(Performance F7.3.2). The amendment to the regulations came into force on 24th April The amendment does not apply to existing homes, but the regulations will mandate the installation of smoke alarms when a building undergoes an alteration or change of use to become a home, or when any alteration is made to an existing home that requires a building consent. Relay contacts (normally open and closed) supplied are available for triggering the security panel and its associated ancillary products. 13 RadioLINK (Wireless) Alarms Accessories EIB168RF RadioLINK Base for Wireless Interconnection of 140 Series alarms (EIB141, EIB146, and EIB144) The EIB168RF RadioLINK Base transmits a Radio Frequency (RF) alarm signal when the smoke/heat alarm mounted on it senses fire. When it receives an RF alarm signal from another EIB168RF Base or RadioLINK device, the attached smoke or heat alarm will sound. It therefore eliminates the need to run long interconnect wires between all the smoke alarms on different floors and in different rooms. It can be used to provide a means of interconnecting 230V smoke / heat alarms which are powered from different circuit phases It is designed for use with the Easi-Fit range of Mains Powered Smoke/Heat Alarms. The RadioLINK Base itself is also mains powered and has rechargeable Lithium cells for back-up in the event of mains failure. The RadioLINK Base will normally be wired to the nearest mains circuit in the ceiling (usually the unswitched lighting circuit). The Smoke/Heat Alarm will then slide on to the RadioLINK Base rather than to its normal mounting plate. As many as 30 units can be interconnected in this way Complies with AS/NZS EIB428RF RadioLINK Mains Powered Relay Module with Wireless Receivable Interconnect The EIB428RF RadioLINK Relay Module is a device that switches a relay upon receipt of an alarm signal. The electrically isolated contacts can be used for many applications such as signaling, turning on lights, etc. The EIB428RF is designed to operate with RadioLINK products but can be used as a standalone hard wired battery backed relay base (EIB407RF). The EIB428RF RadioLINK Relay Module is powered by the 230VAC mains and has rechargeable back-up cells. As supplied the relay operates continuously (i.e. it switches when one of the smoke/heat alarms detects fire and switches back when the smoke clears). When the slide switch is removed to the pulse P position the relay will switch when fire is detected but will automatically switch back after 5 seconds pulsing. The EIB410RF is a hand held remote control. 16 Deaf & Hard of Hearing Ideal for nursing homes, respite care, retirement villages, the deaf, the hard of hearing and the elderly Conventional smoke alarms rely on an audible warning. How then do you adequately protect people who cannot hear the alarm siren? The safe and reliable solution is the special mains-powered smoke alarm system from BROOKS, specifically designed for the deaf and hard of hearing. In the event of a fire, as well as sounding an audible warning, the alarm will activate a high intensity strobe light built into the control panel and a vibrating pad located beneath the sleeper s pillow, to alert them of the danger. The system can be used with ionisation or optical alarms, utilising BROOKS high quality detection technology. 