3 1.0 OVERVIEW All homeowners in Southshore should have a copy of the Declaration of Covenants, Conditions and Restrictions (CCR) of Southshore Master Association, Inc. (the Master Declaration ), which contains broad, general objectives regarding the architectural control in the Southshore community. These objectives, simply stated, are to keep the community attractive for the enjoyment of homeowners and the protection of property values. These Design Guidelines apply to all homes in Southshore s, Hill District. The Master Declaration provides for the formation of a Design Review Committee ( DRC ). A minimum of three (3) representatives must be appointed by the Executive Board of the Master Association to serve on the DRC. Until automatic termination of the Special Master Declarant Rights, the Master Declarant may appoint the DRC. After automatic termination of the Special Master Declarant Rights, any changes to the Design Guidelines must be approved by the Executive Board ( Board ), and members of the DRC appointed by the Board may be removed at any time by the Board, and shall serve for such term as may be designated by the Board or until resignation or removal by the Board. The DRC is not liable for any damage(s) to any person(s) submitting requests for approvals or to any homeowner within the Common Interest Community by reason of any loss, damage, or injury arising out of or in any way connected with the performance of the duties of the DRC unless due to the willful misconduct of the party to be held liable. In reviewing any matter, the DRC shall not be responsible for reviewing, nor shall its approval of an Improvement be deemed approval of the Improvement from the standpoint of safety, whether structural or otherwise, or conformance with building codes or other governmental laws or regulations. Capitalized terms shall have the same meaning specified in the Master Declaration unless otherwise defined herein. 1.1 Guidelines for Improvements that Require DRC Approval An Improvement, as defined in the Master Declaration (Section 1.16), includes all exterior improvements, structures, and any appurtenances or components thereof of every type and kind, and all landscaping features, including, but not limited to, buildings, outbuildings, swimming pools, sports courts, patios, patio covers, awnings, solar collectors, painting or other finish materials on any visible structure, additions, walkways, sprinkler systems, garages, carports, driveways, fences, screening walls, retaining walls, stairs, decks, landscaping, tree lawn, street trees, hedges, gardens, windbreaks, plantings, trees, shrubs, flowers, vegetables, sod, gravel, bark, exterior light fixtures, poles, basketball backboards and hoops, whether fixed or movable, signs, exterior tanks, utilities facilities, and exterior air conditioning, cooling, heating and water softening equipment, if any. Other examples include, but are not limited to, antenna and satellite receivers, outdoor sculptures or artwork, storm doors, security doors, windows, storm windows and siding. 1.2 Design Review Expenses The DRC may require the reimbursement of actual expenses incurred by the DRC in the review and approval process (Master Declaration Article 5, Section 5.2.3). Such amounts, if any, shall be assessed to the homeowner requesting the Improvement and will be notified by the DRC in regards to the amount (such as through a fee schedule) prior to submittal. 4 2.0 DRC REVIEW PROCEDURE Any decision of the DRC will be made within thirty (30) days after receipt of all materials required by the DRC, unless such time period is extended by mutual agreement. In the event the DRC fails to take action within thirty (30) days after a request has been submitted and all information has been received by the committee, then the review is denied and the homeowner shall not initiate any improvements, unless otherwise notified by the DRC in writing (Article 5, Section 5.4). The submission must be deemed complete by the DRC before the 30 day response time frame commences. The homeowner will have the right to appeal any decision by the DRC, pursuant to sub-paragraph 6, below. A simple majority vote of the DRC will be required for approval or disapproval of proposed improvements. Note: Section 5.5 of the Master Declaration allows the DRC to appoint a single representative to act for it, in which case the single rep s decision controls (with right to appeal to the full DRC). Written records will be maintained of all applications submitted to it and of all actions it may have taken. The DRC has adopted the following procedure to comply with the responsibility to review applications for approval: 1. Submit a complete copy of the Design Review Application (a copy is attached in Appendix A) and appropriate forms including copies of relevant drawings and descriptions explaining your proposal. A planned completion date must be specified. Send the submittal to: Southshore DRC, c/o AMI. PO BOX , Denver, CO For painting and accessory buildings (i.e. sheds, patio covers, and room additions) see applicable forms in Appendix A. The application may also be submitted through the Association s provided at clientcare@amihoa.com. 2. The documentation will be accepted as complete or returned with a description of missing information. Incomplete submittals do not qualify for the 30-day review period. A revised, complete submittal will initiate a new 30-day review period. All requests must be submitted with a plot plan and be drawn to scale. Plot plans should depict the property lines of the Lot and the outside boundary lines of the home as located on the Lot. Drainage patterns should also be indicated with directional arrows. A plan, as well as a profile view, if appropriate, is helpful. Use a copy of the improvement survey or plot plan of your Lot obtained when you purchased your home as the basis for such plan drawings. Please be very descriptive and include dimensions, colors, and descriptions of materials to be used in detail to aid the DRC in reviewing your request. 3. The DRC will evaluate your proposal s compliance with the Design Guidelines for your proposed Improvement (see Project Guidelines, Section 4.0 of this manual), as well as overall conformance with community schemes. 4. You will be notified of the DRC s decision (approval, approval with conditions or disapproval) on or before the expiration of the thirty (30) day review period. 5. Upon completion of your Improvement, notify the DRC in writing so that your constructed Improvement can be deemed to be in compliance with the approved plans. 5 representative of the DRC has the right to inspect the Improvement within thirty (30) days after written notification from the homeowner to verify compliance with the approved plan. 6. A homeowner may exercise their right to appeal in the event of an adverse decision by the DRC s representative, if applicable, or by the DRC. Per Section 5.5 of the Master Declaration, there are two (2) ways in which to appeal: (1) If the DRC appoints a single representative to act on its behalf, the homeowner may appeal to the DRC as a whole, or (2) if a majority of the DRC disapproves the submittal, the homeowner may appeal to the Executive Board. The first step of the appeal process is to make a written request, within ten (10) days after receipt of the adverse decision, to appear before the DRC or the Executive Board, as applicable. 