ISSUES: This is a request to modify the required clear sidewalk width on Washington Boulevard and a use permit request to permit an outdoor café for the proposed RA Sushi restaurant. 2 application but has raised concerns about the operation of the proposed outdoor café; those concerns are addressed by the conditions of approval. SUMMARY: The applicant has submitted an application for a site plan amendment to modify the required clear width for the sidewalk along Washington Boulevard from 12 feet to 6 feet, and a use permit request for an outdoor café in the public right-of-way. The use is in Clarendon- Courthouse and adjacent to the Lyon Park Citizens Association. The Clarendon-Courthouse Civic Association (CCCA) has not taken a formal position on the application, but members generally believe that an outdoor café is an appropriate use in the location. The CCCA did raise some concerns about the potential for the outdoor café to occupy more than the permitted amount of the sidewalk; those concerns are addressed through the conditions proposed. The Lyon Park Citizens Association deferred to the CCCA comments. The neighboring condominium building, Clarendon 1021 supports the application. Staff supports the applicant s proposal because the proposed reduction in the sidewalk clear with is consistent with the Clarendon Sector Plan and an outdoor café in this location would serve to activate the streetscape along this corridor, and the proposal, as conditioned, would not result in an adverse impact to the surrounding community. Therefore, staff recommends that: A.) the County Board adopt the attached ordinance to approve the site plan amendment to modify Condition #21 to reduce the clear sidewalk from 12 feet to 6 feet; and B.) that the County Board approve the use permit for an outdoor café subject to the conditions of the staff report and with a County Board review of the use permit in one (1) year (April 2016). BACKGROUND: On January 24, 2012, the County Board approved SP #418 to permit the construction of two office buildings consisting of 284,012 square feet of office space and 22,479 square feet of ground-floor retail space. In addition, the County Board approved the transfer of development rights (TDR) to this site in the amount of 144,211 square feet in exchange for the preservation of historically significant buildings within Clarendon. Construction was completed in early The following provides additional information about the site and location: Site: The 1.13-acre (49,295 square feet) subject site is located on the block bounded by 11 th Street North on the north, North Garfield Street on the east, Washington Boulevard on the south, and North Highland Street on the west. The site is surrounded by the following land uses: To the north: To the east: 11 th Street North and the Clarendon Center development (SP #397). The property is designated High Office-Apartment-Hotel on the General Land Use Plan (GLUP) and within the Clarendon Revitalization District (GLUP Note 12). The site is zoned C-O Commercial Office Building, Hotel and Multiple-Family Dwelling Districts. North Garfield Street and the Clarendon 1021 condominium building (by-right development). The property is designated Medium Density Mixed-Use on the GLUP and within the Clarendon Revitalization District (GLUP Note 12). The site is zoned C-R Commercial Development Districts. 3 To the south: To the west: Washington Boulevard and the Reserve at Clarendon Centre apartment building (SP #343). The property is designated Medium Density Mixed-Use on the GLUP and is within the Clarendon Revitalization District (GLUP Note 12). The site is zoned C-R Commercial Development Districts. North Highland Street and the Olmstead office building (SP #194). The property is designated High Office-Apartment-Hotel on the GLUP and is within the Clarendon Revitalization District (GLUP Note 12). The site is zoned C-O Commercial Office Building, Hotel and Multiple-Family Dwelling Districts. Zoning: C-3 General Commercial Districts. General Land Use Plan Designation: Medium Density Mixed Use (3.0 FAR); Clarendon Revitalization District (GLUP Note 12). Neighborhood: The site is located within the Clarendon-Courthouse Civic Association (CCCA), and across the street from the Lyon Park Citizens Association. The Clarendon 1021 condominium building is across N. Garfield Street to the east. Staff contacted both civic associations and the condominium association in February The CCCA reported that, although their members did not take a formal vote, the membership thought that an outdoor café is generally appropriate in the proposed location. The CCCA made the following recommendations for the approval of the outdoor café: 1) At all times, the minimum clear width of 6' will be maintained, NOT further diminished by pinch points from street furniture, trees, sidewalk signs, etc., and NOT including any protruding feet/anchors of the cafe railings or other street furniture. 2) The sidewalk clear width will increase to at least 8.5' near the intersection, as indicated on the applicant's drawings. 3) When the cafe is not actually in use (e.g. when the restaurant is closed), the movable railings will be moved back to a location that provides at least 8' clear width along the entire frontage, again NOT including pinch points or other protrusions. 4) Appropriate anchors for the movable railings should be provided to ensure that they remain in proper position, both during cafe use, and when they are moved out of the center of the sidewalk after hours. These anchors should be constructed (and may be drilled into the sidewalk) so that they can be plugged to leave a level, safe walking surface when the railings are not in place. The applicant has agreed to a condition that requires that the minimum clear width of 6 feet be maintained along Washington Boulevard, which will increase to approximately 8.5 feet as the outdoor café approaches the intersection of Washington Boulevard and N. Garfield Street. The applicant has also agreed to move the café railings and tables against the building when the café is not in operation. Staff notes that the recommendation that the café railings SP#418 & SP418-U RA Sushi PLA-6958
