1 BY-LAW NUMBER THE CORPORATION OF THE TOWNSHIP OF RIDEAU LAKES BEING a By-Law to amend By-Law to regulate the disposal of Waste at the Waste Disposal/Transfer Sites, the collection of household Waste and Recyclables in the Township of Rideau Lakes and to establish a schedule of fees for the disposal of certain items at the Waste Disposal/Transfer Sites. WHEREAS The Municipal Act, S.O. 2001, c.25 as amended, authorizes the Council of a local Municipality to pass by-laws for establishing and maintaining a system for the collection, removal and disposal of Waste; AND WHEREAS The Municipal Act, S.O. 2001, c.25 as amended, authorizes the Council of a local Municipality to set out provisions for charging rates for the aforementioned service; AND WHEREAS The Municipal Act, S.O. 2001, c.25 as amended, authorizes the Council of a local Municipality to pass by-laws prohibiting the throwing, placing or depositing of Waste or debris on private property or on property of the Municipality or any local board thereof, without authority from the owner or occupant of such property; AND WHEREAS the Council of The Corporation of the Township of Rideau Lakes deems it necessary to pass a By-Law to: 1) Regulate the disposal of Waste at Waste Disposal/Transfer Sites within the Township of Rideau Lakes 2) Regulate the collection of residential Waste 3) Regulate the collection of residential Recycling 4) Establish a schedule of fees for the disposal of Waste AND WHEREAS the Council of The Corporation of the Township of Rideau Lakes plans to reduce the amount of Waste going into the Waste Disposal/Transfer Sites; NOW THEREFORE the Council of The Corporation of the Township of Rideau Lakes enacts as follows: 1/ DEFINITIONS (in this By-Law): BAG TAG means a valid Township of Rideau Lakes tag intended for household garbage collection and/or disposal COMMERCIAL PROPERTY shall include those properties assessed as commercial COMPOSTABLES means any solid waste that may breakdown such as, but not limited to, fruit/vegetable waste, coffee grinds, tea leaves, grass clippings, garden debris, leaves and wood chips. Bone and meat matter is not considered compost material CONSTRUCTION MATERIAL shall include, but not be limited to, those items such as drywall, shingles, used lumber, not part of a building or structure of a Demolition site CONTRACTOR means any person or company, other than the Municipality, awarded a contract for the collection, transportation and disposal of household Waste or Recyclables DEMOLITION MATERIAL means any building or major portion thereof that has been torn down, destroyed or burned

2 HAZARDOUS WASTE shall mean the waste substances which can pose a substantial or potential hazard to human health or the environment when improperly managed INSTITUTE / INSTITUTION shall mean a building or group of buildings that houses one of these - school, museum, or other such institution such as an Art Institute or an Organized Society for promoting a particular object OCCUPANT shall include and mean any occupant, owner, lessee, tenant or responsible employee thereof of any Residential Dwelling Unit OWNER / TOWNSHIP means The Corporation of the Township of Rideau Lakes i) responsible for the establishment and operation of the waste management system ii) owns the land in or on which the Waste Disposal/Transfer Sites are located RECYCLE means to extract and reuse from waste material and shall include newspaper, paper, boxboard, corrugated cardboard, plastics #1, #2, #3, #4, #5, #6, #7, metal and aluminum cans/lids, etc. A more detailed list is set out in Schedule E attached hereto RESIDENT means a person or persons living within the Township, but shall not include any commercial enterprise RESIDENTIAL DWELLLING UNIT shall mean one or more habitable rooms designed for use by and occupied by not more than one family and in which separate kitchen facilities are provided for the exclusive use of such a family, with a private entrance from outside the building or from a common hallway or stairway inside the building RESIDENTIAL PROPERTY shall include those properties assessed as residential SERVICE CLUB means a charitable group or club fundraising to support local residents and charities SCHOOL means any education centre owned by the School Board STREET shall mean any public highway, private road, drive, lane, alley, square, place, thoroughfare or way within the Township of Rideau Lakes TENANT means a person who is lessee, occupant, sub-tenant, under-tenant or the person's assigns and legal representatives" TOWNSHIP means The Corporation of the Township of Rideau Lakes TOWNSHIP COUNCIL means The Council of The Corporation of the Township of Rideau Lakes WASTE means any solid being discarded and shall include, but not be limited to vegetable matter, floor sweepings, discarded wearing apparel, waste paper, plastics, papers, metal/aluminum containers, glass, wood, Construction Material, packing material, crockery, ceramics, etc., in any form or state abandoned, discarded or thrown out by any Occupant of and generated from a Residential Property or Residential Dwelling Unit Page 2