3.0 REVIEW CRITERIA As stated in the Master Declaration, the DRC shall approve any proposed Improvement only if it deems, in its reasonable judgment, that all Improvements conform to and harmonize with the existing surroundings, residences, landscaping and structures. The DRC evaluates all submissions on the merits of the application. Besides evaluation of the particular design proposal, this includes consideration of the characteristics of the housing type and the individual Lot. In the event an applicable governing entity implements a design standard that is in direct conflict with the Design Guidelines by being less restrictive than the Guidelines, the Guidelines shall govern the Neighborhood until such time as the governing entity s design standards are adopted, in some fashion, by the Board. Design decisions made by the DRC when reviewing applications are not based on personal opinion or tastes. Judgments of acceptable design are based on the following criteria, which are presented in more specific terms in the Project Guidelines section of this manual. 3.1 Compliance with Covenants All applications are reviewed to confirm that the proposed Improvement is in conformance with the Master Declaration and any applicable Supplemental Declaration(s). 3.2 Relation to the Natural Environment Fencing, in particular, can have damaging effects on the feeling of open space. Other factors, such as disruption of the natural topography and changes in the rate or direction of storm water run-off can also affect the natural environment. 3.3 Validity of Concept The basic idea must be sound and appropriate to its surroundings. 3.4 Design Compatibility The proposed Improvement must be compatible with the architectural characteristics of the Design Guidelines Manual for the Hill District 5

6 applicant s home, adjacent houses, and the neighborhood setting. Compatibility is defined as similarity in architectural style, quality of workmanship, similar use of materials, color and construction details. The Architectural Styles that are approved for Southshore s Hill District are limited to Colonial, Victorian, and Bungalow. 3.5 Location and Impact on Neighbors The proposed Improvement should relate favorably to the landscape, the existing structure, and the neighborhood. Primary concerns are access, drainage, sunlight and ventilation. When a proposed Improvement has possible impacts on adjacent properties, the DRC may require that the applicant discuss the proposal with neighbors prior to making a decision on the proposal. It may also be appropriate and expedient, in some cases, to submit neighbor comments along with the application. The DRC may only approve or deny based on the criteria for approval as stated in Section 3.0 and Section of the Master Declaration. Although neighbors comments may be considered, the DRC does not base its decision solely on neighbors comments and applicants should not have expectations of approval based on such comments or impact on neighboring properties. 3.6 Scale The size, in three (3) dimensions, of the proposed Improvement should relate well to adjacent structures and its surroundings. For example, a large addition to a small house may be inappropriate. 3.7 Color Color may be used to soften or intensify visual impact. Improvements, such as roofs and trim, must be matching in color. 3.8 Materials Continuity is established by use of the same or compatible materials as were used in the original house. The options may be limited somewhat by the design and materials of the original house. For instance, vertical wood siding on the original house must be reflected in an addition or freestanding structure. 3.9 Workmanship The quality of work should be equal to or better than existing original construction in the surrounding areas. Poor construction or installation practices by the homeowner may cause safety issues and hazards not only for themselves, but also for the Association. Therefore, the DRC and Association assume no responsibility for the construction or installation in reviewing any DRC submittal. All Southshore guidelines, local City, State and other governmental guidelines and regulations, must be followed (or adhered to) Timing The majority of all Improvements can be built or installed by residents themselves, rather than a contractor. However, approved Improvements which remain incomplete for long periods of time are visually objectionable and can be a nuisance and safety hazard for neighbors and the community. All applications must include estimated completion dates. If an Improvement remains incomplete for longer than twelve (12) months, or such shorter period as specified in writing by the DRC, then the Improvement will be considered to be in non-compliance. 7 4.0 PROJECT GUIDELINES 4.1 Air Conditioners, Evaporative (Swamp) Coolers, Attic Ventilators All air conditioning equipment, including evaporative (swamp) coolers and attic ventilators, must receive DRC approval. Window type Air Conditioners are PROHIBITED. Special Considerations: Typically, the motors and compressors on air-cooling equipment are noisy and may be disturbing to neighbors. If an air conditioner is installed, after approval, consider the potential impact to your neighbors. Guidelines: Approval by the DRC is required. No refrigeration, cooling or heating apparatus shall be permitted on a roof. No such apparatus shall be permitted elsewhere on a home or Lot, except when appropriately screened from view by DRC approved landscaping or fencing, and not visible from any public street (Master Declaration Article 10, Section ). 4.2 Antennas, Satellite Dishes, Transmitters No exterior radio antenna, television antenna, or other antenna, satellite dish, or audio or visual reception device of any type shall be placed, erected or maintained on any Unit, except inside a residence or otherwise concealed from view; provided, however, that any such devices may be erected or installed by the Master Declarant during its sales or construction upon the units; and provided further, however, that these requirements shall not apply to those antenna which are specifically covered by regulations promulgated under the Telecommunications Act of 1996, as amended from time to time. As to antenna which are specifically covered by the Telecommunications Act of 1996, as amended, the Association shall be empowered to adopt rules and regulations governing the types of antenna that are permissible hereunder and, to the extent permitted by the Telecommunications Act of 1996, as amended, establishing reasonable, non-discriminatory restrictions relating to appearance, safety, location and maintenance. Antenna. As provided in the Telecommunications Act of 1996, Antenna is defined as follows: (I) an antenna that is designed to receive direct broadcast satellite service, including direct-tohome satellite services and is one (1) meter or less in diameter or diagonal measurement; (ii) an antenna that is designed to receive video programming services via multipoint distribution services including multichannel multipoint distribution services, instructional television fixed services, and local multipoint distribution services and is one (1) meter or less in diameter or diagonal measurement; or (iii) an antenna that is designed to receive television broadcast signals. All Antennas are subject to the provisions set forth below: 1. Any Antenna an Owner places on their property must be registered with the Association within ten (10) days of installation. Owners shall submit a application and drawing detailing how it complies with the guidelines set forth herein. 2. Installation shall be by a qualified person knowledgeable about the proper installation of Antennas. 3. All Antennas must be installed in accordance with the manufacturers guidelines to insure safe installation, and must also be installed in compliance with all federal, state and local statutes and regulations regarding safety. In addition, a building permit shall be obtained, if required by local ordinance. 4. No Antenna can be over 39 inches in diameter or diagonal measurement, at its largest Design Guidelines Manual for the Hill District 7