17 Deaf & Hard of Hearing BAVISA240 Visalert 230V Hard of Hearing Warning Device for use with BROOKS Smoke Alarms Conventional Smoke Alarms are not effective in alerting those with hearing impairments, yet the early warning of a fire is no less important. Visalert is a visual warning device which can be interconnected with your BROOKS 240V/Battery backed smoke/heat alarms. Visalert has a re-chargeable battery backup, a feature BROOKS considers essential. The battery provides the necessary standby power so that Visalert is still capable of providing a warning even if the 240 Volt mains supply fails (i.e. electrical fire).as the intense strobe light provides the warning for the hearing impaired person, this should be battery backed for the same reason Visalert can be placed in both the bedroom and living areas. 18 Carbon Monoxide Alarms Ideal for caravans, boats, as a supplement to normal smoke detection. Senses the building of carbon monoxide, it is not a fire detector. EI261EN Carbon Monoxide (CO) 230V Mains Powered Alarm with 10 Year Rechargeable Lithium Battery Backup CO is a particularly insidious gas; you can t see it, taste it or smell it, but it is potentially lethal. The need for a reliable mains powered co alarm that will operate even in the event of a mains failure is obvious. DELIVERYOFGOODS 6.1WhilsttheSellerwilluseitsbestendeavourstomeetallquoteddeliveryorconsignmentdatestheSellershallinno eventbeliabletothebuyerbyreasonofdelaysindeliverycausedbyanyreasonwhatsoever. 6.2TheSellershalluseitsowndesignatedcarrierforalldeliveries.IftheBuyerwishestouseitsowncarrier,deliveryofthe goodsshallbeexseller sstoreandthebuyershallpayallfreightandinsurancecostsexseller sstoreandshall indemnifythesellerfromanagainstallactions,suits,proceedings,claimsfordemandsandalllosses,expensesand liabilities,howsoeverarising,fromthetransportationoftheseller sgoodsdeliveredexseller sstoreoncedeliveryhas beenmadebythesellertothebuyer scarrier. 6.3IntheeventofanydelaycausedbytheBuyerorcausedbyindustrialdisputes,includingstrikesandlockouts, circumstancessuchasfire,war,mobilisationoranyothercausebeyondthereasonablecontroloftheseller,thesellerat itsoption,mayextendthequoteddeliveryorconsignmentdatesorconsignpartofanorderorsuspendconsignment duringthatperiodofdelayormaycanceltheorderandthebuyershallnotberelievedofitsobligationtoacceptandpay foranorder,oranypartofanorder,inaccordancewithclause5,asaresultofanysuchextensions,partialconsignments orsuspensions. 7.RISK 7.1AllgoodssoldtotheBuyershallbeattheBuyer sriskimmediatelyupondeliverytothebuyer,tothebuyer snominee, ortothebuyer scarrier,exceptwheregoodsareheldforthebuyerinwhichcaseriskshallpasstothebuyeronthedate beingseven(7)daysfromthedateofnotificationtothebuyerthatthegoodsarereadyfordelivery. 8.TITLEOFGOODS 8.1Notwithstandingtheprovisionsofparagraph7,theSellershallretainthetitletoallgoodssuppliedbyittotheBuyer untilithasreceivedpaymentinfullofallsumsdueinconnectionwiththesupplyofallgoodsbythesellertothebuyerat anytimeinthecaseofpaymentbycheque,billofexchangeornote,titleshallnotpasstothebuyeruntilthesameis honoured. 8.2Intheeventthatanyofthegoodsareincorporatedintoorattachedto,ormixedwith,othergoodsbytheBuyer,sothat theyarenolongeridentifiableorseparable,thentitletothecompositegoodsshallvestinandbyretainedbythesellerin accordancewithparagraph TheBuyershallstoreallGoodsandanycompositegoodsownedbytheSeller( Seller sgoods )insuchawaythatthey areclearlyidentifiableastheseller sproperty,andshallmaintainandallowthesellertoinspectrecordsoftheseller s Goods,identifyingthemastheSeller spropertyandofthepersonstowhomitsellsorotherwisesuppliestheseller s GoodsoranyofthemandofpaymentsmadebysuchpersonsfortheSeller sgoods. 8.4IfpaymentforanyGoodsisoverdue,theSellerisentitled,withoutprejudicetoanyofitsotherrightsandremedies,to repossesstheseller sgoodsandtoenterintoanypremisesuponwhichtheseller sgoodsarestored,withoutnoticefor thispurpose. 