3 WASTE must be separated into Recyclables, Compostables and Other Waste generated by a household or Commercial Property OTHER WASTE shall mean: i) other than regular household Waste (see Schedule C) ii) that which may be placed in designated areas (See Schedule C) iii) hazardous waste (See Schedule D) WASTE DISPOSAL/TRANSFER SITE(S) means any Municipal land, building or structure in which Waste, Recyclables and/or Compostables are deposited or processed and any machinery, equipment or operation required for the treatment or disposal of Waste, Recyclable and/or Compostables WASTE SITE ATTENDANT means a person employed by the Township to monitor activities and collect fees at the Waste Disposal/Transfer Site(s) on behalf of the Township. 2/ WASTE DISPOSAL/TRANSFER SITES The following areas shall be designated as Municipal Waste Disposal/Transfer Sites and Recycling Depots for the Township of Rideau Lakes and no other lands in the Municipality shall be used for the disposal of Waste unless so designated by By-Law. The Certificates of Approval for the Waste Disposal/Transfer Sites and Recycling Sites, listed herein, make no provisions for the Township of Rideau Lakes to accept Waste from outside the Municipality. The Westport/Rideau Lakes Disposal/Recycling Site accepts materials from the Township of Rideau Lakes and from the Village of Westport. a) Elgin Waste Disposal/Transfer/Recycling Site Ward of South Crosby Concession 2, Part Lot 5 Certificate of Approval No. A CLOSED January 1, 2005 b) Delta Waste Disposal/Transfer/Recycling Site Ward of Bastard & South Burgess Concession 8, Part Lots 21 & 22 Certificate of Approval No. A c) Portland Waste Disposal/Transfer/Recycling Site Ward of Bastard & South Burgess Concession 2, Part Lot 14 Certificate of Approval No. A d) South Elmsley Recycling Depot Ward of South Elmsley Concession 3, Part Lot 11 C of A Exempt CLOSED January 1, 2008 e) Westport/Rideau Lakes Disposal/Recycling Site Ward of North Crosby Concession 7, Lot 15 Page 3

4 Certificate of Approval No. A / GENERAL REGULATIONS FOR THE OPERATION OF WASTE DISPOSAL/TRANSFER SITES: a) The Council of the Corporation of the Township of Rideau Lakes shall be responsible for the operation and use of the Waste Disposal/Transfer Sites and may contract, from time to time, for the removal and disposal of Waste from the sites. b) No person shall dispose of Waste or Other Waste at any of the Waste Disposal/Transfer Sites or Recycling Depots unless such Waste was generated within the Township of Rideau Lakes. c) All Waste being disposed of at any of the Waste Disposal/Transfer Sites must be separated in accordance with the rules and regulations established by the Council and instructions of the Waste Site Attendant or his or her designee. d) The Waste Site Attendant will supervise the disposal of all Waste at the site(s). e) The Waste Site Attendant, by the authority of Council, will inspect all Waste brought to the Waste Disposal/Transfer Sites. f) The Waste Site Attendant shall determine if the Waste is permitted into the Waste Disposal/Transfer Site, as per the Regulatory By-Law. g) The Waste Site Attendant will determine what charge is appropriate for the Waste being disposed of, pursuant to the Regulatory By-Law and Schedules attached thereto. h) Access to the Waste Disposal/Transfer Sites shall be on such days and during such hours as are set out in Schedule A which is attached to and forms part of this By-Law and no person shall trespass on any of the sites, except as is required to transfer material to or from the site in accordance with this By-Law, or as is necessary to conduct business with the Township. i) No person, unless authorized by a resolution of Council, shall remain at the Waste Disposal/Transfer Sites or Recycling Depots to pick over, interfere with, remove or scatter any materials in the sites. j) Waste must be deposited only in the designated areas at the Waste Disposal/Transfer Sites, as directed by the Waste Site Attendant or his or her designee. k) All Waste must be contained in a clear transparent bag or an equivalent sized plastic/ aluminum garbage can (personal items may be put in small white kitchen/bathroom garbage bags, which then may be placed inside the transparent bags, or an equivalent sized plastic/ aluminum garbage can of equal size). All household waste bags must have a valid Bag Tag attached as described and set out in Schedule B, which is attached to and forms part of this By-Law. l) The charges as set out in Schedule C, which is attached hereto and forms part of this By-Law, shall be paid to the Waste Site Attendant or designee upon entry to the Waste Disposal/Transfer Sites and before disposing of chargeable items. 