Recommendation: That Council request the Region of Durham approve Official Plan Amendment 105, in accordance with the proposed modifications and deferred decisions as outlined in Attachment 1 to the Region s postcirculation letter dated November 3, 2017 (refer to Attachment #1 to PL 90-17); and, That the Clerk forward a copy of Council s resolution and Planning Report PL to the Region of Durham. 2. Executive Summary: On February 21, 2017, following extensive public consultation, Council adopted Official Plan Amendment (OPA) 105 to the Whitby Official Plan regarding the Town s comprehensive Official Plan Review. Upon adoption, OPA 105 was forwarded to the Region of Durham as the approval authority. The Region has issued its post-circulation letter including proposed modifications and deferred decisions to OPA 105. The proposed modifications and deferrals address such matters as agency comments, conformity to the Durham Regional Official Plan, and technical matters (e.g. section (re)numbering; formatting; consistency of policy language/terminology; etc.). The Region is seeking Council s response / concurrence with the proposed modifications and deferrals (refer to Attachment #1). If Council agrees with the proposed modifications and deferrals, the Region s Commissioner of Planning has the authority to approve OPA 105. 3 would not be granted by the Region s Commissioner of Planning and the matter will have to be revisited. Should there be further delay in issuing a decision, then there is a risk that the Region could receive appeals for non-decision. Planning and Development report PL outlines the Region s proposed modifications and deferrals, and Whitby Planning staff s comments. Planning staff generally concur with the Region s proposed modifications and deferrals. It is recommended that Council request that the Region s Commissioner of Planning approve OPA 105, including the Region s proposed modifications and deferrals as shown on Attachment #1. 3. Origin: The Town has received the post-circulation letter from the Region of Durham regarding the Town of Whitby s Official Plan Review OPA 105, and are seeking Whitby Council s response / concurrence with the Region s proposed modifications and deferred decisions to OPA 105 (refer to Attachment #1). 4. Background: The Town of Whitby has undertaken a review of its Official Plan, pursuant to Section 26 of the Planning Act, to ensure that the currency, relevance and appropriateness of the policy framework on which the Official Plan is based meets the needs of the community. The process included the following major milestones: Introductory Discussion Paper & Community Response and Recommended Actions Paper; Public Opinion Survey; Intensification Strategy (OPA 90); West Whitby Secondary Plan (OPA 91); Various Public Workshops regarding land use policy themes; Policy Discussion Papers, including proposed policy directions; Public Meetings and Open Houses regarding Draft Proposed and Final Recommended Amendments; and Adoption of Amendment 105 to the Whitby Official Plan. In February, 2017, following extensive public consultation, the Official Plan Review exercise culminated in the adoption of Amendment 105 to the Town of Whitby Official Plan (refer to Planning and Development Report PL 17-17) Following its adoption, OPA 105 was forwarded to the Region of Durham for approval. The Region circulated the adopted Amendment to various agencies, Report to: Special Meeting of Council Report number: PL Page 2 of 7 Page 3 of 93

4 public bodies, adjacent municipalities and Regional Departments for comments. The adopted Amendment has been assessed for conformity with the Durham Regional Official Plan and Provincial Plans and policies. 5. Discussion/Options: 5.1 Region of Durham s Post Circulation Letter Following the Region s circulation of Council-adopted OPA 105 to commenting agencies and departments, Planning staff from the Region of Durham and Town of Whitby met to discuss the Amendment and proposed modifications/deferrals. The Region s proposed modifications/deferrals are intended to address conformity with the Durham Regional Official Plan, Provincial plans and policies, comments raised by commenting agencies, as well as modifications requested by Whitby staff. The Region s letter and proposed modifications and deferred decisions generally consist of the following: Mapping changes, including: Adjusting mapping layers to correct minor mapping errors; Adjusting the Greenbelt Boundary to match the 2017 Greenbelt Plan (i.e. reflects the removal of certain lands in Whitby from the Greenbelt Plan area); Removing the Intensification Corridor overlay from the Deferred Lands (i.e. Lands subject to Durham Regional Official Plan policy ) as they are subject to further study; and, adjusting the Intensification Areas and Intensification Corridor overlay in certain locations; Adding the Type C Arterial Road alignment to reflect the Region s Schedule C Map C2 alignment for Columbus Road; and, changing the portion of Columbus Road from a Type B Arterial Road to a Local Road designation to clarify the intent; Moving the Future Transitway Station symbols to correctly reflect the locations along Highway 407 and 412; and Adding a new Exhibit for changes to Schedule H Downtown Whitby Secondary Plan, to reflect the change in the land use designation from Low Density Residential to Mixed Use made on Schedule A Land Use. Wording changes, including: Adding cross-references and correct numbering of various Sections; Making minor editorial revisions (e.g. grammar; punctuation; spelling; formatting; consistency); Report to: Special Meeting of Council Report number: PL Page 3 of 7 Page 4 of 93