8.5UntilsuchtimeastheSellerreceivespaymentinfullforanyGoods,iftheBuyersellsorreceivesanypaymentfroma customerorinsurerinrespectoftheseller sgoodstheproceedsofanysuchsaleordispositionandanyinsurance proceeds(orclaimthereto)shallbeheldbythebuyerontrustforthesellerandpaidintoaseparatebankaccountwhich shallnotbeoverdrawnorotherwisedealtwithouttheseller spriorwrittenconsent. 8.6Nothinginparagraphsnumbered8.1to8.5inclusiveshallaffecttheSeller srightsasanunpaidseller. 9.RETURNOFGOODSANDCANCELLATIONSOFORDERS 9.1TheBuyermaywithinfourteen(14)daysofreceiptofanygoodsclaimtherighttorejectanygoodswhicharewrongly oroversupplied,orwhicharenotinaccordancewithanyexpressorimpliedrepresentations,warranties,termsor conditionsofthecontractofsale,withoutlimitingtheseller srighttodisputeanysuchclaim.ifthebuyerfailstonotifythe Sellerinwritingofitsclaimforrejectionandreasonsthereforewithinsuchperiod,theBuyerwill,subjectalwaystoclause 12ofthesetermsandconditions,bedeemedtohaveacceptedsuchconsignment. 9.2ReturnofanyofthegoodscannotbemadebytheBuyer a)withoutpriorwrittenauthorisationfromtheseller,and b)unlessaccompaniedbythedeliverydocketshowingtheseller sauthorisationreferencenumber,and c)unlessreturnedinoriginalpacking,unsoiled,undamaged,and d)unlessaccompaniedbyagoodsreturnadvice(gra). 9.3Unlessotherwiseagreed,goodsreturnedwillbesubjecttoaminimum20%restockingfee. 9.4IntheeventthattheBuyerreturnsgoodsotherthaninaccordancewithparagraph9.2,subjectalwaystoclause12of thesetermsandconditions,thesellershallreconsignthosegoodstothebuyer,freightcollect. 9.5Unlessotherwiseagreed,goodsreturnedotherthanbyournominatedcarrier/swillnotbeaccepted. 9.6TheBuyershallnotcancelanyorderwithoutthepriorwrittenconsentoftheSeller,whichconsentmayormaynotbe grantedintheseller ssolediscretion. 9.IntheeventthattheSelleragreestothecancellationofanorderinitsabsolutediscretion,theSellermayasacondition ofsuchcancellation,requirethepaymentbybuyerofacancellationfeeofanamountdeterminedbythesellerinits reasonablediscretiontocompensateitforthelosssufferedbyitarisingoutofthecancellation. 9.6AttheSeller soption,anyordermaybeterminatedbythesellerintheeventoftheinsolvencyofthebuyerorinthe eventofexecutionbeingleviedagainstanyofthepropertyofthebuyerorintheeventofthebuyerbeingplacedin liquidation,whethervoluntaryorotherwise,orareceiverorareceiverandmanagerbeingappointedinrespectofthe assetsorundertakingofthebuyerorthebuyerenteringintoadeedofcompositionorarrangementwithitscreditorsor anyoranyofthem,orintheeventthatforanyreason,intheseller sreasonableopinion,thebuyerisunlikelytobeableto makepaymentforgoodsontheduedate. 10.SPECIFICATIONSANDINFORMATION 10.1Listedperformancedataisbaseduponourexperienceandissuchasweexpecttoobtainontest.Shouldthesefigures notbeobtainednoliabilitywillbeacceptedunlesstheyarespecificallyguaranteedinwritingandinwhichcasethey wouldbesubjecttotherecognisedtoleranceandrejectionlimitsapplicabletosuchfigures.thebuyershallassume responsibilityforthecapacityandperformanceofthegoodsbeingsufficientandsuitableforthepurpose. 10.2AlldrawingsandprintedmatteraccompanyingaquotationorintheBuyershandbeforeorafteracceptanceofany orderareforinformationonly. 11.INTELLECTUALPROPERTY 11.1TheBuyeracknowledgesthatallrightsinrespectofpatents,copyrights,designrights,trademarksorotherindustrial orintellectualpropertyrightsconnectedwiththegoodsshallnotpasstothebuyer.thebuyershallindemnifytheseller againstanyandallliabilities,claimsandcostsincurredbyormadeagainstthesellerasadirectorindirectresultof carryingoutofanyworkrequiredtobedoneonortothegoodsinaccordancewiththerequirementsorspecificationsof thebuyerinvolvinganyinfringementorallegedinfringementofanyrightsofanythirdparty. 