1 MINUTES OF MEETING OF THE ARCHITECTURAL AND HISTORIC REVIEW BOARD OF THE VILLAGE OF SAGAPONACK IN THE TOWN OF SOUTHAMPTON, COUNTY OF SUFFOLK AND STATE OF NEW YORK A meeting of the Architectural and Historic Review Board of the Village of Sagaponack was held at 3:00 p.m. on Friday, October 21, 2016 at 3175 Montauk Highway, Sagaponack, N.Y. The meeting was called to order by Chairperson Tom White with a flag salute. Present were Board Members Robert Barandes, Nick Martin, Pingree Louchheim and Emily Aspinall. Also present were Village Attorney Anthony Tohill, Building Inspector John Woudsma and Village Secretary Pat Arancio Remkus. APPROVAL OF MINUTES Chairperson Tom White asked for a motion to approve the minutes from September 16, 2016 AHRB. A motion to approve the minutes was offered by Robert Barandes, seconded by Emily Aspinall and unanimously approved. GATES/SIGNS Robin & Ariel Chaus 351 Parsonage Lane Applicant proposes installation of driveway gates This application was approved by the Committee of Two. 2. White Investment LP 2987 Montauk Highway Applicant proposes new wall mounted sign Chairperson White recused himself from this application. Ronald Fisher of Fisher Signs & Shirts, presented the application for Douglas Elliman, who are the new tenants of the building. He explained that it will be located on the north side of the building in the same location of the existing sign and will be the same size Robert Barandes asked if the sign was lighted to which Mr. Fisher responded no. Mr. Fisher provided color samples of the background for the sign, which is similar to a turquoise blue to which the Board commented that they did not like the color. Mr. Fisher stated that this is the color of all of the Douglas Elliman signs to which Robert Barandes responded that he does not see it registered. 1
2 Nick Martin asked if they could lower the position of the sign by placing it on the bottom of the door or outside of the glass to which Mr. Fisher responded that if it were placed on the door it would not be clearly visible and if it were placed on the glass it would have to be a sticker. He stated that he would need to check with his client s designer and noted that the new sign will be placed in the same location as the previous sign. Robert Barandes stated that it was a striking design, but the background is out of context in Sagaponack. He noted that an alternative would be to place the sign in the lower panel of the door. The color is an issue because of the location of the building on Montauk Highway. Emily Aspinall asked if they could reverse the colors making the letters blue/green and the background white to which Mr. Fisher responded that he would need to speak with his clients. Robert Barandes asked the applicant to return next month with renderings with three different options: reverse colors, placement on the door and placement on the side of the building. Village Attorney Tony Tohill stated that there is currently no lighting so we can prohibit the lighting on a new sign. Nick Martin stated that it is a modern sign and suggested that they add trim around the sign and align the sign with the top of the glass of the door. Robert Barandes asked for a motion to adjourn the application. A motion was offered by Nick Martin, seconded by Emily Aspinall and unanimously approved. OLD BUSINESS AMENDMENT/ADDITION / RENOVATION/ David Fox 328 Parsonage Lane Amendment to Board s approval of demolition permit to allow the garage and pool house to remain during construction to be used as a construction office and storage. Bond received and deposited. Structures will be removed before the issuance of the C. O. Chairperson White asked for a motion to approve the amendment to the existing Demolition Permit to allow the garage and pool house to remain during construction to be used as a construction office and storage. A motion was offered by Nick Martin, seconded by Robert Barandes and unanimously approved. Garrard Beeney & Evan Mason 42 Crestview Lane Applicant proposes Amendment to Building Permit #823 alternate design of previously approved access to roof deck Brian Lester, Esq. and Madeline VenJohn, Esq. of Tarbet & Lester were present. Robert Barandes asked if there will be lighting around the glass structure to which Mr. Lester responded no, but there will be tread lighting. He noted that it was designed so the structure would be hidden behind the railing. 2
3 Pingree Louchheim asked if the glass structure was the same height as the railing to which Mr. Lester responded yes. Emily Aspinall asked what material the frame of the glass structure was to which Mr. Lester responded that it was metal. Robert Barandes stated that this application can be approved if there is a stipulation that there be no lighting in the glass structure, only tread lighting no timer. Mr. Lester stated that the lighting would be on a switch to which Nick Martin added that the lighting will only be on when it is needed. Mr. Lester stated that he would agree to the stipulation that the lighting be sufficient to meet the NYS Building Code. The following resolution was offered by Robert Barandes and seconded by Nick Martin: WHEREAS, applicants by their representative Brian Lester, Esq. have applied to modify a prior approval to enable placement of a roof access structure at a residence at 42 Crestview Lane; and WHEREAS, the Board has expressed concerns that any such structure