1 Audubon Landing Home Owner Association Architectural Standards Effective Date 9/25/2008 In accordance with the Supplemental Declaration of Covenants, Conditions, Restrictions and Easements for Audubon Landing s Covenants (Covenants), alterations of any kind to the outside of a villa must be submitted to the Architectural Control Committee (ACC) and subsequently approved by the Audubon Landing Home Owners Association (HOA) Board. Below are the standards by which the ACC will function. They are in accordance with the 2007 Florida State Legislation and the HOA Covenants. These Standards are not meant to alter, override or replace in any way the HOA Covenants, but to further define standards by which to govern. For every architectural alteration and exception to architectural maintenance standards, ACC and subsequent HOA Board approval is required in advance. See the HOA Web site audubonlandinghoa.com for procedure seeking an alteration procedure and Alteration Form. Architectural Alteration Approved Standard Attic Ventilators Driveways/Walkways Door Repair/Replacement (Entry) Flagpoles (Free Standing) Garage Doors Must be as small in size as to be functional, match current ventilation as close as possible, as documented by certified trained ventilation professional and be functional and remain functional. Alterations are not permitted. Repairs/maintenance owner responsibility. To match existing structure and color as close as possible. Kept free of oil/rust stains. Periodic pressure washing to maintain aesthetics is owner responsibility. Match existing style, color and design. Building permit, Site plan or Survey with setbacks, distance to power lines required by Florida Building Code (flag poles are considered a structure under Florida Building Code). Structure cannot impede landscape maintenance (sod, shrubs, and trees). Homeowners may erect a freestanding flagpole no more than twenty (20) feet high on any portion of the homeowner s real property. The flagpole cannot obstruct sightlines at intersections and cannot be erected upon an easement. Flags that can be displayed are the official US flag, flags of the State of Florida, US Army, Navy, Air Force, Marines, Coast Guard, or POW-MIA. Such additional flags may be equal in size to, or smaller than the US flag. ( No larger than 4 ½ by 6 feet) Must be overhead type, match original installed by Declarant. Recommend garage doors to be kept closed when not in use. 1
2 Architectural Alteration Approved Standard Gutters/Downspouts Lanai Additions/Enclosures Lighting (Exterior) Pool & Jacuzzi Roofs Satellite Dishes/Antennas Screen/Storm Doors Owner responsibility for repair, debris removal and overall maintenance. Alterations to original gutters/downspouts installed require ACC approval, e.g., changes to improve flow and direction of water drainage. Must be documented by a professional installer to improve handling of roof water run off. Water flow dispensed cannot impede on neighboring property. Requires permit, comply with set back requirements and building codes, conform to community, height not to exceed roof line, requires inclusion of lanai bed (around base of enclosure, 18 inches in width for lawn maintenance), color white, sidewalls must be entirely screened to include entire wall height. Roof can be screen or covered. Covered roof must be insulated so as not to create a noise annoyance for neighboring property. Other than lighting installed by Declarant, only sidewalk, shrub, back lighting and holiday lighting is permitted. Other than holiday lighting, lighting must use bulbs neutral in color, such as white or amber. Sidewalk lighting to be placed in shrub bed and not hinder shrub maintenance. Spot and sensor lights for security purposes on the street and backside of villas are permitted. Lighting cannot be a nuisance to neighbors. Holiday lighting removal should be completed no later than three (3) weeks following the holiday. Pools & Jacuzzi installation must conform to Hillsborough County and City of Tampa permitting rules, zoning and regulations. Must be enclosed within screened lanai. Landscaping may be moved, but replaced to its original position. Recovery of plants moved are the Owner s responsibility. Visual impact to surrounding properties must be minimal. Pumps, filters for pools and Jacuzzis must be screened from the street and located so as not to cause a nuisance to neighbors. Repair is owner responsibility, must match existing quality, color, style and materials. Exterior over the air antennas are not permitted. Satellite dishes must conform to Federal Law, be no more than 18 in diameter, mounted on the rear of roof or attached to rear Villa wall. Dishes must not be visible from front of villa. Wiring must meet code and be concealed as much as practical. Type: Andersen 3000 Series (May be seen at any Home Depot). Clear, safety glass with vents top and/or bottom with hideaway insect screen or 2. Full-length, clear safety glass with full-length insect screen. 2
