1 Chapter 14 - Heritage 14.1 Introduction The protection of historic heritage from inappropriate subdivision, use and development, and the protection of the relationship of Māori and their culture and traditions with their ancestral lands, water, sites, wāhi tapu, and other taonga, are recognised under the RMA as a matter of national importance. Historic heritage is defined in the RMA as: (a) means those natural and physical resources that contribute to an understanding and appreciation of New Zealand's history and cultures, deriving from any of the following qualities: (i) archaeological; (ii) architectural; (iii) cultural; (iv) historic; (v) scientific; (vi) technological; and (b) includes - (i) historic sites, structures, places, and areas; and (ii) archaeological sites; and (iii) sites of significance to Māori, including wāhi tapu; and (iv) surroundings associated with the natural and physical resources Many natural and physical resources within the district have significant value for heritage reasons. These heritage resources include: historic buildings and structures; archaeological sites; notable trees; and features of spiritual importance. Heritage resources are considered worthy of protection, not only because of their special values to the current generation, but also because their loss would foreclose opportunities for future generations to appreciate their values Issues 1. The district contains identified heritage resources which the community values and wishes to protect but which are vulnerable to modification or loss without adequate protection. 2. Heritage resources of significance to Ngāi Tahu require special recognition and protection. 3. The exact location and significance of some heritage resources within the district have not been defined. 4. Many heritage resources within the district have been identified by national and regional organisations. However, the scheduling of those resources in the District Plan is one which needs the cooperation and support of landowners if it is to be an effective mechanism for protection. 5. Heritage resources that have been identified by the local community can only be protected with the agreement of the landowner. 6. Despite recognition of a resource s heritage value, it can still be susceptible to deterioration or inappropriate change Objectives and Policies Objective 14.1 The identification and protection of resources which have significant historic heritage value to the community and Ngāi Tahu from inappropriate subdivision, use and development. Policy 14.1 To identify significant heritage resources having one or more of the following values: Proposed Hurunui District Plan as Amended by Decisions 15 October

2 1. Historic; 2. Cultural; 3. Architectural; 4. Archaeological; 5. Technological; 6. Scientific; 7. Social; 8. Spiritual; 9. Traditional; 10. Contextual; 11. Aesthetic; 12. Community. Policy 14.2 To protect significant heritage resources from inappropriate subdivision, use and development. Policy 14.3 To protect heritage resources of significance to Ngāi Tahu from inappropriate subdivision use and development. Policy 14.4 To recognise and provide for the relationship that a historic heritage resource may have with the land surrounding it. Policy 14.5 To identify and manage heritage resources in association with Heritage New Zealand Pouhere Taonga, Ngāi Tahu and the community. Policy 14.6 To use iwi management plans and cultural mapping information as tools to assist in the identification of heritage resources of significance to Ngāi Tahu. Policy 14.7 To provide for the appropriate repair, maintenance, seismic strengthening and adaptive re-use of heritage buildings and structures in a manner that is sensitive to their historic values. Explanation Heritage is a subjective issue, requiring the translation of community-expressed values into achievable goals. The identification and protection of the district s heritage values should come from local initiatives, as well as from regional and national registers. It is important that some heritage resources are recognised as complete entities within the context of their surroundings. As a result, subdivision of land which includes the location of a heritage resource is more restricted. Adjoining activities may also adversely affect a heritage resource, so it may be appropriate to include a curtilage of land around a heritage resource to protect its significance. Policy 14.8 To encourage the protection of the district s historic heritage resources and recognise their value to the community, when considering resource consent applications. 