not produce or emit light projecting into the sky or disturbing adjacent or nearby properties; and WHEREAS, applicants have represented that the access structure shall be so designed and installed so as to prevent any such outcomes; NOW THEREFORE, this application for a roof access structure as depicted on the materials submitted by applicants is approved with the conditions that (a) no up light shall emit into the sky above said structure (b) any lighting of the interior stairs providing access to this structure shall be the minimum required under the NYS Uniform Fire Prevention and Building Code and (c) any such lighting shall be manually controlled with the intention, understanding and condition that the use of lights be limited in duration to the actual use of the stairs and access structure. It was approved unanimously. 3
4 NEW CONSTRUCTION David Mitchell 70 Fairfield Pond Lane Applicant proposes construction of a two story, single family dwelling with finished basement, unroofed decks, roof terrace, garage and pool house West Chin and David Jiang of West Chin Architects presented the application. As requested by the Board last month, he provided night time illuminated renderings, reduced the amount of windows and provided the ratio of windows to walls. Chairperson White asked for clarification of the recreation area on the roof. Pingree Louchheim asked if there will be lighting on the roof to which Mr. Jiang responded that there will only be lighting off of the walls of the terrace. Chairperson White asked what the intended use of the recreation area on the roof was to which Mr. Chin responded that it will be seating to enjoy the views. There will be no sound system. Mr. Chin stated that the wood siding will be the same color as the window trims. Nick Martin asked if there were rain screens over the windows to which Mr. Chin responded yes. Robert Barandes stated that the approval must include that there will be no TV, barbeque, kitchen or music on the roof deck to which Mr. Chin stated that it will only be a seating area. Tony Tohill stated that no up-lighting is permitted to which Mr. Jiang responded that there will only be lighting along the perimeter edge below the railing. Robert Barandes asked the Village Building Inspector if a kitchen and barbeque are permitted on a roof deck to which Village building Inspector John Woudsma responded yes. Mr. Chin stated that the barbeque will be down stairs. He stated that the roof deck will be a seating area, not an entertainment area. The following resolution was offered by Robert Barandes and seconded by Pingree Louchheim and approved unanimously: WHEREAS, applicant, David Jan Mitchell, by his representative West Chin Architect has made application for approval of a single family residence at 70 Fairfield Pond Lane, and WHEREAS, the Board has considered this matter at multiple meetings at which time concerns were expressed about the use of glass windows, the risk of offsite glare and the impacts on adjacent and nearby properties, and 4
5 WHEREAS, applicant has now reduced the number of windows and has represented the extent of proposed improvements and use of the roof area as limited to outdoor seating, NOW THEREFORE, this application as amended as of October 21, 2016 is approved subject to the following conditions, each corresponding to applicant s representative s representations: resolved the use of the roof area shall be limited to outdoor seating, any placement, installation or maintenance of a fireplace, kitchen, television, video system, audio system, food preparation or service appliances, whether by fixture or other means, is prohibited, it being intended that any such improvement or similar feature would allow activity other than maintenance of a seating plan and the use of the roof is limited to seating only, and it is further resolved any lighting on the roof shall be limited to reveal on the perimeter edge without up lighting or trespass on adjacent or nearby properties. Debra Simon 53 Sagg Main Street Applicant proposes construction of a two story, single family dwelling Michael Palladino, architect, presented the application. He stated they have removed the pool transoms and have aligned the upper windows of the dormer with the sliders below. They have placed small square windows on the gable areas. They replaced the black standing seam roofs with galvanized steel. They have replaced the black trim with natural cedar, they have reduced the chimney to 7 7 ½ and lightened the color of the stucco and lightened the trim color to a lighter grey. Debra Simon stated that she has added trees to the perimeter of the property to make it even less visible to the neighbors. Chairperson White asked for a motion to approve the application. A motion was offered by Pingree Louchheim, seconded by Robert Barandes and unanimously approved. NEW BUSINESS AMENDMENT/ADDITION / RENOVATION Landgrove LLC 640 Sagg Main Street Applicant proposes addition of two small windows to the 2 nd Fl Laundry/Storage room and change from painted clapboard siding to natural shingles Rena Mande of PBDW Architects presented the application. She stated that in addition to the windows the more major change is the siding. They are proposing natural red cedar shingles in order to fit in more with the historic nature and context of the neighborhood. She provided photos of neighboring homes and noted that the only wall to remain as clapboard would be the front entry wall. Chairperson White asked what the idea behind that is to which Ms. Mande responded that it creates more internal space for the front porch because it is recessed it is not read as the same space as the façade as the shingle. It makes a nice transition between the old and the new. 5