3 Architectural Alteration Approved Standard Screen/Storm Doors (Continued) Color: White or Almond, Hardware: Traditional handle, with choice of finish, Brass or Nickel Closer: Dual closer, door color. Shutters-Hurricane Windows/Glass Sliding Doors Solar Panels Water Softeners Window Film Window Repair/Replacement Air-Conditioning Equipment Bird Feeders, Must meet Florida, Dade county hurricane code and standards and be in use only during storms. Attachment devices must be beige/white and designed so as to be minimally visible from the neighboring property. Roll down or accordion type shutters that maintain aesthetics of the existing structure are permitted. Altering of the outside villa structure is not permitted. Panels are to lie flat with roof pitch, installed at rear of villa, and not to exceed height of roof peak. All non-absorbing parts must be painted to match the roof or background. Piping, wiring and colored devices must be hidden from view. No part of the equipment or attachments may be visible above the highest part of the roof or from the street. Not permitted outside (except as originally installed by Declarant). Inside installation only, must comply with City of Tampa codes, including backwashing of system into sewer system. Certified safety and heat reduction films with manufactured defined standards are permitted. Mirror like/reflective finishes are not permitted. Must equal or exceed the quality and retain the style as originally installed by Declarant. Must meet city and county codes, replaced in same location, matching as close as possible to existing size and shape and not obviously visible from the street. Feeding of birds and animals must conform to Florida State Law. Not permitted. Exception, where such feeders can be placed in the back of Villas so as (1) not to interfere with landscape maintenance (sod, shrubs and trees), (2) not attract unsavory animals (rats, raccoons, etc.) close to the Villas, and where they may cause damage or potentially promote disease and (3) not be in a location where they may become a hazard to Villas in a storm. This exception will not be available to most Villas. Maximum two (2) bird feeders, poles not to exceed six (6) ft. above ground permitted. 3
4 Maintenance Standards Bug Zappers Decorative Objects (Exterior) Decorative Window (Roof line Exterior) Dogs, Cats, Other Pets Dwelling Flag Poles Flags Flowers Approved Standard Permitted in the back of Villas where they will not interfere with landscape maintenance (sod, shrubs and trees), not become a hazard to other Villas in a storm and level of sound will not be offensive to neighboring Villas. Permitted on lanais. No decorative objects are to be displayed Statues/Water Fountains, etc. on the exterior property. Items placed at the front entry must be non-offensive, not impede entry and maximum four (4) feet. Owner responsible to maintain in conformity with community standards: white or beige. Must be on leash and waste picked up immediately as required by City of Tampa Statue & Audubon Landing Covenants. No rust, mildew or stains. Garage doors without severe dents, Carriage lights in good condition. Façade brick/stone in good condition. Maintenance of such items is resident responsibility. Poles (portable) may be mounted to front of Villa between garage door and outside wall facing the street. Homeowner may display by means of one portable, mounted flagpole, facing the road, located on the owner s side of the garage door, a removable United States flag or official flag of the State of Florida or which represents the United States Army, Navy, Air Force, Marine Corps, or Coast guard, or a POW-MIA flag, sports team or decorative flag in a respectful manner. Such flags may not be larger than 4 ½ feet by 6 feet. Small decorative flags are permitted on in-ground pole, (maximum three (3) feet. height) and placed so as not to interfere with landscape maintenance (sod, shrubs, trees). Additional special occasion flags are permitted during holidays/special events, to be removed three (3) weeks, subsequent to holiday/special event. No in ground plantings are permitted with the exception of plantings by Declarant at time of original Villa purchase. Plantings in pots/containers are permitted, reasonable in number, doesn t interfere with landscape maintenance (sod, shrubs, trees), maintained in good condition and non-offensive to neighbors. 4