8 dimension. Any device larger than one meter (39 inches) in diameter is strictly prohibited. 5. All Antennas must be properly grounded and must be placed a safe distance from any power lines. 6. All Antennas must be located in a side or rear yard location, not visible from any street(s) or any neighboring properties, provided such location does not preclude reception of an acceptable quality signal. Antennas shall not encroach upon Common Areas or any other owner s property. All Antennas shall be ground mounted or shall not be installed higher than is absolutely necessary for reception of an acceptable quality signal. 7. All installations shall be completed so that they do not damage the common areas of the Association or the Lot of any other resident, or void any warranties of the Association or other owners, or in any way impair the integrity of buildings on common areas or Lots. 8. Owners are responsible for all costs associated with the antenna, including but not limited to costs to: Place (or replace), repair, maintain, and move or remove antennas; Repair damages to the common property, other Lots, and any other property damaged by antenna installation, maintenance or use; Reimburse residents or the Association for damages caused by antenna installation, maintenance, or use. 9. Wiring or cabling shall be installed so as to be minimally visible and blend into the material to which it is attached. 10. No Antenna shall be placed in a location blocking fire exits, walkways, ingress or egress from an area, fire lanes, fire hoses, fire extinguishers, safety equipment, electrical panels, or other items or areas necessary for the safe operation of the Association or individual Lots or homes. 11. No Antenna shall be attached to fencing shared between Units or common areas. 12. No Antenna may obstruct a driver s view of an intersection or a street. 13. To the extent that interpretation of these provisions is necessary, such interpretation will be undertaken by the DRC in full compliance with all federal, state and local statutes and regulations, as may be supplemented or amended from time to time. 14. If any DRC approved Antennas are installed on Association maintained property, homeowners are responsible for the costs of maintenance, repair and replacement. The Association reserves the right to assess any costs bak to the homeowner, should the need arise. This includes any and all damage that may occur to Association property due to the Antenna If an Antenna needs to be installed in any way that is not consistent with the above-mentioned provisions due to preclusion of an acceptable quality signal, then the homeowner is asked to submit a request for location approval. The Association s approval will then be based on how well the device is screened from view of both public and private areas. IMPORTANT NOTE: Any Antenna/Satellite Dish that is in any way mounted on your house may void applicable warranties. 4.3 Awnings All awnings require DRC approval. Awning colors should match the Body or Trim colors of the house. Homeowners should submit with the Design Review Application, appropriate pamphlets, brochures, description, colors, dimensions, etc., to provide an accurate review for ARC. 9 4.4 Basketball Hoops, Backboards and Poles All basketball hoops, goal equipment and poles, must have DRC approval and are subject to the following: Special Considerations: Many homeowners desire recreational pursuits within their own property. This often results in the construction of various kinds of outdoor recreational equipment. Unfortunately, this equipment is often big, bulky and far from aesthetically pleasing. Consideration of neighbors is extremely important in designing any type of outdoor recreational equipment. Guidelines: Basketball hoops and goals are acceptable if they are attached to the house and painted in harmony with the house, i.e., the basketball backboard must be painted the field color of the house, and the trim on the board must match the trim color of the house; or the basketball backboard may be clear acrylic without any sports logo. Basketball hoops, backboards and goal posts on a post may be considered by the DRC depending on placement on the Lot and the size of the equipment. Equipment with backboards that are not clear acrylic or painted according to the criteria above are not acceptable. Acceptable placement of Basketball hoops with posts would be next to the driveway, unless specifically approved otherwise. Portable Basketball hoops are not permitted within the street or sidewalks (public right of way) as they can impair driving and safety. Portable Basketball hops shall be contained on the Lot. In addition, they shall not obstruct sidewalks at any time. All portable Basketball hoops shall be put away when not in use. They are not allowed to be stored next to the house and must be stored in the garage or a concealed area, screened from view from the street. Any other type of outdoor recreational equipment in the front yard, other than basketball hoops and backboard attached to the front of the house, and in conformance with the above criteria, is prohibited. 4.5 Clotheslines All clotheslines require approval of the DRC and are subject to the following: Guidelines: Clotheslines must be no taller than five feet (5 ). They must be screened from view with latticework or fencing so that the clothes on the line are not visible by any neighbor or from any street. Retractable clotheslines are acceptable, but not required, and they also must be screened from view as noted above. 4.6 Decks, Patios and Covers All decks, patios, and patio covers require DRC approval. Acceptable deck features include planters, railings and steps. The following guidelines apply: Guidelines: a) Visibility (Location and Impact on Neighbors): The proposed deck should relate favorably to the landscape, existing structures and the neighborhood. When a proposed deck has possible impact on adjacent properties, please discuss the proposal with your neighbor. Design Guidelines Manual for the Hill District 9

10 Including comments from your neighbors in your application is appreciated. b) Color: The deck must be stained to match the house field color, house trim color, or with a clear protective finish. Railings, seats, planters, vertical supports and covering must be similarly finished. Staining of composite wood or similar decking material is not required. c) Permanence: Decks and covers are a permanent addition to the house and must be maintained. Expect to use preservatives to retain the character of the deck. d) Size: Deck size will be considered on a case-by-case basis, depending on the size of the lot and the house. e) Building Codes and Permits: In some cases, decks must meet certain building standards and may require building permits. The applicant should check with the City of Aurora Building Department ( ) to determine if their proposed Improvement requires such a permit. f) Materials: Acceptable materials may include cedar, redwood, pressure treated lumber, stone, tile, brick, Trex decking (or similar type material) and concrete. Unacceptable exposed materials include, but are not limited to; plywood sheeting, corrugated plastic or metal, concrete blocks, rough poles, logs or slab wood. g) Design Compatibility: The proposed Improvement must be compatible with the architectural characteristics of the applicant s home, adjoining houses, and the neighborhood setting. Compatibility is defined as similarity in architectural style, quality of workmanship, similar use of materials, color and construction details. 