2 TOWN OF BEDFORD INVITATION FOR BID BID MOWING AND LANDSCAPE MAINTENANCE October 2018 The Town of Bedford, New Hampshire is soliciting bids from qualified companies for mowing Town fields, parks and cemeteries along with landscaping services for municipal facilities and common areas. Sealed Bids will be received at the Public Works Department, Bedford Safety Complex, 55 Constitution Drive, 2nd Floor, Bedford, NH 03110, until 10:00 a.m., November 6, 2018 at which time they will be publically opened and read aloud. The Bid Document will be available at the Public Works Department, at the above address as well as online at beginning on Friday, October 12, A pre-bid meeting will be held at BCTV -1 0 Meetmghouse Road, Bedford NH on Thursday, October 25, 2018 at 10 a.m. to discuss the scope of services and review the applicable field locations. All Bidders are encouraged to attend this meeting. The Town of Bedford reserves the right to accept or reject any or all bids and to waive minor informalities as it deems to be in the best interest of the Town. SUBMISSION REQUIREMENTS Sealed, written bids along with references will be received until 10:00 A.M. November 6, 2018 at the following address: Public Works Department BID Bedford Safety Complex 55 Constitution Drive, 2nd floor Bedford, NH Proposals shall be made on unaltered bid forms furnished by the Awarding Authority. Fill in all blank spaces in. typewriter or ink. Bid forms shall be signed with the name printed below signature. Where bidder is a corporation, bid form must be signed with the legal name of the corporation followed by the legal signature of an officer authorized to bind the corporation to a contract. Bid forms shall be sealed in an opaque envelope identified with the Bid Number, project name and the name of the bidder. Submit proposals as directed by the Invitation to Bid. 3 SPECIFICATIONS I. SCOPE OF WORK The Town requires landscape maintenance for municipal building facilities, common areas; mowing/line trimming of approximately 50 acres of field/complexes including playing fields and adjacent areas; and 5 cemeteries. The full duration of the season starts in April and continues through October of the same year although actual duration is subject to weather and date of contract signing. II. LOCATIONS The following properties/locations shall be considered as part of this item with unit price contained on the bid sheet: Part A. Properties - Municipal Buildings 1. 6 -III. LANDSCAPE MAINTENANCE 1. SCHEDULE a. Special attention shall be given to monuments in the public areas prior to holidays (Memorial Day, 4 of July, and Veteran's Day - Cemeteries) and special events. b. The Town will work with the contractor to determine an appropriate schedule for completing the above referenced items. The Town is flexible as to the days that the contractor can complete this work, however it is the intent that the contractor will keep the schedule consistent from week to week. The town fully understands that that weather, events and/or growing season may at times impact the normal schedule. 2. SPmNG CLEAN-UP As soon as weather permits for Part A, B, C, D and E Properties, the contractor shall perform a complete clean-up of the referenced properties in this section. Opening date for all cemetery properties shall be approximately April 1 or as modified and determined by the Cemetery Trustees. a. Remove all trash, dead thatch, leaves, branches, weeds and debris from all areas (walkways, lawn areas and mulch beds). b. All leaves shall be raked/vacuumed/power blow and removed from property, all fallen branches and sticks shall be cut up raked and removed from property. c. Sweep/power blow all walkways, bed and lawn areas of all winter sand (does not include sand removal from parking lots). d. Repair lawns from minor snow plow damage. e. Complete edging of all shrub/tree and mulch beds to establish contours. f. Provide/install new premium light brown colored pine bark mulch in sb'ub/tree, bed and common areas. g. Prune/trim shrubs as needed and remove dead growth from plantings and shrubbery. h. Trim and remove overgrowtli from boundary lines, along stone walls and fencing- both sides. (Must do pre-inspection with Public Works Designee) 3. SHRUB AND MULCH BED MAINTENANCE a. For Part A, B, and C Properties listed above. b. Prune or trim all shrubs (time to suit season). c. Weed control - all beds at least once a month (includes, herbicide applications, and hand weeding. Herbicide applications shall be made by NH Licensed Applicator). Page 5 of 13

