3 1.0 PREAMBLE Ngati Whatua o Kaipara refers to the uri or descendants from tupuna pertaining to each of the five marae of Kaipara, namely Reweti (Whiti te Ra) to the South and Haranui ( Nga Tai i Turia ki te Maro Whara) to the North west, and Kakanui (Te Kia Ora) and Araparera ( Te Aroha Pa) to the East and Puatahi (Te Manawanui) to the North, there are also uri from each of the five marae who can whakapapa themselves to an Orakei tupuna, making them an uri of Ngati Whatua o Orakei extending with strong links to Waikato and Hauraki. The Marae is seen as the focal point of a Maori community and where there are activities of construction and development within our rohe, it is imperative that the Marae closest to this activity is advised and encouraged to participate in these activities of advising the appropriate tikanga to be observed. For this particular project it is Reweti Marae who we would encourage to interact and participate in various activities during the development of the Redhills (Fred Taylor Drive) - Stage 1 Special Housing Area RANGATIRA T ANGA (Authority) Ngati Whatua signed the Treaty at Waitangi and also at Manukau on 20 March 1840, thus beginning a long tradition of Ngati Whatua commitment to and support for the Crown. Apihai Te Kawau the paramount chief of Ngati Whatua sent an envoy north to Kororareka to offer land to Hobson to build his new capitol in Tamaki Makaurau (Auckland). The Kaipara region was selected by the Crown as the first place for the Native Land Court to operate, from 1864, the Native Land Court granted land to individuals, rather than to lwi and hapu, this made those lands more susceptible to partition, fragmentation, and alienation. Significant costs were also carried by Ngati Whatua. By 1880, Ngati Whatua were no longer selling land as a strategic move to promote development, but using it as a means of repaying debts and as a source of much-needed income. By the 1940s, Ngati Whatua had lost most of their ancestral land. This, and the cumulative effect of the Crown's breaches of the Treaty, has continually undermined the tino rangatiratanga of Ngati Whaua. Ngati Whatua have always exercised their responsibilities as mana whenua in this area to retain and maintain the cultural heritage and values of Ngati Whatua o Kaipara that is embodied in the ethics of Kaitiakitanga, even though Ngati Whatua no longer own much of the land in their rohe. 3 1P age

4 In June 2013 the Ngati Whatua o Kaipara Claims Settlement Act 2013 was passed that acknowledged Ngati Whatua o Kaipara and the Treaty breaches that had occurred. As part of the settlement the Woodhill and parts of the Riverhead Forest were returned as commercial redress, making Ngati Whatua o Kaipara the largest private landowner within Auckland. 5 KAITIAKIT ANGA (Guardianship) Ngati Whatua o Kaipara has a cultural connection with the land and seeks to uphold its kaitiakitanga (guardianship) of taonga within its rohe/area. Ngati Whatua o Kaipara request that these kaitiaki obligations are recognised by permit holders and they are consulted accordingly. The role of kaitiaki continues in current cultural and natural resource management. Kaitiaki responsibilities include, but are not limited to: Protection and maintenance of wahi tapu (sacred) and other heritage sites; Protection of taonga(treasures); Placing of rahui (temporary ritual prohibition) to allow replenishment of harvested resources; Restoration of damaged ecosystems; Protection of sensitive environments; Directing development in ways which are in keeping with the environment; Ensuring the sustainable use of resources; Upholding the tikanga (cultural practices) associated with traditional activities; Providing for the needs of present and future generations. STRATEGIC CONTEXT Special Housing Areas have been established in accordance with the Housing Accords and Special Housing Areas Act Development of new housing will be fast-tracked through the Act to address the housing shortfall in particular regions, including Auckland. The Act allows for plan variations to re-zone land for housing. Those plan variations in the Auckland context introduce new precincts in the Proposed Auckland Unitary Plan. The Proposed Auckland Unitary Plan (PAUP) provides specifically for cultural impact assessments to be prepared to address how development should respond to tangata whenua values. 5jPage

