17 Summary Statements Though its actions, the OPG continues to compromise the ability of the Municipality to enact bylaws that protect the safety of its citizens now and in the future. By offloading important design and quantification issues to after the license is granted, the EIS distances the community from understanding the actual risks associated with the DGR Project. This puts the municipality in direct conflict with the Provincial Planning Act to which they are accountable. Often misrepresenting and deferring science based design to the post EIS stage increases the obligation of the province and its ministries including Ministry of Northern Development and Mines, Ministry of Natural Resources and Fisheries and Ministry of the Environment and Climate Change to monitor the site. This creates an unlimited obligation to provide an indeterminate level of involvement for review and inspection that they do not have the budgetary capacity to commit to. The Federal government and the Joint Review Panel cannot give approval of an EA application where it can be demonstrated that the applicant has offloaded design and other criteria that are necessary to understanding the projects effect on the environment and the public. This would be in contravention of the Canadian Environmental Assessment Act (CEAA). 8.0 MUNICIPAL, PROVINCIAL AND FEDERAL JURISDICTION 16