4.7 Dog Houses, Dog Runs a) Dog Runs: All dog runs must be approved by the DRC, and are subject to the following: Special Considerations: Dog runs should be constructed so that they are substantially screened from view from a street or the ground level of any other Unit, as well to minimize the disturbance of neighbor s peace and quiet. Dog runs must have a 5 set back from any neighboring property line. Guidelines: Dog runs must be located in the rear or side yard, abutting the home, and enclosed with the approved fencing for the respective neighborhood. Size is limited to 250 square feet; fence must be no more than four feet (4 ) maximum height; and may include wire mesh. Temporary Dog Runs may be utilized for a maximum of 60 days. Chicken wire is prohibited. b) Dog Houses: All dog houses must be located in a fenced back yard or in a fenced dog run. Dog houses must be installed at ground level and must not be visible above the fence. 4.8 Drainage Mechanisms All drainage devices, such as French drains, etc. must be approved in writing by the DRC. Approval shall not be granted unless provision is made for adequate alternate drainage. The established drainage pattern over any property cannot be altered without written permission from the DRC (Master Declaration Article 8, Section 8.4). Detailed drainage plans have been approved by the City of Aurora for the Southshore community. Any change to the drainage flow, direction, manner, etc. may require City of Aurora approval. For example, retaining walls in easements or drainage ways may present a problem. Applicants are strongly urged to consult Design Guidelines Manual for the Hill District 10

11 with the City of Aurora Engineering Department ( ) on any proposed Improvement that may affect drainage. DRC approval does not imply approval by the City of Aurora. Homeowners re-routing lot drainage shall be liable for damage to property of adjacent and nearby owners and may also void structural warranties. 4.9 Driveways, Parking Pads, Extensions The addition of an extra driveway or parking area is prohibited. Driveway extensions must have DRC approval, and are subject to the following: Special Considerations: On cul-de-sacs, the front yard is frequently narrower than in other areas of the community. Extensions on both sides of the driveway may take away too much green area and result in a concrete yard look. Guidelines: All driveways leading into the garage must be constructed of concrete. Extensions to concrete driveways already in existence must be no wider than three (3) feet in width on either side of the existing driveway. Extensions must be constructed of concrete, natural or artificial stone, or brick pavers. Asphalt, gravel or rock extensions are not acceptable. Muted tones or colors matching the home may be used Fences All fencing must be approved by the DRC. No above ground fences will be allowed in front yards. Special Considerations: Improper fencing can detract from the appearance of a neighborhood. Cluttering a neighborhood with an uncoordinated selection and placement of fences is not permitted. Guidelines: Invisible (subsurface) fence systems are allowed for installation and will conform to local government requirements. Chain link fences are not approved for installation in Southshore. In Southshore, there are the following types of fences: HOMEOWNER INSTALLED FENCES A. Homeowner Lot Boundary Fencing: Lot Boundary fences are required throughout Southshore. All fences must be approved by the DRC and in coordination with adjacent affected neighboring lot owner(s). Homeowners on Hill District lots may only install the following type of fencing (Lot Boundary Fence) on their side, wing and rear lot lines (provided a developer-installed fence is not already planned for such Lot line, as described in Paragraph below): (i) A 38 (as measured to top rail) two (2)-rail fence (see 38 Two Rail Lot Boundary Fence and location on location maps in Appendix C). This fence must meet setback requirements per the City of Aurora on corner Lots. Please check with the City of Aurora. Maintenance is the responsibility of the Design Guidelines Manual for the Hill District 11

12 homeowner; sometimes maintenance is shared by neighbors. The fence must be stained with the color BEHR Country Beige (BEHR #760C-2 semitransparent exterior wood stain) to match the other fencing in the Hill District of Southshore. The fence side facing the residents shall be maintained by the Homeowner. Homeowners are responsible for maintaining (including staining) their side of the fence regardless of whether they installed the fence or not (such as by adjacent Homeowner or District). B. Patio/Privacy Fence A cedar privacy fence may be installed by homeowners around outdoor living areas (patios). Privacy fences may not be installed within 15 of any Lot boundary fence / property line (see Patio/Privacy Fence detail and Notes in the Fencing Plan in Appendix C). Maintenance is the responsibility of the homeowner. Patio/ Privacy fences must either be stained or painted to match the trim color of the home. Privacy fence to extend no further away than twelve (12) feet from home. Privacy fence to cover no more than twelve (12) feet of home BUILDER OR DEVELOPER INSTALLED FENCES ONLY A. Perimeter Fences Maintained by the Master Association: This particular fence style is limited to fencing fronting Southshore Parkway or as indicated per Master Fence Plans in Appendix C. (i) A 38 (as measured to top rail) two (2)-rail fence (see 38 Two Rail Hill District Fence with Stone Columns and location on location maps in Appendix D). (ii) A 42 (as measured to top rail) three (3)-rail fence with 2 x 4 wire mesh will be installed by the developer (see 42 3-Rail Fence and location maps in Appendix D). (iii) A combination brick and metal fence with stone columns will b installed by the developer (see Decorative Perimeter Fence with Stone Columns and location maps in Appendix D). Maintenance of these fences is the responsibility of the Southshore Master Association, unless otherwise noted. These are the only developer-installed fences in the Hill District portion of Southshore. The fence will be stained with the color BEHR Country Beige (BEHR #760C-2 semitransparent exterior wood stain). The fence stain shall be completed by the developer and maintained by the Homeowner. No fence provided by the developer may be removed and if replaced shall only be replaced with the same fence type. Any additional fencing must be approved by DRC and installed by the homeowners and may only be in the fencing types described in Paragraph above Fire Pits, Fireplaces and Permanent Grills, Exterior Permanent Outdoor fireplaces and Grills require DRC approval. Exterior fireplaces, fire pits and permanent barbecues must be set back a minimum of five (5) feet from all property line walls. Portable Outdoor Fireplaces and Fire pits/chimeneas, commercially-available, located in the rear Design Guidelines Manual for the Hill District 12