6 Emily Aspinall asked what color the clapboard and trim will be to which Ms. Mande responded the clapboard will be a will be a buttery yellow and the trim color will be off white. Ms. Mande stated that they are proposing a copper roof at the very shallow sloped roof of the front entry porch noting that it is not visible from the street because of the existing high hedging and that it is barely visible. At eye level you cannot see it because it is a recessed porch. Chairperson White asked if they could use lead coated copper instead to which Ms. Mande responded yes. Chairperson White asked if this is the same material that was previously approved for the 2 nd Fl rear roof to which Ms. Mande responded yes. Chairperson White asked if they could use lead coated copper on that roof as well to which Ms. Mande responded yes. Ms. Mande stated that they are proposing two additional windows on the second story along the front façade to bring natural light and air to that room, which was originally designed as storage, but will now be the laundry room. They are proposing the addition of two windows: one on the eave wall to the right of the recess above the front porch and one on the east elevation to the right of the front porch on the 2 nd Fl. She noted that there was a suggestion from the Committee of Two to enlarge the window on the eave wall and they provided three different options. The first (Option A) is a smaller elongated window the same height and elongated just like the three previously approved windows above the porch. The second (Option B) is an exact replica of the three windows above so that it would continue on to that east wall and the third (Option C) is a small double hung, which they feel is oversized, but wanted to show that they considered it. Ms. Mande explained that the window on the east elevations is limited in terms of height because the old house is two steps down from the new house at the 2 nd Fl level. Once that is raised up they are limited in terms of the height of that wall in addition to being under the eave. They believe that the elongated short window is quite characteristic of a house that would have grown over time and it adds to the character of the house and the charm of the front façade, which is otherwise quite formal. Pingree Louchheim asked what the original house color was to which Ms. Mande responded that it was yellow clapboard. Robert Barandes commented that it looks like a Sears Roebuck catalog house from the early 1900 s certainly with the windows put sideways to which Ms. Mande responded that the owners have a house in Vermont where they have ridge windows that are installed sideways. Robert Barandes stated that bringing in yellow clapboard at the door is outside of our convention for the Village to which Chairperson White agreed. Emily Aspinall noted that the color is more of a cream color. Ms. Mande stated that it is meant to read more like trim, but they are willing to change the Yellow (Easter lily) color. Robert Barandes stated that he understands that clapboard is a great revision of it as an entrance door. It certainly is distinctive. 6
7 Emily Aspinall asked if they could have the clapboard the same color as the trim to which Ms. Mande responded maybe more like a skin tone. Chairperson White stated that the front entrance is part of the old house and he would prefer it be shingled as it would create a more simple design. You are treating the historical nature of the original structure with a temperament to modernize it to which Ms. Mande responded that they are looking to show that is the area that bridged the old and the new. Chairperson White commented that might not be the best way to do that. Pingree Louchheim commented that she prefers the white color, not just the cedar shingles. Chairperson White stated the shingles underneath the porch are not going to season the same way as the other shingles because it is not going to have the same exposure. Emily Aspinall stated that if the clapboard were the same color as the shingles it would still be distinctive without being a different color to which Chairperson White stated that was the direction he would prefer instead of having a different kind of wood there. He stated that he is not opposed to the copper roof, but he is opposed to the painting of the clapboard. Pingree Louchheim stated that the houses to either side of this structure are white and she likes this structure painted to which Robert Barandes asked if she is speaking of the house in its entirety because the applicant is asking to change the entire house to shingles rather than clapboard to which Pingree Louchheim responded yes, she would prefer the entire house be painted clapboard. Ms. Mande stated that her clients consider this a beneficial change to the house and speaks more to the other houses in the area. Nick Martin asked if the copper is standing seam to which Ms. Mande responded no, it is flat. Nick Martin asked about the color of the corner board to which Mande responded they will be snow white. The corner boards and the window trim will be snow