4 be anchored in the sidewalk is not permitted by the Arlington County Zoning Ordinance; therefore staff does not support the final CCCA recommendation. The Lyon Park Citizens Association submitted a statement that they support and defer to the CCCA recommendations. Clarendon 1021 condominium association stated any anticipated noise impacts should be minimal as very few of their residences face the intersection of Washington Boulevard and N. Garfield Street, and that as long as any concerns are addressed promptly they have no objection to the proposed outdoor café. The applicant has agreed to the standard condition that requires a neighborhood liaison to address community concerns, and the applicant will be required to notify the Clarendon 1021 condominium association, CCCA, and Lyon Park as well as the Zoning Administrator of the name and phone number of the neighborhood liaison. Site: 3001 Washington Boulevard N O R T H Source: Google Maps DISCUSSION: The applicant has submitted a site plan amendment request to modify the required clear sidewalk width on Washington Boulevard and a use permit to allow an outdoor café for the anticipated RA Sushi restaurant. The restaurant will occupy approximately 6,348 square feet of retail space on the first floor of the recently completed office building at 3001 Washington Boulevard. The proposed outdoor café will have 28 seats, 12 seats along a window that will open into the restaurant and the remaining 16 seats at tables. The outdoor café will maintain a minimum sidewalk clear with of 6 feet, which is consistent with the Clarendon Sector Plan guidance for the north side of Washington Boulevard east of North Hudson Street. 6 Proposed outdoor café area At the time the site plan was approved, the County was in the process of updating the regulations for outdoor cafes, and the application was approved with a requirement that there be a 12-foot wide clear zone on the sidewalk on the north side of Washington Boulevard. As this is an 18- foot wide sidewalk with a six (6) foot furniture zone, a site plan amendment is required to reduce the minimum clear sidewalk to six (6) feet to allow for an outdoor café. Outdoor café seating located in a public use easement is permitted with a use permit under Article of the Zoning Ordinance, unless there is either a site plan condition that specifically allows outdoor café seating in public easement areas or the seating area is located on private property, in which case no use permit is required. Site Plan #418, as amended, is not subject to such a condition, therefore a use permit is required. The proposed outdoor café meets the standards of Section of the Zoning Ordinance. The applicant is proposing to have seating adjacent to a window that will open up into the adjacent bar. Staff has determined that this feature meets the definition of an outdoor café as there will be no projections from the building into the café. Because the applicant plans to have windows that can open, the health department requires that air curtains be installed over the windows to keep out dust and bugs. The proposed air curtains will be installed approximately 9.5 feet above the sidewalk and will project into the public easement; therefore, an encroachment is required and is addressed in a separate staff report ( Item C. ). The outdoor café will maintain a six (6) foot clear zone on the sidewalk to facilitate pedestrian movement, and no permanent fixtures will be installed. The applicant s proposal meets County practice and policies for outdoor cafes located on public sidewalks and will not result in adverse impacts to pedestrians using the subject sidewalks, or to surrounding communities. The proposed conditions of approval address the concerns raised by the Clarendon-Courthouse Civic SP#418 & SP418-U RA Sushi PLA-6958
7 Association. The subject building includes office space above ground floor retail, and the outdoor seating would not impact occupants during hours of operation. The proposed outdoor café is located in a mixed-use, high density area and will activate the streetscape in the location proposed. CONCLUSION: The applicant s proposal is consistent with County practice and policies concerning outdoor cafés located on public sidewalks. Staff supports the applicant s proposal because it will serve to activate the streetscape at the location proposed, and will not result in an adverse impact to the surrounding community. Therefore, staff recommends that: A.) the County Board adopt the attached ordinance to approve the site plan amendment to modify Condition #21 to reduce the clear sidewalk from 12 feet to 6 feet; and B.) that the County Board approve the use permit for an outdoor café subject to the conditions of the staff report and with a County Board review of the use permit in one (1) year (April 2016). SP-418-U-15-1: Proposed Conditions: 1. The applicant agrees that outdoor seating area is permitted on Washington Boulevard only as shown on the RA Sushi Outdoor Café Seating Exhibit for Minor Site Plan Amendment and Use Permit plan (dated January 12, 2015), ( Outdoor Café Seating Exhibit ), and that the applicant shall not use the outdoor seating area until a certificate of occupancy has been obtained for that use. The applicant agrees to maintain a minimum of six (6) feet of clearance width along all sidewalks for pedestrians. 