13 yard with a minimum of five (5) feet off any property line do not require DRC approval. Front and side yard applications do require approval by the DRC. Outdoor fireplaces are only allowed in the rear yard and considerations will include, but are not limited to: material, design, size and proximity to neighboring properties. All installations to follow City of Aurora Fire Code Flagpoles; Only US Flag, State Flag or US Military Service Flags can be flown on a Flag Pole. Flagpoles shall not exceed 20 in height and require DRC Approval Flags attached to the front or to the back of the house or on the deck, window or balcony, do not require approval as long as they do not rise above the level of any second-story windows. It is incumbent upon the Homeowner to assure that the pole bracket is attached securely to the house and all worn/torn flags are replaced or removed completely. All flags to follow US flag code 4.13 Flower Boxes on Windows Window flower boxes that are the same color as the trim color of the house and are of the same Architectural style of the home do not require DRC approval; all others do. Temporary (seasonal) flower boxes do not require DRC approval and must be removed when not in use and/or at the end of the growing season Gates All gates, except for those installed by the builder, must have DRC approval. Gates will be allowed in rear fencing on Lots that back to open space. Only the gates shown in the drawings in Appendix C & D for each respective District will be allowed. Refer to Section 4.10 Fences for additional guidelines Hot Tubs, Jacuzzi and Spas DRC approval is required. All requests must conform to the following guidelines: Guidelines: The Hot Tub, Jacuzzi or Spa must be an integral part of the deck or patio area, and the top of the tub must not be visible above the patio rail line. The Hot Tub or Spa shall be fully located within the Owner s deck or patio area, and shall be located in such a way as to minimize the view of the Hot Tub/Spa from adjacent homes or the street House Numbers DRC approval is required. House numbers, as installed by the builder, can be maintained, but no alternatives are allowed without DRC approval. Illuminated Address Signs require DRC approval Landscaping, Tree Removal, Vegetable Gardens All landscaping must be approved by the DRC (please reference the City of Aurora s Landscape Reference Manual or its succeeding document(s) for current landscape requirements). Automatic underground lawn irrigation systems are recommended, and do not need DRC approval, if they meet the following requirements: underground PVC piping, poly-piping, popup sprinkler heads, automatic timer, and back-flow preventor(s). Landscape improvements to front, side and rear yards are required to be in place within sixty (60) days of closing, if the closing occurs between April 1st and September 30th of any year. If closing occurs between Design Guidelines Manual for the Hill District 13

14 October 1st and March 31st of any year, landscape improvements are required to be in place no later than the next May 31st. The following special considerations apply: Special Considerations: Taking the time to create a landscape plan before you install your home landscape can result in significant savings of both money and water. Plant with regard to Colorado s climate, considering the mature size of species selected. There are many resources available to advise you - local water districts, County extension agents, the Denver Botanic Gardens, naturalists and landscape architects. Guidelines for Single-Family Detached Homes: Street trees, if any, have been installed by the builder, in accordance with the Southshore landscape plan. Street trees installed by the builder, if any, may not be removed and must be maintained by the homeowner. Landscaping within the adjacent public rights-of-way must be installed and maintained by the homeowner. Tree lawns (the area between the curb and the sidewalk within the public right-of-way) must be sod/turf grass and may contain street trees, non-woody annuals or perennials, and irrigation systems only. See Special Requirements for Xeric Tree Lawns Tree Lawns, Appendix E for additional information. Guidelines for all Homes: Foundation plantings should not be placed within five feet (5 ) of the foundation of the house or any slab on the Lot. Decorative rock is a far better choice than shrubs in these areas. If evergreen shrubbery is used within five feet (5 ) of the foundation walls, all irrigation must be by controlled hand watering. Automatic irrigation systems are not allowed within five feet (5 ) of any foundation. Grass is not allowed within five feet (5 ) of the foundation of any structures. Avoid excessive watering at all times. Excessive watering near the foundation of a home may adversely affect the foundation and may void structural warranties. Front yard landscape installations must include turf grass or living vegetation that provides a minimum of 60% coverage. The use of Xeriscape principals are encouraged; however the use of large expanses rock, concrete, wood mulch or non-living plant material are not permitted. See Appendix E and F for Guidelines. Homeowners are required to remove seasonal plant material at the end of each growing season to include annual plantings, vegetable gardens or fruit bearing plant materials. It is the responsibility of the homeowner to ensure that installation of any improvements does not alter existing drainage patterns. Homeowners should instruct landscape contractors that the dumping of rock, bark or other landscape materials on the streets and sidewalks of Southshore is prohibited. All materials to be placed on homeowner s Lot Lighting, Exterior: Ornamental garage lights, either installed by the builder or consistent with the original builder s design; do not require DRC approval. Subtle, low-level lighting of facades and front yard landscaping is encouraged. The lighting of address plaques is required for all new or replaced plaques. All exterior lighting installed or maintained on the Units shall either be indirect or of Design Guidelines Manual for the Hill District 14

15 such controlled focus and intensity so as not to disturb the residents of adjacent or nearby properties. Temporary holiday lighting does not require approval. Temporary holiday lighting and decorations should be removed within thirty (30) days of the actual holiday. All other exterior lighting such as post lights, spot lights, security system floodlights or strobes, and low voltage ground lighting (along drives and walkways, accent soft lighting, etc.) does require DRC approval and will be approved on a case by case basis at the sole discretion of the DRC. Guidelines: Lighting shall be located, directed, and shielded so that light rays and glare, to the greatest extent possible, do not extend beyond Lot boundaries. Energy-efficient outdoor lighting devices, including without limitation, a light fixture containing a coiled or straight fluorescent light bulb, LED s and any solar recharging panel, motion detector, or other equipment connected to the lighting device, are permitted. Installation considerations shall include, but may not be limited to, the visibility, style, and location of the fixture so as not to negatively impact neighboring properties. Exterior lighting for security and/or other uses must be directed at the ground and house, whereby the light cone stays within the property boundaries and the light source does not cause glare to other properties (bullet-type light fixtures are recommended with a maximum of a 40 watt bulb). Holiday lighting and decorations do not require approval. Holiday lighting may be installed 30 days prior to the holiday. Holiday lighting and decorations must be removed within 30 days following the holiday Mail Boxes: Cluster Mailboxes have been provided by the developer. All mailboxes will be maintained by the Southshore Master Association and may not be altered by homeowners Miscellaneous Material Storage: No