7 4. GENERAL UPKEEP/MAINTENANCE On a weekly basis, following the Spring Clean-up, the contractor shall be responsible for completing the following items on Part A, B, and C Properties: a. Trash/debris, sticks small branches and significant leave cover from lawn are to be picked up before mowing. b. Lawn mowing. Grass clippings should not be blown into mulch beds. c. Walkways and edges of parking lots are to be blown off and kept clear of debris. d. All areas around fence lines and stone walls are to be line trimmed (in and outside of fencing/stone walls, maintain 3 ft. on backside) e. Mulch beds are to be kept weed free. f. Trees under 20 ft. tail are to be pruned twice per season or as needed to maintain shapes. g. Shrubbery are to be trimmed as needed to maintain shapes. h. Trim all areas not accessible with mowers. i. String Trim all walks shrubbery and mulch bed edges, as needed. 5. FALL CLEAN-UP At the end of the season, the contractor shall perform a final clean-up for Part A, B, C, D and E Properties. Shall include the following items: a. Leaves and fallen stick and branch debris are to be removed from lawn areas and mulch beds. b. Prune all trees and shrubs as needed. IV. MOWING/TRIMMING Mowing shall be done weekly on grass areas on Part A, B, C, D and E Properties as listed above. All Sports Fields and adjacent areas shall be mowed and line trimmed two (2) times per week Mondays and Fridays and may be adjusted seasonally by Public Works Designee, taking into account weather and actual field conditions. The following locations shall be required to be mowed/trimmed for the full 2019 season (April through October): Mowing shall be maintained as specified below beginning immediately upon contract signing. A. Mowing - Freguency and Height of Cut Mowing of fields and adjacent areas shall be performed two (2) times per week, except as otherwise noted. Typical schedule should be Mondays and Fridays, however the Town is willing to consider an alternate schedule provided that the frequency of cut is maintained and the schedule does not change from week to week. Effective mowing height for all turf/grass areas shall vary taking Into account time of year as well as playing surface/use. Public Works Designee may specify specific cutting height(s) as the work progresses. Page 6 of 13

8 The Benedictine Land location will require mowing one (1) time per week and may be scheduled for alternate days depending on planned events. The Joppa Hill Flats (adjacent to fields) will require mowing two (2) times per year. The Town of Bedford fully recognizes that weather will have a significant impact on the proposed mowing schedule. As such, the conb'actor must fully understand and by submission of your bid agrees to the intent of this schedule. When weather delays are encountered, and the proposed schedule is altered, the contractor agrees that the town will be promptly notified and an amicable rescheduling of mowing will be established. Mowing shall be performed one (1) time per week at the Bedford Center Cemetery and two (2) times per month (bi-monthly) at the other 4 locations, however the actual frequency may vary due to actual grass height and weather conditions. The Cemetery Trustees may specify cutting height(s) as the work progresses. For Cemetery Properties (Part E) Trimming alongside fenced areas and fixed structures; including stone walls, fences, and gravestones, within the boundary of the cemetery property shall be performed along with the scheduled mowing throughout the growing season. Trimming shall be performed so as not to intentionally "scalp" the grass down to the soil surface but rather to try to maintain a normal cutting height similar in appearance to the surrounding mowed areas. Boundaries and stone walls shall be maintained three feet on backside. Trimming will not be paid for separately. The Contractor shall also be aware that special circumstances may arise due to field use/events such that the mowing schedule may need modification. In submitting a bid, the contractor agrees to work with the Town such that accommodations are made. B. Line Trirmnins Trimming alongside fenced areas, inside and out, and fixed structures within the boundary of the field/property location area shall be performed at least once per week. Trimming shall be performed so as not to intentionally "scalp" the turf down to the soil surface but rather to try to maintain a normal cutting height similar in appearance to the surrounding mowed areas. Any clumps of trimmed turf or weeds shall be dispersed or removed if dispersal is unsuccessful in removing clumps. Throughout the various sports seasons, additional nets and objects may be present on the fields. The Contractor shall carefully move any net/object for mowing area to proper turf height. Objects that cannot be readily moved will require line trimming around in order to maintain the proper turf height. This would include grass under bleachers. C. Additional Requirements: Contractor must avoid cutting of grass/ directing clippings towards warning tracks and infield of ball fields. Page 7 of 13