5 m) Hazardous Waste, as defined by the Ministry of Environment, shall not be accepted at any Waste Disposal/Transfer Site. Hazardous waste materials that are excluded from being accepted at the Waste Disposal/Transfer Sites are listed, but not limited to, on Schedule D, which is attached hereto and forms part of this By-Law. 4/ GENERAL REGULATIONS FOR THE COLLECTION OF WASTE: a) All Residential Occupants shall receive waste and recycling collection commencing October 1, All Waste must be thoroughly sorted before being placed in a clear transparent garbage bag or an equivalent sized plastic/aluminum garbage can (personal items may be put in small white kitchen/bathroom garbage bags, which then may be placed inside the clear transparent bag or an equivalent sized plastic/aluminum garbage can). No Waste of a semi-liquid consistency shall be collected from any location whatsoever. b) Every Occupant shall place Waste in a transparent bag or an equivalent sized plastic/ aluminum garbage can (personal items may be put in small white kitchen/bathroom garbage bags, which then may be placed inside the transparent bags or an equivalent sized plastic/ aluminum garbage can) sufficient to prevent the entry of water, rain, flies and animals and the escape of noxious odours. c) All Waste shall be placed in a transparent garbage bag or an equivalent sized plastic/aluminum garbage can (personal items may be put in small white kitchen/bathroom garbage bags, which then may be placed inside the transparent bags or an equivalent sized plastic/aluminum garbage can) the size of which shall not be greater that 30 inches by 36 inches and no bag or container shall exceed 40 pounds in weight. d) The transparent garbage bag or an equivalent sized plastic/aluminum garbage can (personal items may be put in small white kitchen/bathroom garbage bags, which then may be placed inside the transparent bags or an equivalent sized plastic/aluminum garbage can) shall be placed by the Occupant for pick up, as close as possible to the travelled portion of the Street or location designated for pickup and in a manner as not to impede pedestrians or traffic and/or at the end of the Occupant s driveway. e) In the case of private roads which are deemed by the Township, in its sole opinion, to be inaccessible for pick up, Waste shall be placed in a Township designated area for pick up and shall not be placed out before 6:30 a.m. on the day of collection, unless in an animal proof container. f) No person shall place out any Waste in the Street before 7:00 p.m. on the day prior to Waste collection for that particular Street. g) No person shall place Waste on another person s property. No person shall spill, scatter, deposit, throw or cast any Waste on any Street or private property. h) Spillage, from transparent garbage bags or an equivalent sized plastic/aluminum garbage can, caused by animals or persons shall not be collected by the Township, its agent or independent Contractor and it shall be the responsibility of the generator of the Waste to clean up said spillage. 6 i) No person shall set out for collection any items including, but not limited to, hazardous waste, grass clippings, leaves, brush, trees, garden waste, scrap lumber, logs, metal, stone, brick, concrete, ashes, refrigerators, freezers, stoves, ovens, water heaters, washers, dryers, furniture or other such large items. j) Items not contained in a transparent garbage bag or an equivalent sized plastic/aluminum garbage can (personal items may be put in small white kitchen/bathroom garbage bags, which then may be placed inside the transparent bags an equivalent sized plastic/aluminum garbage can) shall not be set out for collection and shall not be picked up. k) Waste generated by Industrial, Commercial, Institutional or Service Club properties or premises shall not be set out for collection. The disposal of Waste generated by an Institution, Commercial or Industrial property shall be the sole responsibility of the Occupant of such establishment and the Township shall bear no responsibility for collection or disposal of same. l) Waste that will be collected by the Township, its agent or independent Contractor, shall be only that Waste as set out in this By-Law and which is in a transparent garbage bag or an equivalent sized plastic/aluminum garbage can (personal items may be put in small white kitchen/bathroom garbage bags, which then may be placed inside the transparent bags, or an equivalent sized plastic/aluminum garbage can) and in the quantities as set out in this By- Law. m) No person shall set out any bag or container of Waste without an affixed