materials, such as building and miscellaneous garden supplies, may be stored in the front, on the driveway, side or back of home Ornamental/Decorative Items: Any Ornamental/Decorative Item not mentioned herein, must be submitted to the DRC for approval. Guidelines: Small yard ornaments, outdoor sculptures, flower boxes, flower benches, flower posts, flower pots, natural items such as driftwood, small rocks and similar items used for decorative or hobby purposes, airborne devices (as defined in c below), hanging baskets, wind chimes, etc., are permitted subject to the following restrictions: a) Small ornamental/decorative items, and only those which have minimal impact on their surroundings, may be placed in the gravel perimeter of the Owner s Lot. No such item may conflict with the landscaping, alter drainage, block or divert the watering or irrigation system, present a material disruption to the architecture of the community, impede maintenance conducted by the Association, or introduce real or potential costs or liability to the Association. In addition, such items may not pose a safety hazard or block access to common areas. Additionally, owners must prevent these items from deteriorating or becoming unsightly. b) No items of this nature are permitted in the common areas of the community. Owners will be asked to remove or bring into compliance any items which do not conform to the Design Guidelines Manual for the Hill District 15

16 criteria. Should an Owner fail to remove such items, the Association may remove them and charge any related costs as an assessment to the Owner s Lot. c) Airborne devices, artwork and ornamentation such as windsocks, decorative flags, mobiles, hanging baskets, art work, wind chimes, etc., may be displayed only from porches and patios so long as they do not create a nuisance condition, impede the performance of maintenance, or materially disrupt the Architecture of the home or the community. Prudent judgment by the homeowner must be exercised when displaying any decorative flags, airborne devices, artwork or ornamentation. All miscellaneous improvements that do not conform to the above guidelines will require DRC approval Painting, Exterior DRC approval is not required for repainting your home in the identical, original color(s). Any color change requires DRC approval. Complete the Exterior Paint Request Form (in Appendix A - Forms) for review by the DRC. The following special considerations and guidelines apply: Special Considerations: The current Southshore Hill District Color Palette (found in Appendix B) provides for a wide variety of subtle combinations of field and trim colors that are within a family of hues. The intent is to provide the homeowner with the opportunity to have a combination of colors that appeal to their aesthetic desires and, at the same time, compliment adjacent homes. The Southshore selection list of approved color combinations is based on the original colors selected by the builder. The list gives you the opportunity to simply select colors that have been previously approved within the community. Homeowners may not select colors identical to, or substantially similar to colors on homes adjacent to, or immediately across from their own home (front and rear). Should you find that a specific field or trim color is not contained in the list, you may submit specific colors as your request, and if the DRC determines that the colors are compatible with the Southshore color palette, your request may be approved. As time passes, tastes change. Colors used during the original development may no longer be in style. It is the DRC s intent to maintain a contemporary color selection that satisfies the majority of homeowners. It is also the responsibility of the DRC to assure that new colors will not adversely affect the existing approved paint palette and colors in use. Guidelines: a) Color: Acceptable colors are those combinations identified on the Southshore Hill District Color Palette, found in Appendix B. Specific trim colors go with specific field colors. Adjacent house colors affect the field colors that may be approved. It is imperative that clusters of similar field colors are avoided. The DRC may be able to provide you with color chips and larger paint samples to help you in identifying your current and future color combinations. If you are submitting color names that the DRC is unfamiliar with, please provide one (1) set of all color chips of field, trim, garage door and front door colors with your request. b) Permanence: Generally, you may expect 3-5 years of wear between paintings. 17 likely find the trim deteriorating more quickly than the field, especially for those areas that receive frequent exposure to direct sunlight Play Yards Playhouses, Play Structures, and Trampolines: These improvements will be approved on a caseby-case basis with respect to design considerations which the Committee, in its discretion, may deem appropriate, as well as Lot layout: Special Considerations: Consider what effect a play yard might have on your neighbors. Will the location make it too noisy for my neighbors? Guidelines: These structures must be constructed, located and MUST be screened with dense non-deciduous vegetation to minimize the impact on the adjacent neighbors privacy and any existing structure or common area. If the playhouse, play structure, or trampoline (or the surround for the trampoline) exceeds the height of the property line wall, then the minimum setback requirement is five (5) feet from all perimeter walls. Tree houses are not permitted Recreational Equipment All exterior recreational equipment must have DRC approval. (See the guidelines for play yards and basketball hoops/poles in sections 4.4 and 4.22) 4.25 Residence Structure Additions All residence structures and expansions must be approved by the DRC. Detailed plans must be submitted that include the plan of the structure on the Lot, elevation views, dimensions, types of materials to be used, types of paint, stain, etc. The following guidelines apply: Guidelines: Structures and expansions shall comply with the approved development standards (including setbacks and height restrictions) of the Southshore Final Development Plan on file at the City of Aurora Planning Department and must harmonize with the house and the neighborhood. Contact the City of Aurora Planning and Building Departments for additional information Security Doors, Storm Doors, Security Systems High quality colonial cross buck doors, full panel glass doors, decorative wrought iron doors or decorative aluminum doors do not require approval by the DRC, provided they are black, white, the color of the house trim, or the original accent color. Any other door, enclosure, or change of the builder s original design requires DRC approval. All other security systems or measures, which are installed on the exterior of the house, require DRC approval. Security bars on windows and doors are not permitted Sheds and Accessory Buildings No temporary sheds or temporary accessory buildings are allowed. Sheds or accessory buildings of a permanent nature require DRC approval. Complete the Accessory Building Form (see in Appendix A - Forms) to request approval. Special considerations: Sheds have a permanence of construction and will be part of the Design Guidelines Manual for the Hill District 17