9 Contractor shall avoid mowing wet grass at Cemeteries and shall avoid directing grass clippings on headstones as best as possible. Contractor must avoid scaring or striking gravestones and monuments with power tools such as mowers and trimmers. Any damage to a headstone shall be reported to Public Works Designee and repair costs will be responsibility of the contractor. The Town of Bedford fully recognizes that weather will have a significant impact on the proposed mowing schedule. As such, the contractor must fully understand and by submission of your bid agrees to the intent of this schedule. When weather delays are encountered, and the proposed schedule is altered, the contractor agrees that the town will be promptly notified and an amicable rescheduling of mowing will be established via Public Works Designee. V. CEMETERY MAINTENANCE 1. GENERAL All cemetery properties included in Part E. properties shall be included in this section. 2. MAINTENANCE Once cemetery properties are opened, the contractor will maintain cemeteries in a neat manner such that grass clippings and debris shall not be allowed to collect on the gravestones and common areas including walkways. It is intended that the contractor will perform weekly walkthrough of the properties so as to insure the neat appearance. Removal, dismantling or changing in any way of the gravestones for any reason whatsoever if prohibited. The contractor shall meet periodically with the Cemetery Trustees to ensure compliance with bylaws. The contractor shall remove any items prohibited in the cemetery bylaws (a copy of which is attached), however coordination with the Cemetery Tmstees shall be done prior to any removal of items. The Contractor is expected to make minor repairs to fences, gates and walks as necessary to keep each property functioning as intended. At the sole discretion of the Cemetery Trustees, repairs that it deems are beyond minor in nature, may necessitate a separate quote for such repairs. Under no circumstances will the Town pay for such additional work unless it has provided the Contractor authorization in writing to proceed with the work outlined in a separate quote. Unless maintenance is beyond minor items, there shall not be any additional payment as maintenance is incidental to this contract. Page 8 of 13

10 VI. GENERAL REQUIREMENTS 1. FAMILIARITY WITH THE WORK Each bidder is considered to have examined the work to fully acquaint himself with the exact existing conditions relating to the work and has fully informed himself as to the work involved and the difficulties and restrictions attending the performance of this bid per specifications including attached pre-inspection list. Failure to do so will not relieve a bidder of his obligation to furnish all aspects of the work as specified herein for the consideration set forth in this bid. The submission of a bid will be considered as conclusive evidence that the bidder has made such examination. 2. CARE AND PROTECTION OF PROPERTY The Contractor shall take particular care to avoid damages to all private and public property. He shall make good any damages to the satisfaction of the Town. There shall be no additional compensation for the repair or restoration of private or public property improvements. 3. COMPLIANCE WITH FEDERAL, STATE AND LOCAL CODES The Contractor shall be responsible for full compliance with any Federal, State and/or Local codes, laws, regulations and standards, as applicable. 4. INSURANCE The Contractor shall be responsible for maintaining insurance coverage in force for the life of the contract. The Contractor at his own cost and expense shall procure and maintain all insurance required. Minimum insurance requirements are Workers Compensation, Commercial General Liability and Business Automobile Insurance. The insurer shall provide the Town of Bedford with Certificates of Insurance that lists the Town of Bedford as an additional insured, signed by an authorized representative of the insurance company and providing that the insurer shall give the Town of Bedford written notice at least thirty (30) days in advance of any termination, expiration, or any and all change in coverage. 5. WORK IN INCLEMENT WEATHER During storm or inclement weather no work shall be performed except such as can be performed satisfactorily and in such a manner as to insure no damage to fields or Town property. 6. WORKING HOURS The Contractor shall comply with all local ordinances including noise ordinances pertaming to work. In general, the Contractor shall not operate machinery before 7 am or after 7 pm. Exceptions may be made when work is away from residential areas. Page 9 of 13