6 This report has been prepared as part of the required background documents required for the plan variation application under Appendix 1.1 of the PAUP. This cultural impact assessment report will cover the following: The proposed plan variations by all four separate planning entities, Regional consents, including the stormwater network discharge consent for the entire Redhills catchment by Auckland Council, Qualifying developments by all four separate planning entities. The aim of this korero is to assist both the applicants and council to meet their statutory obligations, and to ensure the cultural heritage and values of Ngati Whatua that is embodied in the ethics of kaitiakitanga is understood and considered for implementation during the construction and development of this precinct and eventually passed on to the future residents within the Westgate/Red hills area. 2.0 INTRODUCTION The purpose of this document is to provide a tangata whenua korero from Ngati Whatua o Kaipara for the proposed development of new urban precincts at Westgate/Redhills. The developers have engaged Ngati Whatua o Kaipara to present this korero as a comment on their applications for a plan variation, regional consent(s) and qualifying development. The developers have as part of the plan variation process, commissioned a Wider Redhills Structure Plan along with a number of reports including heritage reports. Due to the varied planning stages of each entity, the following specialist reports/information have been received: Westgate Joint Venture 1. Archaeological report; 2. Ecological report; 3. 8 The intention of this korero is to provide the applicant and Council with some insights into the cultural impacts associated with the development of the new urban precinct, and if so, how they might be addressed. This report is neutral and neither supports nor opposes the current application for the Redhills SHA and related consents. 3.0 PROJECT PROPOSAL The proposal is to develop the Redhills SHA and there are various landowner groups and developers who are actively preparing plan variation documentation and related qualifying development consents for urban development. The Westgate Joint Venture precinct is bounded by Fred Taylor Drive, Don Buck Road and a cadastral boundary. The proposal involves development of a 46.3 hectare block of land, primarily for creating up to 1200 dwellings and commercial B I Page

9 development. The first qualifying development is for 1 00 vacant lots and a temporary wastewater connection across the road to Westgate Metropolitan Centre. The landholding of Nuich Trust is located in the northern portion of the Red hills SHA and covers an area of hectares. The Nuich Trust Plan variation will ultimately enable 370 to 450 household units within its landholdings. The Hugh Green Ltd Group land within the Redhills SHA comprises approximately 112 hectares and seeks to rezone the land primarily Mixed Housing Urban Zone. It also proposed to provide for Local Centre, a sports park and some smaller reserves and is likely that a primary school will be required. It is expected that approximately 1,800 household units will be established. Located immediately south of the Nuich Trust landholdings, the Fred Taylor Group Joint Venture landholding has a total area of hectares and will create approximately 600 household units. A single network discharge consent is also being sought for stormwater discharge for the whole SHA and the Future Urban zoned land within the balance of the Wider Redhills Structure Plan. Hugh Green Ltd owns approximately 160 hectares of the land outside of the SHA within the Wider Redhills Structure Plan area, currently zoned Future Urban The below map clarifies the landholdings of the various parties. 9 1Page

The vision for Redhills SHA is to create a range of residential sites and open spaces that will contribute towards the supply of housing in Auckland and provide for a range of housing typologies. The developments will require resource consent for land use and subdivision and involves changing the land use from rural to urban, bulk earthworks, a network discharge consent, installation of a gravity-fed sewer pump adjacent to a stream and other works. The applicant, Council and Ngati Whatua o Kaipara have been working together to ensure that water sensitive design is incorporated into this structure plan and to make sure that regional consents appropriately manage effects on the wider environment. Ngati Whatua o Kaipara has a special relationship with the land and all natural resources. In expanding urban development, iwi would prefer that Council makes efficient use of land to ensure that the city retains a greenbelt for its food production and landscape values. Ideally Redhills landscape values should be retained but there will be modification as a result of urbanisation. Redhills will eventually become part of a connected urban landscape connecting Massey with Westgate. Ngati Whatua o Kaipara has a unique role to ensure manaakitanga (hospitality and care) is Page