18 house for years; therefore, sheds must be built to meet the look, quality of construction and workmanship used in Southshore. Guidelines: a) Size: The dimensions of the accessory building are not to exceed a width of six feet (6 ), a length of eight feet (8 ), and a height of eight feet six inches (8 6 ) at the peak of the roof. The 8 height represents a roof pitch of 6:12 with 6-6 tall sidewalls. The roof pitch of the shed must match the roof pitch of the house. b) Materials: Exterior components of the accessory building (siding, trim, and roofing) shall be constructed of materials identical to those used for the construction of the house. Plastic, fiberglass and metal are not acceptable materials. c) Color: The body and trim color of the accessory building must match the body and trim color of the house. d) Visibility: The location of the accessory building should be planned to minimize the visual impact on neighbors and drive-by traffic or view from the street. Sheds may not be practical for all Lots. The DRC will consider the home design, location of the home on the Lot, location of utility easements, and Lot slope when reviewing applications. Approval of sheds will be considered on a case-by-case basis. Landscaping must be used to soften the visual effects of the accessory building and included in submittal for DRC review. e) Permanence: The foundation shall be either a concrete slab or concrete reinforced piers. The accessory building may be attached to the house and be considered an addition to the house. The accessory building shall have the life expectancy of the house and must be maintained in the same manner as the house. If the accessory building becomes an eyesore, it will be in violation of the Master Declaration. f) Building Codes and Permits: Accessory buildings shall be constructed so as to comply with any and all building codes of the City of Aurora. DRC approval does not imply approval by the City of Aurora Building Department Shutters Shutters on windows that are not part of the original construction may not be installed without DRC approval. Shuttersthey must be painted the same color as the house trim, and consistent with other homes in Southshore Signs Signs or advertising of any type shall be erected in accordance with the following guidelines: a) Only signs advertising homes for sale or rent, political signs, invisible fence signs, and security system signs shall be allowed and do not need approval provided they meet the guidelines of this section. Temporary Children at Play signs do not require DRC Approval. They are not allowed to be placed more than 5 feet from the street and must be put away every night. All other signs must be submitted to the DRC for approval. b) Security system signs are permitted and limited to one sign per Unit. Design Guidelines Manual for the Hill District 18

19 c) Political signs are allowed on an Owner s property or window 45 days before and 7 days after an election. One political sign per political office or ballot issue will be allowed, with a maximum dimension of 36 x 48 inches per sign. d) No signs are permitted to be placed on mailboxes, as all mailboxes are the property of the Southshore Master Association. Guidelines: A. Real Estate Signs: Temporary, non-illuminated, real estate signs indicating the availability for sale, rent, or lease of a specific Lot upon which this sign is erected or displayed does not require DRC approval if the following criteria are met: Not to exceed five (5) square feet in total area Not to exceed four feet (4 ) in height Restricted to one (1) sign per street frontage Such signs are to be removed immediately following sale closing or rental occupancy of the property. Such signs may not be placed on any fence installed by the developer. Open House signs shall conform to the above dimensions, are limited in number to six (6), shall be placed only on the owner s property or within the public right-of-way, for the duration of the open house, and shall not block or interfere with traffic visibility. All signs must also meet local sign codes. B. Garage Sale Signs: A sign advertising the existence of a garage must indicate the date, time and location of the sale. Such signs may have a maximum area of three (3) square feet, and may be posted for the period of the garage sale only. Such signs may not block or interfere with traffic visibility, and shall be posted only on the owner s property or within the public right-of-way. All other signs, including but not limited to, posters, billboards, advertising, political campaign signs or displays of any kind, are not permissible for posting in any area of Southshore without the prior written consent of the DRC Solar Panels Approval by the DRC is required for any solar panel installation. Solar panels are permitted if they meet all governmental guidelines for residential use, in which case they may be located on the roof if such solar unit is built into and made an integral part of, the roof structure and/or design, or made an integral part of the structure of the house and solar panel installation Spas All Spas and Hot Tubs require DRC approval and will be considered on a case-by-case basis. Please refer to Section Walls All walls require DRC approval. Retaining walls must not interfere with the established drainage patterns (as defined in the Master Declaration, Article 8, Section 8.4). The Retaining wall must match the other retaining walls with in the Hill District of Southshore (See Southshore Retaining Wall detail in Appendix D). 47 APPENDIX E LANDSCAPE AND IRRIGATION STANDARDS AND GUIDELINES Landscape Architecture Criteria The landscape character of Southshore is one of a classic coastal resort set within the natural features of rolling topography, inspiring offsite and interior views, and wildlife habitats. There are unique drainage ways, native wild grass meadows, connected trails, recreational amenities, Cottonwood groves and the nearby reservoir. These landscape guidelines are intended to enhance the visual narrative and experience that fits the unique natural character that defines Southshore. The project shall preserve natural amenities of the environment when possible, including views, nature, wildlife, habitat, flora and fauna. Quality landscape development will enhance the character of Southshore and southern Aurora. Water conservation through Xeriscape design principles and best management practices shall be used. Landscape improvements should have year-round interest and diversity of color and texture in plant material. Reference Appendix A of the City of Aurora Landscape Reference Manual for appropriate plants to consider in the design. Proper selection and placement of these plants is required and necessary for approval by the DRC, as well as to promote a successful landscape. Plant material shall meet or exceed the plant quality and species standards of the current American Nursery Stock. Water allocation shall be consistent with plant material requirements. All City of Aurora Front Yard Landscape requirements, found in the Landscape Reference Manual, must be maintained. While the original design intent of the individual residential Lot landscape for Southshore is to follow the established standards set forth in Table 14.3A Home Yard Landscaping Turf Option, the homebuilder or homeowner may opt for standards found in Table 14.3B Home Yard Landscaping Xeric Option. These tables can be found in the Sections G and H of the Landscape Reference Manual, respectively. See also Appendix H in this manual for homebuilder minimum landscape standards. 