During the warranty period, any such defects will be repaired or the defective extinguisher replaced (If the original seal is intact and/or if only factory replacement parts have been used to service the extinguisher). This warranty does not cover defects resulting from modifications, alteration, misuse, exposure to corrosive conditions or improper installation or maintenance. All implied warranties, including, but not limited to, warranties of fitness for purpose and merchantability, are limited to the time period as stated above. In no event shall Strike First Corporation be liable for incidental or consequential damages. Strike First Corporation neither assumes nor authorizes any representative or other person to assume for it any obligation or liability other than as expressly set forth herein. Flag Fire is not responsible for the installation or the maintenance of the equipment. In no event shall Flag Fire be responsible for any personal injury, property damage or other losses resulting from the failure of such Products to operate properly, since Flag Fire s sole responsibility for defective or nonconforming Products. Accordingly, the exclusive remedy for breach of this Warranty is the repaid or replacement of defective or nonconforming Products Flag Fire itself (or by others pursuant only to Flag Fire s prior written authorization) or the return of that portion of the purchase price represented by such defective or nonconforming Products, and in no case shall Flag Fire s liability under any other remedy prescribed by law exceed the value of that portion of the purchase price represented by such defective or nonconforming Products.