sticker, as stated in Schedule B of this By-Law. RECYCLING a) All Occupants must Recycle all material that can be recycled. b) The Recyclables that shall be accepted by the Township shall be only that material as set out in Schedule E attached hereto, which forms part of this By-Law. c) Recyclables shall be placed in a blue transparent bag and shall be placed by the Occupant for pickup as close as possible to the traveled portion of the Street or designated pickup location and in a manner as not to impede pedestrians or traffic at the end of the Occupant s driveway. COMPOSTING a) All Residents are encouraged to compost on their own property, any suitable organic material such as, but not limited to, grass clippings, garden debris, vegetable and fruit waste, coffee grains, tea leaves, leaves and wood chips, etc. b) The Township will provide, for a fee, a compost unit which can be located outdoors on the Resident s property. c) The Township provides areas for compost material that cannot be accommodated on the Resident s property. These areas are located at Waste Disposal/Transfer Sites listed in Section 2 of this By-Law. Composting at these sites will be at the direction of the Waste Site Attendant. Page 6

7 CONSTRUCTION MATERIAL In an attempt to lengthen the life of the Waste Disposal/Transfer Sites, the Township shall limit the disposal of Construction material placed in the landfill area at the Waste Disposal/Transfer Sites. All Construction material shall be placed in the appropriate containers for removal, or as directed by the Waste Site Attendant and charged as per the appropriate schedule attached. DEMOLITION In an attempt to lengthen the life of the Waste Disposal/Transfer Sites, the Township may not accept Demolition material at the Waste Disposal/Transfer Sites. CONTRACTORS Persons collecting Waste from others for gain and depositing such Waste in the Waste Disposal/Transfer Sites shall have a Waste Management Systems Certificate or such certificate as may be required by the Province of Ontario or agency thereof, for the hauling of Waste and upon request, shall show proof of compliance with said certificate requirements. Failing such request, collected Waste shall not be deposited in the Waste Disposal/Transfer Sites. PENALTIES AND/OR FINES Any person who contravenes any provisions of this by-law is guilty of an offence and shall, upon conviction, be liable to a fine pursuant to the Provincial Offenses Act. INVALIDITY / UNENFORCEABLE If any provision or requirement of this By-Law, or the application thereof to any person shall to any extent be held to be invalid or unenforceable, the remainder of this By-Law or the application of such provision or requirement to all persons other than those to which it is held to be invalid or unenforceable, shall not be affected thereby and each provision and requirement of this By-Law shall be separately valid and enforceable to the fullest extent permitted by law. REPEAL This By-Law repeals any previous By-Laws, Resolutions, Motions or Actions of Council Bylaws , and The Schedules of the By-Law may be changed from time to time, as deemed reasonable by Resolution of Council. This By-Law will be reviewed annually to consider modifications. EFFECTIVE DATE This By-Law shall come into force and take effect on the date of passing. TITLE This By-Law may be cited as the 'Waste Disposal By-Law'. Page 7

11 Waste collection schedules and Waste Site Hours of Operation are affected by statutory and civic holidays STATUTORY HOLIDAYS Waste collection and waste site hours of operation are affected by statutory and civic holidays. If a holiday falls on a Monday, the entire collection schedule for the week will advance by one day. Monday s collection will occur on Tuesday, Tuesday on Wednesday, etc. to Friday s collection on Saturday. Waste site hours of operation will only shift by one day when the holiday falls on a day that the waste site is normally open. Otherwise, waste site hours will be unaffected. Rescheduling will be published in local media and/or found on the Township website: SCHEDULE A-1 COLLECTION OF HOUSEHOLD WASTE ON PRIVATE ROADS REGULATIONS FOR THE COLLECTION OF HOUSEHOLD WASTE AND RECYCLING ON PRIVATE ROADS 1) Door to door collection on private roads shall be at the discretion of the Township, based on the condition of the road and turning area and the number of occupied residences on the road. 2) If a private road is considered to be inaccessible/unserviceable, by the Township in its sole discretion, all Waste must be transported by the Occupant to an area designated by the Township for collection. 3) Collection on accessible private roads will commence the Tuesday immediately after Victoria Day in May and cease the Tuesday immediately after Thanksgiving. 