2 History Gas-Appliance Directive 96/306/EEC Annex I Essential Requirements, Clause 3.1.7: Appliances must be so designed and constructed as to obviate hazards of electrical origin. 4 Scope See Clause 1 and Foreword Equipment of appliances and devices for the non electric generation of heat by means of solid, liquid and gaseous fuels Appliances supplied by heating energy powered by water or vapor Appliances generating heat primarly by solid, liquid and gaseous fuel auxiliary electrical heating is allowed 4

5 Relations to other Standards To be used in conjunction with and regarded as Part 2 of EN To be used in addition to the CEN-Standards for non-electric appliances and for control devices and to any part 2 of EN 60335, if applicable 5

6 Conditions for the tests According to EN with the following differences: Tests covered and already carried out in accordance with the non-electric appliance standard are not repeated Tests are carried out with both electric and non-electric parts of the appliance operated together Test conditions of non-electric appliance standards are applied privileged Non-electric appliances are tested as specified for motoroperated appliances (advantages for tests of heating, leakage current) 6

9 Relation to Gas Appliance Directive (EM) Guide to the implementation of the Gas Appliances Directive (90/396/EEC) - European Commission Doc. GADGUIDE/Anx.I/doc.2 (accepted 05/00) When subjected to electromagnetic phenomena, gas appliances shall operate correctly and safely under normal conditions and remain safe under abnormal conditions. Gas safety aspects related to electromagnetic phenomena will be subject to examination. Appliances with safety related electronic systems that have demonstrated compliance with the applicable requirements of clause of EN are assumed to conform to the relevant Essential Requirements. The Notified Body shall verify that compliance has been demonstrated. Relevant test documentation provided by the manufacturer shall be used to avoid the duplication of testing. 9

10 Relation to Gas Appliance Directive (ES) Guide to the implementation of the Gas Appliances Directive (90/396/EEC) - European Commission GADGUIDE/Anx.I/doc.5 (accepted 03/96) Consequently the directives 90/396/EEC and 73/23/EEC apply in a complementary way. For the assessment of the conformity of the components to the requirements of the directive 73/23/EEC, the Notified Body shall take into account the results of the conformity assessment procedures of the Low Voltage Directive and accept a manufacturers declaration. The safety aspects of the way in which the electrical components are incorporated into the gas appliances and ensure their proper functioning will be subject to direct examination by Notified Bodies. Any Notified Body checks (formally) the declaration of conformity delivered by the manufacturer to the directive 73/23/EEC. As regards the risks of electrical origin not covered by directive 73/23/EEC, the certification procedures provided for by directive 90/39/EEC are applicable. 10

11 Harmonisation under 90/396/EWG EN priec IEC intends to change all importend and essential requirements SFG discussed the problem (involvement of TC 49) SFG decides (without objections) to propose EN for harmonisation under GAD to avoid the withdrawal of the EN, if the IEC document would by accepted in Europe CEN-Consultant assessed the standard and plead for the listing in the OJ of the EU TC 61 agreed also, so EN50165 would have been the first CLCstandard listed under the GAD 11

12 Assessment of the CEN-Consultant Annex ZA (informative) Clauses of this European Standard addressing Essential Requirements or other provisions of EU Directives This European standard has been prepared under a mandate given to CEN and CENELEC by the European Commission and the European Free Trade Association and supports essential requirements of EU Directive 90/396/EEC. WARNING : Other requirements and other EU Directives may be applicable to the product(s) falling within the scope of this standard. The following clauses of this standard are likely to support requirements of Directive 90/396/EEC. Compliance with the clauses of this standard provides one means of conforming with the specific essential requirement of the Directive concerned and associated EFTA regulations.
