9 FOR MCC USE ONLY CARROUSEL ENTOURAGE APPLICATION DUE DATE IS MARCH 17, 2017 Members of the Multicultural Council Board of Directors, Volunteers, and Special guests visit every Carrousel Village as part of an Entourage. This provides an excellent opportunity for the Entourage participants to acquaint themselves with your Village and community. The Entourage visit serves a four-fold purpose: As Villages prefer to know when the Entourage will visit, the Carrousel Committee would appreciate your indication of a preferred date and time. As fellow members of the MCC, they visit your Village showing solidarity and support, offering encouragement and congratulations. 2. Villages are awarded certificates for making the Carrousel a grand success. 3. To ensure that the rules and regulations set forth by the MCC are being followed 4. MCC office will confirm entourage date and time for your village Members of the Entourage are official guests to your Village. Please offer them a non-alcoholic beverage to drink, as it is usually hot; other hospitality shown will be up to your committee to decide. Please introduce the Carrousel Chairperson to your Village who will, in turn, introduce the remainder of the Entourage. Village would like to host the Carrousel Entourage on First Preference June at pm Second Preference June at pm Thank you for your co-operation. Please return this form to the Multicultural Council of Windsor and Essex County, 245 Janette Ave., Windsor, Ontario, N9A 4Z2, , no later than March 17, IF THE FORM IS NOT RETURNED BY THE ABOVE DATE, THE CARROUSEL COMMITTEE WILL ASSIGN A TIME FOR THE ENTOURAGE TO VISIT YOUR VILLAGE. PLEASE NOTE: THE MCC WILL USE ITS DISCRETION IN DETERMINING WHEN AND ON WHAT DATES THE ENTOURAGE WILL VISIT YOUR VILLAGE. 7

10 FOR MCC USE ONLY VILLAGE PARTICIPATION CONTRACT BETWEEN: THE MULTICULTURAL COUNCIL OF WINDSOR & ESSEX COUNTY (Hereinafter referred to as the MCC ), an Ontario non-profit charitable corporation with a registered office at 245 Janette Avenue, Windsor, Ontario AND: Village (hereinafter referred to as the Participant ) WHEREAS: A. The MCC is the co-ordinator of the Carrousel of the Nations. B. The Participant is a member in good standing of the MCC. C. The Participant wishes to participate in Carrousel of the Nations and the MCC wishes to host the Participant. IN CONSIDERATION OF THE MUTUAL PROMISES CONTAINED IN THIS AGREEMENT, THE PARTIES AGREE AS FOLLOWS: PARTICIPATION REGULATION 1. The Participant shall place an emphasis on developing, informing and sharing its ethno-cultural make-up with the Windsor-Essex County community in a positive and NON-POLITICAL manner. The Participant shall participate in Carrousel, on the following dates of June June (Please indicate the dates that your Village is open) 2. The participant shall have an educational display reflecting the theme of the Carrousel that is announced each year. 3. The Participant shall close their Village no later than times established in City By-Law THIS IS A CITY BY-LAW AND MUST BE STRICTLY ADHERED TO FINANCIAL OBLIGATIONS 4. The Participant shall submit a total fee of $ in accordance with the Carrousel of the Nations Village Application and Fee Form on or before March 17, Note: Deposit will only be refunded to the village if all contractual agreements are adhered to and all payments are made in full on or before March 17, 2017 Note: After April 7, 2017 all fees paid toward Carrousel 2017 will not be refunded and other expenses incurred by the MCC will be invoiced to the Participants. 5. The Participant shall purchase a mutually agreed upon percentage of its total goods and / or services from the MCC designated sponsors where applicable. 6. In addition to the participation fee, the Participant shall contribute to any promotional financing in the manner, and to the degree, decided by the MCC. PARTICIPANT REQUIREMENTS APPLICATION DUE DATE IS MARCH 17, 2017 The Participant shall be responsible for publicizing its own participation and shall submit for approval all advertising, merchandising and publication materials in connection with Carrousel to the MCC on or before March 17, The Participant shall be responsible for completing and submitting all documentation required by the Board of Health, SOCAN and/or any other government body or agency and for obtaining the necessary approval and/or permits with respect to its Village and activities on or before March 17,