3 14.4 Rules General Rules 1. Determining activity status where same matter is controlled by more than one rule: a. the user must firstly review the activity status of the activity and its associated controls within the zone or district-wide provisions applying to the site; then b. taking the activity status resulting from clause (a) above, the user must then review any overlays that apply to the site. If an overlay rule applies to the same matter then the most restrictive activity status will apply. Note 1: Notification must be given by Council to Heritage New Zealand Pouhere Taonga when a resource consent application is lodged in relation to an item listed in Schedule 14.1 Historic buildings and structures, and shown as Cat 1 or Cat Permitted activities The following activities are permitted activities: 1. Any activity relating to a heritage resource listed in Schedule 14.1 Historic buildings and structures, Schedule 14.2 Schedule of recorded archaeological features or Schedule 14.3 Notable trees, which is not otherwise listed as a controlled, discretionary activity or noncomplying activity and complies with the standards within Rule Note: All archaeological sites (whether recorded or unrecorded) are protected under the provisions of Section 42 of the Heritage New Zealand Pouhere Taonga Act 2014 and cannot be modified or destroyed or caused to be modified or destroyed without obtaining an authority from Heritage New Zealand Pouhere Taonga. This includes those sites contained in Schedule 14.2 of this Plan Standards for permitted activities 1. Historic buildings and structures (a) Any alterations and additions to an historic building or structure listed in Schedule 14.1 must be limited to repairs and maintenance. Note: Refer to the definitions of alterations and additions and repairs and maintenance in chapter 20 of the Plan 2. Notable trees (a) The following activities must not occur within the dripline of a notable tree listed in Schedule 14.3: (i) the construction, addition or replacement of any building excluding any utility building that does not exceed 2.5 m in height and 10 m 2 of floor area; or (ii) any impervious surfacing, sealing, paving, soil compaction, or alteration of more than 75 mm to the existing ground level; or (iii) the laying or installation of any underground services, excluding works and associated pilot holes, including for service connections for existing buildings and structures, undertaken by trenchless methods at a depth greater than 1m below ground level. (b) Maintenance pruning of any notable tree listed in Schedule 14.3 must be limited to: (i) living branches that have a diameter of 50 mm or less, or are within 2 m of the outermost foliage; or (ii) any dead wood; or (iii) activities in accordance with an approved management plan. (c) The pruning (other than maintenance pruning) or felling of any notable tree listed in Schedule 14.3 is limited to that which is necessary to remove immediate danger to persons or property Controlled activities The following activities are controlled activities: 1. Alterations and additions, and partial demolition, where the works are for the primary purpose of implementing seismic, fire or access building code upgrades, to a building or structure listed in Schedule Proposed Hurunui District Plan as Amended by Decisions 15 October

4 The Council s control over the following matters: (a) The extent to which the proposed works are consistent with retaining or maintaining heritage values; (b) Design and materials; (c) Whether the level of intervention and solutions will meet other statutory requirements such as the Building Act; (d) Whether interventions will involve the least possible loss of heritage significance and the least loss of material of heritage value; (e) Any recommendations contained in a heritage assessment, conservation plan or engineering assessment; (f) The adequacy on any temporary protection plan; and (g) Consideration of alternatives Restricted discretionary activities The following activities are restricted discretionary activities: 1. Alterations and additions to a building or structure listed in Schedule 14.1 where the alterations and additions are not for the primary purpose of implementing seismic, fire or access building code upgrades. The Council will restrict its discretion to the following matters: (a) The extent to which the proposed works are consistent with retaining or maintaining heritage values; (b) Design and materials; (c) Any recommendations contained in a heritage assessment or conversation plan; and (d) Consideration of alternatives. 2. The erection of a new sign attached to a heritage building. The Council will restrict its discretion to the following matters: (a) Effects on the heritage values of the building to which the sign is proposed to be attached; (b) The scale of the sign in relation to the heritage building; (c) Whether the design and materials of the sign are sympathetic to those of the heritage building; and (d) Consideration of alternatives Discretionary activities (unrestricted) The following activities are discretionary activities: 1. Any activity that does not meet one or more of the standards for permitted activities and that is not listed as a controlled, restricted discretionary or non-complying activity. 2. Partial or complete demolition of a building or structure listed in Schedule 14.1 (excluding partial demolition specified as a controlled activity) other than those with a Category 1 classification under the Heritage New Zealand Pouhere Taonga Act Relocation of a building or structure listed in Schedule 14.1 other than those with a Category 1 classification under the Heritage New Zealand Pouhere Taonga Act The modification, damage or destruction of a feature listed in Schedule 14.2 Schedule of recorded archaeological features, unless an authority has been obtained from Heritage New Zealand Pouhere Taonga. 5. The damage, removal or destruction of a tree listed in Schedule 14.3 Notable trees Non-complying activities The following activities are non-complying activities: 1. Relocation of a building or structure listed in Schedule 14.1 with a Category 1 classification under the Heritage New Zealand Pouhere Taonga Act 2014; and Proposed Hurunui District Plan as Amended by Decisions 15 October