11 7. MOWING EQUIPMENT AND OPERATION The contractor shall utilize only commercial grade mowing equipment for turf/grass mowing. Reel and rotary blades are to be maintained at their sharpest potential to eliminate tear damage to the turf/grass leaf tip and to maximize mowing efficiency. Mowing equipment utilized shall be designed to provide the least amount ofcompaction possible to turf/grass playing field areas. Mowers shall be operated at a reasonable speed so as not to compromise ground speed to clipping rate ratios. Mowers shall always make wide turns so as not to "scuff or leave visible tire tread tear markings on turf/grass playing surface. Operators of mowing equipment shall remove any and all debris from turf prior to mowing. Operators of mowing equipment are expected to mow safely to avoid damage to property and injury to person. In the event mowers cause clippings to become clumped the operator of the mower will remove clumps to break them down enough to filter unnoticeable into the "turf canopy". Mowing direction shall be alternated as necessary to prevent turf/grass layover (windrows). Contractor will be held responsible for all repairs to turf areas, sprinkler heads, fences, gates and other fixed items damaged by contractor's equipment. Damage shall be reported immediately by the Contractor to Public Works Designee with resolution to follow. 8. PAYMENT Payment will be made on a monthly basis and will be based on actual percentage of work completed taking into account total unit price listed on the Bid Form. 9. REFERENCES Bidders are required to submit a list of references along with a list of equipment that is planned to be used for this contract. References shall be included with the submitted bid. The Town is seeking bids from finns that have experience in mowing/mamtaining municipal and/ or school properties similar in size and scope to the work outlined in this bid. The Town reserves the right to reject any bid that does not have sufficient experience/equipment as the Town deems appropriate. 10. RENEWAL OF CONTRACT At the Town's sole discretion, the contract may be annually renewed for up to three (3) additional years, provided that there is no substantial change to scope of service and/or in mowing price as mutually agreed upon between the Town and the Contractor. 15 BYLAWS OF THE CEMETERY TRUSTEES TOWN OF BEDFORD, NEW HAMPSHIRE Articles 1-7 are directions to the trustees. ARTICLE 1. AUTHORITY AND ADOPTION: In accordance with the provisions of New Hampshire Revised Statutes Annotated, Chapter 289, as amended, and the authority granted by the voters of the Town of Bedford through the Town Charter adopted October 5, 1987, the Bedford Cemetery Trustees have been established. ARTICLE 2. PURPOSE AND INTENT: Pursuant to R.S.A. 289, the Bedford Cemetery Trustees are established to operate and maintain all cemeteries owned by the Town of Bedford. ARTICLE 3. POWERS AND DUTIES: Except as amended by the Town Charter or the Cemetery Trustees as indicated in Article 14, the Trustees are empowered to perform those duties established by the Town Council including but not limited to the following: A. Advise the Town Council on matters relating to the Town owned cemeteries. B. Adopt bylaws and regulations for the transaction of business, and the establishment and maintenance of all Town owned cemeteries. C. Prepare an annual budget for the inclusion with the Town Manager's proposed budget to the Town Council indicating what support and maintenance the public cemeteries will require out of municipal funds. D. Annually review the need for capital improvements and expansion of cemetery land, and if necessary, prepare a Capital Improvement Plan to be proposed for incorporation in the Town's Annual Capital Improvement Plan and ten year MasterPIan. E. Expend monies raised and appropriated by the Town for cemetery purposes. Such funds shall be maintained in the general fund and paid in the same manner that funds of other municipal departments are paid. F. Expend income from all trust funds for cemetery purposes in accordance with the conditions of each donation or bequest accepted by the Town. G. As necessary, appoint a cemetery custodian or superintendent who shall not be a trustee and who shall be responsible to the Trustees for supervising the work done in the cemeteries. H. Sell cemetery lots to present or former residents of the Town of Bedford for a price established by the Trustees and approved the Town Council. Exceptions to this may be made by the Trustees, for those who have family members interred in the Bedford Cemetery, and also for good cause, on a case by case basis. I. Annually select officers, including a chairman and secretary, the latter not necessarily need be a trustee.

