1 Ministerial Decree No. 14/2005 (VI. 28.) KvVM on the rules concerning the screening surveys of remedial site investigations Authorised by the provisions set forth in clause m), Paragraph (8), Article 110 of the Act LIII of 1995 on the general rules of environmental protection (hereinafter: Kvt) I have issued the following Ministerial Decree: Scope of Decree Article 1 (1) This decree shall apply a) to groundwater and geological medium, further to pollutants, characteristics and s to be found therein specified in Annex 1 and 2 of this Decree; b) to activities associated with the screening surveys of remedial site investigations, specified in clause b) of Paragraph 22 of Article 1 of the Governmental Decree No. 219/2004 (VII. 21.) on the protection of groundwater (hereinafter referred to as Kr ). (2) This Decree shall not cover the substances (matters) and activities falling under the scope of Act CXVI on nuclear power. Interpretive provisions Article 2 For the purposes of the present Decree, the following definitions shall apply: a) screening survey: determination of pollutants in the contaminated area in the course of the remedial site investigation by sampling and chemical-analytical investigation s; b) historical research: collection of information relating to the forming of the presumed contamination, the activity carried out in the area and supposed to have caused the contamination, the technologies applied, the land use, and the (polluting?) event taken place in the area under examination. General provisions Article 3 (1) In the course of the screening survey chemical-analytical investigation s appropriate for the safe detection of at least the pollution limit value (B) specified in specific other legislation (hereinafter referred to as pollution limit value (B) ), taking into account the measurement error characteristic for the given, shall be applied. (2) Preparation of the samples of groundwater and the geological medium shall be carried out according to the specifications set out in Paragraph (1). Article 4 (1) The extent of the pollutants detected by the screening survey in a concentration exceeding the pollution limit value (B) shall be delimited in the course of the site investigation. (2) Pollutants, whose occurrence may be presumed based on historical research, but are not subject and not identified among those being subject to the screening survey, shall be investigated in a separate process.
2 (3) Pollutants and characteristics to be investigated in the course of the screening survey are specified a) in Annex 1 for groundwater and b) in Annex 2 for the geological medium. Sampling provisions Article 5 (1) For the purpose of the screening survey sampling of groundwater and the geological medium shall be carried out on spots presumably contaminated based on historical research and other information, and/or the results of laboratory analyses. (2) In the case of several, separable contaminations in the investigated area - caused by earlier environmental uses sampling and chemical-analytical investigations shall be carried out in each contaminated area separately. (3) At each sampling point one sample of groundwater and one of the geological medium shall be investigated. If groundwater is the target of the investigation two samples shall be taken at each sampling point at the same time in order to ensure verifiability. (4) No screening survey of groundwater shall be required in cases where facts provide a well-grounded verification of the non-existence of pollution and sampling would entail disproportionate costs. The existence of the mentioned conditions shall be investigated in the planning phase of the sampling and the chemical-analytical investigations; the investigation shall be documented by the attachment of the relevant documents in the final report of site investigation. Documentation of the results of the screening survey Article 6 (1) After the evaluation and systematisation of the results of the screening survey the under mentioned documents shall be attached thereto taking into consideration the specifications of Paragraph (2) of Article 47 of Kr: a) records drawn up on the samplings and the results of the laboratory analyses, b) the list of pollutants identified, and c) the attested copy of the spectra of organic pollutants. (2) The executor of the screening survey specified in Paragraph (3) of Article 47 of Kr shall document the disturbances that originate from the investigation and prevent the investigation/analysis of certain pollutants to be carried out acc. to this Decree (the detection of the concentration of the pollution limit value (B)). (3) Documents mentioned under Paragraph (1) and (2) shall be attached to the final report of site investigation. Article 7 The competent environmental, nature conservation and water inspectorate may give release from the further investigation of pollutants, which due to the disturbances mentioned in Paragraph (2) of Article 6 are undetectable, if there is demonstrated evidence that the concentration of the pollutants to be found in the investigated area do/must not exceed the pollution limit value (B); otherwise targeted chemical-analytical tests shall be carried out. Closing provision Article 8 This Decree shall enter into force on the 8th day following its promulgation.