2. The applicant agrees to comply with all requirements set forth in all applicable ordinances and regulations, including, by way of illustration and not limitation, those administered by the Zoning Office (including the applicable requirements listed in Section for Outdoor Cafes ), the Inspection Services Division, the Community Code Enforcement Office, the Police Department, and the Fire Marshal's Office. 3. The applicant agrees that no live entertainment or dancing are permitted in the outdoor café area at any time. The applicant agrees to comply with follow the requirements listed in the Arlington County Zoning Ordinance (ACZO) Section for Outdoor Cafes as they relate to sound or audio or video entertainment. 4. The applicant agrees that any use of umbrellas in the outdoor seating area shall not encroach beyond the area encompassed in the Outdoor Café Seating Exhibit nor interfere with pedestrian movement along the sidewalk. 5. The applicant agrees to move outdoor café furniture towards the building when the outdoor café is not in use in order to provide a minimum of 8 feet of clear sidewalk. 6. The applicant agrees to designate a neighborhood liaison to communicate with the nearby residents and neighbors to address concerns which may be related to the outdoor café and an on-site liaison (this may be the same person) that shall be available during the hours of the business operation to receive and respond to developer/landlord and community concerns. The name, telephone number and electronic mail address (if available) of the SP#418 & SP418-U RA Sushi PLA-6958
8 on-site liaison shall be submitted to the Zoning Administrator and a copy sent to the Clarendon Courthouse Civic Association, Lyon Park Citizens Association, and the Clarendon 1021 condominium prior to the issuance of a certificate of occupancy for the outdoor café. 7. The applicant agrees to comply with the conditions imposed by the ORDINANCE TO PERMIT THE ENCROACHMENT OF AIR CURTAIN EQUIPMENT INTO TWO PORTIONS OF AN EASEMENT FOR PUBLIC SIDEWALK AND UTILITIES PURPOSES ALONG THE WASHINGTON BOULEVARD BOUNDARY OF PARCEL A, MOORE S ADDITION TO CLARENDON, 3001 WASHINGTON BLVD., ARLINGTON, VIRGINIA (RPC#s and ), WITH CONDITIONS, approved by the County Board of Arlington County on April 18, 2015 prior to the issuance of a certificate of occupancy for the outdoor seating area. 8. The applicant agrees that the County Board shall review the use permit upon any change in tenancy of the subject space. Such review shall occur prior to the issuance of a certificate of occupancy for a new business. SP#418 & SP418-U RA Sushi PLA-6958
9 SITE PLAN AMENDMENT ORDINANCE WHEREAS, an application for a Site Plan Amendment dated January 12, 2015 for Site Plan #418, was filed with the Office of the Zoning Administrator: and WHEREAS, as indicated in Staff Report[s] prepared for the April 18, 2015 County Board meeting and through comments made at the public hearing before the County Board, the County Manager recommends that the County Board approve the Site Plan Amendment subject to all previous conditions with condition 21 amended as set forth in the Staff Report[s]; and WHEREAS, the County Board held a duly-advertised public hearing on that Site Plan Amendment on April 18, 2015 and finds, based on thorough consideration of the public testimony and all materials presented to it and/or on file in the Office of the Zoning Administrator, that the improvements and/or development proposed by the Site Plan as amended: Substantially complies with the character of master plans, officially approved neighborhood or area development plans, and with the uses permitted and use regulations of the district as set forth in the Zoning Ordinance; and Functionally relates to other structures permitted in the district and will not be injurious or detrimental to the property or improvements in the neighborhood; and Is so designed and located that the public health, safety and welfare will be promoted and protected. NOW THEREFORE, BE IT ORDAINED that, as originally requested by an application dated January 12, 2015 for Site Plan #418 to reduce the required sidewalk clear width along Washington Boulevard, for the parcels of real property known as RPC#, , , and 3001 Washington Boulevard, approval is granted and the parcels so described shall be used according to the Site Plan Application as originally approved on January 24, 2012 as shown in the records of the Office of Zoning Administration, and as amended by the Revised Site Plan Application, subject to all previous conditions, with condition 21 amended as set forth below: Condition 21 (subparagraph that addresses Washington Boulevard): Washington Boulevard a minimum 18-foot wide sidewalk measured from the back of curb maintaining a 12-foot wide clear sidewalk, including 5 feet by 12 feet tree pits, planted with 4 ½ inch caliper Willow Oak street trees, placed 28 to 32 feet on center and the tree pits located a minimum of eight (8) inches back from the back of curb, except in front of the plaza along Washington Boulevard, where two (2) Lacebark Elm trees will be planted as shown on the Plaza Paving and Planting Plan. In cases with an approved outdoor café use permit associated with a restaurant use, clear sidewalk width may be further reduced to a minimum of 6 feet in accordance with the approved SP-418-U SP#418 & SP418-U RA Sushi PLA-6958