16 J. Keep accurate records regarding the use of all funds associated with operations and trusts of the cemetery, all lots sold, and the location of all interments at cemeteries owned by the Town. K. Enforce the rules of the cemetery operations. L. Annually, In December, file a report of the prior twelve months activity with the Town Manager for inclusion in the Town Annual Report. ARTICLE 4. APPOTNTMENT: The Town Council shall appoint three Cemetery Trustees in accordance with Section (c) of the Town Charter. ARTICLE 5. ORGANIZATION: The Cemetery Trustees, at an annual organizational meeting, shall elect a chair and a secretary. ARTICLE 6. SALE OF LOTS: The Trustees shall be responsible for the sale of cemetery lots. A. Lots shall consist of one, two, or four burialplots. B. Half lots may be sold consisting of two plots for individual interment. The Trustees shall, where possible, make single plots for single interment available for sale. C. Full lots contain four burial plots and/or sixteen cremation plots. D. The price of lots shall be reviewed annually by the Trustees with proposed changes submitted as part of the annual budget submission. ARTICLE 7. RIGHTS OF TNTERMENT: All lots shall be transferred by right ofinterment to the purchaser, who may not transfer or resell the lot to another individual. Unused lots may be sold back to the cemetery at the original purchase price, with the return of the original document. All rights ofinterment shall include a statement ofnon-transfer of title. All rights ofinterment shall include, in a prominent location, a statement indicating the value of the document and warning that it should be kept in a safe place. A. All interments and disinterments are subject to the rules and regulations of the cemetery as well as subject to the laws of the properly constituted authorities of the town, county or state. B. No grave shall be opened for interment or disinterment by any person not in the employ of the custodian or under the direction ofthetmstees. C. Disinterments shall be made Monday through Saturday only, and at the convenience of cemetery personnel. The utmost care will be exercised in making a disinterment or removal, but the trustees shall not bear liability for damage to any casket, burial container, urn, or cremated remains incurred in making the removal. If the remains being removed are not enclosed in a suitable container, the family must purchase an appropriate container for the transport and re-interment. D. No interments shall be made until the custodian is furnished with a permit, as required by the State of New Hampshire.

When instructions regarding the location of an interment space in a lot cannot be obtained, or is indefinite for any reason, the custodian may at his discretion, open it in such location in the lot as he seems best and proper, so as not to delay the funeral, and the trustees shall not be liable for damages caused by any error so made. RULES AND REGULATIONS Cemetery rules and regulations play a most important part in the beautiflcation and preservation of the grounds. It should be borne in mind that in return for the concession of individual tastes and preferences, the following rules and regulations have been adopted for the benefit and propriety of both visitors/owners and the Bedford Cemeteries. All owners and visitors within the cemetery and all lots and graves sold, shall be subject to said rules and regulations, and subject further, to such other rules and regulations, amendments or alterations, as shall be adopted by the Town of Bedford. All rules previously adopted which are contrary to these rules and regulations are hereby repealed and are no longer effective. ARTICLE 8. BURIALS: Burials are a private matter and are the responsibility of lot owner(s), their executor, or the funeral home. A. Burials are to be arranged directly between lot owners and the funeral director or cemetery custodian. B. All burials, including cremations, must be conducted under the supervision of a licensed undertaker or cemetery custodian. C. Unless otherwise permitted by weather conditions, burials will not be conducted after December 1st and before May 1st. Arrangements for body remains during this period are the responsibility of the lot owners through a licensed undertaker, which may include use of the Town's limited entombment vault if space is available. Remains must be removed from the vault by June 1st. D. Lots are 1 or 2 or 4 plots. After a full burial in an Individual plot, 4 cremation urns may be buried above a burial vault. In a lot without a full burial, a total of 4 cremations may be placed. Cremains may not be disturbed to accomplish a full burial. E. Green burials are not permitted. All full burials must have a concrete vault. Bodies may be buried without a coffin, but a burial vault must be placed upside down over the body. Cremains must be placed in an urn vault or similarcontainer. F. Double deep or full burial vaults may not be placed on top of one another. G. No animals shall be buried in the cemetery. ARTICLE 9. HEADSTONE AND CORNER MARKERS: Individual monuments, flat markers and comer markers may be placed on lots by owners only after the design is approved by the cemetery trustees during consultation with the monument company responsible for the fabrication of the items.