Partial or complete demolition of a building or structure (excluding partial demolition specified as a controlled activity) listed in Schedule 14.1 with a Category 1 classification under the Heritage New Zealand Pouhere Taonga Act Assessment criteria When considering an application and whether or not it can be granted pursuant to Part 2 of the RMA, the Council will have regard to the relevant assessment criteria: 1. Historic buildings and structures, and recorded archaeological features (a) The category in which the heritage resource is scheduled and the reasons for which it has been scheduled; and (b) The nature, form and extent of the proposed development, the effect of these factors on the character of the heritage resource; and (c) The architectural design and appearance of any proposed alterations or additions, including assessment of how these will protect and enhance the heritage values of the heritage resource; and (d) Any conservation plan or environmental impact assessment submitted with the application; and (e) The written consent of the relevant heritage protection authority where the heritage resource is the subject of a heritage order; and (f) The outcome of any consultation with any relevant body or individual, such as Heritage New Zealand Pouhere Taonga, the Department of Conservation or local iwi; and (g) The degree to which the proposal reflects the conservation principles contained within the ICOMOS NZ charter for the conservation of places of cultural heritage value; and (h) The registration (if applicable) and the reasons for this registration of the heritage resource under the Heritage New Zealand Pouhere Taonga Act 2014; and (i) (j) The importance (if any) of land surrounding the heritage resource; and The impact the proposal has on the integrity/value of the heritage resource, including, where a building is part of a group of buildings, the impact on the integrity of that grouping; and (k) The importance attributed to the heritage resource by the wider community; and (l) The extent to which the heritage item has been damaged by natural events, or weather or environmental factors and the need of work to prevent further deterioration. 2. Notable trees (a) The nature, form and extent of the proposed activity and the effect of these factors on the character and integrity of the tree; and (b) Whether the applicant has the ability to undertake a complying development without work affecting the tree; and (c) Any measures proposed which will protect or enhance the characteristics of the tree; and (d) The outcome of any consultation undertaken with the Department of Conservation, Regional Council or any other relevant person or body, including any recommendations made by those parties; and (e) The effect of any trimming or disturbance of the root system on its appearance or health. 3. Heritage resources within the Queen Mary Hospital Heritage Zone (a) The extent to which the proposal is consistent with the overall management goal and policies of the Queen Mary Hospital Management Plan 2011; (b) The extent to which any proposed alterations would have an irreversible effect on heritage form or heritage features of the building or place and whether these would cause a significant loss of heritage fabric and form; Proposed Hurunui District Plan as Amended by Decisions 15 October

6 (c) Whether heritage items will be conserved to the fullest extent practicable whilst allowing for economic uses to be established within the building; (d) Whether alterations proposed will maintain or enhance the integrity of the original heritage items and design; (e) Whether an alteration, if not in sympathy with the heritage items or form, is clearly distinguishable from the original as new work; (f) Whether the proposal has been identified by Ngāi Tahu as being likely to affect matters of cultural or spiritual significance to them, the adequacy of any consultation undertaken with them and the response to that consultation; (g) The ability of the applicant to economically develop the site without alteration of the building; (h) Whether the retention of the heritage features or form of the protected building, causes a reduction in its range of potential uses; (i) The importance of upgrading the building to current seismic standards and for adequate fire protection where this is required; and the effect of such work on the heritage fabric of the building; and (j) Whether the potential use of the heritage item in its current form has been assessed to consider alternatives including adaptive re-use.