11 FOR MCC USE ONLY VILLAGE PARTICIPATION CONTRACT APPLICATION DUE DATE IS MARCH 17, The Participant shall maintain and provide in their final report to the MCC detailed and accurate records of the following information that is required for promotional purposes only.: a) Villages attendance; b) Type and quantity of beverages consumed; and c) Type and quantity of food consumed. This report must be submitted no later than 30 days after the end of the event. 9. The Participant shall not charge admission to its Village and/or related activities without prior consent of the MCC Board of Directors. 10. The Participant shall be responsible for the clean-up of its Village and the immediate area around it or be subjected to an additional fee levied by the Municipality. 11. According to City by-laws, Alcohol and Gaming Commission of Ontario, and Police requirements, any beverages sold by the Participant shall be sold by volunteers with smart serve training only in the following ways: a) Beer shall be sold in beer cups. b) Pop shall be sold in coloured containers c) Alcoholic beverages shall be sold in clear small containers. Note: The Participant shall not sell and/or distribute beer and/or other beverages in glass containers. 12. The Participant shall elect a chairperson and an alternate chairperson to represent their Village at MCC designated meetings. 13. The Participant shall attend ALL meetings relating to Carrousel for which its attendance is requested by the MCC, Police, Alcohol and Gaming Commission of Ontario, Windsor-Essex County Board of Health and/or any other government body or agency. 14. The Participant shall be responsible to obtain noise by law exemption, street closures and pay all required fees to the City. 15. Mobile Food Service Equipment owners/operators must comply with the Technical Standards and Safety Act 2000 (TSSA). For further compliance standards and requirements please visit The MCC believes in accessibility for all people under the Accessibility for Ontarians with Disabilities Act, 2005 (the AODA). Under this Act it is mandatory for complete compliance in meeting all requirements and providing Accessible Customer Service. To find out specific requirements under the standard and how to meet them, we invite you to visit SECURITY 17. The Participants shall provide event volunteers in and around its Village for thirty (30) minutes prior to opening, while it is open and thirty (30) minutes after it closes and shall at a minimum provide the following: a) event volunteers posted at each entry and exit to its Village; and b) if the Village is an outdoor Village, security/event personnel to patrol the outside perimeter. 18. The event volunteers shall be responsible for the following: a) ensuring that no alcoholic beverages are brought into or out of the Village; b) ensuring that the proper entrances and exits are used; and c) maintaining crowd control. 19. Participant shall ensure that the MCC s official event wear is worn by its personnel. Please note that a fine will be levied for non-compliance. See regulation 29. RESPONSIBILITY AND RISK- PARTICIPANT 20. The Participant shall arrange for a minimum of two million dollars ($2,000,000.00) comprehensive liability insurance coverage, listing The MCC and Carrousel of the Nations 2017 as an additional names insured and shall submit proof of the same to MCC on or before March 17, The Participant shall be solely responsible for all financial, legal and civic responsibilities, derived from its Village and activities notwithstanding any other provision contained in this contract. 22. The Participant shall indemnify and save harmless the MCC and the members, directors, employees and/or agents of the MCC against all losses, claims, expenses, damages, and other liabilities (including legal fees on a solicitor client basis) related to Carrousel and the Participant s Village and/or activities however they may arise. 9

12 FOR MCC USE ONLY VILLAGE PARTICIPATION CONTRACT APPLICATION DUE DATE IS MARCH 17, 2017 MCC REQUIREMENTS 23. The MCC shall act as the co-ordinator of the Carrousel of the Nations. In so doing, the MCC will appoint Volunteer Co-Chairpersons to oversee the planning and implementation of the annual Carrousel of the Nations. The MCC will schedule and facilitate workshops for the Village representatives with official representatives from: Alcohol and Gaming Commission, L.C.B.O., Board of Health, Windsor Police Services, Windsor Fire Department, Board of Health (Food Handler s Course Presentation) and others as opportunities arise. The MCC will be the liaison for Carrousel of the Nations with all levels of government and partner agencies. 24. Subject to by-laws and guidelines of the Windsor City Council, Windsor Police Service Commission and the AGCO, the MCC shall have absolute and final decision making authority on all matters arising in connection with or between the Participant(s) and Carrousel, except as specifically provided by this contract and the Participant shall abide by all such decisions. 25. The MCC is responsible for advertising and publicizing the Carrousel of the Nations event. In so doing, the MCC will seek applicable government grants - solicit sponsorship and promotional opportunities -organize and host a "Media Event" or a similar press conference/event launch - write and disseminate media releases to local and regional (including Michigan) outlets - MCC will connect media requests for interviews with Village representatives or performers - maintain the MCC website and overall Carrousel information pages - provide to the public individual Village information (as submitted) via website link, telephone inquiries, etc. - Villages will be responsible for providing content and maintaining their individual page on the website - promote Carrousel of the Nations through TWEPI and Ontario Tourism, i.e. community billboard services, local and international multicultural and ethnic publications, etc. MCC will not be held liable for any errors or omission in any promotional/advertising/print material FINAL OBLIGATIONS 26. If the Participant fails to purchase the agreed upon amount required percentage of goods and services from the MCC designated sponsors the Participant shall be liable to the MCC for a fine of $500 per day for each day the Village is open. 27. Programs printed or information passed out at Carrousel Village must be approved before printing or shall be liable to the MCC for fine of $500 per violation. 28. If the Participant fails to conduct itself in a NON-POLITICAL manner it shall be subject to the following penalties: a) $500 for every day the offending conduct continues. b) If the Participant wishes to participate in a future Carrousel, a retainer equal to the fine will be required. The full retainer will be refunded at the end of Carrousel of that year, providing no penalties by the MCC are imposed. c) If the Participant fails to conduct itself in a non-political manner for two (2) Carrousel's, the Participant will not be permitted to participate in future Carrousel's and the retainer will not be refunded. 10

13 FOR MCC USE ONLY VILLAGE PARTICIPATION CONTRACT APPLICATION DUE DATE IS MARCH 17, If the Participant fails to provide MCC wear as outlined by paragraphs 17, 18 and 19 and/or fails to ensure that its MCC event wear the official MCC wear, the Participant shall be liable for a $500 fine for each day that noncompliance continues. 30. If the Participant sells and/or distributes beverages in glass containers and continues to do so after a written citation, the Participant shall be liable for a $500 fine for each violation. 31. The Participant shall pay all fines to the MCC within fifteen (15) days of a written citation by the MCC. 32. In addition to any other action that the MCC may take, if the Participant breaches this contract, the MCC may in its absolute discretion bar the Participant from participation in future Carrousels or may impose conditions for participation. 33. After April 7, 2017, all fees paid toward Carrousel will not be refunded and other expenses incurred by the MCC will be invoiced to the participants. 34. Any deviation from this contract must be requested in writing to the Chairpersons, Carrousel of the Nations, 245 Janette Avenue, Windsor ON, N9A 4Z2. The chairpersons will respond to all requests in writing. 35.