12 SCHEDULE B CONTAINERS FOR Waste or Other Waste All Waste from Residential Properties, which cannot be recycled, composted or diverted must be placed in transparent garbage bags, or an equivalent sized plastic/aluminum garbage can (personal items may be put in small white kitchen/bathroom garbage bags, which then may be placed inside the transparent bags, or an equivalent sized plastic/aluminum garbage can), and set out for collection. The bags of Waste shall not be larger than 30 x 36 (76 cm x 91 cm) and shall not weigh more than 40 pounds. All residents will be permitted to place no more than two tagged bags of waste out for collection each week. BAG TAGS All transparent garbage bags, or equivalent sized plastic/aluminum garbage cans from a residence, must have one (1) household Bag Tag attached and be fully visible. Bag Tags can be purchased at the Municipal Office and other local businesses throughout the Township. COMMERCIAL, INDUSTRIES, INSTITUTIONS All Waste generated from Commercial, Industries and Institutions may not be set out for collection, by the Township or its agent. All Waste generated from said groups may be disposed of at the Waste Disposal/Transfer Sites, during regular hours of operation and will be charged according to the fees in Schedule C or may be disposed of through a private contractor. 14 SCHEDULE D HAZARDOUS WASTE The following list includes, but is not limited to, the items considered hazardous waste that will not be accepted for collection or at any of the Waste Disposal/Transfer Sites within the Township of Rideau Lakes. Acids Caustics (lye) flashlight batteries Motor oil Aerosol Cans Cleaners Gasoline Oven Cleaners Ammonia Cleaning Fluids Glues Paint Antifreeze Cosmetics Herbicides Pesticides Batteries Detergents Hypodermic needles Pharmaceuticals Bleach Drain Cleaners Insecticides Pool Chemicals Solvents (nail polish remover, varsol) Metal gas containers, propane tanks and all other fuel tanks/containers are considered hazardous and will not be accepted for collection or at any Waste Disposal/Transfer Site. Residents should make use of the County-run hazardous waste days which occur twice a year. Information can be found on the Township website. SCHEDULE E RECYCLING The following items are acknowledged as Recyclables and will be picked up during recycling collection: 1) FIBRES Newspapers & inserts, boxboard, magazines, catalogues, all paper (junk mail, writing paper, photocopy, craft paper, computer paper, envelopes, post-it-notes, etc.), telephone books, soft covered books, etc. can be tied and bundled with other fibres or placed in a blue transparent bag. 2) CORRUGATED CARDBOARD Cardboard must be broken down and tied for pickup or placed in a blue transparent bag. 3) CONTAINER metal and aluminum cans, metal and aluminum food trays (must be clean & crushed) placed in a blue transparent bag. 4) CONTAINER PET plastic containers with the symbol #1 narrow neck containers only HDPE natural plastic containers with the symbol #2 narrow neck containers only (milk and water bottles) HDPE pigmented plastic containers with the symbol #2 narrow neck containers only (detergent, shampoo, bleach bottles, etc. without caps) Plastics with symbols #3, #4, #5, #6, #7 narrow and screw top containers Placed in a blue transparent bag and can be mixed with metal/aluminum cans 5) CLEAR GLASS BOTTLES & JARS (must be clean) 6) COLOURED GLASS BOTTLES & JARS (must be clean) Page 14

15 SCHEDULE F OTHER GENERAL INFORMATION COMPOSTING Residents are encouraged to compost on their property. There are areas at all Waste Disposal/Transfer Sites for compost material, which are available for use, free of charge. Compost material brought to the Waste Disposal/Transfer Site in bags or containers must be dumped from the bags or containers, into the appropriate areas. Bags and containers are then to be deposited in the appropriate Waste area. The following items are considered to be compostable: grass clippings, leaves, garden materials, food scraps, egg shells, coffee grinds, tea leaves, fruit and vegetable waste, etc. The following items are NOT compostable: bones, meat and cooking oils. BRUSH & WOOD Non-treated, non-painted wood may be disposed of at the Waste Disposal/Transfer Sites in a designated area for burning or grinding, under the regulations of the MOE, chargeable according to the fees in Schedule C. All treated and painted wood may be disposed of at the Waste Disposal/Transfer Sites Landfill Sites in a designated area for disposal, chargeable according to the tipping fees in Schedule C. All brush and tree wood will be accepted at the site, chargeable according to the tipping fees in Schedule C. SCRAP METAL Loose scrap metal may be disposed of at the Waste Disposal/Transfer Sites free of charge. Metal/steel appliances will be chargeable according to the tipping fees set out in Schedule C.