Fisher Subject: Re: [ccca-president] New application for outdoor seating, 3001 Washington Blvd [1 Attachment] Hi Sophia, Thank you for following up - the Applicants met with the CCCA at our January meeting and we had a lengthy discussion, but did not take a formal vote at that time. CCCA members present believed that an outdoor cafe was generally appropriate at this location. The applicant conceded to us that they already have the right and ability under the existing site plan to have an outdoor cafe in the tree zone (in between the curb and the required 12' clear zone). So the question is essentially whether they should be allowed to use a different part of the sidewalk for their private business purposes than what is currently allowed, in a location that would cut the pedestrian zone in half (from the current 12' to 6'). Our discussion was mainly focused on the proposed reduction in sidewalk clear width from the 12' required under the current site plan to the proposed 6'. There was substantial sentiment at our meeting that cutting the clear sidewalk width in half at this location -- a major arterial street just over one block from the metro station seems potentially detrimental. Questions were raised at our meeting about whether there are County policy documents that call for a clear width of 8' at this site, either in the Clarendon Sector Plan or the Master Transportation Plan Pedestrian Element. Further research after the meeting by our residents has found that neither the Sector Plan nor the MTP require more than a 6' sidewalk at this location. As well, the application proposes that their cafe will allow as much as 8.68 clear-width near the intersection. The general views of the CCCA as to sidewalk use by cafes is focused on fair allocation of space to both private and public uses. On the one hand, when cafe barriers wander into the sidewalk clear width, can have large anchors that create tripping hazards, and this is compounded by "pinch points", and when they encroach when not even in use (such as early mornings and in bad weather), they are a burden on the community. On the other hand, there are other cafes whose furniture is removed nightly to clear the sidewalk, are carefully maintained, and are adjusted to maintain the full necessary clear width, they can be significant community amenities. We would suggest that at this newly-rebuilt arterial location, although "only" 6' foot clear width is required by County policy documents, greater care than usual is required to ensure sufficient pedestrian space. (Among other things, this location is designated for an 18' total sidewalk width, the second-widest in the Clarendon Sector Plan, and the widest one that does not outright require an 8' clear width.) It makes sense to be relatively less tolerant of unnecessary intrusions into the already barely adequate 6' clear width. Therefore, we hope you will consider recommending to the County Board the following stipulations for any site plan amendment or cafe permit at this site: 1

(We recognize that County policy currently requires that sidewalk cafes be "seasonal" and removed entirely for the Winter. The CCCA has long questioned whether this restriction best fits the community's or the business' needs, and that it might one day be more appropriate to allow cafes to be *used* on nice days in the winter, but require them to be pushed out of the pedestrian route in any season whenever not in use (e.g. nightly or in bad weather). This is a longer-term policy question that we hope to engage with at the appropriate time. If for the sake of consistency, the County currently requires removal of this cafe during Winter, we will not object.) In the meantime, we don't believe the conditions we have proposed above ought to be any economic burden to the applicant and they would also help ensure that appropriate sidewalk width is maintained at all times. With regard to "pushing back" the railings, the applicant noted that part of the enclosure would merely be a 3-foot aisle for wait staff to traverse in servicing the tables, so there should be more than adequate space to move the railings back without even having to move the tables. We note that several restaurants, including the former American Tap Room, have successfully installed railings and anchors that can easily and safely be installed and removed, and that Hard Times Cafe removes even the tables and chairs from their sidewalk cafe nightly. Thank you for your consideration of the CCCA's views. We would be open to discussing these questions with you or the applicant at a future meeting prior to any final vote we might take on a revised application or staff proposal. Wilhelm; Jacob Marks; Susan Minson Clarendon 1021's Comments on Proposed outdoor cafe at 3001 Washington Blvd Dear Ms. Fisher (Arlington County Dept of Community Planning) Mr. Roberts (RA Sushi representation) Ms. Shooshan (The Shooshan Company) Copying: Adam Thocher (Clarendon Courthouse Civic Assocation) and Aaron Schuetz (Lyons Park Citizens Association) Our Board of Directors has reviewed the proposed use plans for RA Sushi's outdoor cafe at 3001 Washington Blvd and come to the following conclusions: Since the outdoor cafe will primarily sit on the Washington Blvd. side and away from Garfield St. side (the street that our condominium faces), we feel that the late night noise impact from the outdoor cafe, which we are primarily concerned about, would be minimal to a majority of our residents on the Garfield Street facade. A small number of our residents that face the corner of Garfield St. and Washington Blvd. may still be impacted by noise from the outdoor cafe, but we hope that this would be minimal and easily resolvable if needed. Another concern we have is of loading and unloading of deliveries, which, if it takes place on the Garfield St. side, could result in trash or traffic disruptions near our condo's entrance. If RA Sushi can mitigate these concerns, we have no opposition to the outdoor cafe plans or the site plan. Let us know if you have any questions.