11 shown to everyone. Therefore, in time, this SHA should connect with the rest of Westgate. 4.0 METHODOLOGY This report includes a desk-top study carried out by Ngati Whatua o Kaipara, the archaeological report supplied by the applicant along with other relevant material. Satellite imagery, the Auckland Council's GIS and Cultural Heritage Inventory (CHI) database and the New Zealand Archaeological Association (NZAA) database were also referenced. Historical information related to Ngati Whatua o Kaipara has been obtained from the Office of Treaty Settlements and internally. 5.0 PHYSICAL SETTING The project area known as Redhills SHA consists of rolling land with a several gullies containing intermittent streams that drain towards the Nongangotepara, Waiteputa and Red hill permanent streams located centrally within the wider Red hills catchment. The applicants are proposing to modify some sections of the streams and off-set that loss by plantmg and enhancing the lower stream reaches and removal of existing farm ponds. There is very little native vegetation left on site as the land has been used extensively over the last century for orcharding, pastoral farming and shelter belts of exotic trees and weeds such as ginger remain. The Redhills SHA is located opposite to the existing Westgate development and is likely to supply housing and a range of commercial offerings to the market at a similar time. 12 6.0 CULTURAL SETTING Ngati Whatua o Kaipara progressively extended their control over this area from 1680s onwards and they exerted control over this area of land up until European settlement through Brighams Claim and subsequent transfers of land between settlers and their descendants. Following colonisation land was progressively cleared of kauri forest and gum extracted. Later it was used for pastoral farming. The site still has no native bush but it is understood that there will be planting and restoration of streams and enhancement planting as a result of urbanisation across the site. The archaeological reports note that historically the Red Hills area was part of the original Brigham's Claim and historical information suggests that the land was used for market gardening and farming following subdivision in the late 19th and early 20th centuries. 121Page

13 The applicant's archaeologists have done a field survey and have not found/identified or recorded any new site within the Westgate Joint Venture, Nuich Trust or Hugh Green Ltd Landowner Group landholdings. There is one previously recorded a site - CHI#18372 which is the remains of a wooden dam. This item relates to European patterns of settlement only. There is some likelihood given the nature and extent of the site that there may be some evidence of Maori occupation that could be uncovered during earthworks and a failure to find evidence by archaeologists at this stage is not conclusive. This report documents Ngati Whatua values, interests and associations with an area or a resource, and the potential impacts of a proposed activity on these. Consideration of the proposal is made in regard to its impact upon taonga, spiritual values and wellbeing. 7.0 TAONGA AND SPIRITUAL VALUES Taonga can refer to artefacts or parts thereof, objects, flora, fauna, water bodies or people. The land drains towards the Upper Harbour catchment. Spiritual values relate to mauri (life force) and wairua (spiritual nature/forces/essences) or people, flora, fauna land, bodies of water etc. The long term objective for the iwi is to protect and restore the mauri of Upper Harbour. The Upper Harbour, coast and all waterways are of special value to iwi. This objective brings our worldview and management philosophy to the Upper Harbour, catchment and ecosystems. The new development provides opportunities to recognise and enhance the spiritual values of Red hills if done respectfully according to tikanga. This may include: Karakia or blessing over the area prior to any excavations and earthworks The planting of eco-sourced vegetation Incorporation/adoption of "Te Aranga" Design Principles and the "Mauri Model" Storm water enhancement/water sensitive design using rain gardens and tree pits 131Page

14 Sustainable building methods Robust sediment controls systems to ensure water quality is not compromised Ensuring wastewater reticulation systems cater adequately for projected growth. The Ngati Whatua Orakei lwi Management Plan Section 7.1 provides a good basis of Ngati Whatua stormwater values which promote water sensitive design. The impact on the cultural landscape can be partially mitigated and enhanced through naming of new streets in collaboration with Ngati Whatua o Kaipara, planting native vegetation and incorporating references to Maori heritage where appropriate. In addition, street lighting should ideally be with LED lights and avoid light-spill to retain the "night sky" which has cultural value and is important for rururu (Morepork/native owls) and bats to co-exist with people. 8.0 SUMMARY OF EFFECTS a) The effects of the development are likely to be caused by bulk earthworks, changing land use, sediment control, stormwater run-off, wastewater, replanting of native vegetation ( a net positive effect), b) Impacts on the Tai Ao i.e. bird-life and aquatic fauna. c) Cut and fill on-site d) Any modification/alteration/filling in of any stream(s) including culverts. 9.0 DISCUSSION Redhills is an area of significance to Ngati Whatua o Kaipara. It is part of a broader rohe that extends north and south of the Kaipara line. This report has identified a number of potential cultural impacts which may result from the project. Some of these are positive, while others will require careful design in order to support a quality built environment. The development should increase access to open space and indigenous biodiversity through planting native vegetation. Other impacts requiring mitigation include the change of land use, earthworks, partial stream loss and storm water. 141 Page