5 Maintenance Standards Furniture (outdoor) Holiday Decorations Lanai Beds Lanai Enclosures Lanai Shades Land Use Lockboxes Mailboxes, Mailbox Posts Outside Villa Walls Painting Plant Stands Approved Standard Small pieces by front entry only. No plastic or upholstered furniture permitted. Placement of decorations can be up to a month prior to holiday. Must not impede landscape maintenance (sod, shrubs, trees) or risk damage to lawn/shrubs/trees. Removal should be completed no later than three (3) weeks following the holiday. Owner responsibility, in ground plants not permitted, maximum 18 inches wide, small rocks or mulch should be used for fill. Clean, mildew free, screens maintained and in good repair. Installed inside lanai for sun blocking, privacy purpose, e.g.,. Roll-type shade or Florida glass, color to be neutral. For residential purposes only. No home business, alterations or outside storage units permitted. Must be placed on entry door only. Alterations not permitted. Normal usage wear and tearassociation responsibility. Damage by other means, owner responsibility. Repair/replacement coordinated with HOA Association and must conform to community style and color. Car polish can be used to maintain luster. Owner responsible for rust removal from sprinkler due to well water. Exterior is HOA responsibility. Interim maintenance/touch-up may be completed by owner using the original community color. In ground, maximum six (6) feet in height, plants present and healthy. To be removed when not in use. Recreational Vehicles (RVs-Campers) No parking permitted. Permitted for loading/unloading only. Signs NO signs are permitted including For Sale, with the exception of a home security sign no larger than 12 inches wide on a post not to exceed 3 feet in height, located within 6 5

Trash Cans Shrub Planting/Trimming Vehicles Vehicle Commercial/Advertising Wind Chimes Window/Lanai Screens Window Treatments Must be stored inside garage, may be placed at curb 12 hours prior to scheduled trash pick up and returned to the garage as soon as practical but before end of the pick up day. All food related trash must be placed in container with secure lid. Not permitted No overnight street parking; no parking on soded areas, or blocking of sidewalks anytime. No overnight parking or storing of such. Vehicles with any commercial markings are not permitted. Level of sound should not be offensive to neighboring Villas. Owner responsibility for maintenance/repair/replacement. Any temporary material not permitted. Window treatment must be maintained in good condition. If viewed from outside of a dwelling, must be white or beige. While not meant to be all-inclusive, the following items ARE NOT permitted by the Audubon Landing Covenants. Alteration of original Declarant s window design Awnings of any kind Carports Deck of any kind Doghouse of any kind Driveway extensions, expansions, alterations Exterior changes of Villa structure, conversions of garage to living area Exterior barbeque pits, fire rings or outdoor kitchens (exception-gas connected grills on lanais only) Fences, other than the existing privacy fence on property line of Villas located on west side of Lake Audubon Dr. Firewood stored outside Gardens outside the lanai 6

(Continued) Landscape changes or additions to the original Declarant s design of retaining walls, ponds, grass, trees, shrubs, plants of any kind Painting of any structure on the property Party fence modification or change of fence between villas Planting beds outside the lanai Planting edging or borders Play equipment and children pools (permitted on enclosed lanais only) Playhouses of any kind, including those placed on the lot or tree houses Sandboxes (permitted on enclosed lanais only) Shutters, other than shutters designed for temporary hurricane protection Sound devices that create nuisance for neighboring residents Sports equipment, (permanent or temporary); such as basketball stands, hoops, hockey nets, trampolines, playground equipment or other equipment considered for outdoor play Storage container/devices (small, closed, decorative storage cabinets permitted on enclosed lanais only) Storage sheds Swing sets Tree removal or planting Vehicle parts/equipment except in an enclosed garage area, hidden from view Vehicles that are inoperative Window air conditioning units Audubon Landing Board of Directors unanimous approval September 25,