18 A. If comer markers are desired, the markers shall be placed at the four corners of the lot level with the ground. B. Only one upright granite monument is allowed per two person lot. It must be centered at the head of the lot, typically in-line with other monuments in that section of the cemetery. Maximum monument size shall be governed by the lot size: Plot Size MaximurnWidth ofbase Maximum Height of Monument 2 Place Grave 48" 36" 4 Place Grave 60" 48" Note: Height includes base. Base not to exceed 8" above average ground level. Base to extend a maximum of 4" beyond monument on ends, 2" on sides. One stone bench, not to exceed 20 high x 48" long x 24 wide for a 2 Place Grave or 20" high x 60 long x 24" wide for a 4 Place Grave will be permitted in lieu of a headstone monument. The bench must be constructed of granite securely fastened to the ground. It must meet the same placement and foundation requirements of a monument. C. Individual graves within the lot may be identified by additional flat markers. Flat markers can be no larger than 12" x 24", should be level with the ground, and located over the burial. D. On the single lots numbered 312 to 369 in the hilltop section, only flat markers are allowed. Flat markers can be no larger than 12" x 24", should be level with the ground, and located over the burial. No upright monuments are allowed on the singlelots. E. All headstone monuments shall have a four foot deep concrete foundation. Foundations are not required for flush markers or corner markers; however, all flush markers and/or comer markers shall be set and kept level with the ground so as not to be damaged by mowing machines. Flat markers provided by the Veteran's Administration may be installed free of charge by the cemetery custodian, provided that the Veteran's Administration issued flat flush marker is delivered to the cemetery. F. Any monuments previously approved by the cemetery trustees will be excluded from these requirements. ARTICLE 10. VANDALISM: The cost of repairs resulting from vandalism is the responsibility of the lot owner. CEMETERY APPEARANCE AND MAINTENANCE A cemetery should be dignified and respectful. Maintenance of the cemetery is important, and keeping the cost to a reasonable level is the responsibility of cemetery management. To that end, the following regulations try to reach a balance between efficiency and the wishes of cemetery users. ARTICLE 11. LOT PLANTINGS: In-ground planting of plants, shrubs and trees is prohibited on cemetery lots. Live vegetation is permitted if placed in an urn or pot, and more than two requires permission from the trustees. Additional pots may be used if placed on "Shepherd Hooks" placed close to the monument. Artificial flowers are not allowed in spring, summer or early fall. Artificial

19 flowers and wreaths will only be permitted when there is no mowing of the grass in the late fall and winter. ARTICLE 12. DECORATIVE ITEMS: When leaving lot decorations please keep in mind the safety of our visitors and the maintenance crew. Items should be placed on or as close the headstone pedestal as possible to avoid contact with grounds equipment. Items that would be considered "offensive" (to be defined and determined case by case by the trustees) will be removed. Shepherd Hooks, when used, must be placed close to the monument base. Items are placed at your own risk, the trustees are not responsible for items that are blown away or damaged. The trustees, or their agent, may remove any item that is an obstruction to the maintenance crew, also dead damaged, and/or neglected flowers, plants, trees and/or shrubs. Flags -Flags are permitted; those found to be objectionable will be removed. They must be placed in an um or very close to the monument base so as not to be an impediment to maintenance. These flags are to be of the "parade" variety, no larger than 12" x 17". They must be mounted such that the flag does not touch the ground. Flags found unfit for display will be removed. Flags found to be under snow will be considered in a state of disrespect and will be removed. ARTICLE 13. HOURS OF OPERATION: The cemetery trustees shall make efforts to be available as needed to individuals seeking assistance with lot sales, but admission to the cemetery is prohibited from sundown to sunup. Alternate arrangements must be made with the trustees. The cemetery is closed to vehicles from approximately December 1st until April 1st, depending on weather. Walking in the cemetery, while closed, is at the person's own risk. ARTICLE 14. REVISIONS TO BYLAWS: These bylaws may be amended by the Cemetery Trustees by majority vote of the total membership and approval of the Town Council. Appeals to decisions of the Cemetery Trustees may be made to the Town Council. Suggestions When placing items on monuments, consider the "neighbors" and-whether your items might seem to be "out of place. " Flags should not be left in place continuously. Flag placement is encouraged for major patriotic holidays such as Memorial Day and Veterans Day. Flags will better survive mowing and maintenance operations if placed in a metal flag holder, this keeps them well off the ground. Comments - There are times of the year when a general cleanup of the grounds will be done. When such is planned, notice will be put in local papers and on the townwebsite allowing time for people to remove items. (Typically 7 days.) Flags removed- There is a box behind the garage in which serviceable flags will be placed The U. S. Flag Code should be followed. Flags will be left unilluminated during hours of darkness; however this is a deviation of the Flag Code made necessary by logistics. People should understand that the protracted display of a U. S. flag could result in its own desecration.