5 Adding new definitions for climate change ; climate change adaptation ; climate change mitigation ; resilient/resiliency ; and transit-supportive (italicizing newly defined terms will be included in the next consolidation of the Official Plan); Including minor modifications to the Future Urban Development Areas (FUDA s) policies as it relates to the approved urban area boundary; Revising certain policies to ensure consistency throughout the entirety of the Official Plan; Adding text, or modify certain policies, to clarify the intent; and Adding and revising policies in response to agency comments, and ensure conformity with Durham Regional Official Plan and Provincial Plans. Deferred decisions, including: Lands subject to Durham Regional Official Plan Policy are deferred pending resolution of the matter at the Ontario Municipal Board; Deletion of Water Street, which is currently designated a Type C Arterial Road, is deferred pending the completion of the Region s Transportation Master Plan and implementing ROPA; and Addition of a Type B Arterial Road north of Taunton Road East (i.e. extension of Desmond G. Newman Boulevard), is deferred pending the completion of the Region s Transportation Master Plan and implementing ROPA s. 5.2 Planning and Development Staff Comments Greenbelt Plan When the Province undertook its review and update of the Greenbelt Plan, the Province identified certain lands in Whitby to be removed from the Greenbelt Plan boundary in the 2017 Greenbelt Plan. The Region s proposed modifications for OPA 105 include the removal of those lands on various schedules, in order to conform to the 2017 Greenbelt Plan. Although excluded from the Greenbelt Plan area, those lands remain outside of the urban area boundary, and are designated as Major Open Space. The inclusion of those lands within the urban area boundary may be considered through the Region s next municipal comprehensive review of the Durham Regional Official Plan. It should be noted that the Ministry of Municipal Affairs comments to the Region expressed concerns with the approach Whitby took to implementing the Report to: Special Meeting of Council Report number: PL Page 4 of 7 Page 5 of 93

6 Greenbelt Natural Heritage System (Greenbelt NHS) in OPA 105. However, it remains our position that the Town s Natural Heritage System (Town s NHS) is a refinement of the Greenbelt NHS, as permitted by the Greenbelt Plan, and provides all of the Greenbelt protections to both lands within and outside of the Greenbelt NHS. Certain modifications included in Attachment #1 are intended to reinforce this conformity with specific references to the Greenbelt Plan Deferred Lands The Town s OPA 90 (Intensification / Growth Plan conformity) was approved by the Ontario Municipal Board in July, The Board s approval of OPA 90 included identification of certain lands as being subject to Durham Regional Official Plan policy , which states: The following policies apply to lands located in north Oshawa and Whitby identified as "Lands appealed to OMB" as shown on Schedule 'A' - Map 'A4': a) the proposed designations and Urban Area boundary as adopted by Regional Council on June 3, 2009 are under appeal at the Ontario Municipal Board and are adjourned; b) the Board may be requested to resume consideration of the proposed Urban Area expansion and designations once a comprehensive review has been completed by the area municipality in accordance with the policies of this Plan, with the approval of the Region. The comprehensive review shall demonstrate conformity with the provisions of this Plan, in particular policies 7.3.9, , and ; and c) Until such time that the provisions of subsection b) above is met, the lands in north Whitby and north Oshawa will remain as designated on June 2, The Region s letter indicates that a decision regarding inclusion/exclusion of the Lands Subject to Durham Regional Official Plan Policy is deferred pending Whitby staff undertaking a further land-needs analysis. Following the Region s decision, work will continue with the Region, in order to address the deferral and related land-needs analysis in a timely manner, in order to resolve the appeal at the OMB. 6. Public Communications/Plan: The Official Plan Review has included extensive public and stakeholder/agency consultation since its commencement, including the following: Report to: Special Meeting of Council Report number: PL Page 5 of 7 Page 6 of 93