15 10.0 RECOMMENDATIONS 1. Nga Maunga Whakahii o Kaipara Development Trust is recognised as the legal entity that governs the operations and management of Ngati Whatua o Kaipara, and has responsibilities to uphold the cultural heritage and values of Ngati Whatua o Kaipara. 2. The Auckland Council & the developers will ensure that Ngati Whatua o Kaipara are invited to any official opening of the development of this precinct and any other rituals that may occur during the construction of this precinct, including tangata whenua rights at any occasion or any activity deemed by council and or contractors as necessary. 3. Nga Maunga Whakahii o Kaipara Development Trust will require all persons directly involved in the development to be present at the Karakia or Blessing. 4. Nga Maunga Whakahii o Kaipara Development Trust is willing to provide cultural ritual to address any accident or significant health and safety breach on site in the event should this occur. 5. Nga Maunga Whakahii o Kaipara Development Trust as a principle rule does not support the removal of native vegetation as proposed (along the stream edges). 6. Nga Maunga Whakahii o Kaipara Development Trust supports the mitigation of replanting with native eco-sourced vegetation to enhance the lower stream reaches and across the development. This should include fruit bearing species to encourage native habitat uptake as well as exotic fruit trees. 7. Nga Maunga Whakahii o Kaipara Development Trust does not support infringement of any structures or obstacles on the ridgelines. 8. Nga Maunga Whakahii o Kaipara Development Trust does not support hard infrastructure by the waterways. 9. Nga Maunga Whakahii o Kaipara Development Trust requests further opportunity for Ngati Whatua o Orakei to contribute to the landscaping discussions on replanting design plans or be given the opportunity to tender for the landscaping. 10. Nga Maunga Whakahii o Kaipara Development Trust endorses the earthworks program to minimize the level of sediment or where maximum sediment controls are proposed. 151Page

16 11. Nga Maunga Whakahii o Kaipara Development endorses residual from the earthworks are retained and reused within the proposal. This recommendation is consistent with Nga Maunga Whakahii o Kaipara Development Trust principle of ensuring the whenua (land) is retained. 12. Nga Maunga Whakahii o Kaipara Development Trust endorses the storm water enhancement/water sensitive design using rain gardens and tree pits. 13. Nga Maunga Whakahii o Kaipara Development Trust supports sustainable building materials and methods of the housing stock. 14. Nga Maunga Whakahii o Kaipara Development Trust requests the opportunity to provide names for the proposed parklands, community facilities and the road names for this precinct. 15. The developers and the Council should familiarise themselves with the Ngati Whatua Settlement Act 2013 and the Deed of Settlement in order to gain an appreciation of the aspirations laid down in 1840 and that have been repeated continuously since then. 16. Nga Maunga Whakahii 0 Kaipara Development Trust encourages street lights should ideally be LED lights, avoiding light-spill which would otherwise impact on the "night sky'' and native habitat. 17. Nga Maunga Whakahii o Kaipara Development Trust strongly encourages incorporating "Te Aranga" Design Principles and the "Mauri Model" (See Dr Kepa Morgan's paper) in this development. 18. Nga Maunga Whakahii o Kaipara Development Trust requires the standard approach of accidental discovery protocols be applied should koiwi (human bones) or artefacts or taonga or archaeological features are exposed during development, earthworks must cease immediately and Nga Maunga Whakahii o Kaipara Development Trust be notified; Should any skeletal remains or artefacts be found during construction It is important that Ngati Whatua o Kaipara be contacted immediately to perform a release blessing prior to involvement of other authorities (NZ Police and HNZPT); The site manager should secure the area so that kowi or taonga remain untouched and site access is restricted; The site manager will notify the NZ police in the case or koiwi or skeletal remains only; 16 1Page

17 Heritage NZ Places Trust (formerly NZHPT); The project archaeologist; Ngati Whatua o Kaipara will advise all parties present of the appropriate tikanga according to the purpose of the activity or event; The site manager should guide the authorities' police and kaumatua to the site affected; The site manager will ensure that kaumatua have the opportunity to undertake karakia and other cultural ceremonies and activities at the site as may be considered appropriate in accordance with tikanga Maori Where appropriate for Ngati Whatua o Kaipara Cultural monitors to be on site 11.0 APPLICABILITY This report has been prepared and submitted specifically for the purpose of the Redhills (Fred Taylor Drive) - Stage 1 Special Housing Area along with the associated wider Red hills Stormwater Network Discharge Consent application.