12.WARRANTY 12.1TheSellerwarrantstotheBuyerthat,underproperandnormaluseandserviceinaccordancewiththeSeller s specificationsandinstructions(ifany)thegoodswillbefreefromdefectssolelyduetofaultyworkmanshipofmaterials, duringaperiodoftwelve(12)monthsfromdelivery,totheextentthatuponauthorisedreturntotheseller,freightpre paid,duringthatperiod,ofanypartofthegoodscoveredbythiswarranty,thesellershall,ifitfindssuchaparttobe defectiveinitssoleopinion,asitsoptionrepairsuchpartorsupplyareplacementpart,providedthat: a)thegoodsoranypartthereofarenot,andhavenotbeen,withouttheseller sconsent,altered,repairedorsubjectedto anytechnicalattentionbyanypersonotherthantheseller sauthorisedrepresentatives; b)theprovisionofthisparagraph12.1may,attheseller soption,bevariedorreplacedbyspecificwarrantyconditions issuedinrespectofparticularproducts,and c)thiswarrantydoesnotcoverdamageduetonormalwearandtear,improperinstallation,useofanyoftheseller s goodsinlifesupportproducts,misuseorneglectorwheregoodshavebeensubjectedtooperatingorenvironmental conditionsinexcessofmaximumvalueintheapplicablespecifications. 12.2Totheextentpermittedbylaw,andexpectasexpresslyprovidedinparagraph12.1,allwarranties,representations, termsandconditions,concerningthegoodsorservicestobesuppliedbythesellerinrespectofthegoods,including,but notlimitedto,warranties,representations,termsorconditionsregardingtheabilityofgoods,whetherexpressorimplied, areherebyexpresslyexcluded. 12.3Totheextentpermittedbylaw,theSellershallnotbeliable,norshalltherebeanyremedyagainsttheSellerinrespect ofanyclaim,whethercontractual,tortious,statutoryorotherwise,foranyloss,damage,costs,expensesorotherinjuryor harmsufferedbythebuyeroranyotherpersoninrelationtoorarisingoutofuseofthegoodsorinrelationtoorarising outofservicesuppliedbythesellerinrelationtothegoods,includingbutnotlimitedto,lossofprofits,lossofbusiness, unavailabilityofgoodsorlossesarisingfromclaimsbythirdparties. 13.LIMITATIONOFLIABILITY 13.1TheSellershallnotbesubjecttonotincur,andtheBuyerreleasestheSellerfromanyclaimactionorliability(included consequentiallossorchange,removal,reinstallation,lossofuseorofprofits)byreasonordelays,faultordefective materialsorworkmanship,negligenceoranyactmatterorthingdonepermittedoromittedbytheseller. 13.2BuyerspropertyundertheSeller scustodyorcontrolwillbeentirelyatthebuyer sriskasregardslossordamage theretoortherebywhatsoevercausearising. 13.3GoodsshowninanycataloguearethosegoodstheSellerconsidersitsnormallines.TheSellerhoweverdoesnot warrant,whetherexpressedorimpliedtheavailabilityexstockanyofthosegoodslisted. 13.4Errorsoromissionsofaclericalormechanicalnatureappearingonthefacehereofaresubject,tocorrectionbythe Seller. 13.5NeitherthisagreementnoranyrightshereundermaybeassignedbytheBuyerwithoutthepriorwrittenconsentof theseller. 14.INFRINGEMENTOFINTELLECTUALANDINDUSTRIALPROPERTYRIGHTS 14.1Ifanyaction,suitproceeding,claimordemandisbroughtormadeallegingthatthesale,useoranyotherdealingwith thegoodsinfringesthetrademark,tradename,patent,copyright,registereddesignoranyotherintellectualorindustrial propertyrightsofthirdparties,thebuyershallforthwithnotifythesellerthereofandgiveeveryassistancetothesellerin connectiontherewithasthesellermayreasonablyrequireandshallnotitselfhandle,dealwithorcompromiseanysuch actionsuitproceedings,claimordemandexceptwiththepriorwrittenconsentoftheseller. 15.GOVERNINGLAW 15.1Thesetermsandconditionsshallbegoverned,andconstruedinaccordancewiththelawsoftheStateofNewSouth WalesandthepartiesunconditionallyandinevitablysubmittothenonexclusivejurisdictionofthecourtsofthatState. 16.USEOFGOODS 16.1TheBuyerwillnotusethegoodsforanypurposeotherthanthatforwhichthegoodsweresoldtoitandwillusethe goodsstrictlyinaccordancewithanyinstructionsorsupportingdocumentationsuppliedwiththegoods,orasdirectedby thesupplier.