7 maintaining an extensive Interested Parties list for the project; providing ongoing notification regarding public engagement opportunities by: mailing notices; maintaining a dedicated website and address; online comment forms; and, publishing notice in the Whitby This Week and Brooklin Town Crier newspapers; hosting Open Houses and workshops; and holding Public Meetings in accordance with the Planning Act. 7. Considerations: 7.1. Public Comments received from the public, by the Town of Whitby throughout the Official Plan review process were reviewed and assessed during the preparation, and prior to adoption OPA 105. Comments received from the public, by the Region of Durham, since adoption of OPA 105 have also been considered in preparation of the proposed modifications Financial The tasks associated with the Official Plan Review are accounted for in the Council approved budget for the Whitby Official Plan Review Impact on and input from other Departments/Sources Not applicable Corporate and/or Department Strategic Priorities The Official Plan Review project will assist in achieving Council s Goals 6, 7 and 8 by addressing safe streets, active transportation, the development of complete neighbourhoods and the enhancement of the downtowns, waterfront and green spaces. 8. Summary and Conclusion: Staff have worked collaboratively with the Region to address comments raised through the post-circulation process. The Region s proposed modifications and deferrals are supported. Accordingly, it is recommended that Council request the Region of Durham approve OPA 105 with the proposed modifications and deferred decisions as outlined in Attachment 1 to the Region s post-circulation letter dated November 3, 2017 (refer to Attachment #1 to PL 90-17). 9. This review included consultation with public bodies, adjacent municipalities and Regional Departments. The adopted Amendment has been assessed for conformity with the Durham Regional Official Plan and Provincial Plans and policies. Overview Amendment 105 proposes comprehensive changes to the policies of the Town of Whitby Official Plan. The Amendment addresses conformity to the Provincial Policy Statement, Provincial Greenbelt Plan and the Provincial Growth Plan for the Greater Golden Horseshoe. The Amendment also makes a number of changes to the Town of Whitby Official Plan to bring it into conformity with the Durham Regional Official Plan, while introducing a vision, guiding principles, goals and strategic objectives which, among other matters: Advances the vision for a healthy, sustainable and complete community; Enables orderly, compact and mixed use development; Encourages Downtown revitalization; Protects and enhances the character of existing communities; Promotes opportunities for economic development and job creation; Incorporates sustainability principles that address climate change, energy conservation, air quality, urban-agriculture and related matters. 10 Overall, the Amendment has incorporated growth management and intensification policies in the Town s urban areas while promoting greater protection to natural heritage features and their functions in the rural area. Employment Areas The Amendment provides for the redesignation of employment land which apply to lands that are designated Living Areas in the Regional Official Plan (ROP). This redesignation conforms to the ROP. The remaining minor redesignations reflect existing development conditions on the ground or are a refinement of the Region s designations. The Region accepts Whitby s employment land redesignations within Amendment 105 as appropriate. Moving forward, there are subject areas that will require further study to be addressed through future amendment(s) to the Whitby Official Plan, including: Minimum Distance Separation policies; Waste Disposal Sites; Wildland Fires; and Source Water Protection. We look forward to ongoing involvement in these future processes. Overall, the Region s involvement in this process and the cooperation and assistance of Town staff has resulted in a document that raises relatively few issues. The review did however, identify specific areas of the Amendment that require modifications to clarify intent, or to address specific issues, as well as additional work that will need to be undertaken, which is the subject of the modifications and deferred decisions contained in Attachment 1 to this letter. It should be noted that the majority of the changes are housekeeping corrections and minor modifications requested by Whitby staff, which include the following: Modifications Transportation There are some technical modifications to the Transportation Schedules of the Amendment to bring this Plan into conformity with the Regional Official Plan as well as the completed 407 Environmental Assessment. 2 Page 10 of 93

