall be readily accessible and permanently identified. The piping from the manifold to within 6 ft (1.8 m) of the appliance shall be designed, sized and installed in accordance with Chapter 13. [NFPA 54: ] This proposal intends to add editorially update to be consistent with changes made in NFPA 54, and to add a new concept, centrally located shutoff valves, which were incorporated into the 2006 edition of NFPA 54. Centrally located shutoff valves have been successfully used in Canada for many years. They have been in NPFA 54 since 2005 and no problem with the location have been reported. COMMITTEE ACTION: Reject COMMITTEE STATEMENT: A Technical justification was not provided for the increased length of the location of the shut off valve. Committee has safety concerns. PUBLIC COMMENT 1: Submitter: Denise Beach, NPGA Requests accept the code change proposal as submitted by this public comment: I concur with the negative ballots. The proposed coverage that would permit shutoff valves to be installed up to 50-ft from an appliance in manifold piping systems should be accepted. The 50-ft distance was taken from the Canadian fuel gas installation code. Shut off valves are service valves, used to isolate an appliance for repairs and replacement. As such, installing them up to 50 ft away does not present a safety issue. 79

The piping from the manifold to within 6 ft (1.8 m) of the appliance shall be designed, sized, and installed in accordance with Chapters 5, 6, and 7. The appliance shutoff valve is not an emergency valve. It is required so that the appliance can be maintained or replaced without shutting off the entire system. The existing 6 ft minimum distance has been in codes for many decades and is an arbitrary distance. The concept of a central appliance shutoff location is similar to the philosophy of electricity distribution in buildings, with all switches (shutoffs) located in one place. There is no technical reason to not allow this, and the experience in Canada where it has been allowed for many years, and in the areas where NFPA 54 is adopted demonstrates that it is safe. All natural gas regulations and tables are based on the use of gas having a specific gravity of sixty hundredths (0.60), supplied at six (6) to eight (8) inches ( mm) water column pressure at the outlet of the meter or regulator. Where the natural gas supplier cannot maintain a minimum inlet pressure of six (6) inches (152 mm) water column pressure, Table allowing a maximum pressure drop of 0.3-inch (7.6 mm) 0.5-inch (12.7 mm) water column shall be used. For undiluted liquefied petroleum gas, gas piping may be sized at eleven (11) inches (279 mm) water column pressure at the outlet of the meter or regulator and specific gravity of one and fifty hundredths (1.50) Table for Sizing Gas-Piping Systems. Proposal removes specific pressure drop to be used in sizing piping systems, and references Section With this change the issue of which of the 2 Tables, 13-7 or 13-8 should be used for sizing a steel pipe systems operating at 7 in. water column. Tables 13-7 and 13-8 are both applicable to 7 water column natural gas piping systems, but 13-7 provides a pressure drop of 0.3 w.c., while 13-8 provides a pressure drop of 0.5 w.c. A lower pressure drop will result in larger pipe sized in some or all of the piping system branches. With Table 13-7, with the lower pressure drop Table removed, Table 13-8 will be used, and this table will provided adequate pipe size for the vast majority of piping systems. The only time when a lower pressure drop may be required is in areas with inadequate gas supply pressure. In these cases, the gas utility company should make installers aware of the need for lower pressure drop and how to provide it. This comment proposes a revision to several pipe sizing tables. The term intended use is more appropriate.