48 Irrigated Area Irrigated Turf Areas: Moderate and low water use turf and turf alternative are encouraged. Irrigation Design: required by developers and home builders. Must follow City of Aurora s Zoning and Code, Sect Irrigation. Hydrozones are essential. Automatic irrigation systems require efficient and full coverage to all plantmaterial. Overhead irrigated sod and planting beds are restricted in areas less than 6 wide. Drip or below ground, low pressure, irrigation systems are acceptable in these areas. Sod and native seeded areas are allowed to use overhead irrigation systems. Trees, shrubs, perennials and groundcovers use below ground, low pressure, irrigation systems for these forms of landscaping. Alternative Xeric Landscaping As per City Code, Homeowners may select a Xeric landscape option on their property. In addition, reference Section Xeric Design in the City Code for ways to implement Xeric techniques in your landscape. Homeowners who opt for this should contact the Planning Director and the Water Department for current guidelines regarding submittal requirements. All landscape plans submitted to the City require approval through the Southshore HOA prior to proceeding to the City s approval process (See Section 3.0 Review Criteria in this manual). Special Requirements for Xeric Tree Lawns: TREE LAWNS Tree lawns (also known as street frontage) are the areas between the back of curb and the homeowner s sidewalk and between side lot lines. While these areas are not a part of the homeowner s property they fall within the public right- of-way, and the homeowner is responsible for maintaining these areas. The use of trees every 40 feet and sod in this area is the preferred aesthetic for the Southshore community. If Xeric principals are desired for the tree lawn, it must be done in tandem with a front yard Xeriscape design. The following guidelines will apply at Southshore: APPLICABILITY Homeowner s can use the following table to determine eligibility and minimum sod area requirements for the Southshore Community: Sod Zone Minimum Requirements Proposed Renovated Tree Lawn Area % to Remain Sod Less than 500 Square Feet Not Eligible for Xeric Tree Lawn Option 500 to 1,000 Square Feet 50% Sod Required 1,000+ Square Feet 40% Sod Required NOTE: Southshore requires that a minimum of 70% of the total enhancement area must be covered with long-lived plant material. The following provides guidelines for those homeowners who wish to provide a water conserving, Xeriscape approach to their tree lawns. The tree lawn is broken up into areas Design Guidelines Manual for the Hill District 48

49 (reference Appendix F Xeric Tree Lawn Diagram in this manual). A segmented approach of these zones is required to meet the standards of the guidelines. The areas are identified as either Xeric zones or sod zones. Sod zones can be either existing sodded areas or newly established hybridized sodded areas. The Xeric zones are newly established, water conserving, Xeriscape planted areas (not sod). Components of these zones are Trees, Sod, Xeric Plantings, and Irrigation. The definition and specific requirements for each component is as follows: TREES Tree lawn trees shall be maintained by the homeowner. These trees provide a consistent character for community. As per Code (Section (B), street trees shall be centered within the tree lawn and spaced 40 feet on center. Reference Appendix G - Preferred Tree List that contains a list of highlighted trees that can be used without DRC review. All trees shall be planted at a 2.5 caliper inches (as measured 4.5 from the ground), per City Code (Section ). Homeowners will not plant Prohibited Plant Species per City Code (Section ). The tree canopy does not count towards required coverage calculation for Xeric planting areas. On occasion, and where appropriate, additional trees may be allowed in the tree lawn when they are not too close to the required shade trees and when they do not present a problem growing into the street or sidewalk zones, or when they present an on-going shading issue in the winter months for the street or sidewalk zones. SOD ZONES Existing sod in the tree lawns can be removed to allow for Xeric planted zones when approved by the Southshore HOA. Appendix F Xeric Tree Lawn Diagram indicates the basic design that is proposed for Southshore s Xeriscaped tree lawns. This guideline allows for a consistent design that reduces water usage in the tree lawn, but also provides a consistent visual approach for the Community. The segmented sodded areas in the tree lawn cannot be less than 6 width and shall be not less than 32 long (as measured parallel with the street). There must also be at least one 32 length of sod area per individual homeowner s tree lawn or at least one 32 length for each street side, if dealing with a corner Lot. The sod shall also extend on either side of the existing trees a minimum of 4 from the trunk of the tree. The sodded tree lawn may consist of the original sod or a new hybridized sod of an approved water-tolerant type by the City s Water Department. Should the new hybridized sod be chosen, appropriate soil amendments shall be utilized in the installation as approved by the City s Water Department. The application or installation of grass seed, seed plugs, synthetic turf, or native seed are not permitted in the tree lawn. Design Guidelines Manual for the Hill District 49

50 XERIC PLANTING ZONE A variety of water conserving plants ranging from deciduous and evergreen shrubs to ornamental grasses, perennials, and ground covers may be used in the Xeric zones. All plant materials chosen must comply with Section , of the Aurora City Code and grow to a height of less than 26. Soil amendments, as approved by the City s Water Department, are required in these Xeric planting zones. Crushed stone mulch over weed control fabric is required in all areas of the Xeric planting zones to help retain moisture in the soil. Small boulders (no larger than 24 diameter, buried a min. of 6 into the soil), are allowed as features in the tree lawn. Boulders are restricted to no more than 1 per 20 linear feet. Boulders shall be a min. of 18 from the edge of the sidewalk, curb, and edge of bed. No rock gardens, or pavers are allowed in the tree lawn. Southshore s requirement for Xeric planting zones is a minimum of 70% of the total xeric area must be covered with long lived plant material. Reference the City s Section and Table 14.8 Plant Material Coverage Values to support calculations for xeric zone(s). Note: Trees in tree lawns do not count toward area coverage. Calculations for determining coverage area in square feet (SF) are as follows: Total Area of Sod Zone(s) + Total Area Covered by Xeric Zone(s) / Total Square Footage of Enhancement Area = Plant Area Calculation (must be minimum of 70%, rounded down) For example, if a homeowner has Xeric Zone A with 451 SF + Xeric Zone B with 702 SF + Sod Zone A with 256 SF + Sod Zone B with 256 SF = 1,665. SF The total Sod Area and Xeric Planting Areas = 2,131 SF, so 1,665 SF / 2,131SF = 78%, which satisfies the Plant Area Calculation requirement. IRRIGATION All sodded and Xeric areas require an appropriate automatic below ground irrigation system. Irrigation heads spaced at 8 foot intervals helps to establish the sod segments. In areas where the tree lawn is less than 6 depth (as measured from back of curb to sidewalk) a low pressure subsurface irrigation system should be used, such as Netafim. Also, different irrigation delivery systems (pop-up spray heads, low pressure drip emitters, and sub surface irrigation) will require their own individual control valves so the irrigation system is as efficient as possible in delivering the least amount of water to the landscaping. For additional information, reference City s Section Irrigation. Homeowners are responsible for any costs and all adjustments required to their irrigation system for their Xeric plantings in the tree lawn.