11 2017 Greenbelt Boundary There are three areas where the Greenbelt Boundary was modified through the enactment of the 2017 Greenbelt Plan. As such, modifications are provided in order to conform with the new Greenbelt Boundary. Deferred Decisions Lands Subject to Durham Regional Official Plan Policy Four tracts of land are subject to a notation on Map 1, Sheet 1 of Schedules A, B, E and Appendix 1 as Lands Subject to Durham Regional Official Plan Policy These tracts are also subject to a notation on Schedule A4 of the Durham Regional Official Plan as Lands Appealed to the OMB, Refer to Policy which was introduced through the ROPA 128 process. Section b) of the Durham Regional Official Plan indicates that, the Board may be requested to resume consideration of the proposed Urban Area expansion and designations once a comprehensive review has been completed by the area municipality in accordance with the policies of this Plan, with the approval of the Region. The comprehensive review shall demonstrate conformity with the provisions of this Plan, in particular policies 7.3.9, , and In particular, Section b) indicates that the Region may consider amendments to an area municipal official plan to designate a supply of land for development up to the time frame of this Plan, including expansion to urban area boundaries, provided that the amendment (among other matters) is supported by an analysis which evaluates and demonstrates the need for designating the additional land. To date, the analysis undertaken by Hemson Consulting Ltd., on behalf of the Town has not demonstrated the need for including additional lands within the Whitby Urban Area Boundary within the 2031 timeframe. In keeping with our discussions with Whitby staff, the Region will not be making a decision at this time with respect to the lands identified by the notation Lands Subject to Durham Regional Official Policy Whitby staff indicated a desire to undertake further analysis of need for the proposed future employment areas and requested that the Region not make a decision with respect to these lands until November 2018 to permit such further analysis. As a result of Policy , a future decision regarding the Brooklin Urban Boundary is expected to require Ontario Municipal Board approval. 3 Page 11 of 93

12 Transportation A decision on two transportation redesignations is not being made at this time, pending the completion of the Region s Transportation Master Plan (TMP) and the future implementing Regional Official Plan Amendment (ROPA). Future Urban Development Areas A minor modification to the Future Urban Development Areas (FUDAs) policy is proposed by the Region to ensure that any future FUDAs will be located within the Region of Durham s approved Urban Area boundary. Responses from Agency Circulation and the Public For your information, Attachment 2 contains a copy of all comments and responses received from agencies circulated a copy of Amendment 105. Attachment 3 includes a copy of all submissions received from members of the public. Page 14 of 93 a) In accordance with Table A contained within Section 2.2.2, the Urban Boundary of the Town of Whitby Municipality as shown on Schedule A Land Use, has been sized to accommodate forecasted population and employment growth to the year 2031;. b) This Plan also identifies the Province s Built Boundary, on Schedule B, which generally includes the built-up area of the Town Municipality as of This Plan requires intends that a minimum of 11,963 dwelling units be developed within the Built Boundary between 2015 and 2031; and. c) Lands outside of the Built Boundary but within 2

Development of these lands shall be planned to provide for urban development and redevelopment in a manner that conforms with the growth management objectives of Provincial Policy policy, the Durham Regional Official Plan, and this Plan and shall have a minimum density target of 50 jobs and persons combined per hectare / Natural Environment Goal Amend AA #12 to change storm water to stormwater in policy To support actions to improve the quality of waters entering watercourses and Lake Ontario from Regional sanitary services, storm water management facilities and surface runoff. Correction requested by the Town of Whitby.