white. Nick Martin asked how the Board felt about snow white trim to which Robert Barandes responded that he is not opposed to the trim work in terms of the magnitude and the size of the house. He thinks for the particular area, going with the red cedar shingles is correct and he has no issue with the windows, but he does not like the color of the clapboard entry even though you will not be able to see it. Chairperson White noted that you will be able to see it when the leaves are off of the trees. Robert Barandes stated that from his perspective the Board is looking at three different pieces. They have already consented to the lead coated copper roof. The second part is the windows, Option A. the Board has no issue with. Nick Martin stated that there are pieces of corner board white trim in cedar shingle houses, so we have the history there. He stated in looking at A001.01, he is counting seven roofs. He asked if they would consider toning down the white trim because essentially what the trim is doing is accentuating modern shakes, which are not in keeping with the vernacular although it is more in keeping with the original house. If you look at your examples of local homes, they are all single to double gabled structures and the issue that we have seen here is a number of applications have multiple gables, multiple structures intersecting, different heights, different shaped windows, different sizes, all kinds of different balustrades, fluting issues. He would prefer to have no corner boards and no trim. Ms. Mande responded they would consider removing the corner boards. 7
8 Nick Martin stated that what makes historic houses from the s unique is that they are simple. The heights and scale are accentuated with the punctuation of this trim. He sees ten different types of windows, different heights and different scopes. He wondered if there was a way to tone it down. Certainly removing the corner boards would be a good step. Emily Aspinall stated that anything to simplify is good and that would certainly simplify the visual. If you look at the neighboring houses on Sagg Main Street, the windows are uniform. There are not multiple gables and the white trim is not so in your face. She is not in favor of the white trim. Emily Aspinall suggested they remove the white trim. Ms. Mande noted that the color swatch speaks better to the brightness of the white than in the renderings. Emily Aspinall stated that there are a million shades of white and asked that they dull down the white. Nick Martin, looking at A001.1, asked if on the rear view was it a simple application of a rake board with a finial on top to which Kevin Warren of John Hummel & Associates responded that it is bead board soffit with an approximately 14 overhang with a fascia board. Nick Martin asked that they explain the depth and detailing to which Mr. Warren responded that the depth of the soffit is estimated at 14 and has a bead board soffit material encased by 1 x 8 fascia board, which also has a rams crown molding. Nick Martin noted that essentially when you are at ground level you actually see a lot of the trim color because the soffit is extended. He thinks it is critical that the Board sees whatever color that is with a few options as it is quite a bit of bright material. Ms. Mande responded that this is existing as was previously approved and the painting of the trim has been completed. Chairperson White stated that if they remove the corner boards that would be something the Board would appreciate and it would fit into the historic path. Nick Martin asked what the material of the gutters and leaders are to which Ms. Mande responded copper. Mr. Warren stated that there is an issue with the lead coated copper roofs because that would be the only introduction of lead coated copper to the house. Robert Barandes stated that they cannot change to a lead coated copper roof because the gutters and down spouts are copper. He asked if they can soften the corners without changing the color. The copper roofs, based on the fact that the leaders and gutters are copper, should be considered as submitted. The Board has no issues with and should consider the windows as submitted in Option A. None of the Board members seemed to have an objection with the change from clapboard to red cedar shakes. There is a question of introducing this additional color change is something we would like to see softened. Ms. Mande stated that they will remove the corner boards and she will submit three to four color options for the clapboard at the front entrance for approval and they would be happy for the Board to pick a color. Mr. Warren stated that he will install the clapboard siding and leave it natural western red cedar along with the shingles for the time being until the Board had reached a determination of the paint color. 8
9 Robert Barandes stated that the Board is approving copper for the roof of the front porch, the clapboard walls at the front door and the submission for the addition of two windows in the laundry room (Option A) as submitted. Chairperson White asked for a motion to approve the front porch roof in copper, for the corner boards to be removed, the additional two windows on the 2 nd Fl will be as per Option A, for the change of the clapboard siding to the natural western red cedar shingles and to adjourn the application to the Committee of Two to decide on the paint color of the clapboard.
